>> investigators are searching the trains that may have been in the area. >> we are looking at all the video and audio on several of the trains to ascertain which ones were in the area during that time yesterday. we are asking for the public's assistance that anybody saw anything on the trains. we have interviewed the operator. we are trying to determine what happened. >> mta says no one should have been out with the victims were. and inspectors saw the bodies. >> we want to emphasize the importance of not playing on or near the tracks. never try to run or walk in front of, between, or behind a train and only cross at the designated crosswalk areas. >> peterson died today at shock

trauma and the other yesterday at st. joseph hospital. >> bail is denied for the teenager accused of fighting a -- of shooting a 5-year-old girl in broad daylight. the community will gather tonight to pray for the victim. david collins begins our coverage. >> the suspect remains in jail without bail, his neighbors are holding a prayer vigil for the 5-year-old victim remains in critical condition. during his review, the 17-year- old suspect was treated almost like he was a candidate for the witness protection program. the defense argued for the potential of prejudice in the case. davis is accused of shooting a 5-year-old girl. the defense asked the judge to not stand in court because he did not want the news media to

describe him. the defense agreed not to seek bail. details of his personal life were revealed. the i-team has learned that he has a long criminal history, his first contact happened at the tender age of 10. most recently, police charged him with robbery back in may. he punched and kicked a teenage girl and then took her cell phone. he was in juvenile court the day before the shooting. >> it is not because these young men did not have a center to go to or that there were not enough parks and recreational opportunities for these two 17- year-old maniacs' that were fighting in the middle of the street. >> davis now faces two counts of first-degree murder. davis is accused of trying to kill 17-year-old.

just before the shooting, they engaged in an altercation. >> it was a fist fight where mr. davis was fighting with another 17-year-old teenager. mr. davis seemed to have decided to take it to another level and went and secured a semi- automatic handgun. >> the arrest exposes all kinds of issues regarding how the juvenile justice system handles children. in jayne miller has more on his criminal history. >> the accusation that he shot and wounded a 5-year-old girl is his first charge as an adult but he is a seasoned veteran in the juvenile system. police commissioner the did not

keep his frustration to himself. >> this comes down to criminals, to thugs, to maniacs on our streets with little to no parental supervision or meaningful adult contact in their lives. >> davis has had plenty of contact with adults. his first contact, we have learned, came at the age of 10 when he was arrested in june 2002 for second-degree assault. july 2003, attempted theft. 2005, drug dealing. in the 2006, he was arrested three separate times of similar charges. the charges grew more serious in 2007. in october, he was accused of armed carjacking and handgun violation. four more arrests followed in

2008 and 2009. in may, he was accused of robbery and assault, beating a teenage girl was stealing her cell phone. sources say he was ordered detained but instead of being locked up in a juvenile facility, he was sent home with an anklet to electronically monitor his whereabouts. sources say he cut off his anklet shortly before the shooting of the 5-year-old girl on july 2. one previous case and called the allegation in 2007 that he beat up his 14-year-old girlfriend because he did not like what she was wearing. he allegedly punched her in the stomach during the time she was pregnant. it does not appear that davis was ever ordered to spend much time at all inside a juvenile facility. our calls and messages to officials today were not returned.

>> we are hearing from the family of the woman found dead along sign steve mcnair. sahel kazemi's sister spoke on the family's behalf. >> she was happy. there were going to move in together. >> steve mcnair was reportedly taking her, but found dead saturday afternoon inside of a natural condo. steve mcnair was shot four times. his death has been ruled a homicide. kazemi bought the gun on thursday. her death has not been classified. >> all scenarios are still on the table as we talk to witnesses, as we look for laboratory testing, as we await for the results of the medical examiner's office. >> steve mcnair is survived by his wife and four sons.

a public memorial is set for thursday. coming up later in sports, you will hear from his longtime coach in tennessee. a business has sustained minor damage after it was hit by a car. it happened around 9:00 this morning. police said the car jumped the curb. the vehicle parked nearby was also hit. the driver was not injured. >> the baltimore county council will vote on a bill that actually would give residents a say about this business flyers that are delivered to your home or put on your car. rob roblin has details. >> we have all gotten them, on our cars and in our homes. there soon may be a way to say no. many of them and up on the grass or in the street, and the folks i talk with say they get fliers

it will stay mostly clear overnight. 70 in oakland, 79 at ocean city. temperatures are arranging to the 80's in the metal. mainly clear skies holding on as we head towards 8:00 tomorrow morning. winds will be light, temperature is 57 to 64 by don. you can see this swirl of clouds. the counterclockwise flow extends all the way down into our region. it gets swept into the mid pedantic, keeping that humidity levels down and the temperatures down as well. there is a weak front expected to come off of that canadian storm and push to parts of pennsylvania, new jersey, new york, and new england. then we head into the middle part of the week. that front stalls so scattered

kazemi, steve mcnair paused girlfriend -- steve mcnair's girlfriend. those that knew him are hoping that people will focus on his legacy. he will be remembered during a memorial service on thursday in tennessee. the titans' coach that found out about the murder while in kuwait at the airport met the media today. >> i will miss him. i asked you to honor what he did on the field and in the community and what he was as a tremendous team mate. that is his legacy. i am proud to have been a part of that. >> i am saddened by the loss of a dear friend. i am not in a position to judge
