gives a little bit of control in the situation they otherwise could not control. she's decorate about 60 cap cast so, far they don't the cast come off, many hang on to them even after they are removed. all right, that wraps it up for me, we begin tomorrow, i'm gonna be anchoring these hours live from mississippi this hardest areas hit by the tornadoes. until then, i'll see you tomorrow. it starts right now. greetings, everyone. you're watching symone. as we wait to find out if donald trump will be indicted in the hush money case involving stormy daniels. the former president using social media to attack the man in charge of that investigation. i'm talking about alvin bragg. now, brags life has been threatened, the grand jury reconvenes on monday. what's next? i am talking to the attorney for the central witness in this case, michael cohen. plus, tiktok is on the hot seat,
1:01 pm
tiktok ceo told congress, this company is not a security threat to millions of americans or in the platform. well, congress isn't buying it. we are talking to some influencers about the potential ban. of tiktok and what that would exactly mean for them. in our celebrating her story series, we are talking to caroline o'connor, major league baseball's second highest ranking woman. i have something to say. former president donald trump has been taking hits on the legal front all week. he could be indicted in the next. yet again, there are concerns that the former president's incendiary rhetoric could be putting lives in danger. alvin bragg is investigating
1:02 pm
former president trump. regarding a hush money payment. to stormy daniels during the presidential campaign. yesterday, bragg was the target of a death threat. brad received a letter that said, alvin, i'm going to kill you. an envelope with suspicious white powder, which was determined not to be dangerous. not to mention, there has been reportedly dozens of threats of harm against brag, hundreds of threat to the district attorney's office. this all comes as the former president had been ratcheting up his rhetoric on social media. writing, quote potential, death and destruction if he's charged with a crime. then adding, any prosecutor making that decision would be a, quote, deranged psychopath. and another now deleted post, trump showing himself images of himself with a baseball bat, near bret's head. trump has also called alvin bragg an animal. house minority leader, hakeem jeffries, is sending a warning. trump's attacks on social media or reckless. take a listen.
1:03 pm
>> well, the twice impeached former president's rhetoric is reckless. reprehensible. irresponsible. it's dangerous. if he keeps it up, he's gonna get someone killed. >> everyone should be unsettled by the targeting of alvin bragg. i agree with leader jeffries. not to mention, the former president is literally calling for death and destruction. all of this as donald trump finally decided to give back on the campaign trail, holding the very first rally of his 2024 presidential campaign in waco, texas. it just a few hours. we're gonna dig into the significance of that place and that setting, and from donald trump's other mounting legal pressures in just a few moments. first, earlier today, i spoke with lanny davis, the attorney for michael cohen. cohen is a central witness to say the least, and the manhattan da of an briggs of estimation of trump's hush money payments.
1:04 pm
here's our conversation. >> the a bragg has received at least one death threat that we know of, on thursday, the former president referred to him as an animal. i don't have to tell you about what that means, alvin bragg is the first -- black district attorneys, a black touch of kearney of manhattan. the president is also sending violence if he is in fact indicted. are you concerned? >> of course. and i quote my client, michael cohen, when he began his testimony, one of the first thing he said to me when we discussed my representing him. donald trump is a liar. michael cohen did his dirty deeds, and lied for him, for ten years. and he predicted, in front of elijah cummings, that mr. trump if he's defeated for reelection, would not accept the election results. and that is a dangerous man. so what is now doing, with mr. brag, is just consistent with
1:05 pm
what we've seen. before for mr. trump. >> i think a lot of people should be vigilant about this rhetoric from the former president. let's talk about this upcoming week, on monday, the grand jury will meet again in the trump hush money case. as michael cohen been asked to testify or has he been asked to be on standby for the? >> i can answer no. certainly, publicly. on your show. the answer is, i've not heard a word. he can't testified without me. i'm in washington, i have to get on a train and get to new york. so, this is saturday afternoon, the answer is, not yet. >> not yet, we have a day. what do you know about the timeline going forward? if anything? >> i don't know a thing. i do know that michael has spent at least five sessions with very meticulous and very professional prosecutors, working for mr. brig. michael and i have only the
1:06 pm
greatest respect for the detail, documentation, in many ways, do i deny the word documentation? that if this case goes forward, and that still it, this case is about documents, and indisputable facts. anyone who thinks it's a weak case, doesn't know what i know. >> so, mr. davies, i think that it is a fact that michael cohen has done a lot of television. we've invited him here on this program, we hope to see him very soon. for a lot of folks, his appearances have generated concern. that he could jeopardize the case. first, do you agree with that assertion? secondly, how are you navigating that? >> so, i don't agree even slightly, this case is about facts. i start by saying, don't worry about michael cohen a. he's proven that since july 2nd, 2018. when he broke with mr. trump, in what he said, were ten years
1:07 pm
of doing his lies and dirty deeds, that's the way he lived for ten years. on july 2nd, 2018, he came out publicly and spoke truth to power. since then, he's been truthful. let me also remind you, donald trump's prosecutors, in the southern district of new york, on december 7th, 2018, published a memo to report, which they said, michael cohen admitted, meaning they have the evidence and he agreed, that donald trump, president of the united states, then, so they couldn't item, but before he was president, instructed michael cohen to pay the hush money. >> and that memo, they referred to him as the former president as an individual one in the memo. so, i have asked legal experts, journalists who have been covering this case for a while. particularly about that memo, i've also asked about the
1:08 pm
juxtaposition between, i know your members of the case against senator edwards, where he paid he had supporters say 1 million dollars to someone. and keep their fair quiet. so that edwards was indicted, but a hung jury, and the department of justice eventually declined to drop the case. so, i have thought that there were very strong similarities, i think the point you're making about the memo, is a good one. this isn't a department of justice decided not to pursue former president trump under that particular case. do you have concerns, or do you agree with? i know already said this isn't a weak case, there are people that say, the department of justice wouldn't even take this up. now, after all this time, alvin bragg is taking it up. what say you? >> simone, first of all, on the strength or weakness of the case, and comparing it to the edwards case, that's what juries are for. is there a case that can go to a jury as to whether or not
1:09 pm
there was any, any 1% political motivation when donald trump instructed michael cohen, out of his own equity line of credit, to pay $130,000? did trump have any political motivation, as the prosecutor say, that trump directed and that was the admission they got, michael cohen to admit to from the evidence directed cohen to make the payment. so, to your question, was there any political motivation by mr. trump to try to prevent the stormy daniels alleged affair, he denies, it to have any political motivation? that's a jury question. the edwards jury found, in a hung jury vote, we don't know how or why, that they were unable to reach a unanimous decision on that. and mr. edwards did have a dying wife of cancer, so, we don't know what happened in the jury room. my point to your viewers, simone, that's a jury question. the due process system gives
1:10 pm
mr. trump the presumption of guilt, there is a trial, he gets a chance to put his evidence on. and then it goes to the jury, whether he had any political motivation waiting to right before the election, now, watching stormy daniels to go public. that will wait to see what a jury says. so, we can't know the answer, we will believe him in the jury system. >> michael cohen, former legal adviser robert costello, he said -- the grand jury at the request of donald trump's team this past week. he has said that your client is on a revenge tour. is mr. cohen seeking revenge here? given what you just said, i'm interested, what if the manhattan da decides not to indict mr. trump? then what? -- >> we will respect what the case is about, with the facts are about. let's just talk about mr. costello. i can't comment to you on what happened in that grand jury room, when he testified. i can only say we came and
1:11 pm
waited for two hours, and case michael cohen was needed to contradict mr. costello. and we were told, he was not needed. secondly, in today's daily beast, mr. costello's emails speak for themselves. one email says, in an email to his partner, we need to keep up the appearance that we're trying to help mr. cohen. when mr. giuliani and the president don't want us to let on that what we really know is to keep him in the tenth. so, mr. costello is simply doing what trump always does, to deflect from the merits of the case, did trump commit a crime by instructing michael cohen to commit -- to pay the hush money. and then he wrote checks as a sitting president, for $35,000 a month, for 11 months, did he commit a crime? that's up to a jury to decide. and for mr. brag to decide, to bring an indictment. that's up to them. >> we will be waiting with bated breath, if there's
1:12 pm
anything comes out of the grand jury on monday. lanny davis, thank you very much for your time, i appreciate it. >> thanks for having me. >> coming up on simone, at least 24 people are dead in mississippi and alabama, after a tornado ripped through the area. we're gonna get an update on the ground in just a few minutes. first, with potential charges coming, donald trump is ramping up the threatening language, paul butler is here to break down whether that could make matters worse for him. legally. that's next, folks. our dell technologies advisors can provide you with the tools and expertise you need to bring out the innovator in you. get help reaching your goals with j.p. morgan wealth plan, a new tool in the chase mobile® app. use it to set and track your goals, big and small... and see how changes you make today... could help put them within reach. from your first big move to retiring poolside

1:16 pm
as he faces a legal setback this week with the former president lashing out on social media. last weekend, trump made the baseless and inaccurate claim that he had effectively arrested tuesday, in connection to an investigation into a hush money scheme involving stormy daniels. it didn't happen. the new york rangers expected to reconvene on monday. meanwhile, in the investigation into trump's alleged efforts to overturn the 2020 election, a judge has rejected claims of privilege, rejecting that some of trump's top aides, including his former chief of staff, mark meadows, must testify before a grand jury. then he added trump's lawyers, evan cochrane, testify in washington d.c. friday for more than three and a half hours before a grand jury investigating president trump's handling of sensitive and classified government documents
1:17 pm
found at mar-a-lago. cochrane was forced to testify after the judge ruled there was sufficient evidence that he committed a crime, through his attorney to that case. this is a lot, y'all. joining me now, paul butler. he's a former federal prosecutor and an msnbc legal analyst. paul, this many places i could go, i want to start with alvin bragg. he is the first black da that manhattan has ever had. he's the first black da, he is the former president of the nsa to america calling him an animal. >> you know, people ask in all of these different prosecutions of trump and investigations that prosecutors coordinating. they're not coordinating, they're certainly paying attention. and i think when jack smith, the special counsel, hears president trump talking like this, and trying to foment the same kind of violence in new york that he tried to incite on january 6th and washington d.c.,
1:18 pm
jack smith is paying attention. he's got this question about whether and what to prosecute trump for. if it seems like trump hasn't learned anything from the impeachment from all the fallout, that he still trying to go after folks and incite violence, i think that that matters to jack smith as much as it matters to alvin bragg. >> really, okay. you have president trump, not only attacking the manhattan da alvin bragg, he's also on social media calling for, quote, death and destruction. which is must stronger language than he's ever used prior to january six. i hear you say the jet -- other any other legal repercussions for that rhetoric? could a judge issue a gag order against former president trump? >> joe, if there is in fact an indictment in manhattan, this case will go to a trial judge, and then there will be more orders including a judge, very
1:19 pm
quickly shutting down donald trump, if he tries to make any kinds of threats against the prosecutors. again, and some kind of organized crime cases and gang cases, cases with ordinary regular thugs if you will, it's not uncommon for defendants to make those kinds of rules, and judges don't like that at all. so, once this case, if it comes before the purview of a trial judge, then i would expect that this conduct from trump to be immediately -- >> what about the overall threats of the manhattan da's office, specifically dalvin brig, there's also reportedly hundreds of threats that have been lobbed at the office at large. how could this affect how the lawyers, the attorneys, in that building are going about their work? especially this particular week. >> you know, i was a prosecutor, you know that there are a lot of people who you are investigating, who are going to be happy with you. usually, nothing happens.
1:20 pm
often, if they get mad that defenders get mad, they tend to get angry or a third of defensive attorneys they do it prosecutors. in fact, it's a violation of new york law to threaten a prosecutor. i think, right now, there's credible evidence that president former president trump has threatened alvin bragg. >> not to mention the president said that letter with the envelope, i hope -- i guess they put their name on, they might be a little trouble. >> well, the fbi should be able to find out who did it, it still remains the world's best law enforcement agency, with trump, it's always an issue of discretion. all of the stuff out there now, is there a prosecutor who's going to focus on these threats of violence from trump's allies? >> we have to wait and see, important question. i want to turn to some other trump investigations, i talked about the judge that ruled that trump officials, including mark meadows, former chief of staff have to testify. before the january 6th grandeur. how significant is this? >> it's huge. you >> got the evan corcoran news as well.
1:21 pm
>> first, mark meadows lost his executive privilege claim, trump can still appeal. we know, the supreme court and court of appeals, are on to trump's game of using the legal system to try to delay. ultimately, i think that mark meadows is going to have to testify. simone, what this is mainly about, i think is that 170 minutes on january 6th, where we don't know what trump was doing, we know he was lethally watching the insurrection. we know he didn't pick up the phone to call the attorney general or the secretary. or the secretary of homeland security. we know that there's no entries in the white house diary, we know that the call log is blank, although rudy giuliani's call logs said he talk to trump that day. they want to know, that jury want to know what mark meadows knows? >> yeah. was trump in touch, we know that there is this war room in the pentagon. was trump in touch with that war room?
1:22 pm
again, mark meadows will now have to spill it to the grand jury. >> you raise a lot of good questions. paula, i know you're good for prosecutor, paul butler, thanks to being with us. >> always a pleasure. >> now, i want to turn to some breaking news, latest gentlemen. there's been a way very powerful tornadoes, they've just torn through the south overnight. leaving at least 24 people dead, and mississippi and alabama. officials also say, dozens more were injured. those numbers only expected to rise, as rescue teams comb through the wreckage, searching for survivors. right now, four people are still missing. ever see news correspondent, priscilla thompson, is in silver city with the latest. >> so bone, there's so much devastation here after those tornadoes touched down overnight. i want to give you a look at what we're seeing in silver city, this was a home that was back there, this is what is left of that. you can see the clothes and the items strewn everywhere. there's also a car you'll be
1:23 pm
able to see back there with the windows completely thrown out. these are the types of scenes that people are coming back to. the roofs completely ripped off of houses, entire bedrooms gone. and we're seeing a similar scene, just up the road in rolling fork, which really bore the brunt of a lot of this damage for homes, again, completely removed from their foundations. 18 wheeler that have been picked up and moved, i talked to many people who were here. when this happened. they described sheltering in bathrooms and closets, and just hoping that this would end. this is what they came out to sea, and now, they're dealing with what happens next in terms of rebuilding their lives. fema is on the ground here, so, there will be some support that way. but a long road to recovery here for these folks. simone? >> thank you so much, priscilla, for that report. congress grilled the ceo of social media giant, tiktok, this week about the threats

1:31 pm
lawmakers need to do rather than singling out one platform. >> i mean it's so interesting because i was watching the hearing. what some of the lawmakers were describing, is exactly comparable to conduct that facebook exhibits, that we know of? the only difference there is the lack of the potential for the chinese government to take a peek at the data. i want to talk about just an impact that a band if you, will not to mention what band would work. what a ban would have on creators, some of the folks who oppose the ban have rightfully pointed out that tiktok gives a voice to its content creators, especially content creators of color. can you just talk about the impact that a ban would have on folks like you and so many other creators on the platform? >> i am so thankful to be able to have this platform. there is not anything i intentionally, my students on tiktok and within a day, i had

1:40 pm
rally in waco, the use of the language death and destruction, a posing with the bat. all of these things are leading to what could happen in violence that could ensue because of the rhetoric that the president is engaged in. let's be clear, the president knows, the former president, knows exactly what he's doing. and what he's saying. it's not an accident. so, i think we should all take this as very seriously, the fact that he's holding this rally in waco, for all of the reasons that you cited in your opening, should give us all pause about the president his actions and the potential consequences. >> you know, it's not just the former president, house republicans they are now investigating alvin bragg. only after donald trump said last weekend, he was anticipating the being arrested. so, house republican they sent a letter, they demanded

testimony. and document about brags investigation. brags spokesperson britain called it unprecedented. it said that congress is not the appropriate branch to rebuke sending criminal matters. brandon, is it the foal for the correctional committee amplifying the target that is already on alvin bragg's back? >> yeah, the house committee has already been acting as an arm of the trump camp. they do whatever he says, you wouldn't be investigating hunter biden if it wasn't on the behalf of donald trump. look, on one hand, republicans are smart to focus on the manhattan case. compared to other ones. i think a lot of people will acknowledge, the case in new york's of all the things donald trump is being investigated for, the weakest ground. i think you get a picture enemies, this is a good one to pick. that said, there isn't -- going too far overreaching. that's where republicans have been very good at.
1:42 pm
