have actually been filed against donald trump. that said, they were major developments this week in district attorney alvin bragg's investigatio into trump's role in the 201 hush money payment made to adult film star, storm daniels. on, wednesday daniels herself met with prosecutors from the manhattan da's office the same today that former trump attorney michael cohen finished testifying in front o the grand jury hearing that' being hearing evidence in that case. here's cohen, a shor time ago speaking with m colleague, al sharpton >> he's trying to threaten the american judicial system tha not just alvin bragg, but fani willis in georgia, washington, any court that thinks that the are going to bring donald trum in, i'm going to call fo protests this is who he is. this is an autocratic want t be this is a guy that doesn't wan to be president of the unite states, he wants to be our our

second part first. he doesn't want to get ahead o the narrative because he doesn't want to be hel accountable. this is a guy who, throughou his entire life, has managed t slip and slither and push an cajole and yell and scream his way out of accountability. and now, when th accountability is moving close and closer and closer to mar-a-lago, he's doing the sam thing using every opportunit he can i actually think it's less about raising money and more about what happened in advance of january six he's trying -- and you already see it through some republican mouthpieces, who are saying, why are we doing this if this could cause a problem? as if we should hold off o justice because donald trump i going to push and pull peopl to do things they shouldn't do in the course of this. and i think he knows that. i think he knows that. the sad thing about all this though, ayman, is that he woul actually benefit in th republican primary from an indictment >> yeah, we are going to tal about the political fallout of this in just a moment. but suzanne, let me get your

thoughts on all this alvin bragg, as expected, is not commenting on trump's post do you have any sense of the chatter behind the scene through your reporting >> well, one thing that' interesting -- it was in the new york times today, this afternoon -- is that there still a witnes to come before the grand jur on monday. i think this is a flui situation. it does not mean that it won't happen tuesday i think of the grand jury come to a decision on monday that there should be an indictmen they can move quickly, and d it tuesday but potentially, we don't know how they are going to handle the actual arrest of donal trump, and if he does come i he's going to need some notice come in from florida and they're going to have to coordinate with his lawyers. that's done in all sorts o cases. if the person needs to b physically on the scene, the may do it differently becaus of the extraordinary nature of this but we are still looking at witness that's going to be coming forward on monday we don't know who it is. it could be a summation witnes

from the da's office it could be yet another person like stormy daniels could be coming in. but it could take a little bit longer we just don't know and i have a feeling donal trump -- you know, somebody may hav called one of his lawyers an told him he might have to be here on tuesday. that could be where this started. or he could have just wanted t throw it out there on saturday, to see what happened we just don't know >> danny cevallos, walk us through what would happen, i he is indicted next week what would we expect procedurally >> procedurally, what normally happens in manhattan is yo report to the pre-six, there's a process there. then you go to central booking your process there, and then you have to wait around unti your first court appearance. that's not what is going t happen to trump. there's no way they are too many problems i secret service, and the fact that he has to be protected at all times. you are not going to stick him with a bunch of people, even i it's only for a couple hours this is going to be negotiated he will be treated differently because he is a former president. and there are security

concerns but otherwise, once he i processed this case will proceed at the same glacia pace as criminal cases do in your county and have for man years, unless he gets specia treatment, in which case i moves up and that's what we need to watch for. because the big question becomes, when do the major advance happen, trial or otherwise, relative to the election that's the key question. and then we need to grappl with the - year issue, that the framers never thought of, which is what do you do we know we can't prosecute a sitting president. what if you prosecute a sittin president candidate and that candidate becomes the president? the whole idea of unmuted even a president is if the presiden is the one person in governmen that if you arrest him you literally arrest an entire branch you can arrest a supreme court justice, you can arrest congressman, life goes on. but the president you arrest - he sits in the cell and yo arrest the entire executiv branch so, it's an interestin constitutional issue coming up >> i was going to say, legally speaking, we probably don' have an answer to some of thes questions. could the timelin of the trial the advanced so

that it concludes before a potential election day? is tha something that people have eve talked about or discussed or considered >> yes, judges hav considerable discretion. but it might just be a trial calendar issue i'm grappling with this as well judges are still grappling wit covid delays because every trial you dela just gets backed up in the pipeline can you prioritize a trial absolutely there are mechanisms for that. judges have a lot of discretion so, i imagine that's what woul happen here. they would move it up to faster but what if trump wants to delay? what if trump wants to pus this into the next election an use it politically believe me, one way or another he's going to use this >> great point there david, there is no evidenc that trump will be indicted or arrested but his comments, as w mentioned, they are newsworthy how should the media b covering this without playin into his effort to control the narrative? i have to say, this morning, h probably posted that on trut social not a lot of followers - it's certainly not the million he once commanded on faceboo

and twitter and instagram. but certainly, because it is him making that statement, the media when ran with that and now it is all around the world >> yeah, i think you need to report it within the context this tweet - well, it's not a tweet - this post did not come in vacuum a couple of months ago h posted that he wanted to pardo all january 6th arrestees. and just a couple of days ag he basically said they did nothing wrong. those posts indicate that this is a man who is not opposed to political violence he wants to even reward an protect the people who came ou and committed violence and - cops for him back on january 6th. so, when he puts out a pos today in advance of a possible indictment and suggests it's time to come out and hit the streets and protest, it's not, please do this responsibly he has already indicated tha

he wants - that he's in favor of politica violence that helps him. i think that this should b seen as another example of his authoritarian impulses and his willingness to go outside th law to prevent accountability. so, we tend to get very worked up, often, as we should, all over an individual outrage from trump but we need to look at the whole trend and the whol continuation of what he's been doing for a couple of year now. and that's why i think thi post is very troubling i don't think it will lead t the violence of january 6th. because he has not organized anything that happened o january 6th. but it's still out there giving a signal to proud boy and others, i want you in th streets defending me. becaus this is illegitimate >> matthew, to david's point

trump playing -- called on his supporters t protest echoing the language h used on the run up to januar 6th. which was organized. even marjorie taylor green said republicans shouldn't protest. what are your thoughts on this >> on whether or not the should protest i mean, i hope - i would hope that republican are responsible and if a president, even their presiden is indicted, they allow th system to go in place like it' supposed to in america i think we are in the situatio where we have allowe presidents for the last 50 years to have no accountability and i think it started wit gerald ford's pardon of richar nixon, which opened the door t other people saying they're no going to be held accountable this idea that a sitting president can't be indicte isn't in the constitution. it's a rule that was done by a series of attorneys general. i think that opened the door and if this -- we get to the point wher anybody is allowed to be pushe back because of donald trump's threats, we are again, one ste closer to the idea that we don't have a presidenc

anymore. we have an autocracy and i think that's what we hav to keep our eyes focused on. >> susanne craig, stormy daniels spoke with new yor prosecutors a few days ago if he testifies to the grand jury, what could she add t this case at this point? >> well, it's a good question. i think the grand jury has now been looking at evidence for months now they have been hearing various witnesses that have come in. and all of it goes to is - what sort of evidence is out there that's not hearsay that' not conversation with somebody and they have been looking a phone records. they have been looking at bank accounts and stormy daniels may not eve be called in if she did, she would have likely been mainly conversations that she's had with michael cohen, with michael cohen's -- his other lawyers that hav been involved. i'm not sure that she would be the one to come in i think she can add a lot to the trial. i think they called he initially just see what sh would say.

felony crime is election law violation, i i think the payof to stormy daniels -- again, i'm a defense attorney, so take this with a grain of salt, i may have some bias but i think the theory o liability, here on election la violation, is a strange as i was six years ago, and if this that by michael cohen paying off stormy daniels, that silence that they got was benefit to the campaign that was not reported it's not the typical electio law violation which, for example, in the case of john edwards -- just to give you an example, h wasn't convicted - is, hey, he took a bunch o money, actual money, cash, whatever it was -- >> - material benefit - >> yeah, the material benefi is money it's very obvious. and this case, stephanie clifford, stormy daniels didn't give the campaign cash, she gave them her silence. >> that wouldn't have helped them, we did not couldn't you make that argument? >> yeah, if you make tha argument, and everything tha helps you is a contribution to the campaign that must b reported favorable news coverage, those kinds of things. i know a lot of people are a

their outing, saying, it's not the same thing but the key is, can the defens attorneys make it seem like th same thing to one juror? so, we may disagree. but if reasonable mind disagree, that sounds like a lot like reasonable doubt. and that's a problem for the prosecutors. so, the worst-case scenario fo alvin bragg is this. he charges the felony. it gets thrown out somehow by motion and alvin bragg is left to prosecuting donald trump for a misdemeanor. a misdemeanor case in newark county - i think that would be a real political problem for alvi bragg and a political boon for trump. >> david, do you want to respond to what danny said he's giving us the legal expertise here do you have a different take o why alvin bragg should pursu this case if in fact he' potentially indicting donald trump? >> i think right now it seem pretty clear that alvin brag has gotten so far down thi road that it's almos inconceivable that there is no an indictment at the end o this i mean, after asking trump t come in and testify, all the time he spent with michael

cohen, over 20 visits -- it really seems like the believe there is a case. i guess the argument - i'm not a lawyer, i'm not goin to play one on tv. i'm not up against danny but the issue is that this is campaign action that michael cohen was helping the trum campaign as part of this campaign, by spending this money, that would be an in kin donation of some sort. that's why this violates new york city campaign law so, everything with trump' unprecedented. this is sordid if we just sit back for moment - we have the former president o the united states who is now the leading candidate, one o the two major parties of presidential nomination in 202 -- he may be facing indictmen because he had his fixer pay $130,000 to an adult film star that's kind of amazing this is not what the founders, or any members of congress who

wrote the campaign finance law had in mind. it's totally beyond what w even envisioned in the days of watergate. so, i think that if it is novel, that will make it harder for any prosecutor to do something new and different. but i'd be surprised if at thi point alvin bragg doesn't feel confident enough to proceed. >> let me pick up on that poin for, you susanne, that david talked about, alvin bragg bein so far down this road -- michael cohen spent hour speaking to the manhattan gran jury this week after trump turned down his ow invitation to testify -- does that signal anything to you about the prosecutor progress here? >> i think david really hit it out of the park in terms o where this is at this is very far down the road one question, though - and i don't know the answer. i wondered it. they were far down the roa another case, that seemed very

strong and that was the valuation case this happens where donald trum will have a property and if he needs a bank loan, h will come in and inflate it in order to get the loan and he's dealing with the irs he suppresses the value of things they have a lot of information about that, about false record that were submitted to banks that case has been picked up b the attorney general in ne york and has is being brough as a civil case, it's going to trial in the fall. and alvin bragg is looking a that and he was fairly advanced o it he still may move forward with that case. but why the stormy daniels cas picked up steam and they wen ahead with that first is just fascinating question i think we may know more about it if there is an indictment and we can read the charges an read some of the evidence that they have, they may have picke up additional evidence in th last few months that we don' know about but that is just one questio

and it's unprecedented we use that word quite a lot with donald trump, carol and i wonder your thoughts o what might happen here - emily kohrs said that th special grand jury recommended indicting over a dozen people, which might include donald trump. walk us through what that woul mean, carol lam. if trump were indicted potentially, in two differen jurisdictions at once in thi country -- >> right so, you are talking about th georgia jurisdiction and the manhattan jurisdiction these are both state prosecutions the grand jury construct i georgia is a little unusual. they have a special grand jury which is a grand jury that has heard all of this evidence and it has allowed them to focus on just this case for as long as they need to focus o it but they don't have the powe to indict. and now the evidence is turned over to a regular criminal grand jury which, i think, i not an ideal situation because this second grand jury presumably, will not be hearin the testimony from the

witnesses directly, but will in fact, be reviewin transcripts and such so, it's an odd construct. it's a construct that came about partly through the legislature and partly through case law so, it's not necessarily the construct that the legislature envisioned but that's what they have. so, if there is an indictment, if that indictment include donald trump, and if the manhattan da indites donal trump -- which, donald trump said, is going to happen on tuesday - he will have the unusual situation of facing tw prosecutions at the same tim in different states. and it's important for folks t realize that states are thei own sovereign. this is not run by the department of justice in washington they are their own sovereign with their own state laws, their own rules. and even if he becomes the president again, he will not have the power over thos prosecutions that he does, a least nominally, over th department of justice. so, it is a lot to handle as
