greetings everyone, we are watching symone. we are getting into the new information about the possible evidence that some of the witnesses of the grand jury in fulton county georgia could be hearing, as soon as tomorrow. when d a fani willis is expected to present her, case against donald trump in his alleged interference in the 2020 election. and, emergency efforts are underway in hawaii. they're going to provide residents with food, they are trying to get folks what, or even medicine. and some are still looking for loved ones, after what is now the deadliest wildfire in u.s. history. plus, arrests made in connection with a brawl in montgomery alabama, the video exploded on social media. our culture critics are going to weigh in on why this confrontation is getting so much attention. >> simone sanders towns in, and i have something to say. ♪ ♪ ♪

>> all eyes on georgia, and the next to the job for donald trump. we have been talk about the potential 4th indictment of the former president. and now, we are learning more details about how can actually play out. as soon as tomorrow, fulton county district attorney fani willis will begin presenting her 2020 election interference case to a grand jury. and, the atlanta general constitutional ports at least 2 witnesses have been giving 48 hours notice to appear before a grand jury on tuesday. willis launched this criminal investigation more than 2 years ago. let's remember where all this started. a so-called perfect phone call between then president donald trump and georgia secretary of state brad raffensperger. during that call, trump demanded that raffensperger find the precise number of votes needed to reverse to president biden's victory in the. state >> the ballots are corrupt. and you're gonna find that they are, which is totally illegal, it is more illegal for you than

it is for them because you know what they did, and you're not reporting it. that's the thing, that's a criminal offense, that's a criminal offense. and, you can't let that happen. that's a big risk for you. i just want to finds, 11,780 votes, which is one more than we have. because we won the state. i only need 11,000 votes, we need 11,000 votes give me a break. >> 11,800, 70 votes. just 11,000. that was the start of the investigation then. the investigation brought into include trump attorney -- rudy giuliani's test before lawmakers, before the action is trumps treated staff marcus, that 2, then fake electors false accusations against election workers, and a curious incident in deep red coffee county georgia. as nbc news reported the day after the january 6

insurrection, coffee county elections supervisor, one of trump's fake electors kathy late, them allowed to employees from the data firm sullivan stricter, into the county election office, as seen in this security video in the spring. this occurred the same day as a data breach out of that very office. text messages from a public court filing revealed that pro trump election lawyer sydney powell, you all remember city powell. well, sydney powell coordinated a visit between the data firm and election officials, who are sympathetic to donald trump's lies. new reporting from cnn, which nbc news has not independently confirmed, says prosecutors in georgia are using those text messages to make their case to the grand jury. in recent ransom but her efforts to hold people accountable, donald trump has referred to district returnee fill us as a right racist. for those who don't not know, or maybe listening or watching television. fani willis is black. but if trump had got his, way and successfully reversed georgia's legitimate election, the voices of untold numbers of

georgians would have been silent. many of them, people of color. according to nbc news exit polls, black voters were crucial to biden's victory in the peach state, making up more than half of its democratic votes. thanks to the work of people like stacey abrams and other organizers, black voters in georgia have turned out to vote in droves, since 2020, despite legislation passed in the state designed to make it harder to do so. but, the former president regards these black votes the same way he regards our democracy, disposable. i'm joined now by -- political reporter for the atlanta journal constitution, an msnbc political contributor, concentration is also here, msnbc legal analyst, and former manhattan assistant district attorney. grant, i'm going to start with you. you have said that former georgia lieutenant governor jeff duncan could be a star witness in this case. what do you think d.a. willis is hoping to hear from him?

>> yeah, he's one of 4 witnesses, at least 4 witnesses weekly we've confirmed, who were supposed to go before the grand shearing this week monday and tuesday. and, i think he gives it if perspective, because he's republican, he's a conservative republican. but he also broke openly with donald trump in 2020. he was among the republican leaders who shouted down, who backed and rebuffed the president, the former president attempts to reverse the election results here in georgia. he also demoted 3 state senators, who were part of the effort to convince or persuade the then vice president mike pence to brought block georgia electoral college votes. well, so i think he gave us a different geo perspective to the grand jury, to show that this is not just a partisan prosecution. this is somebody something that republicans and democrats here in georgia have spoken out against, in terms of donald from stafford to overturn the election results. >> well brett, when do you think we would see any indictments relate to this investigation? >> well, the earliest we could see it is tuesday, that's the day that we have circled on the

calendar, so that's the day that we know that the former lieutenant governor and another witness, independent -- are both set to testify before the grand jury, which is supposed to meet monday and tuesday. >> so catherine, in this case, there is a lot to talk with a possibility of racketeering charges. does the cnn reporting that the fulton county prosecutors have these text messages about coffee county's voting system, give you any more insight into that charge? >> i think all of the evidence we've heard of, between rudy giuliani making false statements and showing a doctored video, and making defamatory statements against the election workers the u.s. attorney of the northern district of georgia resign, either jumped or pushed. the phone call that we all know, about that happened on january 2nd, 2021, was not donald trump's only phone call. he called the a.g. before then to pressure the a.g. into joining an election fraud lawsuit, a frivolous one. he called the governor.

so, i think all of that evidence is me, i hate to predict, but i think they are probably will be a rico, a -- corrupt organizations act charge, which is very different than the federal charge. people are feeling with the federal charge, georgia has its own version, and this d.a. is an expert in charging that, because she's done it in the past. she has done it against school administrators. she has done it in gang cases, there is a pending case now on trial, where she has charged, so this is her expertise. >> and what is the key difference between federal racketeering rico charges, and georgia, what is the biggest ramification if you will. the georgia one is much more expansive. so, if we see a, rico it means that the, daca willis, has, she believes that she has proven beyond a reasonable doubt, that the defendants in this, case and they're probably multiple defendants, engaged in a common plan or scheme to overturn the legitimate results of the georgia presidential election.

so, the difference between georgia and the federal is, there doesn't have to be an enterprise. and, there also are many more crimes that the person can commit, and could be considered part of it. so just in a nacho, she has to prove that there was racketeering activity, and what does that mean under georgia? that means that the defendants, either committed, attempted to commit, or solicited someone to commit a crime, that is chargeable by indictment under georgia law. and, those crimes under georgia law include making false statements, perjury, forgery, bribery, violating the georgia computer act. she also has to prove it was a pattern of that racketeering activity, which means you have to prove beyond a reasonable doubt that at least two acts, and they are called predicate acts, were committed, and it was committed for the purpose of engaging in this kind of plan or scheme, to overturn the georgia results. >> so, i knew kathryn kristen could give us the details. so greg, we're talking about

coffee county right now. we know that sydney powell is the person in trump's orbit, his lawyer, that hired those folks, that data firm that went in, and allegedly, that's when the breach happened that same day they were in that building. we also know that rudy giuliani received a target letter from d a fani willis. who, remind us, were there any other target letters that were sent out, who else in donald trump's orbit with potentially be caught up in this grand jury situation this week? >> yeah, it's a pretty wide net simone. 18 or so folks have received at least, 18 people have received these target letters, noted by them. and they could be facing criminal charges. we've known since then though, at least eight of those people that have received those target letters have struck immunity deals. that is the bulk of the fake electors in georgia. so, eight of the fake electors in georgia have struck immunity deals. so we don't expect them to face charges. but, that also leaves a number of other people on the table. you mentioned giuliani, you mentioned the people involved

in this coffee county scheme. there are others in donald trump's orbit, john eastman, the former gop chair here in georgia. david schaffer, who was involved in this fake electors plot. mark meadows. folks who were intricately involved in the efforts in georgia to undermine joe biden's victory. those could all be part in parcel of this investigation. >> craig, if i may, i want to ask you a political question what republicans in georgia, and how they are responding to this, the potential of this next indictment. at least the grand jury, they convened this week's. obviously, donald trump has been fundraising off of his other indictments, and nationally, they actually have an impact it is polymers. but based on your reporting, what are leaders in georgia saying. because, from what i gather, they seem to be split on this particular issue. >> i think you're exactly right. what donald trump still has a double digit lead here in georgia on other states around the nation.

but this hits home, right. we lived through the brad raffensperger call, we lived through those efforts. we watched firsthand those efforts here in georgia to overturn the election results, the calls to governor kemp, the calls to attorney general chris car, the rest of it. and the runoff campaigns, that control the u.s. senate. so a lot of republicans, they -- but others are very very openly worried about it. they say that the party better have a backup. gop leaders, either don't want to talk about it all, or are privately very very concerned that donald trump, this is a must-win state for republicans in -- their very where the don trump's legal problems stu continue here in. georgia >> all right, greg -- catherine christian, thank you vote floater quit kicking us off today. i now want to turn to hawaii and the devastating wildfires. now the deadliest wildfires in modern american history. officials in maui county say at least 93 people have died, and an early damage assessment from lahaina report, more than 2200

buildings destroyed or damaged in that town. -- steve patterson is on maui. steve, you talked to people trying to get back into their communities. tell us, what are they saying. >> simone, as you can imagine, there's a lot of frustration. imagine having the three year home as the flames are encrypting. and you don't hear warning sirens. that is what i've heard from a lot of people, no sirens, no text messages, no notification whatsoever. now, the government says there were notifications sent out through text via radio, via different methods to get people notice. but a lot less spoke to said, they simply never heard them. and we know, according to the state, those sirens never went off. that's the first point of frustration. secondly, people are now trying to get back into their homes. yesterday, there was like a four mile line, it was on this highway, it got up to the point where we see the roadblocks behind me, and people who have been waiting for 12 to 15 hours. we are told that they have to turn around. police now diverting people

around the north side of the island, where a lot of residents felt it is a very dangerous one road a highway. and so, there's a lot of frustrations, and it's mounting with the fact that, it's mixing the fear. a lot of people left without crucial medications. i spoke to some of those folks yesterday, as they were trying to get back to their homes, where oh what's left of them, listen to this. >> the -- warning systems no radio, no updates. did they give you -- i slept in my car last night i don't want to do that again. i'm running out of medication. would you >> say that medication for people is the greatest >> huge if you can't get in they're instantly -- they're gonna die. still, 1000 people feared unaccounted for, 4500 displaced from their homes, and living really wherever they can. simone >> nbc's steve patterson. thank you very very much. we are praying for the people on the island.

overturned roe v. wade in every state where abortion or reproductive freedom amendments have been put on the ballot, americans of a voted in favor of the amendment. so, what does this mean for upcoming elections? well, i'm going to leave it to my political panel to give us some answers on that. here they, are joining me now former republican congressman carlos curbelo, he's a florida, an msnbc political analyst. the democratic status -- chuck rochelle as well. he is the co-host of the latino vote podcast. welcome to you gentlemen. okay, look, most of donald trump's base favors the reverse of roe v. wade. we'll put the numbers on the screen for some maps. some of the suburban counties in ohio that trump run in 2020, it's seen right on the map. they joined democratic areas in opposing this resolution. ohio issue one. that's represented in yellow on the 2023 map. we have seen this, you know, same pattern with referendums and kansas, and michigan.

let me tell you, there's not enough democrats in kansas to have put that initiative over the hump. when it comes time to vote for a candidate, the candidate's entire agenda, my question to you, carlos, do you think enough republicans will still break from the pack? >> simone, it's pretty clear by now, what used to be an issue where republicans felt comfortable going on offense, abortion, you remember they would go after democrats for partial birth abortion, for refusing to support minimum standards on abortion. right now, it is an issue where republicans are exclusively playing defense. there is no greater evidence of that than donald trump himself. the man who says he is responsible for overturning roe v. wade. criticizing republicans like ron desantis from going to far. in states like florida and others. to me, that's the greatest evidence that now republicans

are playing defense. they're the likely nominee in 2020. for criticizing fellow republicans from going too far when restricting abortion. >> okay, chuck rocha, what does this mean for democrats? you are an actual strategist. it means your advising campaigns right now, working in the cycles, honey. how, i'm not asking tell me about your clients, how are you advising folks to talk about abortion access in their messaging in advance of 2024? >> i think the math you put up, simone, is really something for all democrats to put in. they're 11 counties that voted for donald trump. voting is not an issue. when i'm telling my candidates, talk about freedom. america was built on freedom. we have the freedom to -- for women to make her own health decisions. that seems pretty black and white. i said, let's not get too complicated here, too cute, simone, you've been running campaigns for a while. i think the simple thing is what's best. but simple, the republicans

took about with it. >> well, they did, but, again, be a vote for the actual abortion amendment, the abortion rights and then it is november. we will write to see what the turnout looks like. carlos, you talked about republican candidate, many of them being all in on the dobbs decision. actually, i think that the republican, at least the republican party apparatus nationally has not figured out where they really want to come down on this issue. you have some candidates who have proposed like, and national abortion ban. what works in a primary does not always work in a general election. so, what would you be advising candidates? >> look, republicans had a script post roe. that was, we are going to allow each state to decide. now, of course, some senate republicans got in the way of that. remember mitch o'connell and lindsey graham going sideways. they started calling for a

15-week national abortion ban. again, the -- contradicts the republican philosophy on this issue. it is to allow each state to make its own decisions. now, having said that, simone, in some states, republicans have gone too far. you cited all the examples where conservatives states have decided to preempt republican legislatures from restricting abortion. the state of florida, i, think is an example of the state where republicans really did cross the line. just last year, florida republicans were celebrating a 15-week ban here in the state. this year, they moved it to six. they started losing a lot of those central suburban voters. we saw democrat surprisingly win elections in the jacksonville area of few months ago. so, look, this is an issue, again, republicans are almost exclusively playing defense. if they don't figure this out, prior to trying to win 24, this is something that could hurt

the republican's nominee for presidents and certainly something that could help her republican candidates trying to flip senate seats. because republicans are bullish on taking over the senate after the 2024 election. >> the senate is on the ballot, honey, i will have an interview with someone running for senate in michigan later on in the show. let's talk about the democrats, chuck raja, the vice president, vice president harris, as she, has been out on the campaign trail. the chicago senate times is reporting that the vp is holding previously unreported listening sessions with young voters. it is 18 to 29. and those listening sessions, the conversations about their most important issues. chuck, i think this is something that the president and vice president in need to be doing. if you look at some of the numbers, with young voters, i think that there is a concern about their enthusiasm for this ticket what do you say about the meeting with the vice

president. >> you can't ever start early enough trying to motivate young folks. even trying to get young folks out to vote for a long time. it's the basic fact that it's always harder to get the younger democratic to vote. there's also another thing we. know when this demographic vote, they overwhelmingly, they spend a long time trying to motivate. bernie sanders did. that they showed up and last midterm elections and record levels. let's combine the two things. this choice issue, it's what young people, guess, what they care a lot about. i like to see the vice president doing. this if you start early and often if you want to have them out to vote. >> young people are paying attention. okay, we're paying attention, we want to go on the pools. we want to be sure. okay, and the time we have left, i was on meet the press this morning. i watched choctaw do his thing. he had former vice president mike pence on. this was my favorite question that he asked my spends. he asked the former president

and vice president, he considered himself a maga republican. i want to play what he had to say. >> look, i am a christian and a republican and indeed that order. i always said. that those are my values and those are my ideals. i really believe the agenda i've always been about, i'm looking forward to taking the main stage. if that's the advantage that will bring it all the way back. >> carlos that was the second and so the former vice president pence gave. he said he is a christian conservative. a, conservative christian in that order. he seems very comfortable on the campaign trail now. he's a little over a week away. we can away a half for the first debate. what do you think about him navigating the type rope of going after trump, not criticizing the record, also being proud of what they did. it's a lot. >> simone, i watched you, this interview was particularly interesting. mike, pants look, i give him

credit on january 6th. he has been explicit. he has been consistent. he has shown a lot of integrity. on everything else as it relates to his relationship with donald trump, mike pence wants to have it both ways. he wants to be honest with voters on january six he, doesn't want to be honest with voters on how dangerous donald trump is. so, what he get asked about this maga movement, sure, he can say that he supports a lot of the policies that were passed. that he is proud of them. he should be explicit in telling the members of this movement how dangerous donald trump's. not just because of what he did on the 6th of january. because of what he would do if he would return to the white house. >> see, the political panel, former congressman carlos kubela, chuck rota, i appreciate you both, my friends. thank you, thank you, up next, folks, the latest call for president joe biden to step aside in 2024. i have thoughts.

inside the house. which, house the house of representatives, a moderate congressman from minnesota is calling from his fellow democrats to primary president biden. well representative dean phillips has a decided if he will challenge president biden in 2020, four he's encouraging others, to quote unquote jump in to the, race here is what congressman phillips told my colleague chuck todd this morning on meet the press,. >> people want to turn the page. that's fair, to say as a democrat, i adore joe biden. he saved this country. he can cement his legacy, my real called action is not about me. the call to action is about to ask the president to pass the torch. there's an extraordinary bench of people ready to go, approximate. i would like to see a moderate governor for hopefully from the heartland from one of the four states that democrats will need. this is the time to meet the moment. i'm doing something that i know is unpopular as a democrat. i'm speaking truth. that's my job in my duty. >> i met the congressman this.

morning he is a lovely man. yes, speaking truth is part of his. job it's also part of. that here's how i see it. i just don't think there is a legitimate ad for tighter and other democratic candidate. look at the polls. a recent new york times poll actually shows that president biden's reelection bid is gaining support among democrats. and this is not an active primary folks, president biden is going to be the democratic nominee for president. other democrats have declared themselves candidates in the 2024 presidential primary, i'm talking about robert f. kennedy junior and barium williamson, they trail president biden by more than 50 points in that same poll plucking a moderate governor from the heartland state to run for president might sound like a solid strategy. at this point in this particular election doing so without an exploratory committee at a national level campaign apparatus, a plan to get on the ballots in the primary states. even an appetite from the people, it's just simply

are unpacking some of these key races with our series on the ballot and today we are going to michigan. panel q is running for senate she's been elected to a statewide position on the michigan board of education. she is currently serves as the president. she will make history as the first black woman to represent michigan in the u.s. senate. can she advance in a primary against the well-known democratic commerce woman? look at rest pamela joins us to answer those questions. welcome to you. i want to start where i ended. congresswoman elissa slotkin is one of your opponents she's already made a name for herself in congress. you have been serving in a statewide elected position. what do you think matters more to michigan? gainers >> i think the people of michigan, the voters of michigan are looking for leadership. i have served here in michigan for a decade, simone.

i currently serve as you mentioned as the state board of education president. i am the only person on the ballot who has been elected, not once, but twice. statewide, i was elected in 2014. very few democrats, republicans, govern tory are a. is the a.g., race the secretary of state. i was the highest there. and then again, in 2022, over 2 million votes. i have been here in this state standing up for public education systems and standing with the people of flint during the most horrific man-made crisis that we will know in this country. so, that is what the people of michigan will be focused on. a proven leader going to washington and fighting for them. >> you have said that your campaign is going to focus on, i'm going to quote, you making sure that children have access to an education that prepares

them for the future that they deserve. if you look at the numbers. well, michigan has one of the lowest high school graduation rates in the country when you specifically tell us what your office has done to change that? how could that be applied nationally? >> we are so happy to finally have a governor and a legislature who understands and is prioritizing our children. what the other statistics that we should look at our, michigan has been at the bottom of 50 states when it comes to equitable funding for our children, when it comes to having buildings that have been invested in. we had to have seven children in 2016 who sued the state of michigan for a basic rights of literacy. they still need us, simone, in my capacity. as a michigan board of education number. i have my own attorney. i went and help them through

the state, they were right they did deserve what they were asking for. it was teachers in the classroom books in the classroom to have air in the summer and heat in the winter. and not tara classroom space with rodents or mice when you look at our statistics and our numbers, yes we have been at the bottom. it is because a policy of the past it is now just being addressed through the new administration and the priorities that we've set forth as the state board of education has finally been addressed. >> you mentioned the governor, gretchen whitmer, i want to talk about her she recently signed an executive order establishing a new education department known as my leap. the departments going to have an office in it the rate in michigan is 2.7 times higher for those with only a high school diploma you actually oppose this executive order

saying it threatens the very essence of our education system. why is that? >> the framers of our constitution separated here in michigan and that's why i had to run statewide to get on the state board of education. the frames were separated the public education set shin from the office if we look back in the past when the power has been taken from the michigan department of education, which i am responsible for placing the person in charge of that. department. when the governor has taken our, what we've seen is that the harmful impact has taken place in detroit, whether it was millions of dollars in debt, my concern is that what happens when those not a governor whitmer who's at the helm, who is in that office as governor, that is one issue just the fact that the framers of our constitution are framed --

so the two offices are separate. >> lastly i want to talk about gun violence and gun safety. this year saw a mass shooting at michigan state university. this is a concern. gun violence in many michigan city's. it's concern nationally what gun safety legislation would you support if elected to the senate. would you abolish your core about the filibuster? >> yes we need to continue to strengthen and address the public health issue that we've seen for far too long. taking assault weapons out of the hands of people who can get them. just taking those off the street. so, addressing assault weapons. also making sure that not >> we have checks and balances >> were checking who's getting guns and there's so much more we could do there we've made strides in michigan with red flag laws and some other pieces
