the washington, d.c. court of appeals releasing an opinion on a lawsuit and jim angle has the ruling. >> this is a big blow to obamacare. the u.s. court of appeals issued an opinion saying the irs went too far in interpreting the law. it said that subsidies would be available in the exchanges established by the states. 36 states didn't establish their own exchanges but gave out subsidies anyway and the irs ruled it was okay to give out whether state or federal. but the court said that is not the case. you cannot do that. and it ruled that it is absolutely not okay for the irs to do this and they went too far and they have in fact knocked this down. let me give you the quick language from the decision here. because we conclude that the aca restricts the section of the b subsidy established by the state we reverse the district court and vacate the irs resolution. it means millions of people in the state will no longer get subsidies and if their insurance is more than 8% of the income they will no longer be
