fire. new york city firefighters responded and one of the was shot twice in the leg. this is an active ongoing situation. theresa: this happened in staten island. the gunman is still holed up in the house, very active scene. jim smith is in stocks hd with more on this. >> reporter: you are looking at the activity, police department, members of the u.s. marshals service on the scene in the area of our road, destiny court, this began earlier this morning when a person that was the marshals were attempting to apprehend barricaded themselves, set fire to the home, fired at the fire department, one firefighter was shot. the condition of that firefighter not known at this time and also not known whether the person is under arrest if they are still barricaded or on the loose at this point. we are still seeing a massive

of new york city three brooklyn men were on a search for buried treasure, there scavenger hunt unwittingly kick off a massive police manhunt wednesday night. >> they were down there four hours. cat and mouse. >> reporter: cops and firefighters come through sewer tunnels after a witness called 911 when he spotted a man going through a manhole cover at 7:30 p.m.. turned out one of the accused treasure seekers, keith evans is a trainee with the department of environmental protection. his fellow hunters, 45-year-old stephen hannibal told police they were looking good jewelery and other valuables. police commissioner said clearly terrorism is a concern in new york city, not like they can weld shut 50,000 seamen holes. >> what happened here last night, see something and say something. >> reporter: police smelled something, they were charged up

now connecticut joins the list of states that no longer have the stomach to kill the most notorious criminals. the crime was shocking and heinous. home invasion in cheshire, conn. in 2007. jennifer petit was raped, strangled and murders, her daughters, hayley and michaela died of smoke inhalation after the home was set ablaze. michaela was sexually assaulted. joshua komisarjevsky and steven haze were sentenced to death for the murders but their lives and the lives of ten and other men on death row will be stared. the state supreme court ruled 4-3 that the death penalty is unconstitutional. justice richard palmer said the state's death penalty no longer comports with contemporary standards of decency and no longer serves any legitimate been a logical purpose. of a ruling is evidence of growing national opposition to the death penalty.

although it only applies to connecticut it could be cited in other states grappling with capital punishment. for those whose lives have been torn apart the ruling rumsfeld influence that have never fully hills. dr. william petit whose wife and daughters were murdered in at home invasion criticized the ruling written statement saying the death penalty and its application is a highly charged topic with profound emotional impact articulately on the victims and their loved ones. conn one has to execute a prisoner in 2005 and before that the previous execution was in 1960. because of this ruling the most severe punishment a criminal in that state can get his life in prison without parole and the court ruling cannot be appealed. back to you. greg: no states in this area allow the death penalty. a couple people went to the hospital in brooklyn and tried

greg: a fire fighter shot twice in the leg when responding to a firefighter this happened this morning in staten island, a firefighter is expected to be okay. we have a reporter on the scene. theresa: lidia curanaj joins us with the latest. >> reporter: very hectic scene out here. there is a lot of firefighters here, a lot of police officers out here and you can see a lot of blocks have been roped off. let me show you what is happening as we speak, we are told the suspect is still inside the home and has been sporadic leash shooting at emergency officials outside here. this is how it started, 6:00 this morning the u.s. marshals service came out to 15 destiny court to deliver a warrant. that suspect started returning fire. then the police backed off.

all of a sudden a fire started, a fire started at the home and that is an firefighters came in. when the firefighters tried to battle blazes suspect continued to fire and that is when the fire fighter was shot twice in the lower leg and that firefighter is expected to be o.k. but this is not very hectic scene in staten island, 15 destiny court, we have a hostage negotiator outside the home trying to get the suspect out and police told us he has been sporadic leash shooting at them and that is why we are being held back so many blocks back and a lot of the emergency vehicles all over staten island, still a very very active scene out here but we will bring you the latest information as soon as we receive it. greg: stay with us, we will look at the scene. any sense of when they initially

wanted him for? he is still in there. why did they come to arrest him? >> reporter: i am sorry? greg: why were they looking to arrest this guy in the first place? >> reporter: we are not sure. police have not given us much information, lee telling as u.s. marshals service was issuing a warrant that they wanted to arrest this person, bring him into custody and he started returning fire at them and police backed off and all of a sudden he said the home on fire. they are not giving us much information. greg: whatever fire he started looks like it is out right now. firefighters responding to that fire was shot twice in the leg is expected to be okay. i can't remember the last time we had a fire fighter shot in the city. it has happened before i am sure. while the situation. we thank you. we will stay on this.

>> and it's ongoing right now. lydia she ran that is on the scene with more. what's going on? >> this is still a very active, very busy scene, you've got dozens of firefighters and police officers, emergency responders as well as hostage negotiators. we even saw several police officers with machine guns. this is the scene right here down behind me and as you mentioned, greg, that suspect is still holed inside the home at 15 destiny court. this all started around 6:00 this morning. the u.s. marshal service came out here to issue an arrest are warrant, meaning they wanted to arrest the man, take him into custody. a source tells me that hand has a long rap sheet, there was some sort of parole violation, but this guy has a very long rap sheet. so they went in to arrest this guy, and unbeknownst, no one realized, he had a weapon, and he started firing at police officers. and all of a sudden he set fire

if you want to take a look at the scene, 15 destiny court. the u.s. marshalls have come to the home and came to arrest him. i'm being told it was on a parole violation and all of a sudden he started shoot. the police backed off. then a fire started at the home. fdny came out to battle the blaze and while battling the fire the suspect started to fire and he shot one firefighters twice in the leg. that firefighter is expected to be okay. he's in serious but stable condition. as you can see here, a lot of emergency responders here and hostage negotiates and firefighters are here. police officers with machine guns as well. earlier the suspect was firing some shots erratically but that hasn't happened for quite some time. the suspect was talking to police officers over the phone as well.
