the verdict finding him guilty of first degree murder of a 10 month old baby and their grandmother two years ago he faces the site for his life in an unusual move the judge started the penalty phase of the trial a short time after the verdict was reached. that means jurors have begun the process of deciding whether he will be put to death. normal until would happen tomorrow but the defense is calling his mother to testify. she is on the stand right now. she returns to india tomorrow. she of course very very emotional essentially she is begging jurors to spare her son's life. now we spoke with the defense just short time after the verdict was read. >> as lawyer i would representing him in a different direction and hopefully would have come to at least save his life, and if not perhaps murder three, but that would have been dicey. it's a second degree murder case. in my opinion. but the jury did see prejudicial

facts that led them to find first degree on both. >> there are a number of mitigating factors which will come out during the course of the penalty phase, but i do believe that we have legitimate mitigating circumstances introduce and i'm confident that the jury will agree. >> reporter: again, his mother on the stand right now. the penalty phase of this trial has begun. he faces death in this first degree murder trial. back to you. >> thank you is a bone in a. a developing story out of delaware county. a bar fight got brutal. ended with a victim being stabbed in the neck. the video is so violent we won't show it all but police were able to make out the suspect. now they just have to find him. fox 29's dave schratwieser is live at upper dash plea police headquarters tonight with the latest on this manhunt. dave? >> reporter: dawn, that attack in the bar sent everyone in that bar scrambling last night and tonight police are scrambling looking for this suspect who they describe as armed and dangerous. that fact has folks who own

businesses polling that busy corridor worried about the impact on their businesses. >> it's not going to be good for us. it's not going to be good for our business. >> reporter: businesses along this stretch of market street in upper darby are struggling to make a buck each day. so the last thing merchants like hair salon owner me lane today madison wanted to hear thursday was news about a near fatal stabbing at this bar on this block. >> we need our clients and we're trying to build up our salon and we want our people -- we don't want our possible to be afraid any more. >> reporter: this was the scene caught on tape inside the la cantina bar wednesday night when a man pulled out 95, stabbed bar patron in the neck and fled. >> we're concerned. he's got a knife and we want to get him off the streets. >> reporter: police came to the scene and quickly attended to the victim. wilson, who lost a lot of blood. superintendent chitwood credited police officer and iraqi war veteran michael crispin with quick action to apply pressure to the victim's serious neck

wound. >> as a result of his actions he certainly saved his life up to this point in time. >> reporter: investigators say the bar has been a problem in the past but it recently changed hands. while chitwood says things have improved, incidents like this hurt business along this busy corridor near the 69th street terminal. >> this is a business district. so it shouldn't even be here. it's a business district. >> reporter: detectives say the suspect is 23 year old miguel escalan. he lives on the 7,000 block of guilford road. police raided his home but he wasn't there. the superintendent says escalan is an illegal immigrant from honduras. making attempts to find him even more difficult. >> he's got no immigration papers. he's got no pace port. he came here illegally. he'll probably leave illegally. how do we find him? >> reporter: now the victim is still fighting for his life tonight in a local hospital. he is in very critical conditi condition. police is do not have a motive for this attack. dawn? >> all right, thank you, dave.

some good news tonight in the fight against ebola. texas health officials say a dallas county sheriff's deputy who exhibited symptoms of ebola has tested negative for the disease. michael mon anything had gone to a health clinic on wednesday complaining of illness. he was among a group of deputees who went inside the dallas apartment where thomas eric duncan was staying. duncan died yesterday of ebola. officials say monig is in good condition. >> us marines stationed in spain heading to west africa to help with the ebola crisis. one had dread soldiers being deployed to liberia the area hit hardest. officials say 4,000 people in west africa have died after contracting the disease. making this the worse ebola outbreak on record. us officials say thousands of other troops are on stand by and could be sent in if more help is need. here in the us officials at a summit in washington, d.c., addressed the rising financial concerns involving the -- with combating the disease.

but mostly cloudy conditions tomorrow and most of the rainfall really starts to arrive tomorrow afternoon and evening. so if you're headed out friday night you'll want to have the rain gear handy. but what about the up you coming weekend? we'll talk about how this system could impact some of those plans coming up. >> dawn and iain? >> thank you scott. police in delaware county trying to figure out what sparked a fatal fire last night. the flames broke out about 9:30 at the elwyn institute on elwyn road. officials say 38 people were evacuated but one person was unaccounted for. they later found him dead inside the building. take a good look at this surveillance video. philadelphia police say that it shows the suspects in novembe november 2013 murder in the city's kingsessing neighborhood still unsolved 11 months later. the killing was one of nearly 250 in the city last year. >> but to the victim's grieving sister, it's much more than a crime statistic. bruce gordon with a story of frustration and fear. >> reporter: police say this surveillance video shows james

brockington's killers walking down the 5400 block of christian street just moments before they took his life. brockington's sister says the video dredge up far too much pain. >> i can't watch it at this point. >> reporter: monique asked we not show her face. >> it's a year later, and they're still free. so, yes, that has me nervous. i don't know these people, and i don't want anyone to be able to recognize me. >> reporter: the suspects a husky black man with a full beard and braided hair and his accomplice a thin black man in a dark hoodie and tan shoes approached brockington right in front of his home on christian accompanied by third man, a so-called person of interest. police say there was a brief conversation and then one of the two men pulled out a 9-millimeter semi-automatic handgun and fired eight shots into brockington. he died at the hospital. >> they knew the victim and knew them. >> reporter: homicide lieutenant mel williams says the have it yod should help track down the killers. >> i think that anybody that knows these individuals can identify them. >> reporter: the individual quality is good enough you can

>> we continue to follow breaking news from the courthouse in norristown tonight. the verdict is guilty of first degree murder in a montgomery county double murder case. he was on trial for killing a baby and her grandmother in king of prussia two years ago.

time sheets that indicated she was receiving care from a personal attendant after the attendant had already died. crow says she never met the attendant. never forged the time sheets and an imposter is responsible. >> tonight philadelphia police are hoping that surveillance video will help them catch whoever wrote a racist slur on a center city high school. the graffiti was found spray painted on the front doors of a catholic who'll 62 on north 19th street. found about 1:00 o'clock this morning. workers have clean it off and the school opened today. authorities say there are security cameras on the school grounds and they are looking over that footage to hopefully catch whoever is responsible. >> two years after super storm sandy nearly three dozen new jersey gas stations are getting state money to install backup power supplies. the stations are on or near storm evacuation routes and will share the nearly $2 million in grant money. 28 stations will install permanent generators while the others will use quick connect devices for mobile generators.

of festivals taking place, football games, we've got you covered, though. the high today made the up to 70 degrees. a pretty seasonal day. the low this morning in center city was 51 degrees. stepping outdoors right now the philadelphia international airport it's going to be pretty nice sunset. 66 degrees right now. the sun will set this evening one minute after 6:30. temperatures pretty uniform. mid to upper 60s. 65 in millville as well as trenton. the cool spot root now, 56 degrees currently in the pocono mountains. so if you're stepping outdoors, scattered clouds, cool, grab that height jacket or sweater. clouds increase, but once again, the rain is going to hold off until tomorrow. our next system still off to the west. we'll watch some disturbances pick up some moisture as they move through the midwest, the ohio river valley then eventually toward our area. so on the radar you can see the typing of our next system it arrives as we move during the day on friday. most of the heavier rainfall not really until friday afternoon and evening for your friday night plans. but by lunch time we'll have

mostly cloudy skies, no rain showing up right now with fox future cast, but there liking and drizzle before most of that rainfall arrives during the afternoon time frame. so tomorrow evening's rush we're looking at damp and dreary and chilly conditions. highs tomorrow upper 50s to right around 60 degrees if we can make it. by friday night, we're still looking at the clouds as well as showers. heavier rainfall south and east of philadelphia but we'll continue to saturate the atmosphere saturday morning we're looking at drizzle and also unfortunately showers. what about as we move into your saturday afternoon and evening. for tonight, dry, chilly lows in the city around 50. tomorrow, rain most of it arriving by the the afternoon. and it lingers through the first part of the day on saturday before all is said and done about half an inch to an inch of rainfall. what about the big homecoming game? temple taking on tulsa. we're talking about an early shower chance at the game especial physical you're tailgating. clouds stick around only

now there's no question this season has not been at the level of what nick foles did for the eagles last season at quarterback. but as foles said a few times, he knows the problems and believes he has had a better week this week in practice. >> i feel really good about all the drills we've done from a quarterback standpoint. with coach musgrave and then offensively throughout all our team periods i feel like we're working well. we're working at a good pace. we're learning if we do make mistake we're on to the next play and it goes to film. we're coachable and we come out here and if we guys make corrections and that's what wa want. >> just doing fundamental things and we'll see at the big game on sunday. >> we had another chip kelly news conference moment today. eagles don't look at what they do the field each day as practice. chip kelly has told the players they are training to be better for the games and today chip was asked why he refers to practice as training segments.
