he issued. it is going to be one of these tests, and donald trump live with this new version of the gag order. we will find out. >> with each new one of these, the judges issuing these rulings learn from the way he has treated all the previous gag orders i think they are getting a little stealing their spine in terms of what it's going to take to enforce these things. >> yes, the district attorney and the judge both aligned on the washington d.c. gag order. >> thanks, lawrence. the breaking news of the night is that donald trump has been gagged, again, after a flurry of new findings at the end of the day. asking the judge to expand his gag order and donald trump's defense lawyers filing their objections to expanding the gag order claiming that donald trump did nothing wrong by

attacking the judge's this -- the judge's daughter. it now for bids donald trump from commenting on the judge's family or the district attorney's family. their families were not previously covered by the gag order. the judge also warned donald trump, as requested by the district attorney, that if he continues to disrupt the case, donald trump will lose his legal rights, as a defendant, to even know the names of his jurors in the case. the first line of the district attorney's filing in the case tonight says, defendant's dangerous, violent, and reprehensible rhetoric fundamentally threatens the integrity of these proceedings is and -- is intended to intimidate witnesses and trial does like-including this court.

the district attorney is asking the judge to clarify or confirm his previous gag order on donald trump that protects family members of the court, the district attorney and all other individuals mentioned in the order the district attorney pointed out that a social media account that donald trump publicly ascribed to the judge's daughter was, a fraudulent impersonation. the district attorney added, there is no constitutional right to target the family of this court, let alone on the blatant falsehoods that have served as the flimsiest pretexts for defendant's attacks. defendant knows what he is doing, and everyone else does, too. the harm to the orderly administration of this proceeding is magnified by the high likelihood that potential witnesses, prospective jurors, and other trial participants will observe defendant's attacks and understand that, if this court's family is fair

game, then so are theirs. this issue is not complicated. family members of trial participants must be strictly off-limits. defendant's insistence to the contrary bespeaks a dangerous sense of entitlement to instigate fear and even physical harm to the loved ones of those he sees in the courtroom. donald trump's attorney's brief points out that the gag order does not apply to family members of the court in the district attorney and that of course is why the district attorney was asking the court to expand the gag order. so, that is what the court decided to do. trump's criminal defense orders argued in their filing that donald trump's comments about the judge's daughter officially became part of the case, when the trump lawyers use that as a

reason for the judge to recuse himself. the judge denied that. the trump lawyers argued, trump's comments concerning your honor's daughter are properly understood a criticism of the court's prior decision not to recuse itself, the challenge to social media pro posts reflect president trump's exercise of core constitutional rights under the first and sixth amendment. the advocacy was also necessary and appropriate. at 7:50 8 pm tonight, the judge issued his decision and order. he quoted the trump's lawyers defense that trump's statements plainly constitute core political speech on matters of great public concern and criticism of major public figures to which the judge said, attacking family members of presiding jurists and attorneys assigned to his cases serves no legitimate purpose. it merely injects fears in

those assigned or called to participate in the proceedings, that not only they but their family members, as well, are fair game for defendant's vitriol. the judge quoted the district attorney saying, multiple potential witnesses have already expressed grave concerns about their own safety and that of their family members, should they appear as witnesses against defendant. that led the judge to this conclusion. it is no longer just a mere possibility or a reasonable likelihood that there exists a threat to the integrity of the judicial proceedings. the threat is very real. admonitions are not enough, nor is reliance on self-restraint the average observer, must now come after hearing the recent attacks draw conclusion that if they become involved in these proceedings, even tangentially,

they should worry not only for themselves, but for their loved ones, as well. such concerns will undoubtedly interfere with the fair administration of justice and constitutes a direct attack on the rule of law itself. again, all citizens, called upon to participate in these seatings, whether as a juror, a witness, or in some other capacity must now concern themselves not only with their own personal safety, but with the safety and the potential for personal attacks upon their loved ones. that reality cannot be overstated. the judge accused trump's lawyers of baseless misrepresentations that result in accusations that are disingenuous and not rational. to argue that the most recent attacks which included photographs, were necessary and appropriate in the current environment is farcical. the judge found that there

exists no less restrictive means to prevent such risk to the proceedings. the judge gave donald trump this morning, defendant is hereby put on notice that he will forfeit any statutory right he may have two axis juror names if he engages in any conduct that threatens the safety and integrity of the jury or the jury selection process. leading off our discussion tonight, u.s. attorney and professor of the alabama school of law. and, cohost of the podcast sisters-in-law. also harry litman former u.s. attorney and deputy assistant attorney general. joyce, let me get your reaction to what you read in the order tonight. >> you know, this is very

serious, lawrence we see these orders from judges day in and day out every once in a while you read an order and the language stops you cold. this is a judge who has had enough. he is not reacting in an emotional way. it is measured, well grounded in the law. as you pointed out, he lays it out step-by-step and then he concludes that there is nothing less restrictive he can do. he, in essence, admonishes trump that if he crosses the line again, he will face criminal contempt. he cites to the statutory provisions in new york law that permit judges to invoke criminal contempt and there are two possible penalties. one is the fine, and the amount is so de minimis that if we get to that point the district attorney's office will say this dollar amount will not do anything to deter trump. the other option is custody. the judge can punt a defendant in jail for up to 30 days. look, this is an extraordinary

step. i am still not certain we imagine that the former president will be jailed pending trial. but, the judge has laid it out clearly and said that donald trump is attacking the heart of the rule of law with deliberate conduct. so, if he continues to do it, if the judge finds that he does it with the intent to material, influence or impede the trial, the judge has told donald trump what comes next. >> harry, when i was reading the judge's order, it made me kind of work back through what led to this. it reads as if this really might not have been possible until tonight. like the judge was waiting, if he was going to do this, he was going to need more, he was going to have to see the threat develop so that he could get to the point of writing credibly in his order, the threat is very real. >> that is exactly right. he wants to try to be

dispassionate because he does not want to look as if he is perfectly -- personally exercise because it involves his daughter. trump administration 70 some tweets or social media over the weekend including pictures of the daughter. but it is both that and what has happened recently, the judge has a new arrow in his quiver that they did not have in d.c. and that is really everywhere in the order. that is the upcoming trial. two weeks from today. all the points he makes about people being cowed and participating in proceedings have real bite and constitutional force because he can say, there is a trial in front of us that you are threatening to prejudice and undo and frighten the participants of. that gives him the extra leverage that say another judge would not have had yet.

i think it is a game changer, basically, for the rationale that permits him to do this very thing. one thing to add to what joyce said, it is always tricky with trump. you don't want to put him in jail, but the judge puts in his order, this a very interesting point, maybe you lose your statutory, that is the right to know the names. you learn a lot about individual jurors and that is a creative kind of threat that isn't down the line of we are going to put you in jail which pretty much everyone wants to avoid if possible. >> we had plenty to talk about just on the filings we got at the end of the day from the district attorney and the trump defense lawyers. what happened with the judge's order, he basically adopted all these arguments being made by the district attorney that i

was going to be asking you about, especially the argument that this is not just about the judge's daughter. this is about every potential juror who comes into the courtroom. every potential witness who might be called who is out there thinking, if this guy can attack the judge's daughter, imagine what he can do to me, imagine what he can do to my family and that was the real threatening aspect of what trump was doing that the district attorney persuaded the judge he had to take action against. >> yes, that is exactly right. jurors do not have long-term protection like judge's daughters probably will be able to access this is a very real threat. the da pointed out in their briefing that they have had witnesses tell them they are getting concerned. potential jurors are often concerned. we have both dealt with situations like this but no one

with as public a megaphone as trump, who has a demonstrable impact on his followers. jurors would literally have to be looking over their shoulder in your. this goes beyond what's happening in this trial. this ties back in to the targeting that donald trump is doing on social media of people up to and including the president. we are at the point where a judge simply has to say, enough is enough, i will find a way to hold this man accountable or we can't, in good faith, ask jurors and witnesses to go in and play their roles in this trial. >> the trump lawyers filing to this judge tonight, arguing that our client has a perfect right to attack your daughter whenever he wants to, that is legitimately part of this case. that did not get anywhere with this judge. >> farcical, he called it. there is no legitimate purpose,

he called it. the notion, and he gave a lot of peons in the opinion to trump's right to have first amendment criticism, et cetera, et cetera. this sort of vilification about the judge's daughter has zero first amendment value and true risk as joyce was just detailing to a trial that is about to begin. he swatted it away. but, i think he did it in a way that he wants to not open himself up to any accusation that he is getting personally engaged in it and he did not. it is grounded in the law and says there is nothing on your side really, it is contemptuous of trump's suggestions that this is core political speech and, that there is something really big on the other side. thank you very much for starting off our discussions

tonight. more breaking news, donald trump managed to post the $175 million bond in his new york civil fraud judgment against him for the $464 million judgment he is appealing. joining us now is dan alexander. dan, how did donald trump do it? who gave him the money? >> he did it with the help of a company called night specialty insurance company. they fall under an umbrella of companies. owned by don hankey. he made his fortune originally offering subprime auto loans. he is comfortable with looking at people who have marked out for the histories and saying, they have the collateral we can afford to do this and we are going to make money on it. apparently, that is what happened in this case.

>> going forward, donald trump has now the money to cover that bond so his assets will be protected. during the appeal, what do we expect donald trump had to put up in order to get this backing to do this? >> one of my colleagues just got off the phone with don hankey who said that the collateral for this was a combination of cash and investment grade bonds. we knew he had a substantial amount of cash, we estimate his liquid assets at roughly $400 million right now. what is interesting here is that he has tied up a chunk of that both as collateral on this judgment and also with collateral in a bond in the e jean carroll case. forget building massive new

buildings were propping up truth social with a big injection of cash, those things will be very difficult for him to do at this point. >> how does this affect any other aspect of his legal predicaments. when you are evaluating the risk with a borrower, would you want to consider he is a criminal defendant in four different cases? >> certainly you would, but that being said, lenders and insurance companies, the sorts of people who will enter financial arrangements with donald trump, they are people who want to make money. time and time again, despite the fact that trump has been accused of fraud, found liable for fraud and charged with criminal counts, there have been people willing to do business with him. they might not be the a-list banks that, they might be demanding higher interest rates, but there is going to be somebody out there willing to put up money.

today's florida's supreme court held the 15 week abortion ban and a six-week abortion ban that the state legislature passed after the 15 week ban. but, florida voters will have an opportunity to change that in november. in a separate decision today, the florida supreme court of proved a ballot measure that would protect abortion rights

in the state's constitution on the november ballot. a proposed amendment says, no law shall prohibit, analyze, delay or restrict abortion before viability or when the necessary to protect a patient's health as determined by the patient's healthcare provider. the amendment requires the support of at least 60% of voters to be added to the constitution. if it passes, it would nullify the abortion bans. florida is one of several states trying to bring the issue directly to voters in this election. voters in seven states have already voted in favor of protecting abortion rights, not restricting them since roe versus wade was overturned by the united states supreme court. it is particularly crucial now given that this new six week ban well, all but eliminate

abortion access in the south while further straining abortion clinics elsewhere across america last week democratic representatives unveiled a bill to counter abortion misinformation. the bill seeks to ensure accurate abortion access nationwide in response to antiabortion centers often calling themselves crisis pregnancy centers intended to deceive patience . thank you both, very much, for joining us tonight. congressman crockett, your reaction to the florida supreme court saying yes, the legislature can enact any ban it wants, but, florida voters are going to get a chance to rule on this >> i am happy and i am happy. i know that there are those

that definitely are saying, wait a minute, how can you be happy about the six week ban. it is the extremism that is motivating people to get up off the couch because they recognize that freedoms are on the line. because the supreme court allowed this rogue legislature and rogue governor to do this, i think this will be a motivating factor. for once, i may have some faith in florida. november may be a different day because we know that every time we have taken this issue to the people, the people have decided, overwhelmingly, that they want to basically allow our medical providers to assist women in making these very important decisions with their lives. >> dan goldman, a 60% vote necessary for the amendment in november to become law. that sounds tough, but current polling shows 62% of florida

voters supporting it including 53% of republicans supporting it. >> that is exactly right and that is consistent across the country. americans and especially women want the right to control their own bodies. when you look at what the state legislatures and governors are doing in states like florida where they are trying to force women, who don't want to have babies, or risk health issues by having babies to have them, and then you see the alabama supreme court telling women who want to have babies through ivf that they cannot, the only logical explanation is that they want to control women. this is a battle for freedom. as a man, it is a battle that is on the line for me, too not just because i have four daughters, but because the health of my wife may be at risk if abortion care or

miscarriage care is not available. family planning is on the line. they are not going to stop here with the freedom to reproductive health. they will continue. they will go after contraception. they will go after lgbtq rights and guy marriage. they will not stop until the conservative, evangelical, hard right view of the world overtakes this entire country. i am glad that we will have an opportunity for florida voters to make their opinion known. the courts are not going to save us against donald trump, they are not going to save us against the supreme court. we are going to have to get out to vote every single person in this country has to make his or her voice heard so that we, the american people, decide what our freedoms are. >> representative crockett, joe

biden's -- he wants to see federal guarantees along the lines of roe versus wade. donald trump is refusing to say what his position is. is he for a 15 week ban, a six- week band, what is it going to be? he is a florida voter and also refusing to say how he would vote on this constitutional amendment in florida. >> i think the silence speaks volumes. we know where trump stands. we know what the supreme court has done to decimate our freedmen -- freedoms. it is not about whether or not you agree with abortion, you understand abortion access, it is about freedom as a whole. we know that the three trump justices have absolutely put us into the upside down. this is why we are struggling. this is why people are having to push back. i wish the state of texas did have this option.

i could almost guarantee you that we would not have people facing up to life in prison if the people had an opportunity to choose. the fact that it is a 60% threshold, they thought that was going to be what they could do in ohio to win we saw an overwhelming number of people come out. honestly, this was probably the wrong fight to wage at the wrong time when they are trying to take the white house back. we know arizona is pushing for the exact same thing. i am looking for good things out of arizona, out of florida, and anything we can do we are going to do. i think it is really important that dan is one of the people who brought this bill. dan is in new york. we know that there are those who believe that if you are in new york or california, that you are safe, but they are trying to push a nationwide abortion ban and we are going to push back. >> dan, on the legislation that you and representative crockett

have introduced, it is about getting clear information out there for people about this. now we see with florida, basically in -- the entire south has an abortion ban in place one way or another. new york is one of the places that people are wondering about. what will your bill do to help people in these states living under abortion bans? >> the first thing it will do, it will provide a central repository of accurate information where people can go to figure out options for themselves and whether it is to come to new york or massachusetts or go to other states that welcome women who need abortion care, they can find it there. it is also designed to stop the malicious and manipulative efforts by so-called crisis pregnancy centers to woo women into their centers by appearing as if they are a planned parenthood or the like and then

today, the biden-harris campaign released a memo saying that it sees the state of florida now as winnable after today's florida supreme court ruling. as we just mentioned, florida's supreme court also ruled that voters in florida will be able to vote on an amendment that will guarantee abortion protections in the florida state constitution. in other states, other republicans running for

election are showing a new vulnerability because of the republican party's attacks. a recent poll from the university of texas found incumbent republican senator cruz is tied, tied at 41% against his democratic challenger colin allred. 52% of texas independents have an unfavorable view of senator cruz . as the u.s. supreme court content -- considers restricting the abortion bill -- pill, a statement was released that senator cruz is leading the charge to ban the abortion medication and that senator cruz supports outlawing abortion with absolutely no exceptions. joining us now is democratic

representative colin allred. getting to a tie at any point against a republican in texas is impressive. you are at a tie with enough time to move that number up. >> yes. we know this has always been, in texas our task is to get more fellow texans out to vote. what we are also seeing is that texans know who ted cruz is. we know what he has and has not done. he has been mis-risen -- misrepresenting us in the united states government. i was born and raised in dallas by a single mom. i made it to baylor, to the nfl, i beat a 20 year congressman just to get into congress. now we have a chance to take out one of the worst senators in the country and i know we are going to do it >> the polling on independent

press in texas seems to be the spot where, if there is a victory for you, that is where it is going to be. they are heavily against senator cruz, now. there and favorability of him is astronomical. no one gets a zero. usually just by seeing the word democrat or republican, you get some unfavorable. 17% is about as low as it gets. >> i think texas has a long tradition of independent leaders who put texas first who have natural profiles but are texans first and foremost. we have gotten away from that in recent years with these followers like ted cruz who follow whatever they are told to do, if you talk about his family, call him everything but a child of god that is not who we are as texans. i think we need to get back to that. i think you are right when we talk about, there are folks who are wondering where we are going to land.

i might have been voting for republicans in the past, but i don't see myself in this version of the republican party. those folks voted for me and that is how i got into congress. i have tried to serve in a way that shows we can bring folks together. there are some important fights. abortion access and act boats to make your own medical care. it is also not a good time to go on vacation when your constituents are freezing in the dark and then when you come back make jokes about it texans don't accept that. our task over the next few months, of course, is to make sure that texans and americans know we can get rid of ted cruz and put someone in the senate who cares about all the texans not just himself. in the nfl we had guys called me guys. looking out for themselves. ted cruz is the ultimate me
