scan showing that this system is loaded with moisture and it's moving very slowly. the actual center of the low is off the carolina coast and this is hugging the eastern seaboard and being held back by high pressure and the rain will not given to fall in philadelphia until later on tonight. zooming in you can see in dover there is light rain and we have all the buoys and we can get live data from the buoys, this is lewes, delaware and these are wind gusts, along the shore we could have wind gusts of 40 to 45 miles per hour tomorrow. and this could cause minor tidal flooding, the big story is the rain, we haven't had a soaker like this in more than a month. southern new jersey, it's moving in between now and 9:00, for the philadelphia and metro area, between 9:00 and midnight. most of evening is rain free, and the rain is moving in at midnight and 9:00.

charter school in north philadelphia today killing one man and injuring two others, the violence sent shock waves through the community, david henry is live now with the full story. >> it happened just as a group of eighth graders were getting ready to leave the school on a class trip. it was a close call, too close for parents that came running for their children. >> it could be anywhere but in front of my kid's school is scary. >> this driver got into a shootout with a pedestrian on a school sidewalk and the driver was killed and the pedestrian is stabilized in hospital. as is a buy stander that was hit by the vehicle. the mother of one of the shooting victims came running from blocks away. >> no! no! >> a distraught mother desperate to find her injured son and

other mothers frightened for the safety of their children. >> i was scared and i didn't know what was going on, i got the information and came and got my children. >> the children say that the school staff did a good job of keeping everyone calm. >> were you fright anded in there? >> yes, we were planning to go on a trip to an opera, and we stayed after school, and we were on lockdown. parents say there is too much drugs in the area and the school is not even a safe haven. >> in front of the school, of all places, put the guns away, and go hand to hand, there is no need for all of this gun. >> thugs with guns done honor boundaries. >> these guys don't really care about what is going on.

erupted, and the 25-year-old victim was 8 months pregnant and first responders were not able to save her baby. the second victim was hit in the back and leg and he is in critical condition. he is wanted for questioning in a separate homicide just yesterday. >> the push to increase the tax on cigarettes in philadelphia cleared a final hurdle today. governor corbett signed the house bill this afternoon and it adds a $2 a pack tax on cigarettes, in order to fund the schools. they say it's a steady funding source for the state's large of the school district. the bill is designed to provide $83 million a year in revenue. new details tonight for the man wanted for killing a pennsylvania state trooper, they think that they spotted eric frein but once again he managed to elude investigators. walter perez is live now with the latest on this man hundred.

>> reporter: there are several sightings of the man they believe is eric frein, and they shared new information including unusual items left behind. >> investigators say they believe that eric frein is playing some type of twisted cat and mouse game with them leaving behind clues that seem to prove he is somewhere in the massive perimeter set up by law enforcement. they found his jeep and empty packages of serbian cigarettes. and authorities found soiled diapers in this densely wooded area. >> that is one technique to be able to stay in position for a longer period of time. >> dna testing is underway on the diapers. and there are sightings by civilian ands police but someone they believe is frein. >> he kept himself far enough

a 21-year-old upper darby man is the first to be charged under the human trafficking law. choir is accused of sexually assaulting to young girls. investigators say that he drove the 15 and 16-year-olds to his mom's house in delaware county where he ordered them to have sex with him and his friend. they say they complied because he threatened to kick them out.

well, a former municipal court judge plead guilty for allegedly using his position to fix cases, joseph waters had resigned his position on the bench yesterday, according to court documents, waters called judges presiding over the small claims case asking for a favorable ruling, he admitted to his part in fixing a firearms case for his friend. waters had served for a judge since 2009. costly overtime is weighing down the budget. the comptroller studied 46 employees within five state agencies, they found they could have saved $750,000 just in 2015 by hiring additional staffs, they cited hidden costs including payroll taxes and pensions. >> we found that when employees in the city with the older

crime in the death of kevin ward jr. they revealed that ward had a significant amount of marijuana in his system. they show that his judgment was impaired when he walked into on coming traffic on that upstate new york dirt track and was then hit by stewart's car. >> stewart says this is the toughest most -- experience of my life. taken the phillies will try to prevent things from going further south in south florida. finally, here is something you don't see every day. a high school football game in south dakota, the kicker kicks it off a player's helmet and it's still good. look closely. what are the eyes off the foot, off the helmet, and in. all of that for an extra point, it seems like a lot work.

to get here. i want to show you what is going on live in cape may, where surf is definitely up and by later on tonight and tomorrow morning we'll have a wave, 6 to 9 feet and also a rip current, and not a lot of swimmers out there and this causes minor tidal flooding tonight and tomorrow morning. satellite 6 along with action radar showing the actual center of the low is off the coast of south carolina. it has a lot of real estate and we are dealing with cloud cover and temperatures are on the cool side. philadelphia 69 degrees, down from the high of 73, 2 degrees below average and allentown and reading 66 and sea isle city 70, the ocean temperature is 69 degrees and with the winds off the ocean that is pulling in the cooler air and these are the sustained wind speeds 10 to 15 miles per hour. as the storm system is getting closer, winds could get up to 40

miles per hour. not because this storm is particularly strong, it's actually a pretty weak storm system, but as it moves in we get the reverse flow from high pressure and low pressure, that causes a wind tunnel affect and with the low piling up the water at the shore that will cause tidal flooding, we are not looking at flooding from the rain but it's really from the ocean. future tracker showing rain approaching the philadelphia area at midnight tonight. that is slow to move in but it intensifies for the morning commute. you see all the red, that is the torrential rain and that causes slow conditions and ponding of water on the roads, as we head towards lunch time, the heavy rain lifts towards philadelphia and it won't be nearly as wet for the evening commute, by 4:00 you don't see the red but the speckles of green and it's showery and damp and cloudy and the weather is improving as we head through the day. the main impact tonight, through

thursday, 1 to 2 inches of rain generally, locally up to 3 inches, wind gusts 25 to 35 miles per hour inland at the shore, 35 to 45 miles per hour. and again coastal flood advisory is in affect for tonight and tomorrow morning. the exclusive accuweather seven-day forecast, rainy and windy and cool tomorrow, the heaviest rain for tomorrow morning, a high of 66 degrees but we clear things out for the weekend, sunshine is back for friday afternoon and 75 degrees and then a flow from the south that brings us a taste of summer, even though it's fall. right in time for the weekend, 81 on saturday and sunday 82 and monday more clouds but warm with a high of 80 degrees, and then the weather goes downhill on wednesday. cool with showers and 72 degrees, wednesday mostly cloudy and a chance of rain and a high of 70 degrees, i'll have an update on tomorrow's storm
