only temporary. >> president obama is saying today that this fight isn't over. he was speaking at the american latino heritage forum that the white house was hosting at the interior department and really saying that they aren't going to take no for an answer when it come to getting a jobs bill through congress. >> that's exactly right. what you'll see is the bill chopped up into smaller components. things that actually could pass the united states senate and also the u.s. house of representatives. one of the reasons why the legislation didn't clear the senate yesterday is how difficult it is to get 60 votes to clear procedural hurdles in the united states senate. even if all democrats had voted for the legislation, you still would have needed another seven republicans. so you're going to see the white house as well as senate democrats and congressional democrats go back to the well to see what can get 60 votes in the senate and also, a majority support, 218 votes in the house. >> and senator reid pulled back voting no so they could talk

about it again in the future. >> right. that's a procedural move you see time and time again when the majority ends up losing a vote. that the majority leader would decide to vote against it so they can bring it up again. >> we've got a long way to go with this one. we'll talk about it. great to see you. the news nation also following breaking news right now at the manslaughter trial of michael jackson's doctor. let's take a live look at the courtroom where a cardiologist from the california medical board is testifying. just a short time ago, conrad murray's lawyers dropped the claim that jackson gave himself the fatal dose of propofol. it came after dr. steinberg outlined six ways that murray was negligent including leaving jackson alone. >> when you monitor a patient, you never leave their side. especially after giving propofol. it's like leaving a baby that's sleeping on your kitchen counter

top. >> certain areally visual there. stephanie, explain what's going on as we see the trial taking shape this afternoon for the prosecution to come to rest. >> reporter: well, good afternoon to you. this was a bit of a surprising move. i do want to clarify from what we are hearing, the defense is dropping the claim that jackson may have swallowed propofol. so we understand the defense lawyer michael flanagan said a studied commission said the effects from swallowing propofol would be trivial. the judge and the prosecutor seems surprised by this disclosure which by the way was not done in front of jurors. as you said, testimony continuing right now with the cardiologist from the california medical board who reviewed the case and concluded that the deviations in the standard of care allegedly given by dr. murray directly contributed to michael jackson's death. they found six dee yagss in care. the cardiologist testified that had dr. murray taken the proper

steps, michael jackson would still be alive. >> all those deviations giving propofol, giving it in an unmonitored setting without personnel, without appropriate monitoring, without the appropriate equipment, not being prepared. if these deviations would not have happened mr. jackson would have been alive. >> and another deviation not mentioned there was not calling 911 in a timely manner. now, yesterday we heard testimony from conrad murray via the tapes. this was the taped interview that he gave with police. and one of the thing that was talked about was the moment in which dr. murray described in which prince, paris and blanket, jackson's three children, learned of his death. it was some emotional tapes. it was an emotional tape, dr. murray saying on the tape that the children cried. that then paris uttered words of unhappiness and was worried that

she would have to live alone without her dad and be an orphan. so that is the latest here at the trial of dr. conrad murray. and again, testimony continuing as we speak with the cardiologist from the california review board. thomas? >> stephanie stanton in l.a. for us. we move on to breaking news coming to us out of florida. take a look at these images. officials say a small plane landed on florida's turnpike. this north of miami. as we're learning now, the plane landed on the turnpike near hollywood, florida. it didn't appear to have hit any cars at this time of day. at least two people were seen to be on stretchers, as you can see. one side of the turnpike is now shut down. psych traffic slowly moving on the opposite direction there. some police vehicles going by. just look at the way that this plane landed coming right up against the semibarrier in between the different direction, or the opposite direction of traffic. once again, a small plane landing on florida's turnpike

north of miami in the hollywood section of florida. again, two people that we know of right now that we're seeing taken off in stretchers. we're waiting to get word on more people that may have been inside the aircraft but it did not come in contact with any vehicles on the road. we are getting some new strong reaction this afternoon from secretary of state hillary clinton about an alleged iranian plot to assassinate saudi arabia's ambassador to the u.s. today, the u.s. imposed new sanctions on an iranian airline. the state department has issued a terror alert for americans worldwide. the alleged plan involves a bomb at an undetermined washington restaurant and blowing up the saudi embassy in washington. u.s. officials tell nbc news there was also a secondary plot targeting the israeli embassy as well. an iranian born naturalized american is under arrest and was arraigned tuesday in new york. starting last spring, he allegedly tried to hire an assassin from a mexican drug

cartel. but american official say his contact turns out to be a u.s. undercover agent. >> it was a flagrant violation of international and u.s. law and a dangerous escalation of the iranian longstanding you've of political violence and sponsorship of terrorism. >> iran is calling the allegations ridiculous. joining me in our studio, tehran bureau chief, it's good to have you here as we try to dissect through all the information that's now coming out. this afternoon press secretary jay carney giving a briefing at the white house a short time ago. says that this plotting happened at senior levels of iran's elite quds force. what can you tell us about the elite quds force? >> it is the revolutionary guard's international branch. they've taken the most elite members of the guard and put them in the quds forceful these the top of the top in iran and they do all their operations abroad. having said that, it is

uncharacteristic of that to pull off an operation like this on american soil at a time when iran is under such scrutiny over its nuclear program. i just can't see them wanting this headache. on the other side, and in the comments that are coming from the doj and the secretary of state, very vocal. they must have some evidence to back this up. so i think over the course of the next few days as the evidence come out, we'll have a clearer picture. >> we'll see the one suspect making an appearance in court. a second suspect is believed to be in iran. what do we know about the connection that he may have to the iranian government? >> the second suspect may have some connection to the man that was arrested here. apparently they have a cousin linked in the quds force. he would have been a senior operative in iran advising him, telling him to go about his business if indeed he was involved. the other guy is in iran at large. so i don't think we'll ever see him again. >> and wheen while, iran is calling this ridiculous and saying this is america setting us up, making us look bad so

and in the process, probably have killed scores of americans. >> we're still waiting on an abundance of fookts legitimize all of this. still a question of whether the iranian government was involved in this, especially to the higher senior levels. why would they attempt such an assassination, especially as ali is pointing out. they are in such a tentative world view as it is under the nuclear program suspicions. >> that is the question that is being asked right now amongst the former national security intelligence professional community. why did this happen? if it did indeed happen? it is clear there was a serious tlelt. the administration has a plan. it has been effective in counter terrorism, at home and abroad and it is really looking at ways to prevent terrorist acts and it found something. why would the iranians do something now? and the intelligence community of professionals are looking at this saying, wow, this is a really amateurish action. this does not appear like the

quds force and it doesn't add up. >> this is all based on the fact there is this alleged iranian plot to assassinate saudi arabia's ambassador to the u.s. we're hearing how the u.s. is going to be responding. sanctioned, probably more to come. how might saudi arabia respond? >> certainly, this strengthens the american hand in promoting more aggressive measures against iran in the international arena. this means that the u.s. when engaging other countries on diplomacy, putting more political pressure for iran to stop the nuclear program, this will strengthen its hand. saudi arabia is very circumspect yesterday. did not respond immediately. there are major tensions between saudi arabia and iran. a regional competition over many years. so this may very well unleash different dynamics. right now, it is too early to tell. certainly we need to allow for some cooler heads to prevail and not see any rash actions take place. >> great to have you on today. thank for your time.

mitt romney is emerging as the leader of the pack. grill at the table by his rivals, he defended his 59 point economic plan. the massachusetts health plan that went into effect while romney was governor, even the wall street bailout. take a listen. >> action had to be taken. was it perfect? no. was it well implemented? no, not particularly. were there some institutions that should not have been bailed out? absolutely. romney care has driven the cost of small business insurance premiums up by 14% over the national average in massachusetts. >> i'm proud of what we were able to accomplish. i'll tell you this. we have the lowest number of kids as a percentage uninsured of any state in america. you have a million kids uninsured in texas. a million kids. under president bush, it went down. under your leadership, it's gone up. joining me now, talk show host and msnbc contributor,

michael smerconish. what is your take away? >> i think he looks strong. there have been no gaffes, no stumbles of any significance by mitt romney in any of the debates we've had thus far. a long process, slow and steady wins this race. i've often said that he doesn't need to win the debates. he just needs to survive this whole primary process and so far he is doing that. >> he is doing that. something else getting a lot of buzz is herman cain getting attacked for his 999 plan to fix the economy. he defended it on the daily run-down. take a look at this and we'll talk on the other side. >> the fact that i got attacked so much, my plan got attacked so much, that's a good thing. it gives me an opportunity to correct my misperceptions. >> for most people, they'll have a net-net tax decrease because we've expanded the base. >> so he thinks it's a good thing. it is an interesting thing to watch.

that 19 other candidates really care about the surge he's taken in the polls and they find him to be a contender. do you think he won points last night for how he was presenting his comebacks to the attacks on the 9-9-9 plan? >> i think he did last night but it will be interesting to see whether he can now sustain the scrutiny that i suspect will follow herman cain. just as michele bachmann was a flash in the pan and then the joot any bar was raised. and frankly, she didn't match it. and then rick perry, same kind of thing. he look enticing to a number of folks. they took a closer look and his number are in free fall. when people really start to parse the 9-9-9 proposal. when for example those 47 or so percent who haven't been paying taxes now recognize they'll be on the hook for 9%. i think there will be a lot of legitimate questions raised and i don't know if he'll sustain the scrutiny. >> it was interesting when rick santorum asked the crowd there, who liked the idea of the 9%? not one hand went up.

see? that's how many votes you'll get in new hampshire. i want to move to rick perry. he seemed to have a lot of pressure on him. a lot of people having expectations to see how he would do. take a look at how he performed. >> i'm going to lay it out all for you tonight. mitt has had six years to be working a plan. i've been in this about eight weeks. >> so after the debate, he said debates aren't my strong suit. this debate really zeroed in on the economy. how could perry not have gotten details of any economic plan out there given the fact that he knew that would be something of last night's debate. >> last night, i'm in my barcalounger like everybody else, tweeting, my thought about him is that he look overcoached. whether you like or dislike this guy, he is full of something and vinegar. i won't fill in the blank. he's now lost that edge. he seemed so docile and so coached and following talking points. i thought he blew a huge opportunity. the big story yesterday,

jointly adopt in louisiana. they instead offered. the louisiana registrar said this is an issue of you and your partner not being married at the time of the adoption. but you were not denied legal recognition of the adoption in new york. so why do you feel that you and your partner are being treated unfairly in this instance? >> well, if you ask the state of louisiana, they're basically saying because we're an unmarried couple. that seem to be the catch 22. we can't get married. even if we did get married, louisiana would not recognize that marriage. really, the issue that we feel is that this is more of a constitutional issue. this was an adoption that happened in the state of new york. the decree was sent to the state of louisiana. and because of full faith and credit, they really should have

granted us the amended birth certificate like in any adoption. >> have you thought about coming back to new york and getting married here and then going back to louisiana to say, because it is legal to get married in new york, to go back to louisiana? would they recognize it then? >> they still wouldn't recognize it. just as a matter of point, my partner and i did actually have a civil union in connecticut because that's where we were living at the time. just over the border. and that civil union has become just as a matter of law, is now considered a marriage. so technically we are married. but louisiana does not recognize it. >> louisiana attorney general said that he was pleased with this decision by the supreme court saying it does not compel, or he does not compel louisiana to change its public records to conform to other state's laws. when you hear something like that, what is your response? >> it's extremely disheartening and it makes us very, very

angry. really at the crux of the matter is our child's rights. this is not a gay rights issue. this is a children's rights issue. this make our son really a second class citizen. he doesn't have a birth certificate. and we don't understand that. that's the part that's confusing to us and it is very upsetting. >> where do you go from here and how do you make sure he is properly medically covered by mshance? >> we've had to do some thing. we've had to supply documentation. we've had to supply really the adoption decree from the judge which is a sealed document. so technically we're breaking the law each time we use that document to establish our parent -- our child-parent relationship. we're being asked to break the law and that's what we've had to do. we do that for our own protection. so at this point from my understanding, really it's legislative action. and it is going to take some time and it will be difficult. but we're not giving up. we're doing what's right for our child. and honestly for many children

>> nbc's like russert joins us live from capitol hill. democrats plan to brakt up trying to get it through piece by piece. >> that's correct. look, most democrats would admit to you privately that this bill in its entirety had no chance of getting through congress. specifically because it would have great difficulty in the senate but also named dead on arrival by republicans in the house. what they're really imploring is a piecemeal strategy. try to get bits of pieces of bill that they had they will come across the aisle and support. what type of proposal would be in? there's the extension of the pay roll tax. i spoke a to have a republican aide who said that is something the house could bring up. perhaps this fund you've heard often about it, trying to help veterans coming back from iraq and afghanistan to get a job. thing like that that they could work on. president obama with a huge push for infrastructure. he would like to see some direct money there. his idea of an infrastructure

bank is dead on arrival in the house of representatives. there is some speculation that a big highway surface transportation bill that's being worked on by republicans and democrats could possibly see the light of day out of the house. there are a few areas there. this idea of a wide reaching, widespread deeply funded $447 billion bill is very much viewed as a stimulus to republicans. that's something they won't move on at all, thomas. so it really will be bit by bit by bit, piece by piece by piece. nothing that grand. >> meanwhile, there is something else that's supposed to boost the house and the senate having a vote on free trade agreements with south korea and panama. >> we talked about the one thing the republicans say is that it is in their view, a job creator. it will eliminate terrorists. these bills are expected to pass both the house and the senate today and be signed by president obama. the white house has said all along that they would like to

present the president of south korea with that deal signed, sealed and delivered. that graem is ready to go. that should pass. you've heard some democrats come out today against the unionization practices that go on in colombia but really, widespread support overall. a lot of folks have said, these were things that were negotiated under the bush administration. democrats thought they were made better under the obama administration. and there's no -- there is a very secure pathway. no road blocks for these thing to be slowed up. >> great to see you this afternoon. thanks. >> you too. be well. there is growing anxiety that a major deal to free an israeli soldier held hostage for five years by hamas could lead to new violence. now israeli soldier giad will be set free for the release of 1,000 palestinian prisoners. joy has been dampened by news that about 300 of those palestinian prisoners have been

convicted of killing israelis. nbc's market fletcher joins me now live. he is also the author of the new book, "the list." great to see you. the book is out. you're a busy man, always writing a book or doing something of importance that we must talk about. this is very important to talk about this soldier. israel's cabinet minister said the release of the terrorist will be immense incentive to kill israelis. are those fears just identified? especially now that they've been trying get to this process over with over the last five years? >> i think so short term. the israel writes afraid that they had to do this deal they felt to get their man. the people they released include 350 people who were serving life sentences for killing up to 600 israelis. in the past, there have been these kinds of lop-sided prison exchang exchanges. in 1985 they released 1,500

palestinians to get three soldiers back. there is a history of this. what happened in the past? the israelis say, many of those released went straight back to terrorism or fighting israel through terrorist methods. so there is a real history of this. >> meanwhile, it as you point out, this continuing cycle. there are more militants threatening to capture israeli soldiers as long as palestinians are still held captive. what is the way to get to the core of the issue here? to stop the bloodshed basically? how can that be resolved? >> that's a great question. it can't be resolve in the short term. the peace negotiations have been going on for 18 years and that's why when the palestinian president mahmoud abbas went to the united nations. he's in the process of trying to get the state of palestine through peaceful means, nonviolent means. that is in a way a hopeful sign but hamas rejects that. they have sworn to the disruption of israel and insist

that they will continue the fight against israel. and right now they're releasing the prisoner for 1,000 palestinians. the hamas leaders have already said their first goal now is to kidnap another israeli soldier. >> it goes on. while wif here, i want to ask you about "the list." will you tell us about the book? >> oh, sure. it is a book about how jewish holocaust survivors adapted to their new lives after the second world war. it is based very much on my own family story. most of my family died in the holocaust apart from my parents. and i wanted to write about that. what was it like to find out what happened to your family in the holocaust? how was it to rebuild a life? unfortunately i couldn't ask my parents. by the time i had the idea for the book they were dead. i had to do a lot of research. an emotional story which also became a bit of a political thriller. but i won't give that away. >> thank you for sharing it as much as you did. the book is called "the list."
