"mornings on 2" starts now. good morning. welcome to "mornings on 2". i'm dave clark. >> ial tori cal bell. there is an accident involving all of the weekend lanes closed. it's a motorcycle crash, camest about 25 minutes ago. you can. this is a major delay. let's go to hayward, newschopper2. this car apparently flipped over into the ditch.

the person got out and started running across freeway lanes, which led the police to briefly shut down the freeway, ran across the freeway really. lucky enough to be hit by something. so there's activity on both sides of the freeway. you can see the car in the ditch on one side and then there are police officers with a person on the other side. this is causing a major traffic jam on interstate 880 from hayward and union city, fremont in both directions. traffic is really bad, as there is a big police presence. it's unclear what's going on. it could be that this person was trying to flee police. we know for sure if you are on 880 hayward in both directions approaching the whipple industrial exit. this car is overturned to the ditch. i'm not sure if anyone else was in it. one person has come out. you will see activity

continuing. at 7:02. back to the desk. >> thank you, sal. an investigation is underway within the san francisco police department. it stems from video of an arrest posted on youtube. ktvu's kraig debro has been reviewing the video clip and joins us now with some details. good morning, kraig. >> reporter: good morning, tori. we're at the hall of justice where police will be conducting this investigation. this is the second videotape involving san francisco police in a month. police are still investigates officers' actions stemming from an incident following the pride parade. this tape is a little bit different. significant differences exist between this one and the -- between this pride parade and the one on sunday. police say they stopped a woman on the street because she was a suspect in an assault they were responding to. police say the unidentified woman who was pushing a baby stroller at the time was drunk and refused their attempts to

put her in the car. she was not only resisting but she was swearing. one of the officers put her on the ground and she appears to be down face first. she went to the hospital but -- they wanted to take her to the hospital. she bit an emt. i spoke to an officer about this. he told me that the takedown appears a little funny. he says officers are typically supposed to guide the person down the ground and not let go of them. we don't know yet until the investigation is complete if the officer inadvertently let go of the woman on the way down or what happened but that's the word i got from one officer. kraig debro, ktvu channel 2 news. >> thank you, kraig. well, late last night, the oakland city council approved an ordinance that would make the city the first in the

country to license marijuana cultivation. claudine wong is joining us from city hall with a look at how this impact would impact some of the smaller growers in the area. >> reporter: that's the big unknown. critics are concerned that this new new ordinance would literally wipe out the small ones. people got very passionate and debated this for hours. well, january that's when the permits would be issued. between now and january, the city council has promised to take a look at the plan that would address these small pot growers to make sure they don't get swallowed up. the critics wanted to know what does it mean for the smaller dispensaries? this ordinance does not necessarily address them. the ordinance provides for four

permits, $211,000 in permit fees. the city council wants to put an 8% sales tax on the sales there. an annual revenue estimates start at $1.5 million. that would be a big shot in the arm for this cash-strapped city. but one officer says it would also allow for strictor quality control. >> if i was a patient, it would give me reassurance that i'm getting the best medicine out there. >> i think this is something that's needing to happen. i just hope we don't circumvent the small growers who made this occur in the first place. >> reporter: the man is to work on a -- the plan is to work on a plan in this operation. people are talking about history in the making. that's what's happening here in oakland but it's important to say there is one other bay area city, thinking about getting on board this kind of train as well. we'll talk more about that coming up in our next report.

live in oakland, claudine wong, ktvu channel 2 news. 7:06. the oakland city council approved a $2 million settlement. this is for people who said their homes were searched by officers who had obtained search wants by providing false information to judges. more than a hundred people, some of them drug suspects, joined the class action lawsuits. it states that search warrants were improper for years, ending in 2008. four police officers were fired because of the case. seven others kept their jobs, saying they had been improperly trained. 7:07. bp is denying rumors that its chief executive, tony hayward, plans to step down. today's "london times" says this would announcement would be made in early

august/september. a spokesman for bp says hayward remains in place and has the support of the management and the board. now, the government's pointman on the oil spill downplaying fears that the new cap on the oil well is causing problems. federal incident commander, thad allen, says at least five leaks have been found around the oil well but he dismissed them as very small drips, like an oil leak in a car. he also says seepage found along the floor less than two miles away. that's coming from an oil well that's no longer in production. >> but they do have a storm coming in. >> they do. let's check in with sal for an update on the commute. big problems out there. >> we have a problem in hayward. apparently a cash that occurred about 25 minutes ago with this car that ran into the ditch, chp reported that the driver was seen driving erratically

shortly before this collision happened. several other cars were involved in this crash, and then the male occupant of the car, the guy who was driving the vehicle that flipped over, ran across the freeway lanes and was apprehended on the other side of the road. he's now in the back of that patrol. they had to chase him and actually found him on the other side. so the police are there. unfortunately, other people are seriously injured in this crash. this is 880 at whipple in hayward. traffic is both directions is slow. westbound 580 at airway, we have a crash involving a motorcycle blocking almost all of the lanes. westbound traffic is a mess coming in on off the altamont pass. the only decent news we have is the bay bridge toll plaza, which is normally a lot more crowded, is doing well. 7:09. here's mark. good morning to you, sal.

look at this. we're starting off with pretty much the same weather story the past couple of days. quite a bit of overcast in oakland. currently 57 degrees. most of the bay area in the 50s. the fog bank will gradually clear back to the shoreline as we head into the afternoon hours. it's a forecast that you would expect in the summertime months. that's what we have today. the clouds and even some drizzle, cool coast, mild inland. for thursday and friday, we'll interview minor warming. the hottest locations inland only in the mid- to upper 80s over the next few days. santa rosa, 52. concord, 56. san jose at last check reporting mostly cloudy skies and 55. the weather system has been developing up to the north. this has been one part of the source of the cooldown. the other one will stick around for today -- will stick around

for the day. as far as your time line forecast throughout the day, this morning at 8:00, still areas of fog, we do have some partly cloudy observations out towards concord. by lunchtime, clearing inland but still patchy fog. temperatures 57 to 72. and then by 4:00, partly to mostly cloudy. but we'll keep it cool for the beaches with some patchy fog nearby. here's a look at the numbers and these forecasted highs about the same and maybe cooler. today, most likely one of the coolest days of the week, san jose 76. livermore will be checking in at 80. your five-day forecast temperatures up a few degrees for thursday and friday and holding steady into the weekend. it looks like a cooler day as we head into sunday. dave and tori? >> thank you, mark. good news for apple. the tech company reported their numbers and we'll see how the

we have a car in a ditch just off the hayward freeway on 880 at whipple. this first happened when police say that this car was driving erratically, got into a major collision with other cars, flipped over. the driver of that car then got out and ran across all of the lanes of the freeway and was apprehended on the other side. this is causing major traffic issues on interstate 880 in both directions right near the industrial whipple exit. hayward fire on the side of both there. they've also determined that

this person that was driving the car is mentally unstable. the code is 5150. they've secured that person. they are getting medical attention for him and the traffic is terrible. we'll update this coming up. 7:14. apple has good financial news to report despite the recent complaints about that new iphone 4. pam cook's in the newsroom to tell us how the investors are reacting this morning. pam? >> pretty well. i'm just checking apple's stock. it's up 7.5 a share. the dow jones gaining a little bit at this hour, up about 6 points. as you can see, a live look at the big board, the new york stock exchange, 10,235. it's in response the tech stocks to apple's 2nd quarter earning of -- quarter of 57

billion. now, apple pretty successful at beating analysts' expectations. apple says the numbers translate into a profit that's up 70% from a year ago. they credit the mac sales. the new iphone 4 was available for less than a week during the second quarter. analysts say apple's forecast is a reasonable prediction. >> basically said even since then they've showed no slowdown in demand. in fact, they are selling every phone they can make and they are still backlogged a week in the stores and two to three weeks in the at&t stores. >> apple's forecast 3rd quarter

revenues 2.3 billion more than the 2nd quarter. now, apple's report definitely helped tech stocks in asia and europe. but the dow is only up slight despite reports from coca-cola and wells fargo. reporting live in the newsroom, pam cook. back to you. >> thank you, pam. 7:16. well, 30 people were hurt last night, one of them critically, when a united airlines jet on its way to los angeles hit severe turbulence over kansas. the flight took off from washington, d.c. it was diverted to denver so the injured could be taken to the hospital. passengers say, with no warning, that plane suddenly dropped, sending people and drinks flying. >> two hours into the flight, a little bit of turbulence, just a couple of bumps and then the plane dropped 20, 30 feet, all of the sudden.

i saw a few people hit the ceiling. >> more than 20 people were hospitalized. their injuries d as bruises, whiplash and sprain. 7:17. we checked just one hour ago, there were no new fires reported in berkeley overnight. but police and firefighters continue to search for suspects in a recent rash of arsons. since friday there have been at least 13 suspicious fires just south of the uc campus. mostly in trash cans. the latest was reported around 4:00 yesterday morning on telegraph avenue just a block from campus. surveillance cameras took these pictures. they show two men walking to a trash can in front of a store. you cannot see exactly what happened but flames flare up the moment the two men leave. i hope the two that are in the video, they get caught and something worse happens to them than a night in jail and they

letter of reprimand or be suspended. he will not be fired. in sacramento, a bill has passed the assembly. it's being debated in the senate. that bill would essentially ban open carry weapons in california. jamarcus russell is due back in court next month for a preliminary hearing on the drug charges against him. >> yesterday, he appeared in a mobile, alabama courtroom. he entered a not guilty for possessing codeine cough syrup without a prescription. the raiders cut him this year. actress lindsay lohan is waking up in jail this morning. she will not be spending her full 90 days behind bars. she started to serve time for violating probation. because of overcrowding, she will only spend two weeks in

well, good morning to you. welcome back. 7:23. we're finding out more about the teenager who fell to his death from a cliff near marin koch's muir beach. andrew leonard hicks was getting ready for his senior year at henderson high school. he was a national honor society student who planned to become a

doctor. on monday, hicks and his family were on a hike a mile south from muir beach, when he fell 500 feet to his death. family members say he had gone off the main trail to get a better view of the ocean. 7:23. in santa cruz, a demonstration by homeless advocates is entering its third week on the steps of the county courthouse. the demonstrators who have been sleeping on the sidewalk at all hours there are protesting the city's camping law which prohibits sleeping outside between 11:00 p.m. and 8:30:00 a.m. organizers want local officials to establish a safe place for the homeless to camp. construction is underway on the first of four tunnels. this morning a groundbreaking ceremony will be held for a second tunnel. the southbound battery tunnel. the tunnels will lower the roadway and create new park space above. >> bravo.

>> uh-huh. we gotta go to sal. you still have that major traffic problem in hayward? >> this was an unusual one, where there was a person seen driving erratically on the freeway, 880 at whipple. that person got into an accident. several people were injured. that person himself who flipped his car into a ditch ended up running across all of the freeway lanes and being unresponsive to police. the police had to use their taser and finally brought this person into custody and determined he was mentally stable. they are taking care of that person now. we had one of our ktvu employees drive past the scene. he told me that the traffic is just terrible in both directions. 880 near industrial. if you look over to the right of your screen, you can see that that car over there is still flipped over upside down into a ditch. it's amazing that the person who was driving was not injured more severely. that car is there. let's take a look at --

today's chronicle reports the san francisco police department has launched an investigation into a controversial incident caught on video. we want to warn you, some might find this video disturbing. police say the woman was drunk and belligerent and shouting obscenities at the police officers. an ordinance was approved to make oakland the first city in the country to make marijuana licensed. after several hours, the council voted to allow four large industrial farms to be licensed to sell to medical

dispensaries. this requires large growers to pay more than $200,000 a year in permit fees and 8% sales tax and carry $2 million in liability insurance. critics argue this will put small marijuana growers out of business into the city of corte madera has filed a lawsuit. they want to shut down a medical marijuana dispensary arguing there. they say it's housed at the tamal plaza that's zoned for light industrial. parents complained about that location right near redwood high school, about a mile away. this matter goes to court on september 30th. after long, intense negotiations, san francisco's mayor and supervisors agree to a $6.5 billion budget late last night.

the spending plan restores funding for many health and human service programs. it does not include two controversial proposals from the neighbor to increase the number of condo conversions and contracting with private companies for some city services. the budget received preliminary approval but the supervisors must still take a final vote last week. ac is warning riders to expect more delays and possibly for ten days. hundreds of drivers did not report to work on monday and tuesday. this comes after a cost-cutting measure on the drivers. >> we think that's a terrible thing to because it penalized the riders. >> ac transit did an entire

restructuring of the service that's provided to the public. he this department put the -- they haven't put the public on notice. >> the bus driver's union has gone to court seeking a temporary restraining order but the judge's warning will not be issued until july 30th. concord police are investigating an apparent murder-suicide attempt involving a mother and her child. police were called to a house on parklin court early yesterday. they say they found a 0-year- old girl with a knife -- 10- year-old girl with a knife wound. the girl said her mother woke her up and attacked her. mrs. say it looks like the woman then -- police say it looks like the on stabbed herself. the child is in serious condition. the motive is still not clear. san francisco police are searching for a woman who robbed two bank of america branches. the surveillance photo was taken july 12th at the bank of

america branch on balboa. investigators sea she had a gun and demanded money. police describe her as being between 5 -- five feet and 5'3". vallejo police are investigating two incidents involving ads placed on craigslist. in both cases, the potential buyers were robbed at gunpoint. one man drove to buy a car. when he got there, would two people robbed him of the $2,000 he brought to buy the car. a similar incident happened there a few weeks ago. police believe this man might have been responding to the same ad. police need your help finding an elderly man who suffers from again shaw. look at his photo.

the the u.s. senate is expected to pass a bill that would expend unemployment benefits for 2.5 millions. democrats overcame a philly butter with the supports of two republican senators and the new senator from west virginia. after a senate vote, the to the is expected to approve it. dozens of farm workers prayed in front of governor schwarzenegger's office calling on him to sign a bill that would pay him extra time. the bill would overturn a 1945 law which exempts farm workers from overtime pay unless they work more than ten hours a day. most california workers get overtime after eight hours. the california farm bureau says changing the law would put some farmers out of business. the governor has not said whether he will sign the bill.

7:45. we're following some new developments about that controversial firing of the federal agriculture department official. the secretary of agriculture now says he needs to take another look at the supposed racist comments made by that employee. alison burns is live in our washington, d.c. bureau with much more on this. >> reporter: the second issued a statement overnight saying he will conduct a thorough rereview -- review over the firing of that worker. but the employee says she's not sure she would go back. this video is the controversy and has been blasted all over the internet. the full story is coming out. the farmer's family says the woman helped them and she said the clip was taken out of

consumer advocates. she released a statement saying she's proud of dramatically improving customer satisfaction ratings while she headed up anthem. the los angeles times is reporting this woman for the chief justice of california. she would become the first asian-american for the job. if approved by voters, she would replace the current chief justice in january. and democrats say they have enough votes in the state to confirm elena kagan. that vote could be scheduled as soon as next week. she would replace john paul

police in vallejo want your help. they are trying to solve a fatal hit-and-run case. it happened saturday night around 10:00 near mini drive on princeton avenue. police say a man was struck and killed by a speeding car. the car described as white with four doors and tinted windows, similar to a lexus ls-400 or a toyota avalon. witnesses also say it had oversized rims and tires. if you know anything about this, contact the police. 7:53. if your child's daycare uses pesticides, chances are you may not know about it. a new uc berkeley survey finds that 90% of daycare centers in california are problems with insects such as ants, bees and spiders. but only 24% of those schools notify parents when using pesticides to get rid of the

station. this videotape shows two officers trying to put a female suspect in the back of a patrol vehicle. you can see the woman struggling against the officers. what you can't here is the number of times, the woman uses the f-word. as the unidentified woman is about to be put in the car, she says my baby is in the street! after a struggle at the back door of the vehicle, the woman is spun around by the officer and goes to the ground face first. now, a veteran officer i spoke with who didn't want to be identified said police investigators will try to determine if the woman was guided to the ground by the officer or thrown to the ground by the officer. this veteran officer said you can guide a suspect to the ground but not throw the suspect to the ground. this officer has been put on paid leave pending the outcome of the investigation. reporting live from kraig debro, ktvu channel 2 news. >> thank you, kraig. one minute after 8:00.

new this morning, the faa is ordering airlines to speed up inspections for cracks in boeing 767 planes. recently, some cracks were discovered in the structure that holds the engine to the wing. federal officials say these could be very dangerous because it could cause the plane to lose an engine. oakland could soon become the first city in the nation for medical marijuan claudine wong is live with more. are any other cities considering other plans? >> reporter: certainly oakland is not alone. berkeley is considering going to the voters in november to talk about six kind of similar growing operations. certainly, this would change the landscape on how we're looking at marijuana being grown and distributed for medical marijuana use.

higher with the iphone iv even though they've had -- iphone iv even though they've had some problems. sal, what's happening with the commute? >> the east bay has been the hardest hit. with we have video whether we had the problem on 880 in hayward where a vehicle went into a ditch. the driver of the pickup truck got out of the vehicle and ran across the freeway lanes. ultimately had to be subdued by the police and you might imagine this caused a lot of traffic. they actually had to tow this vehicle away, obviously with a long cable and that person had to be subdueped and taken to the hospital. other people were injured as well. 880 is still a mess. both directions right near whipple. highway 24 westbound. that traffic is moderately heavy on the way to the tunnel. not too bad. the traffic is going to be heavier on the oakland said. this morning at the toll plaza, we have a little bit of a backup. it's backed up for maybe a five-

hillary clinton announced new sanctions against north korea. clinton made the announcement in south korea with robert gates. clinton says the u.s. will freeze some of their assets and prevent businesses and individuals from traveling abroad. she says sanctions are designed to have them limit nuclear activities. they are bracing for more severe weather as the typhoon season already rolls in. therethere have already been several devastating floods this year. the government says more than a thousand people died or they just disappeared as a result. a lot of people have been forced to leave their homes just to get away from the high waters. another tropical storm is expected to sit in the southern part of the country this weekend. now, in addition to the flood floods, china is also dealing with a massive oil spill. it's caused by a pipeline explosion last week in the yellow sea. workers have been struggling to clean up this oil which has now spread across a 70 square mile

baseball coach accused of hitting an umpire has been booked in jail on battery charges. police say david davis turned himself in to the solano county jail yesterday. he faces a minimum fine of $2,000 or up to one year in jail. davis is accuser of hitting an umpire after a close call during a little league tournament game on sunday. he claims he was acting out of self-defense when the ump charged at him. former raiders' quarterback, jamarcus russell, is due back in court next month for a preliminary hearing for the drug charges against hill. yesterday, he appeared in an alabama courtroom ander entered a not guilty plea for possessing a bottle of codeine cough syrup without a prescription. as you know, the raiders cut him earlier this year. actress lindsay lohan is in jail this morning. but she won't be spending her full 90-day sentence there. lohan started her jail time yesterday searching time for

welcome back. there is a new field poll that indicates the attitudes of californians towards abortion haven't changed much in the last four years. 71% of registered vote, agree with the supreme court's 1973 roe v. wade ruling. that's down 2% from 2006. there is also little support for either making abortions easier or more difficult. 52% of registered california democrats support the status quo, while 44% of republicans want no change. 50% of independent voters say the current law should remain in place.

it is 8:23. we're learning more about the teenager who fell to his death from a cliff near marin county's muir beach. 17-year-old andrew leonard hicks was preparing for his senior year at henderson high school in pennsylvania. he was a national honor society student who planned on becoming a doctor. on monday hicks and his family were on a hike a mile south of the beach when he fell 500 feet to his death. family members say he had gone off the main trail for a better view of the ocean. 8:24. well, san francisco will celebrate milestone number two in the conversion of doyle drive to the presidio parkway. now, construction's already underway on the first of four tunnels. this morning, a groundbreaking ceremony will be held for a second tunnel. the southbound battery tunnel. these tunnels will lower the roadway and create more park space above it. that event bean against at 10:00 a.m.

oakland city officials voted late last night in favor of a plan to authorize wholesale pot cultivation. but efforts are already underway to make some changes to this controversial ordinance. claudine wong is at city hall with the very latest on all of

this. claudine? >> reporter: well, certainly, this morning there is concern for the small growers, the people who then supply these medical marijuana dispensaries up until now. there are literally hundreds of them who have the small growing operations. this would change things. this 5-2 vote literally changed how things are being run. we're talking about very large scale industrial growing operation. this is history in the making and people are pash nat about it. right now -- passionate about it. last year, the dispensaries sold $20 million in marijuana. oakland already has a pot tax. we're talking about money now and this new ordinance would mean money for the city. this takes the business of pot growing up a bunch of notches. we are only talking about four permits but those would go to industrial-sized operations. each requiring $2311,000 -- $211,000 a year in permit fees,

8% sales tax and $2 million in liability insurance. >> as the industry continues to emerge and grow, we know other cities are looking at this and trying to figure out where these types of facilities can be located. >> reporter: almost 200 people have expressed interest in the four permits that would be made available. a few already say they are plans ready to go. one operation boasting it would be the world's largest. talking about what it would mean for the little growers, one of the things thety council responded to last night after the vote was to look at a plan that would take into account that. this ordinance does not do that. we have until afternoon when these go into effect. this may be history in the making. certainly while there are critics from people concerned

about how all of this would play out, there are a lot of people who say, look, if this is happening, why not be in front of it. >> 8:31. well, last night, the richmond city council voted to limit medical marijuana dispensariesle the council will require the pot clubs being nonprofit collectives in commercial districts only. they have to be at least 1500 feet from a high school and 500 feet from other schools or daycare centers. the new law doesn't set a limit on how many collectives are allowed but city officials say they would consider a cap later into after long and tense negotiations, san francisco's mayor and thank supervisors agreed to a $6.5 billion budget last night. this restores funding for many health and social service programs, to increase the

in hayward right now after this dramatic crash sent a vehicle into a ditch. police say the man in the vehicle tried to escape the scene so police had to use a taser to subdue him. this just in -- storms are now threatening to delay bp's undersea efforts to permanently plug up that leaky well in the gulf of mexico. the federal government's oil spill chief is saying if that storm moves into the gulf, the ships would have to leave and bp wouldn't be able to watch that capped well. we're following new developments about the controversial firing of a federal agriculture department official. the secretary of agriculture now says he needs to take another look at the supposed racist comments made by the worker over 20 years ago. ktvu's alison bushes is live in our washington, d.c. bureau with more on this. good morning, alison. >> reporter: good morning, tori. shirley sherrod says she was

it website. the photo in question exaggerates the activity at bp's gulf oil spill command center in houston. the pictures showed workers monitoring a bank of ten giant video screens kiss playing underwater images. a blogger noticed the picture had been altered. a spokesman says two screens were blank in the original picture and a staff photographer used software to add images. the spokesman says the photographer was showing -- was just showing off his skills. and there was no ill intent. the alameda city council just cast a vote to sever ties with a developer working on a massive project at the former navy base. sun cal had plans for almost 500 homes at the base, along with a sports, complex,s, offices and a ferry terminal. but they agreed to scrap the project because of the

company's financial ability and loopholes. vallejo police are investigating two recent incidents involving ads placed on craigslist. in both cases, the perspective buyers were robbed at gunpoint. the latest one happened monday night. a san francisco man drove to vallejo to buy a car advertised on the site. when he got there, two people robbed him of the $2,000 he had taken with him to buy the car. a similar incident happened there two weeks ago. police say a man was robbed, responding to what may have been the same ad. san francisco police are searching for a woman who robbed two bank of america branches. take a look at this photo the it was taken july 12th at the bank of america branch on balboa. investigators say she had a gun and demanded money. four days later, police say the same woman held up a bank of america branch on diamond heights boulevard. police describe her as about 5

feet to 5'3". and she has hair tinted red. if your child's daycare uses pesticides, chances are you may not know about it. a new uc berkeley survey finds 90% of the daycare centers in california have problems with insects, such as ants, bees and spiders. but only 24% of those schools notified parents when using pesticides to get rid of the pests. 35% of schools did not post warning signs about the treatment. stanford university researchers say they have found a way to predict the success or failure of fertility treatment. normally researchers rely on a woman's age to determine the likely success of a treatment but they say they developed a new test with more accurate results. it considers dozens of factors, including age, embryo growthed a a woman's response to the treat. the researchers are seeking fda
