we begin with a developing story. a pennsylvania state trooper shot and killed during a training exercise in montgomery county. about 9 o minutes ago the

trooper's family and colleagues paid respects outside temple university hospital. never teed i jacquez joins us with more on what happened this afternoon. >> reporter: jim, there was a deep sadness outside the hospital as loved ones broke down into tears. this after the trooper was shot in the chest during a training exercise. it was an emotional night as pennsylvania state troopers were forced to say goodbye to one of their own. loved ones were there as the body of the trooper was placed into a hearst and escorted by his family in blue. the 26-year-old trooper based at the station died during a training exercise. it happened just before 5:00 this evening at the montgomery county public safety training campus in conshohocken. authorities would not tell us how it happened but they said he died after a bullet pierced his chest.

ked rah, who has been a trooper since the summer of 2012, was rushed to temple university hospital but nothing that doctors could do. family, friends and colleagues gathered to say goodbye before watching him disappear into a sea of red, white and blue lights. >> tonight, we're told that both the state police and the montgomery county district attorney's office will be investigating this case. meantime, he is the 96th member of the state police to be killed in the history of the pennsylvania state police. we're live outside of temple hospital, nbc 10 news. we're tracking rain to our west. will the storms hold up and make their way into our area tonight? sheena parveen is watching the radar for us. >> that's right, jacqueline. we're seeing thunderstorms to our west. some are trying to move in. but they're, in fact, very slow-moving storms. i think a majority of the area

will not be seeing this. over harrisburg, it's trying to approach part of lancaster county and berks county. look at the motion. this is over the last couple of hours. it looks like some of this is breaking up a bit. in parts of the area, we have scattered showers around paradise and near earl. again, slow-moving. through the overnight hours, still a chance for a few isolated showers, but into tomorrow morning, it's mainly going to be the clouds and fog that you wake up to. patchy fog by 8:00 a.m. temperature around 61 degrees. by 10:00 in the morning, the fog will clear out, temperatures in the mid-60 s. but we'll still have some clouds around. by noon, temperatures in the upper 60s. we could see a few more showers tomorrow. more rain in the forecast as we go into your weekend and big changes with our temperatures too. you can stay informed with the first alert storm app. it's free on your phone and tablet. go to nbc10.com to download it.

the ebola outbreak hits close to home. health officials confirmed the first case to be diagnosed in the united states. the patient is being treated at texas health presbyterian hospital in dallas. that person developed symptoms days after returning to texas from liberia. the cdc says there's zero risk of transmission for those on the same flight as the infected patient. no other patients suspected in texas. it's killed over 3,000 people across west africa. the high stakes battle over who will own the now closed revel casino is still under way at this hour. nbc 10 was in new york today for the start of the bank auction for the atlantic city casino. $98 million was the top bid made by a canadian asset management firm named brookfield property partners. in the last hour, ted greenberg

confirmed that brookfield raised its bid. it's going back and forth with florida developer for the right to buy revel. tonight a 2-year-old boy in delaware is in critical condition after he got his hands-on a gun and shot himself. new at 11:00, we talked to the boy's family as police investigate how this happened. the gun went off at a home in the valley run neighborhood of clay mont. we're joined live outside the home in newcastle county. denise? >> reporter: jim, i've been in touch with newcastle county police all night long. they have wrapped up their investigation for tonight. they've determined that this young child found the gun in an unknown location inside his home. 2-year-old a.j., the boy in this video, telling his mother and father he loves them. >> i love you. >> i love you too mommy. >> is in the hospital tonight surrounded by his family who are hopeful he'll make a full recove recovery. >> he's better.

he's in icu now. he's getting better right now. >> the toddler found a loaded gun and accidentally shot himself in the head this morning. his mother was home at the time of the shooting. >> a happy go lucky little kid. very bright. i feel very sorry for him. >> oh, my god, no. >> cell phone video shows panic in the neighborhood as the it 2-year-old is rushed from his home. >> you have to watch your children all the time. it's a little sad. >> investigators took evidence from the home on cliffside court in the valley run development while others went door to door in a neighborhood canvas conducting interviews trying to find out what people saw or heard. how you did the boy get his hands-on an unsecured gun in the first place. according to the campaign, looking at injury stat particulars and guns, guns are widely -- approximately 3.3 million children in the u.s. live in house holds with firearms that are kept loaded and unlocked.

and most unintentional firearm-related deaths in children occur in or around the home. a child enough old enough to turn a doorknob is old enough to pull a trigger. >> reporter: a.j. is recovering at a.i. dupont hospital and is in critical condition after undergoing surgery. they will determine if charges will be filed in the case. reporting live, i'm denise naka nakano, nbc 10 news. new clues in the search for the suspect in the murder of a trooper. state police found two pipe bombs in the woods that were fully functional, but not deployed to explode. they were among several items that were hastily discarded at a campsite used by suspect eric fre frein. there's been one credible sighting of frein in the past 24 hours. now to the secret service scandal tonight. an agency official acknowledges

there's an investigation into an elevator incident involving the president. published reports say president obama was in an elevator in atlanta this month with an armed security contractor who has three criminal convictions. that's a violation of secret service protocol. agents apparently questioned the contractor and discovered his criminal history after he refused to stop taking cell phone video of the president. this comes as the head of the secret service answered questions from angry lawmakers on capitol hill today. director julia pierson testified today conceding there were multiple failures by the secret when a man with a knife climbed the security fence and made it into the white house all the way to the east room. despite the lapse, pierson testified that the president is safe today. lawmakers from both parties called for an independent review of the breakdown. tomorrow, smokers will pay more for cigarettes in philadelphia. the tax alone on a pack of cigarettes will be $2 more than what it costs today.

the money is intended to fill a critical budget gap for the city's school district. will the extra tax really help? we're digging into the numbers tonight and george, there are some indications that smokers are already buying less tobacco in the city. >> reporter: that is what official rs seeing, jacqueline. this tax, admittedly was never meant to be a permanent fix. with it, comes a practical reality. why would you buy your cigarettes at this gas station inside the city limits when you could simply cross the street and buy the same cigarettes for it $2 less just outside city limits? at mom and pop shops like rocks borrow news, cigarettes sales are a critical business. now the price signs may need to change accommodating the additional $2 a pack tax that has city smokers fuming. >> i will have to go outside the state lines to buy cigarettes. that's ridiculous.

>> to raise it $2 a pack is crazy. >> this should rake in $49 million essential preventing a thousand new layoffs, further crippling the districts. many brands will cost $8 or $9 a pack. >> this is necessary for right now. >> the controller acknowledges the need for a stopgap, but his office's new figures show city revenue from existing tobacco taxes was at $628,000 in 2012. it went up in 2013 and now most recently, it's down 11% to $649,000. all that fluctuation before this new wildcard of simply crossing out of city limits to purchase. >> it is generally recognized, this is a band-aid to deal with the current emergency. >> what's more, cpa kevin ryan says the city that's now charging smokers more has never been especially effective at collecting other so-called

syntaxes like it's liquor tax. >> i think there are going to be different types of businesses collecting these taxes. i'd like to think compliance is going to be better. >>. >> reporter: the new $2 tax comes on top of a $1.60 excise tax already in effect. the state's department of revenue is setting up an oversight program promising vendors there will be enforcement visits and prosecution of tax evaders. live tonight, george spencer, nbc 10 news. in less than an hour, if you run a red light at three of abington's township's most dangerous intersections, you'll have to pay up. the warning period ends at midnight. abington's police chief says this is not about the money. >> there's no money incentive. we're doing this strictly because it's going to make our most dangerous intersections safer. from that san point, we're getting excellent feedback.

the man who killed a philadelphia police officer in the '8 os is sparking a new controversy tonight. mumia abu jamal will give the graduation speech at a college in vermont. we talked to the college and philadelphia's fraternal order of police. nbc 10's keith jones reports. >> this is a slap in the face to all officers. >> not mincing words, the president of the fraternal order of police in philadelphia is outraged that goddard college in vermont is allowing students to collect this infamous cop killer to speak at their commencement by calling in from a prison phone. the now 60-year-old is serving a sentence for killing officer daniel faulkner. a crime who still haunts faulkner's widow maureen. >> she went home with this last

night. this is recurring in her life for years. >> i picked up a phone and got ahold of goddard college. the associate director of alumni affairs spoke with maureen defending their students' selection. >> they find the issues he raises to be worthy of careful consideration. >> back at the scene at 13th and locust more than three decades later, a plaque sits feet from where he was murdered. in that same 30 years, abu jamal finished his degree at goddard college. >> my question is why is he receiving special benefits from prison when nobody else gets it? >> he's being held in schuykill county. police officers put their lives on the line every day to protect society and now we have a college allowing an individual convicted of murdering a police officer to share his opinions with impressionable students. that fact is very troubling. end quote. wetzel says inmates have a constitutional right to access it was and can't prevent goddard from taping the call.

>> they look at it as a journalist speaking about an underrepresented population, a prison population that's practically invisible. >> they ought to pick up the transcripts and withdraw from the school and go somewhere else. >> keith jones, nbc 10 news. tomorrow, philadelphia mayor, michael nutter will sign a bill easing the penalties for carrying a small amount of marijuana in the city. under the new law, if you're caught with fewer than 30 grams or just over an ounce, you'll face a $25 fine. if you're caught smoke tg in public, you do get a $100 fine and community service. but you won't be arrested in either case. the new law is scheduled to go into effect october 20th. guilty, that's the verdict in the murder-for-hire plot in atlantic city. a jury in camden county convicted this man. he hired two people to kill his daughter's boyfriend. he faces up to 70 years in prison. the second of three debates set for tomorrow morning between

pennsylvania's gubernatorial candidates. republican governor tom corbett and his challenger tom wolf will be facing off in philadelphia. election day is coming up november 4th. it could be the end of paying big parking fees for concerts and special events in atlantic city. tomorrow, city council will vote on a measure that would slap casinos and parking lots with bigger fines if they suddenly change their parking rates without notifying the city. they would have to pay a thousand dollar fine up from the current $100. it comes in response to hefty price increases last summer when some places charged as much as $50 to park for a free concert. now your first alert weather with meteorologist sheena parveen. well, tonight we have some showers on the radar and we could certainly still see a few as we go overnight tonight. showers for the overnight hours for some of us. then we'll be dealing with patchy fog by early tomorrow morning for your morning commute. our next real rain chance won't

be until we head into the weekend. there is some rain that will be starting off your weekend. behind the rain and it's not going to be all weekend, we're going to have cooler temperatures moving into the forecast. so sunday, for the eepg ls game, it's going to feel like football weather certainly. on the radar, most of the area is dry. we have a line of thunderstorms off to the west. this is approaching lancaster county and berks county. it's a slow-moving area of storms. it could start to break up and die down before it moves into these areas. but through parts of lancaster county, we have a few isolated showers. they're not making much progress. around paradise and bareville. we'll continue to watch this. a majority of the area will not see the thunderstorms overnight. just a chance of some showers. an area of low pressure to the west. you can see the rain spinning around it. we'll keep our eye on these storms into the morning hours. either way, we'll be expecting fog to start off your day. temperatures in the mid-60s.

if philadelphia 63. lehigh valley, the low 60s. same thing in delaware. we'll see areas of patchy fog with kind of cool temperatures north and west. so future weather showing that rain to our west dying down soon. by 8:00 in the morning, the clouds are here with us and then through noon tomorrow, they're still here. we'll continue to see the clouds, then a slight chance of showers as we go at least through part of the day. as far as your bus stop forecast is concerned, the fog will stay with us in the morning north and west. patchy fog temperatures mid-50s for the bus stop. in philadelphia, low 6 os. in the suburbs tomorrow morning about the upper 50s with patchy fog. here is future visibility showing that patchy fog moving in, settling in around the morning commute hours but quickly clearing out closer to 11:00. a chance of a few showers, patchy fog developing late tonight. 6 o for the low in philadelphia. then tomorrow, the early clouds and fog, but the afternoon will be cooler than today. anywhere from 71 to 74 degrees
