. complete bay area news coverage starts right now. this is the 10:00 news on ktvu, channel 2 news. police search for two suspects tonight after a teenager is stabbed to death waiting at a bus stop after school. good evening, i'm julie haener. and i'm frank somerville. the stabbing victim was a 17- year-old student at newwark high. tonight his mother spoke exclusively to ktvu news just a few hours after learning that her son had been killed. within the past 30 minutes, police reopened the area around the crime scene on cedar boulevard at birch street

behind the new park mall. ktvu's lloyd lacuesta is there and join us now with late details. >> reporter: frank it happened right here at this bus stop across the street from newwark memorial high school where a 17- year-old student was stabbed to death at 3:45 this afternoon. police say he was at the bus stop waiting for a ride home when the witnesses say two men assaulted him. tonight we talked to a grieving mother. >> my son is a good son. he used to go to church. he would go to school and then come home. >> reporter: she says a car accident delayed her this afternoon from picking up her son justice after football practice. so he was waiting for a bus. she says her son called his girlfriend on his cell phone after he was stabbed. >> he just said he got stabbed. and so by the time the girlfriend was there, the other

football player friend of his saw him in the middle of the road. >> reporter: police say he died on the street. justice was a star linebacker for his high school and had plans to play college football. his mother says he was devote today his family and not involved in any trouble. she suspects that confrontation at a teen party recently involving two outsiders may have something to do with her son's death. >> they were beating up a cheerleader. so my son was the one who jumped in and stopped them from beating her up. and that's how all of this started. >> reporter: newwark police tonight said two males of unknown age were seen running from the scene. they were dressed in black clothing and hoodie sweatshirts. >> i just wish whoever did this to my son would come forward. what they did was wrong. my son was a good son. >> reporter: justice is the

fifth homicide of the year for this city. police are asking anyone with information to give them a call. live in newwark, lloyd lacuesta, ktvu, channel 2 news. san francisco firefighters say a car travelling at a high rate of speed flew off northbound i-80 this evening and slammed right into a home in the portola neighborhood. it happened just before 6:00. the car went into an enclosed deck on to the home on item somebody avenue. the car's driver is being treated for his injuries. no one in the home was hurt. the fire officials say the home does not appear to have suffered serious structural damage. dozens of people gathered tonight for an emotional candlelight vigil in memory of a man killed by the police this past weekend. during tonight's remembrance, the man's mother collapsed after hearing some disturbing allegations. ktvu's ken wayne attended tonight's vigil and join us now with a live report. ken? >> reporter: julie, about 75 people showed up for the candlelight vigil for 34 guy

helping napa valley college students shoot a music video. martin was the singer. he says the police seized his two cameras and the video that shows what happened. he says the officer didn't say anything before opening fire. >> he didn't say not one word, pointed into the allly and shot twice. and then pointed a gun directly at us over here in front of the tattoo shop. told us all to get on the ground. >> reporter: the song is about escaping street violence. it is called "i am sick of just living like this." ♪ i am looking out the window ♪ ♪ i hate to see myself in the mirror ♪ >> reporter: we stopped by and called the police to get their reaction to these latest allegations, but they had no comment. live ken wayne, ktvu, channel 2 news. the forensic expert testified or rather a forensic expert testified about dna in the preliminary hearing in the richmond gang rape case.

the forensic supervisor of the contra costa crime lab said dna evidence found at the crime scene is linked to four of the seven defendants. the seven adults and teenagers are accused of gang raping and beating a 16-year-old outside a homecoming dance at richmond high school last year. the final witness is expected to be the lead investigator. also tonight, one of two mothers accused in the deaths of four children in a fire at a fairfield apartment is now facing murder charges. a salano county judge says there is enough evidence to consider four counts of second degree murder against james. her sister is charged with involuntary manslaughter. the women are accused of leaving their four young children alone. investigators say a candle left burning started that fire last april. bus riders in the east bay marched to an ac transit board meeting in oakland this evening to protest the cuts in service.

they are demanding no additional service cuts for three years. ac transit slashed bus service by 16% this year. but an additional 6% cut was postponed last month after the agency's 1700 bus drivers were both forced to accept concessions. still the ac transit board is warning that more cuts might be needed in march. >> the fate of the military's done don't ask, don't tell policy is once again in the hands of the u.s. senate. today the house of representatives voted for a second time to overturn the ban on gays serving openly. >> america has always been the land of the free and the home of the brave. we are so because our brave men and women in uniform protect us. we honor -- let us honor their sacrifice, their service, pair patriotism by re-committing to the values that they fight for on the battlefield. >> the bill moves to the senate as a so-called privileged bill stream lining the process for bringing it to a vote.

a spokeswoman for senate mantel leader harry reid says that won't happen until next week at the earliest. republican senator susan cowan of maine says she believes there are enough votes to pass it. the tax bill won approval in the senate and now goes to the house for a show had down vote. the vote sailed through the senate. it was 18 in favor and the opposed. the vote is a win for the american people and the nation's economy. a tax deal would extend bush era tax cuts at every income level for another two years and renew jobless benefits for the long-term unemployed. the deal exempts the estates worth as much as $5 million from taxes and imposes a 35% tax rate on larger inheritances. the president is now urging house members to come together in what he called the spirit of common purpose and approve the $858 billion deal. nine san francisco police officers were honored tonight

for bravery in the line of duty. [ applause ] >> four officers were awarded the bronze medal award for stopping a man armed in february. and five were given the gold medal award the highest award for catching two men trying to kidnap two women back in 2004. that shooting of ward was controversial at the time but in 2007 the officers were absolved of any wrongdoing. time magazine has named facebook's zuckerbook the person of the year. he says facebook changed the way we view the world. >> time magazine today named facebook ceo mark zuckerburg the person of the year calling him a connecttore saying he has merged the fabric of life. >> he has allowed people to

parents are grateful that police chief is asking the fbi to conduct an independent investigation. they say they don't trust the police department's own internal investigation of the fatal shooting. >> i said i will never see my child again no matter what. that's the worst. and his little daughter has to grow up without her father. >> reporter: 67-year-old nelly jones and her 68-year-old husband frank said they never thought they would have to bury their son and now help raise his 2-year-old daughter. they are critical of the police officers who shot and killed their son. >> fear takes over. i am going to be real with you. the training goes out the window. >> reporter: do you think that's what happened? >> that's exactly what happened. >> reporter: on november 8th derek jones an east oakland barber shot owner was shot and killed by two police officers near his shot. the police were responding to a domestic violence call.

jones ran from them and appeared to reach for a metal object in his hand. later police say that object was a small metal scale. >> the suspect appeared to be reaching for a shiny object or he reached for his waste so i shot him dead instead of giving him a chance. his mother read a poem during the public safety meeting about the police justification for officer involve shootings. police chief anthony bets also spoke at the meeting and called for an independent investigation by the fbi. >> but as an african american man and as a father, i understand your pain and i hear you and i have listened to everything that you said. >> i would like to say thank you. i appreciate what you are doing. and i'm just looking for some justice. >> reporter: the two officers involved in the fatal shooting of derek jones are on paid administrative leave pending the outcome of the police department's internal investigation and another probe by the alameda county district attorney's office. reporting live here in oakland,

amber lee, ktvu, channel 2 news. san francisco prosecutors said today they will re-try a man serving two life sentences who a judge ruled was wrongfully convicted. conrad now 69-year-old was convicted of a double murder in the city's bay view district. a san francisco judge ruled yesterday that a key witness lied on the stand when he testified he was not in a witness protection program. his lawyer contends that witness was, in fact, paid thousands of dollars and given a place to stay by a police homicide investigator and later the police chief earl sanders. the witness in question died two years ago. california's overhaul of primary elections is moving forward after the state supreme court today refused to stop proposition 14 from taking effect. voters passed that measure in june. it will eliminate party primaries and require state and federal candidates to run in a single primary. the top two finishers would then compete in the general election, even if they are from

the same party. this would not apply to candidates running for president. students marshaling on universal boulevard in oakland are demanding passage of the dream act. the demonstrators said they had no choice being undocumented immigrants because they were brought to the u.s. as children. maria says she came here when she was one. it will help them become a citizen. >> citizenship means more than money or college. it means, you know, being able to travel or being able to drive. you know, things that people who are citizens take for granted. the house passed the dream act last week but it faces tough opposition now in the senate. it would provide many undocumented young people with a pass for citizenship provided they attend college or join the military. go into mcdonalds once a month apparently wasn't enough for a little will be little girl from northern california. her mother said she wanted to

go every week after a commercial encouraged kids to collect an entire series of toys. now the mother is taking mcdonalds to court hoping they change the way they do business. >> reporter: the nation's largest fast food chain got served as a mother and a public advocacy group filed a class action suit saying they use fraudulent ads and toys to target children. >> so that really concerns me that mcdonalds has that kind of influence on my children and the things that they would request from me on a regular basis. >> tobacco companies had the courtesy not to go after 3-year- olds. coca cola and pe psi cola don't go after 3 year(s) olds. mcdonalds does and shame on them. >> the suit was filed in state superior court in san francisco where county supervisors last month banned toys from kids meals that don't meet certain nutritional standards. >> i am very sympathetic to the parents in sacramento that are challenging marketing towards

kids that is unfair and leads to unhealthy food choices. >> reporter: in an e-mailed statement a mcdonalds spokeswoman said. >> i just think that for kids now i doubt they will have something that harm them. >> other mothers tell us they feel pressured by their kids to buy a happy meal. >> mommy i want a happy meal. i buy it for him and i learned about every meal he liked it. >> the suit doesn't seek monetary damages. it calls for a ban on mcdonalds marketing happy meals on television, billboards and in its own restaurants. in san francisco, david stevenson, ktvu, channel 2 news. . a second victim is now died from that shoot-out in a south sacramento strip mall yesterday that killed the mother of a 2- year-old boy. the sacramento county sheriff's department said a 20-year-old man died from a chest wound.

five other men were wounded but are expected to survive. detectives are trying to sort out which ones, if any, were innocent bystanders, just like monique nelson who was killed by a stray bullet moments after her putting her young son in her car. a search is underway for one suspected gunman identified as 24-year-old lonnie orlando mitchell of sacramento. they say he should be considered armed and dangerous. they double the bail for a man accused of sexually assaulting a girl at a wal-mart store. the suspect did not enter a plea. the judge said the previous deal of $120,000 was a miscalculation and made it $220,000. the alleged attack happened last friday at the wal-mart. here is a look at the good samaritans wearing a incident ared shirt who being at that willed him in the store and held him until the officers arrived. prosecutors say the trial of a teen accused of detonating

two pipe bombs at a san mateo high school is set to begin next month. alex pleaded not guilty by reason of insanity to attempted murder charges. prosecutors say in august, 2009, you went to hillsdale high school with pipe bombs, a sword and a chainsaw with the intention of killing as many people as possible. the incident he happened when a teacher tackled him. no one was hurt. it was 2 years ago tonight that the mother of a young girl went to a san raphael bar to go to a football game. when she walk out the door that night it was the last time she was seen alive. her body was found in the bar's parking lot the next day. today family and friends, along with the police, returned to the scene to publicize a new $50,000 reward officer to help find the killer as a woman devoted as a mother. the father of the little girl drove by the crime scene the day her body was found.

>> i never wanted to come to this street ever again in my life. but if this is what it's going to take we will be out here every year until we catch this person. she left the bar with a man from chicago. they recently talked to that man. while he remains a person of interest, at this point he has not been arrested. alameda unified school trustees have approved a plan to trim $2.5 million to their budget. if they don't say yes to a new parcel tax they will be forced to close 0 or consolidate some schools. under the plan these schools will be closed. k-3 grade classes will be increased. and all middle school days would be reduced to six periods. the san francisco unified school board is moving forward with a plan to significantly cut its school bus fleet from 44 to 35 vehicles. they are hoping to save $3

. the signature tower of the new bay bridge is getting taller tonight. a lot tower. they are working to lift four steel columns into place. each column is 200 feet long. the tower will stand three fourths of its height.

christian kaftan is here to tell us why the crews are speeding up the timetable. >> reporter: the best way to describe this is the crews are racing against time. just a few minutes ago we saw workers on the outside of that self-anchored suspension tower. they are working on the inside of that section it's hollow and working to bolt that new section into place before rainy and windy weather brings this work to a halt. >> crews began foysing the first of four 1.1 million point tower sections into place this morning. >> the higher this gets the more noticeable it is. we are over 300 feet now in the air. >> reporter: time laps video from cal trans shows the progress. crews will be working 12-hour shift around the clock. they started the job one day earlier than originally planned for safety reasons. the storm forecast for the end of the week could make a monumental job more difficult than it already is.

>> the rain isn't so much a challenge as wind is. because even though these things weigh 551 tonnes when you get them up there on strands the steel can catch which happened like a sail. >> reporter: the eye popping work meant some commuters couldn't help but slow down and take a look despite cal trans warning to resist the temptation. commuters say every time crews move a major section into place their drive slows to a crawl. >> since they have been working on the bridge a lot of distractions on the bridge. >> reporter: this is a project where the price tag has soared while the timeline has lagged. the commuters welcome another sign that it is nearing an end. >> it will be like a freeway going through there instead of a bridge. so it is pretty impressive. you know, i would love when it >> reporter: now, cal trans is saying if the weather cooperates they will be able to install three sections of the tower over the next five days. if the wind kicks up that will

and help stop diabetes. . >> a remembrance was held today for the 51 homeless people who died on the streets of san jose during the past 12 months. a candle was lit for each one. those who work on behalf of the homeless say the number dying there has fallen about 50% in the past two years. and they are attributing the decline in deaths this, in part, to on site clinics and respite centers at shelters. with an eye to all of the wet weather on the way the south bay's largest homeless agency is increasing the number of beds available to help the homeless get out of the rain and the cold. those who work with ehc are responding to a need as they have seen shelters in san jose, sunny veil and gillroy filled

to capacity in recent weeks. those who seek relief welcome the help. >> you are wet. once you are wet you stay wet and you stayed cold. and then, you know, you are fighting the cold. >> ehc says that every year in santa clara county 20,000 people experience an episode of homelessness. in news of the world tonight in australia heavy waves smashed a wooden boat against the rocky coast of christmas island. it carried would-be immigrants. there were as many as 100 men, women and children onboard and at least 28 died. and another 44 were rescued. the boat's engines had failed. some of those seeking new lives in australia came from as far away as iraq. >> in greece, violence erupted in athens today during a general strike against the government's new measures. protestors threw gasoline bombs at riot police, set fire to cars and vandalized the store fronts. at one point a group of young people beat a politician. a bail-out loan has forced

greece to cut the pensions and salaries while raising taxes and retirement ages. across south korea sirens blade to signal the start of a nationwide arid drill today. people stopped working and headed to underground shelters. military fighter jets flew overhead to simulate air strikes from north korea. the south is on heightened alert for possible war since a strike from the north island last month. today's strike was the largest since 1975. america based airlines is adding flights virgin america will offer daily flights from san francisco to mexico and to cancun from la and from san francisco the following day. the 3-year-old airline made its first ever quarterly net profit at the end of september earning $7.5 million. alaska airlines announced it will begin new service between mexico and san jose. the flights to go.

2008, plus the beetle. volkswagen says so far they have had no reports of fires. alameda residents are being warned tonight about raccoons that are causing problems. ten reported encounters with raccoons in the passed six months. last thursday four of the animals entered one family's home through a pet door and attacked their two dogs. the dogs are now recovering from their wounds. the control officials say homeowners should make sure to keep pet doors locked at night and don't leave food outside. direction over the next few days. actually right into next week. so you see last night's weather system blowing out of here. this western pattern is not unprecedented. seen this pattern before stretching out into the pacific. you don't see that once every year when you see a pattern like this where you get so much activity focused on central california? with us one after the other after another. the most recent computer model gives us a break between storms which will be nice. a long way to go before we can actually time these out. tonight we are talking about patchy dense fog. if you step outside right now i don't care if you are in hayward or out in redwood city it is cool. overnight lows tonight in the 30s. partly sunny tomorrow. a nice dry day. wet as heck as we get into friday. right now outside it is 36. 38 in napa. look for some patchy fog in those locations as we get into the next couple of days. and with that we are looking at temperatures 41 overnight in oakland. 36 in hayward.

temperatures are going to continue to be on the cool side with the fog showing up in the valley. and in this system teed up offshore it gets here, as i mentioned, on friday. so tomorrow is your break day. by friday this thing rolls in here. here is how it breaks down tomorrow. we wake up and it's cool. lunchtime temperatures still mild. clouds increasing late in the day tomorrow. more clouds come in. and then that's it it starts to rain. the most recent computer model looks like this. we get through thursday. we get into thursday evening. look at that, even the chance of some rain starting to show up along the coast. i expect most of the showers will be late thursday night into friday morning. but you get the picture. now, look what happens friday. and then you get into saturday. friday afternoon. and it just keeps coming. so there is a lot to figure out with all of this timing. just know that it is going to be a very wet period. these are a series of storms which are looking for the breaks. and when talking about it there is a chance of flooding, especially here. if you get a little break in here we can take three inches of rain a day. if you don't get breaks you
