politics, endorsed by the ohio governor and also in the running is the governor frank larose and whoever wins will run against the current senator sherrod brown. we have steve kornacki and vaughan hillyard, and we will go to start in ohio, and jessie, you are following that one there in ohio. >> yes, the three men in the race are trying to become the republican nominee to take on sherrod brown and this is a state that is increasingly red, and the governor was just re-elected, the republican, and the other senator in the state is a republican, and sherrod brown is the last stop for democrats here if they are going

to hold on to any kind of statewide power here at this time. so this is a seat that is seen as a top pickup opportunity for the gop. and so the question is, who becomes nominee today and who is the most effective option for going up against the democrats in the fall, and depending upon who you ask, they will obviously have their opinion on who that is. when we are looking at how things are set up here, as you mentioned, two wings of the party, and shaping up to be a referendum on former president donald trump. you mentioned the three candidates, but if you are turning on the television and looking at the ads it is two-man race between businessman matt dolan and businessman moreno. moreno has the endorsement of trump, and we caught up with dolan last night before the campaign, and this is what he shared about the involvement with the former president. >> are you more engaged with the

former president to see if he would endorse you in this race? >> i did not. >> why was he considering it? >> well, i have been laser focused on ohio and making sure that people understand that i understand ohio and i want to go fight for ohio to make a stronger america. so, at the same time, mr. dolan is telling me that he is seeing somebody whose policy position line up as what people see as trump policies, and he is getting it done and he made a point of saying that he is getting it done but he is not doing it with shouting, and clearly trying to draw a contrast there, ana. >> it is not just ohio's primary but there are primaries in arizona and florida and illinois and ohio and kansas. >> yes, a special election in california near bakersfield where kevin mccarthy, the former

house speaker, he is leaving the house. there is a special election to fill that vacancy, and also in illinois, there is going to be a number of house primaries, and one in particular that we are keeping an eye on in a potentially competitive district where it is establishment and maga dynamic, and we will see what emerges on the republican side. and in ohio, a congressional primary on the republican side, and marcy kaptur, a long-time democratic congresswoman, and a longtime republican target in 2022 and she was successful, because the republicans nominated a scandal-plagued candidate, and the republicans are hoping for another shot at kaptur in ohio, but this race is the marquee contest today. obviously, very competitive, and certainly looks like moreno and dolan may have separated

themselves from larose the secretary of state heading into today, and you have establishment, and you used to call it the establishment, and you could say that the trump wing is more of the establishment part of the gop party today. and you have dolan who is being backed by the strength of his race when he lost to j.d. vance-backed candidate. and we have areas where they have more college degrees and dolan was strong around cleveland and around columbus back in 2022 and ran up the good margins there, but ohio has blue-collar working areas, and areas demographically in the trump wheelhouse, and this is why the state is more redder when trump emerged in 2016, and the areas were resistant to dolan in 2022 and that is the

biggest challenge if he is going to be fending off the trump-backed moreno. and if the democrats have any chance of winning back the majority, they have to win ohio, and more involved, but with ohio with the expectation that trump is going to carry the state in fall, that is an enormous headwind for sherrod brown, but this state, one that we will be revisiting a ton between now and november. >> we will watch what happens tonight. it could be close or a blowout. vaughan, you in arizona where president biden is set to hold a rally tomorrow. take us through primary day there. >> right, ana. we are a lot less exciting here in the state of arizona, and folks are more focused on the spring training baseball as it is taking place, and that said, we will be looking at the results of the presidential

preference primary tonight, because the mail-in voting has been taking place over the last few months, and my own family sent theirs in over the last few month, and we will see what happens with the margins of donald trump over nikki haley. and of course, donald trump has hit the delicate threshold, but it is not stopping the fact that president biden is making way to the greater phoenix area here this evening, and he is having an event tomorrow. for all that jesse is getting today, i will give him a run in arizona seven months from now, because looking at the results of the election, joe biden beat donald trump by just over 11,000 votes, and that is where you are seeing the democratic and republican allied forces spending money. goi back to 2016, and hillary

clinton made a stop here before the 2016 election, and this is notable when you have donald trump and joe biden squarely setting the sights here. kerry lake is going to be likely the nominee here for the state, and she is going to have a primary set to take place four months from now, and we anticipate seeing her this afternoon when she comes to vote in person, but for now, we are anticipating president biden's arrival in the state for what is a contentious seven months ahead, ana. >> thank you, vaughan hillyard and jesse kirsch, and all of you there. and now, we are joined by joy and john, and now, with the maga rally, does that carry the

weight that he thinks it does? >> well, mike dewine has a lot of weight, and so this is intrigue for two reasons as steve pointed out. most of the odzmak oddsmakers b that the republicans will have an edge, but look, the incumbent senator from ohio, a strong democratic senator sherrod brown, and so if moreno, trump's candidate, will give brown the chance to win, but there is a growing caucus within this caucus that looks like the fighting freedom caucus like josh hawley or j.d. vance, and whoever is going to succeed the

leader of the senate mitch mcconnelly. >> but what if moreno loses, and does that signal anything about trump or anything for november? >> certainly. we know that donald trump has an outsized image when it comes to the races, and often underperforms, and moreno has trouble as a candidate, and dolan is a strong candidate in the state of ohio, but looking at j.d. vance, the trump wing won, and he is trending in republican politics in a trumpian way. i think that it is going to help moreno in this case. >> the team dolan is backed by the governor of ohio dewine, and interesting conversation about civility in politics. let's listen. >> this is what we have to do as republicans. we have to recognize that

civility in politics is not a weakness. and strength, and we need to judge strength not on how loud we are, but how much we get done for the american people. >> the fact that he had to say civility is not a weakness. that speaks volumes, no? >> yeah. definitely does. but i think that he is also tapping into what we have seen happening across some of the republican primaries. there is still a stubborn anti-trump sentiment within the republican party, and it is small, but it is still there, and he is appealing to those folks who will come out in the suburbs to vote for him. so, the larger question goes towards general election that, you know, if he does not prevail, you know, and if it is moreno, and will the republican voters who want to stop trump, and, you know, protect democracy go to cast votes for sherrod

brown and joe moreno, and if talk is cheap, and then you go to vote for trump and moreno anyway. >> we know that americans are disenchanted by the two presidential nominees and yet the group no labels is struggling to find candidates for an alternative ticket, and the list of nos is growing including former representative liz cheney and maryland governor larry hogan, and georgia governor brian kemp, and chris christie and mitch daniels, the former indiana governor and chris sununu of new hampshire,

and what do you see with that? >> well, two things can be true. and i have shared this with others that it is difficult to mount a presidential run if there is an alternative in the making that may be successful at a grass roots or state level in a different arena, but to mount a presidential run, the barriers to entry are high. you can't get your candidate in front of the american people in all 50 states. so no labels is struggling from the mechanical issue, but then the general lack of support. i think that their mission is doom for failure, and they should abab don it, and there is more of an impact from the rfk jr. running on the similar issue of vaccine freedom, and that is something of enough of a constituency in the united states to disrupt a two-person race, but in that case, it actually hurts donald trump more than joe biden. >> what you think, atima? >> well, i don't disagree with

congressman jolly. >> well, that being said, if a third-party candidacy can't gain momentum now, will it ever? >> i don't quite think so. i think that at this point from my experience from working political parties from the local level to the national levels as a democrat, it is going to be much hard to build brick-by-brick, state-by-state, a party to bring a candidate, because it has not worked before, and it takes infrastructure and work and funding in today's climate. >> atima omara and congressman jolly, thank you. and now, congress may be over the last hurdle to avoid a government shutdown this week,

law enforcement agents can go in saying how far defendants have a guilty mind and hinging on how fair it is how groups of people think and behave when that testimony relates to a criminal state. this is a case involving a woman smuggling drugs across the border as they say she must have done it willingly. and this is testing amount of evidence that can be admitted into drug legal cases. and so, now, with just a short time left, remind us what is possible for them to look at. >> and we have a case that is asking the court to expand on the bruin decision that gun regulations have to be consistent with the tradition that is something that the founders must understand which

is sparking challenges to the existing gun laws, and meaning that a felon or someone who is accused of domestic violence can have a gun. and this is also, if a ban of bump stocks went beyond the existing law allowed. and other cases of the immunity cases, and whether the presidents are immune from prosecution and official acts, and the first amendment cases involving the social media, and can regulate the social 3450edia, and another one where the justices allowed the government to flag disinformation on the major platforms. ana. >> every week we be looking for the issues. thank you, ken delainian. and today, the deadline for donald trump to file a brief in the immunity case as the characters in the president's hush money case are given the green light to testify in new york. and plus, the trump ally is

a new court deadline for donald trump today. the former president's legal team is due to hand over a brief to the supreme court on trump's presidential immunity claims ahead of arguments next month. meanwhile, we are following several developments in his other legal fights including hush money case, and the georgia

rico case. we will bring in justice reporter ryan riley and legal attorneys kelly and oogenga williams. what are we seeing, ryan? >> well, they have a brief due today to outline the arguments for immunity. in the lower or appeals court, donald trump's attorneys argue for broad definition of immunity, and that he could order seal team 6 to order a assassination of his rivalry and that he could do so after being impeached by the house and the senate there, and so it is a broad outline there, and i would not expect them to make that

supreme court and sort of pressing them on the immunity claim. really the big claim is hearing them at all, and kicking back the trial. right now, we were originally supposed to be in the middle of the donald trump's trial in connection with january 6th attacks and we were supposed to be in a couple of weeks here, but that is not where we are supposed to be because of the appeals, and the supreme court delayed before the presidential election, it would be moved to the october or september range, if the president finds that the president is not immune across the board. >> so while we await these decisions, do you think they will file all of the briefs today? >> i think they will hold it back that he has the absolute immunity, and he can do whatever he wants as president.

it is key to wonder if he is acting in official capacity or not fulfilling the presidential duties at the time, and that is important for the supreme court to make a determination in that. >> how is the special prosecutor jack smith going to poke holes in there and that what you see in that odiah in this? >> well, i think that the trump team is going to try to send the facts over to court for further finding which is a finding here, and the judge chutkin said no immunity here, and she specifically said i will not answer the question that trump wants which is some outer immunity, and that he could be outside of or within, and they could say, i want you to answer that question, if you skip it over, and then send it back, and

at that point, that decision could run it its way through the appellant court, and then back to the supreme court, and if that point, there is no trial before the election. >> game, game, game. and now, ryan, let's talk about the hush money, because now in this case, there is a rejection to limit the testimony in the trial, and he says michael cohen, stormy mcdaniels and karen mcdougal can all testify, and what do you have more of this? >> well, it is a rehash of 2016, and we have to all remember at this time, almost eight years ago now when all of this sort of went down, and another interesting component of the ruling that the judge made is that the jurors will not be hearing directly the tape from "access hollywood" in which trump made those derogatory comments about what he could do as a celebrity in terms of sexually assaulting women, and getting away with it, and that is not something to be played

directly, but it will be referenced, because a lot of this is made in relation to the comments, and the prosecutors said they were so worried about the impact of what they would have on the election with the female voters and they had relations with donald trump before, and this is the heart of this. >> and so he called stormy daniels and karen mcdougal liars and what do you make of that decision? >> well, the prosecution laid it out here, and speaking as a former prosecutor, you want to tell the story, and have witnesses to provide the narrative, and as a defense attorney, you want to strip the story, and you don't want more evidence in, and here the judge said that the prosecution can tell the complete story, and have the witnesses to come, and yes, you can always impeach the witness, and challenge them, and

cross-examine them, but they are going to be on the stand. here the prosecution is excited and ready based on what the rules are, and president trump would be allowing counsel here, and if i am d.a. bragg, i would think that trial is good one for me. >> and there are restrictions that were put in place, and daniels can not testify about a lie detector test that she took in 2018, and exact limitations on mcdougal's testimony and the "access hollywood" tape cannot be played at trial, and it can be referenced at trial, but why these restrictions, kelly? >> well, the judge made the restrictions because of the fact that he did not want it thought that it was potentially not relevant to the case as well. so, we have to look at the case, and what it is about, and this

case is about business records and falsifying business records, and the fact that stormy daniels got this money, and how she got it as well. once you go outside of the perimeter, it is not relevant and prejudicial to the defendant in the case. >> and now, seven co-defendants are seeking a review of the decision not to disqualify the fulton county special prosecutor fani willis. what happens next. >> he wants kathy there for the decision, and then the appellant court is going to have to access the case. i think that the case is going on to go forward and if we have had recent decisions in the pretrial motion, and that is the

judge sees it going to trial and accounting for the delay. >> thank you, both. and a former trump aide is heading to prison today. peter navarro has until 2:00 p.m. eastern to surrender to authorities in miami for defying a subpoena to the january 6th committee. he had asked for the higher court to intervene, but they rejected his bid yesterday. new on capitol hill where the lawmakers have a tentative deal to avoid a shutdown, and how they over came something to look at. and plus, the texas governor greg abbott vows to fight back after the supreme court put that state's immigration law on hold indefinitely. well, it looks like there may be a deem in place to aide a government shutdown this weekend. congressional leaders are saying they have struck a tenty deal of funding homeland security which is the biggest sticking deal of getting a bill pass. moments ago, president biden said that he would sign the bill as soon as it passes. the clock is ticking, and a full deal has to be in place 11:59 friday to avoid the shutdown. ali vitali is joining us from the hill. things are better than a day

this is a law known as sb-4 which makes crossing the border a state crime, and allowed local, and state crimes deported, aka migrants. >> well, this decision same from one of the most conservative justices of the court, samuel alito, because he is in charge of the decisions from the 5th circuit, and that is where it came from, and he stayed or put on hold sb-4 which is the texas law to allow local police to arrest anyone they suspected coming across the border illegally. in texas, where 70% of the residents are latino, that could lead to profiling, and we saw many people from the community that said that disrupted 150 years of the united states federal and state government having a split over controls

immigration law, and that authority should stay with the federal government, and that is ultimately where it is going to go on hold. so, far they have not heard the or ral argh -- oral arguments, and now this is on hold indefinitely. >> what about the numbers at the border? >> we are seeing about 7,000 per day, and this is compared to 1,000 a day around last year, and this is typically surprising, because you will see the major surges happen again. and whether sb-04 had any impact happening at the boortd is sglurnlg and so they want to make more apprehensions at the border, and say that the federal government is not doing enough,
