i'm ali vitali in forthan lemaire. jury selection wrapped up more quickly than we thought it would on friday. it's made up of seven men and five women along with six alternates. according to "the new york times," the prosecution plans to frame trump's actions quiet about an alleged affair. that's going to be election interference. the defense, meanwhile, will seize on three apparent weak points, witness credibility, the president's culpability, and the case's legal complexity. one of the potential first witnesses expected to testify is david pecker who bought and buried damaging stories about trump. he's alleged to have worked with trump and his former attorney michael cohen to bury the stormy daniels story. other witnesses expected to testify include a who's who in

donald trump's world. karen mcdougal also alleged a sexual relationship with trump. as trump left the courthouse on friday, he continued to insist he plans to testify in his own defense. back here in washington after months of delay, house lawmakers have approved a $95 billion foreign aid package. in four back-to-back votes on saturday, lawmakers from both sides of the aisle overwhelmingly voted to approve the new funding package. a fourth bill would force tiktok's parent company based in china to sell the platform. president biden put out a statement saying members of both parties in the house voted to advance our national security interests and send a clear message about the powerful leadership on the world stage. it's expected to pass

the white house is reportedly expected to announce a new sanctions package. three u.s. sources with knowledge of the issue tell axios a battalion is accused of human rights violations in the west bank. the special unit is made up of ultra-orthodox soldiers all of whom are men. the state department reportedly started investigating them in 2022. according to republic ka, they gagged, handcuffed, and left an elderly palestinian man for dead and they raped a teenager. axios reports the sanctions will end once the idf remedies the behavior. israeli prime minister benjamin netanyahu, however, is protesting the move saying, quote, at a time when our soldiers are fighting the monsters of terror, the

intentions to post an insanction on the idf is the height of absurdity and a moral low. columbia university is holding classes virtually following the demonstrations over the war in gaza on campus. the university's president made the announcement earlier this morning, but it comes a day after a well-known raby at the school urged students to leave campus as soon as possible. in an online post, he called the recent demonstrations terrible and tragic saying the university police and staff cannot guarantee the safety of students. a group representing jewish campus life, however, say they do not believe students should leave columbia and are calling on the university and city to do more to ensure students' safety. last week more than 100 people were arrested on campus. the pro-palestinian protest continued throughout the weekend. some jewish students say they've been threatened with heat speech and calls for violence.

welcome back to "way too early." it's just before 5:30 on the east coast, 2:30 out west. new developments in donald trump's civilian fraud case with the hearing to take place this morning. the hearing comes after new york attorney general letitia james on friday asked the judge to void trump's bond. she wonders if the company has the funds to back it up. in february the judge ruled trump and his colleagues engaged a decades-long scheme to inflate his net worth to get better deals and interest rates on loans. he was at risk at having his

property seized after he failed to obtain the bond for the $464 million judgment but a new york appellate judge reduced it. neither trump's lawyers or trump commented. dave, thanks for joining us from florida. what's the chance here that the judge will actually void trump's bond in the several fraud casing and what does that actually mean in the larger scheme of things fordonald trump? >> if the judge voids it, trump will have to go back to the drawing board and find someone to put up the bond. he had trouble getting anyone to help. it's hard to say. i think the courts in new york state seem to be bending over backward to allow trump to appeal and not pay the full judgment which is like four times the amount of the bond. he got a guy who is not admitted

trial. opening statements are expected to begin in a few hours. what are we expecting to hear from the prosecutor and defense? this is happening faster than i think we thought it would. >> yes. donald trump is on trial, but the defense is going to try to change that. the defense is going to try to put michael cohen on trial. they're going to try to raise reasonable doubt that this guy is a convicted liar. they're going to try to concept over the part he hide to protect donald trump. they're going to try to say you cannot believe anything this guy says. he's a key witness, and if you don't believe him, the whole case goes away. the prosecution is going to show they've got corroboration. the first witness is going to be david pecker, the guy who can corroborate michael cohen and used to be on trump's side. he's going to set the stage for what this is about.

this is not a one-off payment to stormy daniels, but a scheme to prevent things being said. karen mcdougal is expected to testify. a doorman apparently had information that turned out to be false about trump's love child. i think it's damaging for the former president who's going to use the sergeant schultz defense, i know nothing. >> you look at how the prosecutors are going to paint a picture after the "access hollywood" case comes out. i was covering him at that point. people were freaking out. they thought it was over for trump. they didn't want it to get any worse. i have one legal moment. looking ahead later this week to thursday, there's a case with big implications in the supreme court. they'll take up trump's immunity

claims. litz cheney is out with a new op-ed this morning, do this quickly. why does speed matter here? >> it matters because the case that poses the greatest existential threat to donald trump's freedom is the d.c. election interference case in front of judge chutkan who wants this case to go, but she can't let it go until the supreme court finishes with this appeal. the longer they drag their feet, the less likely the case will be heard before the election. if he's elected, they're going to shut it all down. trump could win by losing. i document think he's going to win when it comes to absolutely presidential immunity, but if the supreme court throws it back and says you need to do a new hearing and examine all these factors, that's going to slow things down so much it's going to make it impossible for this case to be heard. that's why it hooks hike the

time now for cnbcs by. let's bring in silvia amaro. what can we expect from wall street today? >> good morning. so it will be a positive start to the trading day and week on wall street. this is after we saw a very rough end to the trading week last week. just to give you an idea, there was a special focus on tech. we saw the sector ending the week, down by more than 7%. some analysts have explained that, suggesting what we saw was a repositioning among investors as we await to hear from some of the big tech companies that are due to report this week. just to give you an idea, we're going to hear from meta, microsoft, and alphabet. it's also likely to be a very busy week for investors on the data front. we're going to get new gdp figures in the united states as well as cpe numbers.

that's very important for the fed and investors will be waiting to hear what we might hear from the central bank in terms of potential rate cuts. no doubt this is going to be the start of a very business week, guys. meanwhile tesla has slashed prices of its cars globally. what prompted this? >> so tesla is under a lot of pressure. in fact, if you look at their shares in premarket trade, they are moving lower. what we heard from the company is that they are cutting prices by about $2,000 across all its models in china, and that comes after they announced price cuts in the united states as well as germany. there are several reasons behind this. one of them is following that. we'll see what we hear from the company. tesla is also due to report this week. and, finally, something that

a lot of viewers' ears are going to perk up to, but a potential ban against tiktok took a major step forward this weekend. what's the latest there, and can you assure people? we're not talking about an outright ban on tiktok. it's more a change in ownership, right? >> exactly. legislation suggested what congressmen would like to see is that bytedance, the chinese company that owns tiktok, they want them to sell their stake in the company. however, this is not something that's likely to take place any time soon. that's according to several analysts. however, if you look at the details in the legislation, they are indeed asking for that stake to be sold within a year, this, hour, comes after we saw a separate bill also in the house also pushing for the same thing, however, with a more, with a stricter timeline. the key here from a geopolitical

the party looks like. she and a lot of people have realized this is not a short-term moment. even if donald trump is not elected president, there is no future from anybody, kristi noem, who thinks she has a future in the republican party, probably wants to run for something herself, you have to be aligned with donald trump. no one is waiting for him to go away. she's also trying to be his vice president. >> that could be an easy springboard. >> of course. there's one train leaving right now, and it is with donald trump. doesn't matter what he does. it's because the voters are still there. we've seen poll after poll show voters understand the things that are being thrown at donald trump right now, and they're still sticking by him sh at least in the republican party. we shouldn't expect anything different anytime soon. >> if this is what is required to be on the vp short list, think of how that translates into a white house like trump's. >> obviously, we saw with mike pence, as well, there's very little room for that. in some sense, it's normal. if you're on the ticket with the president, you back them up in everything they do. i think what is interesting, so many people are willing to put

themselves in that position right now. so many are willing to say, i know what donald trump is like. i know what it'll be like to stand next to him and say, yes, sir, and repeat all the things he says, and they're willing to line up because they know if they want a future, that's the price you pay. >> this is not like backing a tariff's policy, though. this is backing someone who would have been convicted in at least one of the trials. that's the simulation that they're being asked to respond to. i want to switch gears. you have a new opinion piece out in "the new york times" titled, "mike johnson steps into his power even as he might lose it." do you think he is getting vacated? i hear the name john boehner a lot, and i don't think johnson is going to do what beohner did and resign. >> i think marjorie taylor greene would have brought the vote last week. democrats have said they'll probably stand by johnson because the context they're doing this is he brought up something they wanted. it'd seem, i don't know, unfair to take him out for that. i think the question for the long term is, is that goodwill

he has with democrats going to last? kevin mccarthy lost his job because democrats didn't think he was an honest broker. right now, they like johnson. things could change quickly. say they impeach joe biden. are they going to stick around for him? say they have to bring up funding bills for the rest of the year and, once again, they abandon the bipartisan agreement. if they find mike johnson is no longer a good faith actor, or they're not getting something out of the deal -- i mean, a coalition only works if both sides are getting something out of the deal. democrats could lose their motivation for supporting him, and maybe that's marjorie taylor greene's plan, to let it stretch out and democrats lose patience, as well. >> i don't know how many rounds you can go. the motions to vacate, one person can trigger it an infinite number of times. say they save him this time and another vote happens immediately. i don't know how many rounds democrats have in them. >> exactly. that might be the marjorie taylor greene plan.
