to bring up legislation that would appeal the 1864 law. they're calling the bluff for republicans he said, this is terrible. republicans removed the bill from the agenda. in the house, republicans called for recess before votes could be cast on a similar bill. democrats quickly reproach their colleagues on the floor. >> shame. blood on your hands. let on your hands. shame. shame. >> arizona is now set to be grounds zero on what will be the first true nationwide abortion election in this nation's history. it's a product of 50 years of antiabortion act of his him.

for half a century, republicans have argued out of both sides of their mouths over reproductive rights. in one side, they call abortion murder. you are baby killers. they claim the fertilized eggs are full human persons. at the same time, they claim that their real objection to a right to an abortion as enshrined in roe v wade was that it prevented americans from voting on the issue. they said it should be left to the states and the democratic process. well, thanks to the successful efforts of the republican antiabortion movement and donald trump and his majority on the supreme court, abortions have been kicked back to this date. the right to safe and legal reproductive care is now up in the air in every state in the nation. abortion rights have been explicitly on the ballot and stay white referendum or initiative in six days, and every single one, the pro- abortion rights side won.

even conservative states, states donald trump won like kentucky and ohio, where republicans pulled out every stop to stop it getting on the ballot. arizona will have this in the fall. it's expected to be next along with several others, including lord up. and this year, for the first time since the supreme court overturned roe, we are facing a presidential election on one side. we have a man who nearly single- handedly destroyed roe v wade, as he will be the first to tell you. >> i was probably the person responsible for the ending of something that all legal scholars, both sides, wanted and, in fact, demanded to be ended. roe v wade. for 54 years, they were trying to get roe v wade terminated, and i did it and i'm proud to have done it. >> i did something nobody thought was possible, and roe v wade was terminated and put back to this date.

>> not all legal scholars wanted roe v wade overturned. that nonsense. on the other side of the selection, joe biden promises explicitly to restore roe v wade as the law of the land through legislation. if he's able to work with the democratic house and senate. the thing about all of this, and is really wild to watch this -- i don't members quite seen something like this. republicans, at least the ones with a modicum of sense, understanding are in desperate trouble on this issue. just clear as day that voters are not in line with their position on abortion. they are just running around saying anything they can to anyone, just trying to run away from themselves. from their own position. donald trump is the prime example. in a recent statement desperately trying to create

some distance between the catastrophe of his own making, he said he supported leaving abortion rights up to the states. that includes states like mississippi where a 14-year-old who is a victim of rape has to have the child, trump has flip- flopped all over the issue. >> i am very pro-choice. i am strongly for choice, and you and i hate the concept of abortion. >> but you would not ban it? >> no. i build buildings. don't ask me questions on if i'm pro-choice or pro-life. i've evolved on a lot of different things. >> as you know, i'm pro-life. >> i have been pro-life. >> the answer is, there have to be some form of punishment. >> pick any position. he said it at some point. none of that matters. it doesn't matter what he says.

belief, and they will not stop until they are definitively politically defeated over and over and over, until it is drowned out of them. they have the tools to accomplish this. robbing women of bodily autonomy in state judiciaries, federal judiciary, and governor's mansions. if they win the presidency this november, they will control a federal government that they can, for instance, or to the fda to overwrite approval of mifepristone. they can revive another 19th century lost on the books, which is basically just falling into disrepute and not used, called the comstock act. quote, every article or seeing designed or intended for producing abortion -- the federal mail would shut down all the shipping related to abortion. how do you think that would work? what do you think that would do? you might be saying, it sounds

a little far-fetched to thaw out a dormant law for the 1800s, but that's exactly what they literally just did in the arizona supreme court yesterday. so we are now seeing the spectacle of arizona republicans running for office, twisting themselves into not. take for instance, this candidate. she lost the race in 2022, though she never conceded. she is now running for senate against ruben gallego. yesterday, in the wake of that disastrous decision, she put out this date meant, desperately trying to run away from what she knows is the wrong side of the issue. i'm calling on katie hobbs -- that's a funny one. i guess she is the governor now. i call on katie hobbs and the state legislature to come up with an immediate common sense solution that arizonans can support. of course, her party blocked

that today. and that statement -- which was fine as these date meant go -- would be slightly more credible if she hadn't explicitly endorsed the very same 1864 law onstage into a microphone on camera just two years ago. >> obviously, i think roe v wade should be overturned, and i have a good feeling they are going to do the right thing this time. we have a great law on the books right now. if that happens, we will be a state where we will not be taking the lives of our unborn anymore. >> we have a great law on the books right now. so this is what the abortion election looks like. as election day approaches, republicans will continue to lie about their own positions because they understand how toxic they are. make no mistake. i have already shown us and continue to show us every day what they do when they have

power. congressman ruben gallego is a democrat in arizona running against lake for senate in 2024, and he joins me now. congressman, before we get to what your partner has said about this, i want to just get your reaction to the supreme ruling from yesterday. >> well, i am horrified. arizona voters are horrified. i have a nine-month-old daughter. she has less rights than my mother in this world. in this modern world, in 2024 arizona. we are going back to laws that were essentially signed into law by, you know, judges that were appointed by abraham lincoln. that's what we are dealing with right now. doctors will be going to jail, nurses will be going to jail, and politicians like kerry lake wants that to happen. and actually said it is a good

law. a great law. >> you served in the arizona state house, and this moment was really remarkable to me. there's this tension between the genuinely held beliefs from republicans that state legislatures, city councilmembers, members of the u.s. tenant. conservatives everywhere really believe -- i really do believe that. and the politics of it. and it was just so striking to me, what the arizona republican majority did. they could've done the political thing. what was your interpretation of the arizona republican state legislatures actions today to block an immediate overwriting of this decision? >> well, because they truly do believe that women do not have a right to an abortion. they believe the doctor should go to jail for providing safe and legal abortions, and nurses and other providers. they are voting against the overturning of the bill and

they are telling us what they want to do. believe them. this is the opportunity for everyone in arizona to understand we have a real threat. they have an initiative they need to vote for in november. we need to vote out these republicans that are antiabortion right. if you want to help out this campaign, we want to make sure we posed her lies, someone who cited by statute this bill, and now she wants to claim she doesn't report it. kari lake is lying. she wants to outright ban abortions in arizona. >> the most recent polling we have, i imagine this will be updated. should abortion be legal always? 62% favor that in your state. nationally, abortion should be legal in all or most cases at 70%. how do you -- i mean, there is a full on attempt -- a kind of

panicky attempt. but there's an attempt to muddy the waters and run away from the position. do you worry that can be successful? people are not necessarily completely locked in two who is on which side of this issue, or who is a responsible. how do you deal with that is you talk to folks who are trying to win the vote from? >> arizonans are not dumb. they know kari lake is lying and she will say anything she can to hold onto power . her positions have changed so much, and we have her on record, on camera with her audio voice, and she is directly citing the actual territorial law. for someone who is not known for being deep on policy, she somehow knew this particular band that is going to be designed specifically to arrest doctors and nurses. they're not going to believe it. were certainly not going to let people forget it. and arizonans have seen this

days for tax fraud last year. he's just one year younger than trump, and he is now in a cell in rikers island, part of a long list of people who faced real punishment for the things they did for donald trump. the criminal justice system with a hush money trial set to start in just five days. the u.s. attorney's office in the session district joins me now. i found it very striking to watch this man go to rikers, and i want to take the opportunity to say that rikers has been a human rights disaster for a long time, and most of the people that i go through there are not white. they are black and brown, and they are poor. they do not have the kind of lawyers that donald trump does. they have multiple deaths there, and it is a brutal, brutal place, and it has been for a long time. there is something really sobering the real about this man being sent there.

>> absolutely. but he's made this choice, and he's made this choice again and again to be loyal to donald trump even when it doesn't benefit him. >> it's crazy to do this after you've already done a stint. >> after in connection with the first trial where he was convicted of tax fraud, donald trump -- all his lawyers, their whole argument was that we are here because of his greed. it wasn't just -- they demonized him. usually when someone is demonized in court that way, they don't then continue to lie on the stand for donald trump. i guess there is greed to this. he had the agreement for $2 million in severance so that if you wouldn't can't cooperate with law enforcement, there's a element to it. you think at some point somebody would say, how long am i going to take the fall for this guy? >> we have seen this flurry of desperate activity from donald trump to forestall this trial.

in a way that indicates to me that he does not want this trial to happen. >> clearly. >> today, we got another -- the third legal challenge to delay the hush money trial that a new york appeals judge rejected yet again. what does that indicate to you? >> calling this is a basketball analogy, because i've been watching a lot of basketball lately, these guys -- trumps lawyers, they are just taking half-court shots, and they are all air balls. none of these guys are steph curry just checking it up there and seeing what happens. were not even talking about buzzer beaters. the game hasn't actually started yet. the game would start on monday. all of these motions, if you go through each one, for retrial publicity, when he's the one contributing to it. the gag order is only necessary because of donald trump's team. they're all just terrible motions. >> i asked katherine christian

who was on the program the other day, is this normal? is this over about people that have money and resources? my question to you is, why don't people normally do this? let's you are rich, and you got good lawyers. and you are facing some criminal trial. my understanding is, it not standard operating procedure to be chucking from half court, desperately trying all this stuff. why do people not do that usually? >> usually, all of his attacks and motions, he is suing the judge who has even had the trial, who hasn't yet issued a sentence. usually, you want to reserve any criticism of a judge until after you have been convicted and sentenced, and then you have an appeals process and want to say, the judge made a bunch of errors here. but the judge might actually have some leniency toward you. you want to be in the judge's

good graces before that happens. >> not infuriating the person who is judging you. i figured that was the case. i'm watching this, it really does seem -- i can't tell if this has always worked for him to just be on people and to try everything. b, he is a sociopath, so he doesn't regulate well, he is talking to lawyers and they are just doing what he says. or seeing that because of the conditions of his campaign that there is sort of this antagonism that is useful to him politically. and it doesn't seem a sound legal strategy. >> no. the normal criminal defendant is also not in the position to become president. at that point, he might think that even though this is a's date trial, he's going to be able to waive some magic wand and make some sentence go away. >> a normal criminal defendant -- the normal criminal defendant is in rikers, sitting in rikers desperate for things

this has been by far the most feckless and incompetent house majority in our lifetimes. whatever you think it's hit rock bottom, it somehow gets worse. so right now, back after two weeks away, the house is back. marjorie taylor green is still dangling her threat to take out republican speaker mike jones. johnson has absolutely no control of the caucus. he just lost another routine floor boat. it is his fourth since becoming speaker. he's also down to a two point majority. meanwhile, his predecessor, kevin mccarthy, who packed up and resigned rather than dig around, is back in town with some real talk about his former colleagues. >> i'll give you the truth about why i'm not speaker. one person submitted an ethics complaint because he slept with

ever received, being called mccarthy's predecessor is the least favorable. so thanks, but no thanks. it's chronology. but the fact is is that i'm here . it's a very important busy time for all of us to talk about democracy, not about their dysfunction. their dysfunction is an impediment to democracy. in ukraine, we really are at a very critical place. we have been for a while. they keep saying they're going to do it, we will do it next week, and all the rest. but this is very serious. the people of ukraine have been so ukraine just. they fought for their democracy, and doing so for democracy at large. the world is understood that russia should not be violating the sovereignty of the borders of ukraine. and the congress of the united states is hung up by a putin caucus as their own leadership has said that shares of some other committees had said that

on wednesday that they reached a decisive moment. ukraine will run out of artillery shares an air defense munition without additional support, he said. what has to happen? is it as simple as mike johnston just bringing it to the floor for a vote? is that all that has to happen? >> that's all that has to happen, but it's about donald trump allowing mike johnston to bring it to the floor. and all of this activity is springing from donald trump. so he's a puppeteer, and he doesn't mind shining a light on these strings, so he makes these people look bad. why is it that he is so pro- putin? i keep saying, all roads lead to putin when it comes to trump. this is deadly serious. people have lost their lives in the weeks and months that we have just delayed all of this. and in terms of our reputation

and the world, it is greatly diminished by what is happening in the house of representatives. >> i agree with you that trump is ultimately the one blocking it. but just in terms of how this might play out or get to a vote that actually does authorize it, it seems to me that trump won't change. ultimately, the speaker of the house, who is the person who is elected to run the house, he's the one who has to bring it to the boat. i don't see another option, unless i'm missing it. >> you described it. the point is is that you can bring a bill under rule, which means you need a majority to pass the rule and pass the boat. they obviously can't pass a rule, so you just bring it under cyst tension, two thirds, and we would win a two thirds vote. but at the same time, his people are saying, if you do that, we will vacate the chair and you won't be speaker. you know what? what are we therefor? we are there to do a job, not

to keep a job. the job right now is to fight for democracy in the world and play our role in all of this, as well as, again, having wrist for the in touche in which we serve, which of course, is lacking on their side. they don't care about the people's house in the constitution. they are there to people elected every two years. a constant reinvigoration. some longer, some newer, a const good mix of people coming into our country. what do they do but diminish it by one vote to vacate the chair. that goes back to the previous speaker who sold the speakership down the river by yielding to that to become speaker. again, don't spend time on that, and let the courts take care of trump's. let's talk about what's happening in the world. in gaza, we need humanitarian assist vince. that's part of the legislation

for ukraine. umana terry and assistance for the palestinians. it respects israel's right to defend itself, and we want to have some humanity onto that as we do that debate. but we just have to pass legislation to do it. we are legislators. they seem to have missed the purpose of our jobs. >> they can't pass anything. i want to ask you about a letter asking to withhold offensive weapons from israel. we strongly urge you to withhold any offensive weapon transfers until an investigation into that and is concluded. those responsible are held accountable. you are one of the signatories, along with 55 other lawmakers. why did you sign? >> i think that is a very contained requirement. until you have an investigation of how this happened with cars that are marked very clearly,

marked very clearly to be humanitarian assistance. so israel says that they are going to have an investigation. they began such a thing, but i think we have to have it also in an independent commission. the letter is simple. until you have an investigation, we should withhold. they are having an investigation. i think it was a very contained letter. other people have different standards for what we should be doing in terms of offensive weapons. but we have a relationship that is a national security issue and israel has been our partner in that. we have a problem now with 33,000 people killed. but october 7th was a horrible, barbaric act. hostages must be freed. there are ways to do this that are not -- shall we say, dehydrating or withholding food

and nutrition and the rest from children and families. >> i want to ask one last question on abortion rights. it goes back to this point you made about legislating. a lot of people will say a lot of different things in this campaign about where they are in abortion, particularly republicans trying to run away from their position. is there any doubt in your mind that a democratic majority in the house and senate would have any problem passing a bill to codify roe at the federal level? >> no. the democratic majority. of course, we have to get rid of the filibuster. but the fact is that we have to fight this state-by-state issue. the decision has to be made by women and their families. not by politicians as to the size and timing and if they're going to have a family. this is a democracy issue. it's a drumbeat across america

starving people. children are dying of malnutrition. you need certain types of food and medical facilities have been destroyed. but i tell you this also, chris. the president is wrong. you don't have to be begging netanyahu to do anything. we are supplying israel with huge amounts of money for decades. right now, there is legislation that would give israel -- and i voted against that legislation -- $10 billion more for unfettered military aid. the president has got to say, sorry, netanyahu. you are not getting one penny more until that situation in gaza radically changes. we are not begging you anymore. that's what you have to do. end of discussion. >> obviously, for months now, there's been talk about some sort of cease-fire deal. obviously of the utmost importance from the israeli side of the hostages. we don't know how many of those hostages are alive. we just don't know the number.

and this harrowing headline today, which suggests some real complications here. hamas does not have 40 hostages to meet the official swap with israel. senior officials say they don't have the 40 living hostages in gaza to meet the criteria for an exchange. any deal has to have some reciprocity, and hostage release is one of them. now you have hamas saying, we don't have them. >> this is a nightmare on top of a nightmare. i read that -- you know, who knows how they died or why they died. but obviously, you are absolutely right. people now have been held under terrible conditions for months, and israel has the right to demand their release. it's got to be part of the package. >> senator bernie sanders. thank you for chatting with us tonight. that is all in on this wednesday night.
