good afternoon from washington d.c. and welcome to "alex witt reports" . right now, large protests in israel demanding the return of hostages in gaza and the resignation of israel's prime minister benjamin netanyahu . talks for a cease-fire and hostage deal are set to resume in cairo tomorrow. six months to the day of the october 7th massacre. israel and hamas are sending delegations and is raising hopes that a truce could temporarily pause the nightmare unfolding in gaza. we have several reporters in place covering all of today's new developments we begin with nbc reporter from tel aviv. give us a sense of the pressure israel's prime minister benjamin netanyahu is under from his own people and from the u.s. to reach a deal with hamas. >> reporter: he is under pressure, as you mentioned, from his own people. let me set the scene for you.

week. late yesterday his lawyers issued a 37 page filing renewing the call for the judge overseeing the case judge merchan to recuse himself because of his daughter's work as a consultant for democratic candidates. they have tried this once before in august. the judge, relying on advice from judicial ethics committee rejected their efforts. earlier this week, the manhattan district attorney office told the judge in a letter that there is no reason for the judge to change his mind because of circumstances have not changed. and trump's arguments are a daisychain of innuendos joining me now is kristy greenburg, former federal prosecutor and msnbc legal analysts -- analyst. form and trump promised evidence linking the firm of his daughter to campaign solicitations that mentioned rackley the manhattan district attorney's case. did donald trump and his attorneys expose the links or is there any evidence of that shown? >> as you said, judge merchan that with the motion for

recusal based on his daughter's employment creating, actual or perceived conflict of interest. he dealt with that on august 2023 and denied the motion. trump pass to now claim there is new evidence or changed circumstances that will get the court to reconsider. he points to three things. one, trump is the presumptive republican nominee and that warrants a change. that does not change the conflict analysis the judge already entered into. the second, as you mentioned, they focused on the need for recusal based on judge merchan's daughter's letter x account. saying there is no evidence based on that. but, that account has not belonged to her for over a year. she deleted the account over a year ago. any recent posts cannot be interested to her. therefore, are not new evidence that should support a recusal. the third thing they point to our recent comments from the

judge. which said he was preparing for the trial and he would be impartial. none of which is a basis for recusal. there is nothing on earth that is new in the motion that would support a basis for recusal. all this is, is the runaround of a gag order that prevents donald trump from attacking the daughter of the judge and his lawyers have taken up the bidding for him. which is improper. i do not see this coming 10 days before the trial is anything other than a delay tactic that the judge will dismiss. >> you broke down what they are arguing and what the responses could be to the arguments. i want to dig into the argument that the circumstances have changed. trump is the likely republican nominee. is there any chance the judge will buy it?

what is the process for judge merchan to make a decision on the motion? such i don't think there is anything to it. at the time the motion was made and it was decided in august 2022 trump was running for president when the decision was issued. the fact that he was a candidate and his presumptive nominee is not a change of circumstances that would change the analysis of a conflict of interest from the court. i do not think it will move the needle. i think the judge will issue a ruling on this rather quickly. you will see the ruling this week. the trial is scheduled to start on monday the 15th. we are a week away from the trial starting. i think you will get a quick decision from the judge dispensing this and saying he can stay on the case. >> a quick timeline. there is more bad news for former president trump ahead of the trial. judge merchan denying his bid

for different reasons, they were concerned about it, but it was something that most of them said was a top concern. >> definitely a top concern for them. finally, participants were questioned about what would affect their vote between now and november. take a listen to what they said. >> let me cut to the chase if convicted of a felony before the election but doesn't affect if you would vote for him or not? >> yes. >> in what way? >> i do not think we should have a convicted felon as president. >> in your mind bow, would be i will vote for -- awful for america if trump or biden won? the correct. such would be the same version of awful? >> probably not. >> the second person said she is planning to vote for jill stein. if the choices were between donald trump and joe biden she would not vote at all, especially given what we heard from that person and the idea that some people change their minds if former president trump is convicted, how could that
12:52 pm
have an impact on the selection. >> there were two things that could change how people were leaning. one is a potential conviction for donald trump. on the biden side, it is the economy. if the economy got worse he may consider voting for donald trump. it is existence of other candidates. someone like jill stein or robert f. kennedy jr. it shows how they could be spoilers for people who do not want trump or biden, but decide they want to vote. i was also struck by a woman we have not talked about yet that said she probably was not going to vote. she did not like either one. she considered them two bags of trash and did not think her vote counted anyway. there are a lot of states where the voters will go the way the vote goes. there are a handful where an individual has been vote really matters and michigan is one of them. >> it was striking to hear the motor talk about michigan say
12:53 pm
she did not like her vote would matter. it is definitely going to matter, especially in a state like michigan where biden won by a small margin. thank you for breaking this all down. next, what accountability would really look like one of the most heartbreaking stories of the week. k. across bipolar depression. unlike some medicines that only treat bipolar i, caplyta treats both bipolar i and ii depression. and in clinical trials, movement disorders and weight gain were not common. call your doctor about sudden mood changes, behaviors, or suicidal thoughts. antidepressants may increase these risks in young adults. elderly dementia patients have increased risk of death or stroke. report fever, confusion, stiff or uncontrollable muscle movements which may be life threatening or permanent. these aren't all the serious side effects. caplyta can help you let in the lyte™. ask your doctor about caplyta. find savings and support at caplyta.com

today, new reports of iran planning a possible attack inside israel. white house officials telling nbc news they are on high alert for a possible attack by iran in retaliation for an israeli strike on the iranian consulate in syria that killed several senior officials this week. joining me now is former state department senior adviser in msnbc columnist, thank you for being here. so, we should just cut to the chase here. i mean, do we feel like iran is going to be attacking israel here, and could the u.s. and u.s. officials possibly be on the attack, as well? >> here is the challenge of the current situation, with netanyahu being so focused on
12:57 pm
the war in gaza, this is what administrative defense, analysts have been saying for weeks if not months, that israel is now vulnerable on other fronts. the chaos that has come out of gaza has resulted in houthis attacks, backed by iran, and now hezbollah acting up in the north of israel. so, iran is hoping to seize this opportunity, and it is believing that israel is distracted, and that israel's allies are not 1000% behind netanyahu at this moment and that is what a regime like iran tries to do, take advantage of movements of dissent. >> and i want to talk to about this heartbreaking story that happened, which is the world central kitchen aid workers being killed. now, the world central kitchen rejected the idea of finding

something that the idf cannot credibly investigate its own failures in gaza after they said that they had let go of some officials related to the attack. tell me, what do you make of the fact that they are now pushing for this independent investigation? do we think that could actually happen here? >> traditionally, independent investigations have happened either through the united nations or one of the international criminal justice bodies, for example. the challenge we have in this one is that for most of the time, on the global community, the united states has been the one to have israel's back, understandably, given iran and others in the region that still chant "death to israel." but, when it comes to accountability for the killing of aid workers, this attack on jose andres's team is not the first one by idf. it is actually dozens of them over the course of the last several months, and because israel has such a tense relationship with u.n. bodies, it does seem difficult that a
12:59 pm
fully independent investigation will be possible and i will say this, the united states itself for the challenges that have happened in iraq, in afghanistan, has not allowed independent investigations into u.s. activities, as well. so, this is traditionally what happens when countries with power, countries that are the ones driving the force of the war typically do not want independent bodies looking at their activities. >> i want to ask you about hamas and israel having talks, do you feel like there is any sort of optimism there, given the fact that hamas is participating, at least, in this? >> the hamas organization has representatives in cutter right now, which is where we see officials from the united states, from israel, and other interested ally countries gathering to try to figure out a path forward. now, hamas and netanyahu's regime don't see eye to eye on anything. neither one truly believes in a

two state solution. so, that aspect is a nonstarter, this idea of this being a moment to have a negotiation about the final boundaries of palestine and israel. what they are hoping to negotiate on is the release of hostages and a cease-fire. and what the terms would be of that, what needs to happen first. there is a lot of distrust, particularly in this moment, where it does not seem that either side is willing to leave what happens in the room. they are definitely playing on the interests of other parties, they are both conducting their own pr campaigns. so at the moment, hamas is saying that israel cannot negotiate in good faith when they are attacking aid workers and israel is saying that hamas has no interest in really releasing hostages. >> well, a situation we will definitely continue to watch closely. thank you so much for being here. that will do it for me on this addition of "alex witt reports" i am yamiche alcindor and we will see you again tomorrow.
