night, i'm greg lee and i'm cristina rendon. >> it has been 30 years since polly klaas was kidnaped from a slumber party and then murdered. her killer, richard allen davis, has been on death row ever since, and now he hopes to change that. >> his attorneys believe a legal loophole may entitle him to resentencing. ktvu is an. reuben is live at the santa clara county hall of justice, where the case went before a judge today, an. >> yeah, the father of polly klaas was here, and he's furious that resentencing is even a possibility and that he has to relive this all over again. one of california's most notorious killers wants his death sentence overturned. it was back in 1996 that richard allen davis was convicted in the kidnaping and murder of 12 year old polly klaas, now he's back in court thanks to a change in the law. >> it's horrible. this should have ended 30 years ago. i had every expectation that once he went on death row, it was done. whether he was executed or not, it was finished. but here we are

. >> marc klaas. polly's father, calls this revictimization the issue. a recent criminal justice reform law that invalidated certain sentencing enhancements. it may have opened the door to have cases like richard allen davis's reconsidered ordered. >> this is a big deal, not just for mr. richard allen davis, but for others on death row in california, legal analyst stephen clark says this will be a first test for the new law. will he get another shot at getting his death verdict overturned? even though the technical issue is only these prison priors, which only added 1 or 2 years to his sentence, klaas says it should be a wake up call for other victims families that hundreds of cases could be impacted by what happens here. >> this case is the tip of the iceberg, and it's going to happen again and again and again and again. and i'll tell you what's going to happen in some instances, somebody is going to get out. >> richard allen davis was not present for the hearing. neither his attorneys nor the sonoma

county prosecutor's handling the case were willing to comment. i'm not going to make any statements on the record. >> it's affected my health. it's affected my mind. it affects everything. >> but for marc klaas, any resentencing is like reopening a wound. >> there's only one beneficiary from all of this. it's the guy on death row. it's the guy that murdered my kid. >> the next court appearance in this case is set for may 31st. and that's the day the judge will decide whether this case is eligible for resentencing. greg. >> a case that many will continue to watch. and reuben live in san jose for us tonight. and thank you. >> santa clara county district attorney jeff rosen is taking steps to change the sentences of more than a dozen prison inmates , from death to life behind bars without parole. the da says the move comes four years after the district attorney's office stopped using the death penalty. rosen said he lost faith in capital punishment in recent years. he called it an antiquated, racially biased, error prone system that deters nothing and the costs and costs

the county millions of dollars. >> we're doing a few things. one, we're bringing finality to the case, finality to the victims. >> this is what's going to happen. this person is going to die in prison. and we're also able to then take the resources that we were using to defend these convictions. and apply them in other, more productive places in our office. >> if approved by the court, the move will affect 15 people who have been sentenced to death in santa clara county. the oldest case goes back as far as 1979 and is still being litigated. governor gavin newsom suspended executions in california in 2019, and legal experts say there are enough signs to suggest it is not coming back. >> people who study the death penalty are realizing that it's an institution. i think of the past, and i think it's something that will go away in california and da rosen's approach to saying the death penalty is wrong across the board, i think is a giant step in the right direction and will be one of the

dominoes that helps ultimately end the death penalty in california. and i think throughout the country, by the end of the summer, all death row inmates will be transferred out of san quentin as part of the facility's transformation from a state prison to a rehabilitation center. >> new at five a federal judge has chosen the former chief probation officer of alameda county to take over as a special master at the troubled fbi dublin prison. u.s. district court judge yvonne gonzalez rogers appointed wendy still to start the job, effective immediately. she was among the top candidates proposed by the attorneys representing women suing the prison. still will be in charge of ensuring reform at fci dublin, where eight correctional officers, including the warden, have been charged with sex crimes against inmates. also new at five another blunder for united airlines, one of its planes clipped the wing of another plane. a spokesperson says united airlines flight 2181 was parking at an unspecified gate when its winglet made contact with the wing of another united aircraft that was already

giants to take on the san diego padres in san francisco's home opener, a right hander jordan hicks, starting the game off with a strike. fans say they're ready for the excitement that comes with seeing the home team play their first series at home and looking good. >> i mean, i'm excited for today. we're one and one with them, you know they we beat them the first day. the second day they came back crushed us. we crushed them. so today is the real deal. >> the giants making a lot of changes in the off season, including new gm bob melvin. fans say they're reevaluating the team's odds this year with new names on the roster are a lot better than it has been in the past. >> it's been great to see new guys, new youth in their lineup and everything like this, so it's awesome. it's great. >> the giants front office also saying the team has high hopes. >> we got a lot of new faces on the team and i think a huge potential for this team to deliver this year. >> excitement for the home opener started long before that

first pitch. fans started showing up hours early to hang out at momo's, across the street from the ballpark owner scott morton says the home opener is always a welcome addition to his bottom line. >> every single year. we look forward to this day. it's circled on our calendar for a reason. aside from the playoffs, this is the busiest home game we experienced and we're just so excited to have giants fans back. >> even the clearly outnumbered padres fans here say you can't beat the excitement of a giants home opener. >> it's actually nice. everyone's here. they're very nice. they're very receptive, we all have a common enemy, the dodgers. so we're loving it. >> yeah, something that even giants fans and padres fans can agree on their hatred of the dodgers. i think everybody can get on board with that, as we said, the giants winning this one in amazing fashion with that walk off run in the bottom of the ninth, giants fans still elated. you can probably tell there's a lot of excited fans

ten year veteran, is one of them. >> this is the time of the year where a lot of us workers, we pay our bills from working for the a's. >> food services alone has a pool of 800 workers, not to mention ushers, security janitors and facilities personnel. >> you got so many people that will be out of health care from may all the way to october. which is really bad. moms, dads, grandparents, everything. seniors. you have a lot of younger people with families, with small children. vanessa riles is a campaign coordinator for ebay's the east bay alliance for a sustainable economy. >> miss riles says many of the jobs are union jobs that pay well over minimum wage and just another job that they may find may not have that same level of support. oakland will be hard hit once again. >> a lot of them are from the area in east oakland where the coliseum is located, which we know is already a disadvantaged

area where people don't have enough economic security, don't have enough housing security, and don't have enough job security. >> many workers say they've gone from this insult all those employees, we stayed loyal to him, even though they wasn't putting a decent product on the field. >> when they have a winning product on the field, we all do good to this insult. >> we haven't heard them say anything about a severance pay for us workers. now the last home game is scheduled for september 26th. tom vacar ktvu fox two news. >> two bay area members of congress, barbara lee and mark desaulnier, introduced a bill meant to help recoup some of the losses from the a's move. the money ball act requires any professional baseball team that relocates more than 25 miles away to compensate the local community and the state, or else they could lose the antitrust protections that they currently enjoy. last hour, we talked with congressman desaulnier where the legislation stands in congress.

>> we're not doing a lot in congress, so trying to move it, but i'm reasonably enthusiastic. major league baseball and sports have become so monetized that i don't they don't need the antitrust provision. >> mlb commissioner rob manfred has already waived relocation fees for the a's. >> san francisco supervisor and board president aaron peskin has officially entered the race for mayor of san francisco. peskin filed all the necessary paperwork today. he has served on the board of supervisors for 17 years. he is considered more progressive than the current mayor and incumbent, london breed. peskin says he will use his experience as a policy maker, and his recovery from alcoholism to help the city deal with homelessness. the fentanyl crisis and affordable housing. >> san francisco values are values of caring about our people, of doing right by our city, of being fiscally prudent, of having a thriving economy. those are san francisco values.

happened for failure to protect its workers. 14 months after that deadly shooting that took seven lives. attorneys filed that lawsuit today. ktvu is alice wirtz is live from half moon bay with that story. alice yes. >> today at the center in the middle of town, they had a press conference. one of the survivors of the tragic massacre that happened here a year ago talked with his lawyers and advocates from the community to talk about how they want the landlords of the farm to be held accountable for this tragic incident. just over a year ago, this tiny coastal town in san mateo county experienced a shocking case of workplace violence. seven people lost their lives in a mass shooting that took place at two farms, five men, two women. the shooter parked outside the sheriff's office before being arrested. today's event, packed

with media pedro felix romero perez was shot five times and survived. >> i had two bullets in my stomach. >> his brother, jose romero perez, killed with six other farm workers. >> he also is that i have suffered a lot. >> lawyers filed suit claiming the employer, california terra gardens, failed to safeguard their farm workers from numerous dangers. >> everybody has a right to feel safe in their home in the state of california. not only did california terra gardens violate those rights by providing squalid living conditions for the farm workers, but they violated those rights by not providing a place where their tenants felt safe. >> attorney joe cotchett pointed out this was a traumatic event at the workplace that should never have happened. >> that's the tragedy. but we were shocked when our investigators came back with

photographs, the likes of which you can't imagine. >> pedro perez was in the container he lived in when he was shot five times. containers are typical housing for many farm workers with no running water or electricity. >> one would think after 40 years of cesar chavez, we would be able to put people in something better than a container, a container. >> belinda arriaga is with alice , a community nonprofit that works with farm workers immediately providing housing support. >> and of course, alice has been doing a lot of mental health work to all would like to see more state and federal support for farm workers everywhere who endure the same conditions. >> it's the landlords and the farms that fell short, and it's the landlords and the farms that are going to be held accountable for the harm that pedro and his brother's family are suffering. >> and it's this memorial that was put up here in half moon bay

in front of alice, the organization that helps these farm workers. it's a memorial to those who have passed and to those who have died from other circumstances. being a farm worker in the state and the country. i'm live here in half moon bay. alice wurtz, ktvu fox two. >> alice, thank you. >> more than 68,000 illegally trafficked guns in the us came through unlicensed dealers who aren't required to perform background checks. that's according to new data from the bureau of alcohol, tobacco, firearms and explosives. the agency says the guns were used in 368 shootings across the country. the report goes on to allege that people who illegally trafficked firearms, whether it's out of the trunk of their car or at a gun show or online, are contributing to violence around the country. cinco de mayo celebrations are a month away now in the san jose police department wants residents and visitors to know public safety is a top priority. the department released its operation plan today for the weekend of may 5th. police say some roads will be closed and

extra officers will be on patrol. historically, san jose has drawn large crowds of people during cinco de mayo, which is often led to heavy traffic and arrests. >> starting today, dozens of restaurants across san francisco are offering special deals deals for spring restaurant week. the event kicked off today and runs through sunday. the 14th special menu start as low as $10 for brunch or lunch, and go up to $90 for dinner. organizers hope people will come out and support an industry that needs all the help it can get. the return of oakland's first friday is being postponed due to wet weather. the popular community event was supposed to resume today after a three month break. organizers blame the hiatus on financial difficulties for the festival. the monthly block party has been a gathering place for various artists, performers and small businesses in oakland for several years. a date for the next event has not been announced. >> i love when our engineers here at the television station is on top of the weather, and alan palomo's and our technical operations center is doing just that. take a look at this. it's our live weather camera looking

in the direction of diablo in the background there, where a little bit of snow is capping the mountain range at 3800ft. then look at the clouds. and yes, those clouds are producing some major rainfall, primarily just training across the east bay. let's zoom in. you see that lightning bolt just happening right now in between 680 and the brentwood area? pretty much over that mount diablo area where you saw those ominous clouds. there you have another lightning bolt just right over mount diablo. we have another cell containing some very heavy downpours now just off 680 as you are heading north. that's at five 8680 corridor there. and then as you're heading north, that is, i'm telling you, heavy downpours, very dangerous driving and these conditions. and then we have the snow lining the eastern foothills from the tri-valley all the way into the mount hamilton area. hit and miss. scattered showers also being noted around the peninsula. and this is going to

. >> a 4.8 earthquake in california may not make national headlines, but it is rare to see a quake of that magnitude hit the northeast. >> that earthquake struck around 1030 this morning on the east coast. the epicenter was in new jersey, but it was felt as far away as baltimore and philadelphia. authorities say there was no serious damage and no one was hurt. >> but fox's connor hansen reports it still gave millions of people quite the scare. videos captured the earthquake, knocking pictures off the walls in sterling pets. officials believe the epicenter of the 4.8 magnitude earthquake was near lebanon, new jersey. it's the first time a tremor with that strength has hit the tri-state area in more than a century. >> it felt like the pavement was giving way under me, and i didn't know what to think or what to do. >> the epicenter was about an hour's drive from new york city. earth cam footage captured lady liberty shaking. the quake rattled a united nations meeting, and tourists in times square were taken by surprise.

>> right under our feet, we felt the shaking. we were just nervous, like, what's going on? because, you know, we haven't heard. we haven't had an earthquake in so long. >> new york city officials say they're checking buildings and infrastructure for any damage. >> tunnels are very resilient for seismic impacts, so they move with the ground. so again, it's a hands on inspection. we go and do visual inspection to see if there are any any damages . >> geophysicists say fault lines run through new york. but right now there's no reason to worry. >> i believe authorities are in the scene. they are examining the situation and also scientists are closely working with them to gather any information that's, that's needed to, to make any further decisions. >> officials are warning that aftershock could continue over the next week or so. in new york. connor hansen, ktvu, fox two news is coming up. apple does something it tried to avoid during the entire pandemic. details on the latest tech

it is a tech giant's largest layoff since before the pandemic . ktvu james torres reports the details of those layoffs and what's expected to happen next. >> for practically the entirety of the pandemic, apple avoided large mass layoffs. we saw that in the thousands for other tech giants, apple is not immune to the realities of running a business. tech reporter ian scherr says while apple's layover numbers are much smaller, it's still a sign of the times. >> it's hard to tell exactly what apple is thinking, right? that's part of life following that company. but one of the things that's been pretty clear from a lot of the reporting is that it making a car is incredibly hard. >> experts suggest those employees were likely working on apple's self-driving car project, which had been dubbed project titan, within the company. apple scrapped those plans earlier this year after quietly working on it since 2014, 614 total positions are

now eliminated from eight santa clara county offices. that's according to a filing with the employment development department. apple filed a worker adjustment and retraining notification, or a warn report, which was obtained by ktvu. it reveals hundreds of software hardware and development engineers are laid off, along with a handful of data scientists and machine shop managers. >> the one thing that i think a lot of people who watch the tech industry are trying to figure out is if this is the end of the layoffs, you know, there are hundreds of people who have been laid off from apple. that's far, far smaller than the thousands upon thousands of people we saw laid off from google and facebook and whatnot. so it may be that this is actually a sign that maybe this is the end of the layoffs. >> some of those employees may relocate to the company's artificial intelligence division, something scherr says

makes sense. >> it's clear that making more complex, different type of products like cars is very hard. artificial intelligence, by comparison, is very much within the wheelhouse of apple making software, right? so in a lot of ways, it makes sense to put more effort toward that. >> ktvu did reach out to apple and its attorneys, but have not yet heard back. i'm james torres, ktvu, fox two news. >> the latest jobs report is showing good signs for the economy. u.s. employers added 303,000 workers to their payrolls in march, which was much more than the 200,000 economists had expected, with the nation's consumers continuing to spend. many employers have kept hiring to meet steady customer demand. the unemployment rate dipped to 3.8% from 3.9% in february. analysts say the fed may hold off on cutting interest rates for a while on the news. new video tonight from thursday's protest at the lockheed martin facility

in sunnyvale. it shows a man accelerating towards a group of demonstrators and then threatening them with a knife. you want to go to prison? >> hey, get out of the way. you want to go to prison? everybody's gonna die. >> you can hear that man say, quote, get out of the way or someone is going to die. a protester can be heard pleading with the man to drop his weapon. the driver replies, quote, i've got to get to my job. he then gets back into the vehicle and slowly moves towards the demonstrators. lockheed martin has not confirmed the man is an employee. they did tell ktvu in a statement. they respect the right to fair and peaceful protest, and they are investigating this incident. the protesters were demanding the u.s. end its financial and military support of israel. the israeli military is taking steps to hold itself accountable for the deadly airstrike on aid workers in gaza this week. >> two israeli officers were dismissed and three others punished today in connection with the attack that killed seven world central kitchen workers. hamas and its allies

say it was a deliberate attack. but in a new report, israel found it was a, quote, grave mistake stemming from syria's failure. it also says the entire decision making process will now be reexamined. >> and why did you pull the trigger thinking this was hamas? that's a thorough investigation done by a values based organization that is holding its people to a very high standard. >> the report was released just hours after israel's security cabinet approved a series of immediate steps to increase the flow of humanitarian aid into gaza. us secretary of state antony blinken says israel needs to prioritize the protection of civilians. >> too many people have been caught in this crossfire of hamas. is making children, women, men are losing their lives, their safety has to be a priority. and military operations need to be designed around their protection, not the other way around. >> this weekend, cia director william burns is expected to

travel to cairo for a new round of talks regarding a cease fire and the release of hostages. mcdonald's is taking back ownership of 225 restaurants in israel as it faces a growing boycott. the company, colonial limited, operates mcdonald's restaurants in israel, and after the october seventh attack by hamas, it announced it would be donating free meals to the israeli military. but as the war has gone on, the protests and backlash have gotten louder. the company is now selling the franchise back to the mcdonald's corporation. >> president biden traveled to baltimore today, one week after the deadly francis scott key bridge collapsed. he's urging congress to quickly approve federal funding to help with the bridge rebuild. fox's rebecca castor is in maryland with more details on the visit as crews work to clear the tons of debris from last week's bridge collapse. >> president biden is renewing his support for the city of baltimore. >> your nation has your back and i mean it. your nation has your back. >> president biden, doubling down on his commitment for the

federal government to spend whatever it takes to reopen the port of baltimore. on friday, he toured the site of that deadly bridge collapse and later met with the relatives of six construction workers who died. >> i know a little bit about what it's like to lose a piece of your soul to get that phone call in the middle of the night to say, family members of god, i've been there. >> the francis scott key bridge collapsed last tuesday after a cargo ship struck one of the support beams. the president is now urging congress to quickly authorize federal funds to rebuild the structure, which some experts estimate could cost at least $2 billion. >> no matter anyone's affiliation. public, private, federal. state, local, democrat, republican. we are all one team here for now. >> most operations at the port are still shut down, and officials say that's costing millions in lost revenue every day and upending the supply chain. the army corps of engineers expects to open a limited access channel to allow larger cargo ships to flow in and out by the end of april. but

the closures. the countdown is on to monday's total solar eclipse, and while the bay area won't be able to see the full eclipse, millions of people are heading to locations where they will get a chance to see it. >> fox's evan brown shows us how local governments and scientists are making their final preparations. >> this is it. the final weekend heading into one of the biggest spectator events of the past decade. millions of americans are expected to put on their viewing glasses and watch the rare total solar eclipse on monday. counties in new york, texas and indiana have already declared a state of emergency to help deal with the crowds, and officials along the path of totality are warning folks to get to their viewing spots as early as possible. >> our local communities have been working to prepare for this influx of visitors, but there's no way around the fact that there will be incredibly heavy traffic and very large crowds. >> and of course, it's also going to be a field day for scientists. the eclipse will

all over the country are traveling to get a chance to see the total solar eclipse. >> one woman from texas knows a thing or two about that. this will be the 21st eclipse. she has seen her passion for chasing the celestial event has taken her to all seven continents. >> first one north america, was the 1991. my second one in north america was the 2017, and this will be my third. but i've been to europe for one of them. i've now gone to africa twice. i've gone to australia three times. i've gone to antarctica twice. >> she also goes to schools and shares her passion for solar eclipses with students. >> again, the bay area is not in the path of totality, but we will be able to see a partial solar eclipse monday morning. 34% of the sun will be covered by the moon. the partial eclipse begins during the 10:00 hour, reaching a maximum at 1113 in the morning. by 1215, our sky should be back to normal even in a partial eclipse. looking at the sun directly, it can cause permanent damage to your eyes.

heavy downpours. take a look right there. right now, in between brentwood and discovery bay. byron also, this is a very heavy downpour at this time. and when you see the different shades of green, that gives you an indication of some pretty moderate rainfall. the yellow indicates a heavy downpour at that particular time. so it's a messy evening commute for people along 680 and 580 this evening. plus we have snow falling in the mount hamilton area and also in the eastern foothills. a hit and miss scattered shower around the peninsula and across the bay towards san leandro and san lorenzo. we're going to continue to see all this activity, at least for the next couple of hours, and then it will finally begin to die down. temperatures currently are in the 50s, except for fairfield at 48. liver law is at 45 degrees. with that heavy rain and different neighborhoods around that particular neighborhood, that area, it is going to fall down to 34 degrees tonight in santa rosa, 38 degrees in concord, mid 30s and throughout the tri valley. and because of these

frosty temperatures, the national weather service has issued a frost advisory for 1:00 tomorrow morning through 9 a.m. also in the north bay, and for all of our friends at mendocino county, you have a freeze warning now. right now, with the chilly temperatures, we've got winds 32mph in throughout the san bruno gap there, 40 mile per hour gusts, 18 at mountain view, 31 at hayward. it is blustery for the evening commute, but this system is finally traversing to the east and digging to the south. and as it does so again for people heading in and out of town, we have thunderstorm activity lining i-5 . so when will it be moving out? look at at 10:00 tonight, skies are beginning to clear and with that cooler air mass in place, that's when we have the frosty temperatures taking a big nosedive. by tomorrow night, we start to cloud up again and it will lead to more rain showers. no accumulation really expected. it will be gone before our
