when his sexual assault trial may begin and what may happen at that trial. good evening, i'm dawn timmeney in for lucy noland. >> i'm iain page. our crews have been in court all day. let's get right out to bruce gordon in norristown. bruce? >> reporter: short answer to all of this don't hold your breath waiting for this high-profile case to get underway. what with the complexity of the issues here and some tight schedule link by the defense attorney the lead attorney brian mcmonagle looks june 5th of next year before this case gets underway. not necessarily here in norristown. >> we love you. >> thank you. >> roughly two hour long pretrial conference gave a glimpse into what fights may lie ahead in this high profile case. the 79-year-old com bee legend is charged with drugging and sexually molesting andrea constand a temple university athletic department worker at his cheltenham home back in 2004. today we learned the defense will seek to move the trial out of the philadelphia area because

of heavy publicity. prosecutors made clear they will fight that attempt. >> i just finished up a case that was pretty high profile here in pennsylvania. we were able to get fair impartial jury and we were able to get the justice in that case. so we plan on doing it in this case also. >> reporter: cosby accused of of molesting dozens of women over many years all of the other cases are in civil court. but prosecutors in this criminal trial now say they'll attempt to bring 13 other accusers to the witness stand to establish a pattern of bad behavior by cos cosby. the defense did not take questions but in statements made after the session blasted the string of accusers and media's handling of their claims. >> the time has come for somebody somewhere to shine a spotlight on the trampling of this man's civil rights and that time is now. smart man a long timing a said in injustice anywhere is a threat to justice everywhere.

those words were true when they were spoken and they are true today. >> victims of sexual assault deserve our support and protection. women should not be object joke toy tide but not at the cost of sacrificing every person's fundamental right to be deemed innocent before proven guilty. >> reporter: much of this court session today was spent wrangling over telephone call between cosby and andrea constand's mother some months after that incident at his home. in the phone call cosby makes comments that could certainly hurt his cause but defense wants to call thrown out, that is not to be loud to be used at trial claiming the call was illegally recorded. prosecutors say the call was legit and they say it's pretty clear from that recording of the call that cosby knew he was being recorded any way. no ruling yet on that issue. dawn? more to come. >> all right, bruce, thank you. a philadelphia police officer is under internal

investigation for an off duty shooting involving a relative. police say an argument turned physical last night at the officer's home on taunton street in northeast philadelphia. police say the officer fired his gun at least twice. the relative who was hit was last listed in critical condition but stable. no word right now if the officer will be charged. developing to night in atlantic county two men are charged in connection with the shooting of an atlantic city police officer. they made their first appearance in court today and it was big show of support by other officers. our dave schratwieser was at today's court proceedings. dave? >> reporter: iain lots of police officers in court today while officer josh lee vadell recovers from his gunshot wound in an atlantic city hospital. he was shot early saturday morning near caesars as keen know he wants to improve we're told but in the meantime those two suspects face the judge for the first time. over 100 officers from more than 20 police departments flooded in

lander courtroom as shooting suspect martel chris psalm and dimitris cross stood before a judge. they came to show their support for officer vadell who remains in critical but stable conditi condition. >> i've been close to josh for sometime and he's a strong kid. he's a tough killed he's a hell avenue cop. >> reporter: president matt rogers says the show of support has been overwhelming as vadell fights to recover from his injuries and the police community in south jersey comes together. >> from the hour it happened up until now it's been a humbling experience to seat law enforcement community from local, county, state, federal come to our aid. >> reporter: chisholm from millville and cross from bridgeton charged for attempted murder after the pair an third man jerome damon of camden allegedly tried to rob three men at gun point saturday morning near caesars casino as officer vadell came upon the robbery and stepped from his patrol car he was shot. his partner quickly returned fire killing damon. suspect has little or nothing to

say in court. >> we want to get a lawyer. >> cross and chisholm captured after intense manhunt following the shooting investigators have not said who shot officer vade vadell. a nine year veteran of the force. rogers has worked with the officer. he prayed his bravery in the line of duty. >> this could happen to anyone. he's the guy because he's going to get through this. he's going to recover. >> reporter: again, he is improving. two suspects are held on $750,000 bail each. a gofundme page set up for the officer to help with his medical expenses has already surpas its0 goal now at more than $52,000 from almost six hun dead donors. >> that is good news, dave, thank you police are looking in a city in the crescentville section of the city after man showed up with a gunshot wound to his leg. right now officers say that man is not cooperating. police think the shooting happened in the 500 block of rows sally street.

surveillance video shows a group men running off near a liquor store. police think some type of fight may have spark the shooting. a new jersey republican running for a seat on the west deptford township committee is dropping out of the race. a new report he harassed a reporter. michael kavits submitted this letter of resignation today. a reporter for the daily beat says kravitz harassing -- sent her harassing messages on facebook one saying the former candidate hoped someone would sexually assault her. the chairman of the party committee found no evidence kravitz account was hacked. he called the comments repulsi repulsive. we are still tracking hermine in your fox 29 weather authority. the storm headed west and creating big waves from massachusetts down into delaware. we are not in the clear just yet as some areas are seeing a little rain from hermine. let's check in with meteorologist dave warren. >> yeah, now going to be what's left of hermine. national hurricane center will no longer issue advisories.

it is close enough about 115 miles off the coast and here's the rain from it. just some light rain which is spinning around that center of low pressure. so it will work its way from the north to south. right along the parkway there. right through parts of burlington county, atlantic county, ocean county get little bit of rain. heaviest rains off the coast though. so it's just north of atlantic city but moving south so areas cape may county around margate city and martyr south into ocean city, avalon, stop harbor would see a little bit of rain over the next few hours. not much moving the storm that. will change. it will start to kick off to the north and northeast. here's the track from the national hurricane center it stops right there. right at 2:00 o'clock the last advisory as close as we can see 115 miles east of atlantic city with winds about 50 miles an hour. it will slowly dip south and then track to the northeast. so it's moved north, moving west but on its way out. here's the future weather computer that shows rain showers continuing even through 11:00 o'clock tonight. not everywhere. just right along the coast here

where you could see that light shower threat tonight and it will continue to move south. now the clouds will stick around tonight. by tomorrow, it's slowly begins to move out. here's where we see the change in weather tomorrow afternoon. as the temperatures start to climb a bit and the highs will close in on 90 degrees. we could could be looking at a heat wave coming up look for light breeze out of the north here overnight tonight. heat wave and the weekend forecast in the seven day all coming up. >> all right. dave, thank you. a 19-year-old who disappears after sunday's made in america festival has been found. nelson armstrong got separated from his friends late sunday night after the concert. police announcing today that armstrong who is from oregon was located and reunited with his family. no word tonight on exactly where armstrong was found. well, after 50 years of service itt tech is shutting down all of its college campus campuses. the for profit college announced today it's stopping academic services at more than 130 campuses in nearly 40 states. u.s. department of education

last month banned the school from enrolling new students who use federal financial aid. shut down will impact 35,000 students and cost 8,000 employees their jobs. itt says it will help students find other options. jury selection began today in the trial that will determine who will have to pay the victims after 2013's deadly center city building collapse. the lawsuits were filed on behalf of the six people who lost their lives and the 13 others who were injured after a four-story brick wall came crashing downton salvation army store. the plaintiffs are suing the salvation army. demolition contractor, the man operating and an excavator and architect in a new york real estate speculator. reports say about 120 potential jurors will be interviewed and that selection could take weeks. loved ones are worried sick tonight over this new jersey woman. she's been missing for days and police found some things in their search that have her family even more concerned.

could still be in sussex county. >> a man charged with murder tonight in a gruesome death in north philadelphia. police say joel horton ran over a woman with a car and then beat her to death with a shovel. it happened on sunday on the 700 block of lowden street. police were called out to a report of a person screaming and when officers showed up, they say 52-year-old adrian lindsay was underneath the car and that horton was standing by it. police have not said how the two may have known each other. you decide 2016. the race foment s senate heating up in pennsylvania just two months ahead of election day both candidates are working hard to win over voters in the keystone state. >> both katie mcginty and senator pat toomey stopped in philadelphia to try to spread their message. mcginty kicking off her fall campaign push in south philadelphia. she was joined by senator bob casey and representative bob brady inside the sheet metal workers hall along columbus boulevard. mcginty compared her opponent to donald trump and claimed she weren't fighting for higher

wages. she also attacked toomey for support wagon she calls bad trade deals. >> they want to pay your property wages, number one. number two they want to hand our good jobs over to chain nan all these bad trade deals, and i want to say this. so we know with pat toomey he literally wrote the book on the bad trade deal. >> mcginty claiming that pat toomey is only backing budgets that help the wealthy. across the city senator pat toomey was talking about taxes. toomey stopped by small businesses in northeast philadelphia. he argued that while working with governor tom wolf mcginty supported raising taxes on all pennsylvanians. toomey says that is something voters in the keystone state cannot afford. >> katie mcginty says she stands with the middle class but if you look at what she actually does, and what she proposes doing, it would be great harm to the middle class so i'm calling on katie mcginty to stop pushing for all of these tax increases

>> british airways is warning passengers of residual delays after a now fixed computer glitch. the hiccup in the check in system caused backups at a lot of airports including in the us. british airlinings ended uppercase canceling more than 100 flights to or from london. some passengers are not happy with the way the company handled the situation. >> apologize for the inconvenience at the airport. but -- they never did update us

what was happening. >> this latest glitch comes after other computer glitches in july caused a lot of delays. brock turner the former stanford swimmer convict evidence sexually assaulting an unconscious woman is now officially listed as a sex offender. the 21-year-old was at the green county sheriff's office he registered there. it's in ohio he's currently living with his parents. turner will now be known as a sex offender for the rest of his life following his release from jail last friday. he was convicted back in march of assaulting an unconscious woman after fraternity party in january of 2015. prosecutor has been seeking six years behind bars. turner was sentenced to six months and spent just three of them in jail. this sentence also sent a dangerous message to victims of sexual violence it sent the message don't bother to call the police because you will not get justice. and to potential perpetrators it sent the message don't worry the

courts will have your back. >> california pass nude legislation last week in the wake of the turner case it would require tougher sentences for sexual assaults. >> former fox news channel gretchen carlson settled her lawsuit against roger ails. it led to the down fall of chief executive at a statement today 21st century the parent company of fox news channel and fox 29 said "we regret an apologize for the fact gretchen was not treated with the respect and dignity she and all our leagues deserve. a source told the associated press carlson was paid $20 million carlson alleged she was demoted and let go from fox after she refused ails sexual advances and complained about workplace harassment. meanwhile greta van susteren quit after 14 years as a prime time anchor at fox news channel saying that fox quote has not felt like home to me for few years.

of testimony cosby gave decades ago during a civil lawsuit filed by his accuser andrea condon couldn't stand. judge has yet to decide on the matter. meanwhile prosecutors said in court today they want 13 other women who claim cosby sexually abused them to testify at some point during the trial. pennsylvania's new attorney general says his predecessor former second in command will leave the job after this week. attorney general bruce beamer says friday will be bruce castor's last day as solicitor general. former attorney general kathleen kane created the position of solicitor general in march and filled it with bruce castor. castor is also a central figure in the cosby case having chosen a decade ago not to charge the entertainer with sexual assault. kane resigned last month following her conviction on charges that included perjury. it's the stuff nightmares are made someone in a clown costume apparently trying to lure children into the woods and it's been happening in north carolina. >> so far none of the children

finally have the last look at hermine the last advisory came down 2:00 o'clock this close it was going to get is right here many 150 miles east of atlantic city. now the wind still 50 miles an hour. so rough surf maybe some beach erosion even minor coastal flooding today with the high tide. possibility of that tonight. doesn't look likely the low of the two tides and the winds start to go change direction a bit. radar getting a little close. impact we'll see from this little bit of rain here. the radar going close and showing you exact wrl that rain is coming down see if it's in your neighborhood right around the ac expressway. the garden state parkway right where they meet a few showers coming through. up through parts of ocean county here. we're seeing a little heavier rain trying to work its way through these bands are spinning around the low. so they come in from the north and dive to the south. they're not really making. progress west so east of 95 but up through atlantic city and up through the parkway there through parts of long beach island that's where the little heavier rain is.

maybe tenth of an inch or possibly about .20 of an inch of rain possible. here's the radar. this is future weather computer that shows shows wait look like and here's where it is headed. it will start to spin south just a bit. little band here across maybe the coastal sections seeing a few showers overnight tonight. then we'll see a little break tomorrow. things will start to change though starting here tomorrow and continuing through the end of the week. those showers there out around washington, d.c. will try to work their way in but that is really the heat and the humidity that are building in. still gusty tonight. these are the current wind gusts out of the north about 20 to close to 30 miles an hour so breezy day as that storm gets a little closer but it's moving out. the time of this there it is thursday. here's the change of weather. this heat plus the humidity will start to build in from the south. not lasting long though. there's the end of it but before it gets -- moves through, we're looking at temperatures climbing into above 90 degrees. could be a stretch of three days. we'll call eight heat wave. that heat index that will be the key though near 100 degrees it

ends on saturday. things are clearing by sunday p.m. the afternoon the morning could see a few clouds maybe few lingering showers. this is what it will feel like in the upper 90s on thursday. maybe close to or touching 101 of the computer forecasts we look at and there it is 100 degrees in philadelphia by thursday afternoon. and it will drop a little bit there on friday. so we go from hermine to heat. 88 tomorrow. 92, 94, 95 degrees all with high heat and humidity. enjoy tomorrow, though. just a few clouds though still a bit breezy. 82 up to 88 degrees. clouds linger down to 78 degrees. one day it's nice is wednesday. we talk about three days in a row of heat and humidity with showers and thunderstorms friday and saturday. could be clearing by sunday. we'll say clouds to sun. monday and tuesday looking nice with lower humidity and a cooler breeze talk about what's happening this weekend temple saturday, eagles sunday phillies back in town on maybe. temple deals he dealing with that heat and humidity. not the eagles.

marijuana plants in the backyard of this west haven home. employees say it has a street value of more than a million dollars. inspectors made the discovery while carrying out a compliance inspection. no arrests have been made yet that daycare owner has had her license suspended and the facility shut down. on the run tonight, three men police say spray painted graffiti on building in philadelphia's frankford neighborhood much this happened back on august tim. on the 1000 block of fulcroft street. one man painted r m.d. on the building then all three took off. it's a flash she widespread crime designed to get your attention and it's costing city taxpayers more than million dollars a year. graffiti painted across the city has crews cleaning up thousands of sites each year and now authorities believe the taggers from a national ring of graffiti artists have decided to make philadelphia their next urban canvass. dave schratwieser explains. >> reporter: it's a job city workers repeat over a hundred

thousand times each year. paining over graffiti flash across buildings, bridges, even trucks throughout philadelphia. it costs taxpayers big bucks. >> we spend $1.2 million a year to clean up graffiti. >> reporter: but on this day, the city workers are at the corner of spring garden and front streets just off i-95. they're here to spray paint over this giant so hiv called tag that says bowzr swank it's no ordinary graffiti or tag. city officials believe this is the work of out of town graffiti artists who came to philadelphia with one purpose. >> they classify it as artwork. we classify it as destroying other people's property. it's graffiti. >> reporter: fox 29 investigates found that the tag bowzr swank or sometimes swang bowzr started popping up in prominent places in philadelphia about seven months ago.

>> they keep on destroying property. and keep on tagging them. >> reporter: these are elaborate tags that cost about $600 in paint and can take as many as two days to complete. great feeder tee crew putting these up may be part of a nationwide ring and can go just about anywhere according to city officials. >> on fences, rooftops, second, third stories. >> they cut the gate over here. >> reporter: owners of this food supply company on north american street got stung by the out of town taggers in early august. they broke in through a rear fence and tagged five delivery trucks with the word bowzr. >> they paint all the trucks. >> reporter: what do you think about that? >> i don't know much that's a mess. >> reporter: a few weeks earlier, the taggers struck at emerald and lehigh two stories off the ground at a business called iron works. it's owned by carlos santos. >> damage your property? >> yup. >> reporter: cost you money? >> yup.

>> reporter: time? real hard working guy, right. >> yeah. >> reporter: you don't need to be cleaning that up, i guess. >> no. >> reporter: santos told fox 29 investigates that the taggers even cut the feed from his surveillance camera that would have captured them tagging his building. simply cut the cable to the cameras. >> damage it, yeah. i pay for this. a lot of money talking it out of my pocket. >> reporter: as it turns out philadelphia is not the only city being hit hard by the bowzr swank tagge taggers. their work has shown up in dallas, detroit, san francisco, oklahoma city and tulsa. philadelphia officials are convinced it's the same crew traveling across the country. they use the initials ehc. >> it's the same writing. out of town people because these tags were never seen a month ago. >> reporter: in fact authorities in oklahoma city and tulsa believe the bowzr swank

tags found in their cities were the work of at least three people. they have been arrested on other charges but not for painting graffiti. >> we got plenty of taggers in philadelphia, right. >> we don't need no more. >> reporter: oklahoma investigators tell fox 29 investigators they believe these taggers go on so-called spray indications to other cities where they do their work. in fact one of them was arrested here in philadelphia back in january but the district attorney's officer says the case was dropped when a witness failed to show up for core. no one knows if he's still here but city officials have a message for him if he is. >> move out of the city and get out of here and go back to where they came from. ♪ >> reporter: back at front and spring garden city crews had to paint the entire sign of this new building to cover up the giant bowzr swank tag. the cost of to the city taxpayer between 1800 to $2,500. >> this guy here this damage is maybe close to 11 grand.

been brewing for quite awhile now. fox's kristin lee has the story. >> reporter: at first glance, this house looks like the victim of storm damage, but, no, this damage is manmade. >> why would you want to put a family out of their home? unless you just cold hearted, right? >> reporter: the sheriff's office tells me edgar mcclellan charged with trespassing and felony vandalism after running down the home with a backhoe saturday morning. when i got to the home monday, family members were surveying the damage. walls on the left side of the home are caved in. this is the ceiling on the floor. flies made their way into the kitchen. no reason why. >> no reason why. nobody -- enerve had a beef with this man. >> reporter: family members tell me they've never had problems with mcclellan but the sheriff's office tells me this is the result of a neighboring dispute. john hug den who lives in the damaged home was arrested just a few hours before the bulldozing incident. he was charged with reckless endangerment after firing gunshots into the woods behind his home.
