noon. >> good afternoon. i'm gasia mikaelian i'm andre senior. >> thank you for joining us. we begin this noon with breaking news after a mysterious smell at a san jose sunrise middle school, sending two students to a hospital, a half a dozen others being evacuated. now, the campus located on east julian street. and that is where we find ktvu. south bay reporter jesse gary with much more on this story. jesse andre garcia, good afternoon to you. >> the large fire and ems presence that had been outside this school for most of the morning has left, as you said, two students are hospitalized here in the south bay. six others being evacuated. let's go ahead and take a look at our video. the san jose fire department says this began around 9:00 this morning. teachers here at sunrise middle school, which is a charter school in the roosevelt park section of san jose. those teachers called 911, saying at least eight students were sickened by something in the air in a classroom in the rear of the complex. fire responded with a full first alarm. 25 firefighters, three ambulances

and a hazmat unit. investigators say the origin area has been isolated and the students treated for symptoms ranging from shortness of breath to nausea. the hazmat unit performed tests on the air and the affected classroom and found elevated levels of carbon dioxide, or co2. >> there are several things that are fairly common in institutional settings. for example, cleaning materials, which are used to clean institutions on a regular cycle is something we commonly look for, in this particular instance, there was also a experiment that was either scheduled for today or yesterday that had to do with vinegar and baking soda, one of those volcano projects. so we're also determining if any of that material leaked out. and contributed to an odor that may have made the students feel ill. >> the source of the co2, which is not flammable, is being investigated, fire officials say symptoms for the six students were not hospitalized have eased . the school remains open at this hour and we're going to update this story for you later this afternoon. try and give you

more information about what caused these elevated levels of co2 and the impact, if any, it had on the students beyond just making them sick. we're live in the roosevelt park section of san jose this afternoon. jesse gary, ktvu, fox two news. we'll head back to you, andre. >> scary situation for those students. and parents to jesse. thank you. >> now to the east bay, where berkeley school superintendent addressed allegations of campus anti-semitism on capitol hill. she's one of three school leaders testifying in front of a house committee. ktvu james torres shows us her exchange with lawmakers and what she says the district is doing to handle anti-semitism. >> so you find teachers that are bigots, and instead of fighting them, you transfer to another school where they can still remain bigots. is that the way this works? >> republican lawmakers on the u.s. house committee of education and the workforce grilled three school leaders from different districts in the country, each accused of mishandling reports of anti-semitism. that includes berkeley's unified school district superintendent. >> if we have a concern or a complaint about anti-semitism or

any form of hate, we take it very seriously. we investigate and we take action pending the outcome of that investigation. okay. >> all right. so i guess the action is not firing. i was just moving to someplace. the word of action is very subjective. >> superintendent and nikki ford, morthal sat for 2.5 hours in front of the committee, answering questions on how she is addressing jewish hate within the school district. this week, the u.s. department of education's office for civil rights launched an investigation into the district that's in addition to federal complaints filed by the brandeis center and the anti-defamation league. the chairman of the brandeis center is kenneth marcus, who headed the office of civil rights in the trump administration. house republican kevin kiley of california read off part of that complaint. >> incidents include students repeatedly hearing anti-semitic comments in classrooms and hallways, such as kill the jews, non-jewish students asking jewish students what their number is referring to. numbers tattooed on jews during the holocaust, and jewish students being derided for their physical

appearance and demonized as evil. >> without going into too much detail, martel says a total of nine anti-semitic incidents were reported and investigated. lawmakers pressed her on if that meant any firings. >> i'm not asking you to give us names or anything, but can you just tell us in general, has anyone been terminated? >> in general, i can say to you that i can't speak about personnel matters, but i can tell you that we do follow up and we take action. >> i'm pretty sure your colleague, doctor, mr. banks, gave us an answer so you can. and i respect and appreciate that. >> but i'm not going to be able to do that. i can let you know that again, when any issue comes up, we investigate it. and pending the outcome of that investigation, we do take action and those actions range. >> leah simon weisberg is the parent of a berkeley high school student. she defended the superintendent, saying the anti-semitism problem isn't a problem. >> i just think it's not true. and i think it's taken out of i think it's an exaggeration, and i think that the folks who are behind the organizations that have filed these complaints, you know, are not civil rights organizations. >> superintendent martel also heard from east bay congressman mark desaulnier and used an

everything to reasonably stop a complaint from coming. >> and you believe that the process will show that we believe the process will show that. >> martel says she is cooperating with the office of civil rights investigation parents this afternoon are planning a rally to support her testimony. reporting in berkeley. i'm james torres, ktvu, fox two news. >> the biden administration is set to deliver a first of its kind formal verdict this week on whether israel's airstrikes on gaza and restrictions on delivery of aid have violated international and us laws. this comes as the us pauses a shipment to israel of thousands of powerful bombs over concerns how they could be used in a dense urban setting. the israeli military says its troops are in the rafah area, even as cease fire negotiations continue. jeff paul has the latest developments now. >> the israeli military releasing footage wednesday showing what it says are troops in eastern rafah. un officials

say military operations in rafah will impact the aid operation that is keeping the population across the gaza strip alive. one of the main hospitals in rafah now abandoned medical supplies scattered everywhere, wards are empty after israeli troops seized control of the rafah border crossing. the idf says it's now reopened the kerem shalom crossing in gaza, but a united nations agency says no aid has entered and furthermore, there is no one there to receive it. on the palestinian side, the us has urged israel to have a credible plan to evacuate civilians before conducting a major military operation in rafah. amid these discussions, the biden administration paused a shipment of bombs to israel last week. israeli military officials are downplaying the delay. >> when there are disputes and there are they are being resolved behind closed doors. we are responsible for the security interests of israel and we are

attentive to the interests of the united states. >> displaced palestinian families are gathering by the waterfront in the central gaza strip. they've been asked to move, but don't know where to go. >> every time you're in a new area, you do not know where there is water and where there are services. >> israel maintains that the last hamas stronghold is rafah in tel aviv, israel. jeff paul, ktvu, fox two news the house oversight committee has canceled a hearing with the washington, dc, mayor over a university encampment shortly after 33 protesters were arrested. >> police have been clearing a pro-palestine tent encampment at george washington university since dozens of protesters left the site and marched to president ellen greenberg's home. mayor muriel bowser and mpd chief pamela smith were preparing to testify about the district of columbia's handling of the protest. >> stanford university is reminding students the encampment at white plaza violates university policies. officials say it goes against a policy on overnight camping and

rules on equitable use of the plaza. the university says disciplinary cases are proceeding and more names of students are being submitted. some may have their diplomas held while their cases are processed. stanford is also warning encampment members they could be suspended. >> san francisco school board members called a special meeting to hear the results of a state audit on its budget crisis. it came just days after sfusd learned the california election officials are education officials will now have to veto. will now have veto power over some of the district's financial decisions. ktvu ali ramos joins us live to explain the district's budget problems and what it will have to do to fix them. ali. >> school board members and state education officials agree a hiring freeze, the layoff of about 300 employees this month and school closures will likely all need to be part of the solution is a wake up call. >> we now have been given roadmaps we've been given deadlines. >> san francisco school board members accepted the reality presented by state auditors sf ucsd's financial problems

threatened to plunge it into insolvency. >> i cannot emphasize this enough. your solutions are yours. the state is not going to be bailing you out of anything. >> state auditors said the district needs to work more closely with other school districts, clearly state what it plans to cut in the future, and rely less on consultants. auditors and community members decried the fact that the district had no full time business officer for several years. >> the district doesn't have to heed the advice of a consultant like they would have to of a cfo, right? so that's just like the basics that we see. like you run a business, you run a school district. >> there are state mandated changes coming to sfusd. state officialsent letter to the district on friday letting it know that it's assigning some fiscal advisors to the district. those advisors will have approval and veto power over the district's budget decisions for the next two years. >> we're worried about school closures also, i think there's, you know, even it seems even more imminent, given that the state is now stepping in or will be a list of schools at some

east bay mud tells us that 12 inch cast iron water main ruptured early this morning in the area of south 45th and carlson streets, right near kennedy high school. crews had to shut down the main and repair the damage. several neighboring homes didn't have water service while those repairs were made. >> the remains of a six and final victim in the baltimore bridge collapse has been recovered. now, salvage teams located the remains of 37 year old jose minor lopez yesterday, he was one of the construction workers on that bridge when a container ship hit it six weeks ago. that ship somehow lost power, making it impossible to steer. this week, engineers will

remove a large, heavy piece of the bridge that's sitting on the bow of the ship. they're trying to clear the shipping channel. the goal is to restore full access by the end of this month. severe storms are battering parts of the midwest with heavy rain, gusty winds, and tornadoes. tornadoes were spotted late tuesday in southwestern michigan, northern indiana and northwestern ohio. severe damage was reported near kalamazoo and shredded a fedex facility. officials say no serious injuries were immediately reported. officials have closed schools in one west virginia county because of overnight weather issues. earlier in the week, a twister ripped through an oklahoma town and killed at least one person, tiktok's, fighting back against a possible nationwide ban. >> the social media app and its chinese parent company have filed a lawsuit against the united states. their suit challenges a new law that could ban the app in america if it's not sold to a new buyer within nine months. tiktok officials argue the law is an unconscious national attack on free speech. some lawmakers say tiktok poses a national security risk. they're trying to make it about

free speech. this bill was focused on national security that tiktok is a destructive tool, pointed at the united states of america, and especially our children and our constitution. right to own property. >> when it is against the national security. >> tiktok's parent company says it currently has no plans to sell. if tiktok loses the lawsuit and refuses to find a new owner, it could disappear from american app stores. the boy scouts of america is about to undergo a major change, the youth group announced. starting in 2025, the organization will be known as scouting america. this marks the first time in its 114 year history the group will undergo a name change. the organization's ceo says the move is part of its efforts to be more inclusive. >> i think it sends this really strong message to everyone in america that they can come to this program, they can bring their authentic self. >> the ceo also says this means everyone, regardless of their gender identity, is welcome. membership is currently at a

historic low. the organization trying to bounce back from a sex abuse lawsuit that ended in a $2.4 billion settlement. >> well, today was weather, education day at the oakland coliseum. the a's and ktvu teaming up once again for the special event that brings out elementary and middle school science lovers. they gathered for a pregame event where they got the chance to learn from some of our ktvu meteorologists about the world of weather and science. ktvu rosemary ruscoe, bill martin, roberto gonzalez, and mark tamayo were all in attendance at this very special event. and here now in studio back from that event is mark tamayo. mark, i know you do this every year here. it's fun to have those kids come out and you show them a little bit about what you do. >> yeah. and as we kind of prepare the demonstrations, we actually kind of learn a bit ourselves. right so a little reminder. yeah. so it was a fun event. we talked about how fog forms the wind air density. and also it's really cool we didn't show in the video. probably the highlight was a big weather balloon. we launched it and it

actually we were measuring weather data from the coliseum, and it tracked all the way toward the santa cruz mountains. so very cool. yeah, it was a fun day. great weather today as well with some sunshine. and we'll talk about the nice conditions for today as well. so as far as the winds though, pretty strong in a few spots, especially for the higher elevations. no, the wind advisory in fact for the north bay has expired, but it's still in place out towards solano county. take a look at these winds. the gusts from earlier today. you can see mount diablo 61 miles an hour. oakland hills at about 40 miles an hour, and napa at about 33 miles an hour. all these areas in blue. you can see a wind advisory. so this does include places like fairfield out toward vallejo and vacaville this afternoon. that's in place until 8:00 thursday morning. here's the overall weather trend, though with temperatures. as you can see, we were just a few days ago. last weekend we had that cold pattern setting up. we have been recovering nicely today. the warmest locations back up into the 80s, and eventually we're thinking a few spots approaching the 90 degree mark, getting pretty close over the next couple of days. here's a

satellite where you can pick out that northerly wind. you can see. in fact, you know, it's interesting. we were at the coliseum, the weather balloon launched right about here. it was approaching monterey bay due to that northerly wind pushing the balloon from north to south. so lots of clear skies this afternoon. no fog to speak of. it is a dry weather pattern, and we're going to hold on to this pattern over the next at least couple of days. current numbers out there san francisco 72 degrees. half moon bay though, kind of on the cooler side. 59, san jose 74, and concord 75 degrees. as we check out the wind reports. right now there's vacaville. they have the wind advisory still gusting to 43 miles an hour. other areas we still have some breezy conditions out toward napa, santa rosa, concord, winds gusting to 22 miles an hour and out toward sfo. the winds not as strong here at about 12. there's half moon bay at 15 and san jose winds gusting over 20 miles an hour. here is our live camera looking above san francisco, out toward the golden gate bridge, and no fog to speak of. so we are completely in the clear across the region. here's what's

happening, though. you can see that area of high pressure offshore, that area of low pressure to our east, the pressure difference setting up that wind event for today, the wind out of the north, this area of high pressure wants to stick around. and as a result we will have more sunshine, 80s and 90s inland. we could be tracking some more fog though, as we head toward friday, and possibly probably a better chance as we move into the weekend. here we are for your thursday. we will have lots of sunshine out there and then into friday we'll see a little bit more of an onshore breeze. so with that, some patchy fog for the coastline will cool off the beaches, but the inland spots will continue to warm up. today though. look at this. lots of 70s the warmest locations approaching the 80s. and here is a look ahead. your five day forecast. it is still warmer for your thursday. by friday, warm to hot. the warmest locations close to 90 degrees. we do bring in some cooling out toward the coast, and probably a typical pattern as we head into the weekend. warm inland cool for the coast so it looks like kind of a 2 to 3 day deal with those warming temperatures here in the bay area. but a nice forecast over the next several

it was plugged into seattle-tacoma international airport's electric power. no one hurt. >> former president donald trump gets a legal win in his classified documents case. a federal judge is postponing the trial indefinitely. danamarie mcnicholl has the latest. >> former president donald trump's criminal trial in new york could be the only one he faces before the november election. on tuesday, a federal judge announced she is extending several deadlines in his classified documents case in florida and canceling the may 20th trial date. judge eileen cannon says a number of issues still need to be worked out, including disagreements over how the evidence will be used. >> what jack smith admitted in court was that, in his words, they mishandled the classified documents and misrepresented those to the court. >> the delays push a potential trial off for months. trump pleaded not guilty last june to dozens of charges related to his handling of classified documents found at his mar-a-lago estate. trump's lawyers argue he was legally allowed to hold on to that information.

>> if the american people don't see that this is solely to take him off and out and make sure that he's sitting in a courtroom cold and listening to this corruption, then we are completely misguided and blinded. >> special counsel jack smith hoped this, and the other trial involving the former president in washington over alleged attempts to overturn the 2020 election results would go to trial before election day. the supreme court is currently weighing whether trump should be immune from federal prosecution in that election interference case, which is also been on hold for several months. the justices are expected to decide by the end of june. trump faces an election interference case in georgia, but it's not clear when that may reach trial in miami. danamarie mcnicholl, ktvu, fox two news. >> president biden will be in the bay area this week. few details being released about the trip, but we do know the president is set to travel to san francisco tomorrow, friday, he'll participate in two campaign receptions in the bay area. his last trip to the bay area back in february, mr. biden met with the widow and daughter

of alexei navalny following the death of the russian opposition leader. the president will then travel to seattle for a campaign receptions later on friday and saturday. >> california lawmakers are working to hold oil companies accountable for spiking gas prices. during an overnight meeting at the state capitol yesterday, the vice president of california's energy commission said there's no clear evidence so far of price gouging. however, he did say oil companies are profiting from those price hikes. the meeting comes as the california energy commission works towards setting a cap on oil refinery profits and a potential penalty for companies when they make too much money off of california drivers. >> we are still in the process of evaluating the opinions of the of the experts. we have. okay, currently, what we understand is there's a divergence of opinion. >> i think the personally that the oil companies, the four major companies that control our refinery market here are manipulating prices. >> oil industry leaders say this could drive refineries out of

a possible military offensive on the city of rafah in southern gaza. the decision comes as president biden pushes for israel and hamas to compromise and reach a ceasefire deal. an agreement would head off a large scale assault on rafah, where more than a million palestinians are sheltering. meanwhile, following pressure from washington, the israeli military has reopened the rafah border crossing between gaza and egypt, which is used to deliver fuel and aid supplies. police officers break up another pro-palestine encampment overnight, this time on the campus of george washington university in washington, d.c, as rebecca castro reports from washington, the action by police comes just hours before the city's mayor was set to answer questions from lawmakers. >> pro-palestine protesters in d.c. police going head to head overnight at george washington

university, less than a mile from the white house. similar scenes have played out at schools across the country, but this response from d.c. law enforcement comes much later. university leaders asked police to intervene two weeks ago, yet no action was taken until just hours before dc's mayor and police chief were scheduled to testify on capitol hill about the city's response to protests. >> they began very peacefully, but over the past few days, we began to see an escalation in the volatility of the protests at gw. a total of 33 arrests were made this morning. >> chief smith says protesters were gathering items that could potentially be used as weapons, which is why police took action when they did. >> mpd's response to first amendment demonstration is apolitical. it is without regard to one side or the other, and it's focused on public safety. >> as garbage trucks begin to clear what's left of gw's encampment, dc's mayor and police chief are off the hook

from testifying, at least for now. house oversight committee chairman james comer said in a statement. i am pleased the potential oversight hearing led to swift action. we will continue to hold dc officials accountable to ensure our nation's capitol is safe for all. police now have the area blocked off where students were protesting. there are a few holdouts, but police say they're not going to allow students to come and set back up the encampment, signaling the end of demonstrations at another university in washington. rebecca kaster, ktvu fox two news. >> the family of a san francisco street performer who was killed less than two years ago says they're frustrated that his former girlfriend, convicted in the death, is set to be released . ktvu is amber lee talked to the sister of the victim, the da's office and defense attorneys about the case. >> quack quack quack. this youtube video captures jordan semler's breakdancing skills. his stage was often pier 39, in san francisco. >> i see a man that loved his craft. jordan was very happy in

bringing smiles to other people's lives and their faces. >> but that joy with which jordan lived his life suddenly ended on november 25th, 2022. he was found dead in the driveway of the apartment building in the diamond heights neighborhood, where he lived with his longtime girlfriend, sarah buchanan. she had stabbed him once near the chest. buchanan was convicted of involuntary manslaughter last month and sentenced to three years, but she's expected to be released next month with credit for time served. >> they're shocked to, so i'm still working through that, buchanan will be free less than two years after killing jordan. >> her attorney released a statement which said in part, the verdict was both fair and just because it was based on the applicable law and relevant evidence presented at the trial. >> i want to expose and share that the legal process is not fair and just simpler, says there was no black juror in the trial and she says there were

crucial evidence and witnesses ruled inadmissible. >> the district attorney's office said in part, we take each case seriously and put on the best case we can based on the facts, evidence and the law to meet our burden of proof. in this case, we sought a conviction for murder, and the jury returned a conviction of involuntary manslaughter. >> there is a great issue with men that suffer with domestic violence, but it's something that's not visible. or it's not, focused on. >> sempler says her brother suffered from emotional and physical abuse in his ten year relationship with buchanan, according to court documents. jordan came home drunk, woke buchanan up and called her derogatory names. she said she lunged at him with a knife to scare him, an account that sempler says doesn't tell the whole story. >> there is, this this emotion, this feeling of wanting to persist, to just persist, to fight. >> sempler tells me she's

frustrated and will fight for justice tonight. to her brother, jordan, buchanan is expected to be released june 14th. at her next court hearing, sempler says the family will take action, including filing a civil lawsuit against buchanan, amber lee, ktvu, fox two news. >> an arrest was made and a man is now in jail after he ran a red light at a busy intersection in san jose and killed a cyclist. it happened around 730 yesterday morning at east capitol expressway and center road. investigators say the driver of a red pickup truck was going westbound on capital expressway and was speeding when he ran a red light. the truck first hit a cyclist and then another pickup truck. the man on the bike died at the scene and traffic was shut down for hours in all directions. >> i think everybody just needs to be aware. i think road safety is everyone's responsibility. so it includes being defensive on your own, right? i'm not sure that there's a whole lot that the bicyclist could have done here. if you're following the rules of the road. somebody

wasn't. and unfortunately, that's what occurred. >> this was the 17th deadly collision in san jose so far this year. and police say that intersection is among the most dangerous in the city for the number of crashes every year. san jose mayor matt mehan, in a statement said, quote, these deaths are far too often the consequence of distracted and reckless driving, and i applaud the work of our police department and district attorney who will arrest and prosecute those who put residents at risk on our roadways. >> a new development involving a crash in pleasanton that killed a family of four last month. tarun george, his wife rincy and their two sons died when the car they were riding in slammed into a tree. they'd borrow the car from one of george's coworkers. the car's owner has now filed a complaint with the national highway traffic safety administration, saying before the crash, he noticed the steering wheel veered to the right even when lane assist was activated. the complaint says the owner was concerned that the failure happened again while the family was driving the car. >> it sees multiple complaints, about an activity or a

expire. take a look at though the overall temperature trend. if you have stepped outside for just maybe 10s, you probably already know this. it is a warmer pattern out there for today and into thursday. it's a dry pattern as well, so no fog to speak of. lots of sunshine here in the bay area. here is the satellite where you can see that northerly breeze setting up over the over the state. so lots of clear skies this afternoon. and we're going to hold on to this pattern for tomorrow. we could see a return of the low clouds and fog near the coastline as we head toward friday, but that will just mean some cooling right near the immediate shoreline. right now, san francisco is 72. santa rosa in the upper 70s, on track to reach the 80s this afternoon. concord, mid 70s and san jose 74. we'll check out those wind reports right now. it's still breezy in a few spots. and look at vacaville gusting to 43 miles an hour out toward sfo. winds at about 12 and half moon bay winds at 18 miles an hour. in san jose, winds gusting to 25 miles an hour. here is our live camera looking above san francisco this

afternoon. lots of clear skies, a bit of some haze in the sky. so with this pattern that does set up the air quality is not the greatest. with this area of high pressure moving in overhead and also keeping us dry. so here is the pattern for today. why is it windy? well we have this area of low pressure to our east. this area of high pressure offshore. the pressure difference talks about help to boost that wind speed. so that's what we have for today. and then as you can see for your thursday and friday we'll have a warm to hot pattern primarily inland. and that means temperatures in the 80s and a few spots could be close to 90 degrees here we are today though, enjoying the sunshine for your wednesday thursday mostly sunny skies. keep an eye on this fog though. down toward monterey bay, this could cool off the beaches as we head toward friday. interesting. maybe some thunderstorms out toward portions of the sierra. the southern sierra may be approaching fresno as well, so we'll keep an eye on that by friday. but it looks like on friday we'll have temperatures heating up inland close to 90 degrees. some cooling though, right near the immediate

this morning, the apa heritage foundation announced a number of events taking place in chinatown and citywide. the theme of this year's celebration is moving forward together. events taking place include a lion dance competition, art lessons and displays, a health fair, and the first ever cultural festival in chinatown featuring the band's go to line line dance competition. >> go grab a bite. you know on every street, you can basically spend your whole day there. and that is the intent. >> the events begin this saturday and continue over three consecutive weekends. the san francisco board of supervisors has unanimously passed a resolution meant to protect firefighters health by prohibiting toxic chemicals in their firefighting gear. the resolution bans toxic carcinogens that make the firefighters turnouts water and heat resistant. officials say the chemicals have been linked to major health problems, including cancer, the leading cause of death in firefighters. san francisco is one of five
