with maureen's peace, hopefully we can get that for you in a minute. oakland obviously has had financial problems in their school district for years. now this new grand jury report is coming out, again we hope to have maureen's piece queued up in a few minutes and will get with them. in the meantime pg&e creditors want to give the bankrupt utility a new name. the sacramento bee reports the plan by bondholders was set aside up to $18 billion to pay claims on the 2017 and 2018 wildfires caused by pg&e equipment. they also want to rebrand pacific gas and electric as golden state power, light and gas company. they are considering all options, pg&e filed for bankruptcy in january citing aliens of dollars in wildfire liabilities. now we go back to maureen naylor, reporting on the new grand jury report, it is a scathing report on the oakland unified school district. here is maureen naylor.

>> reporter: in a scathing report of the alameda county grand jury accuses the oakland unified school district of having a broken culture. concluding the district is not doing justice or a 36,000 students and 87 public schools. ray souza is on the grand jury. >> it is not you can point to one thing and say they did this wrong. it is pervasive. the board, the leadership, the management, the people that work there. >> reporter: the report cites a range of problems including mismanagement, favoritism, disregard for authority among mid-level management and a lack of accountability. financial instability was also highlighted. the grand jury finding oakland unified wasted millions of dollars, pointing to lack competitive business practices and poor contract management. one example, nine building projects halted because of overspending including the most egregious of construction project at fremont high school that was $51 million over

budget. >> these kids deserve an education and there is money there to do it. it is just not being used properly. >> reporter: the report concluded that if ethical norms are ignored year-to-year and many held many not health questionable for conduct than a broken record emerges. the grand jury found the recent element and killing a teacher strike will certainly add to the district's financial burden. the funny part of the problem is a lack of continuity. the district has had nine superintendents since 2003. or roughly one new boss every year and a half. oakland school board president said this report raises important questions, many of the issues are familiar, but we will use this report to face these issues head-on and improve how we operate. oakland unified the client a request for an on camera interview but the president released a statement says that the district takes the grand jury report seriously and will be reviewing it and issue a formal response within 90 days. in oakland, maureen naylor, ktvu fox 2 news. we have no details tonight about a possible motive for sunday's shooting at a home in san jose that left five people

dead. jesse gary tells us a relative says the alleged gunman was upset that his wife was able to get visas for her family members in vietnam, but he couldn't do the same for his. >> i did not see how some of you get so angry to want to take a life. there is a precious life that god gives. >> alexandra cortez lives in the boerne mobile home park next to a man named van khuat. tuesday van khuat for the mercury news and his wife's cousin phoned saying he wanted to commit the killing. the reason was that he was furious she was able to get some vietnamese family members immigration visas, and he was not able to do the same for his own immediate family. san jose police say sunday night, chi dinh ta shot and killed four daily members and then turned the gun on himself and took his own life. >> been here 27 years, do not renumber an incident like this were four people were murdered.

and, it is just sad. >> reporter: police said the gunman's wife, daughter and niece were able to escape. they said this of suspect used a handgun to shoot several people inside. officers used a bearcat to help rescue a man and woman from the home who had been shot at least once each. they both died at a hospital. cortez says she never saw any problems with mr. kuat or his relatives living in the cul-de- sac, they said that violence is never a way to settle the dispute. >> he should've been to the authorities or whatever lawyer he was working with rather than taking it out on other people. that is not right. it is common sense, you don't hurt other people that because you're not getting your way. i just feel like, you know, he should have brought the drama somewhere else. >> reporter: his wife was able to escape the massacre by jumping a fence and hiding in another house. it is a police have not commented on the new revelation. we tried to talk to mr. kuat about all of this but he was not home. in south-central san jose jesse gary ktvu fox 2 news. residence at a mobile home park in palo alto say they are

saddened by the death of a man who lived there. investigators were called to the buena vista park on el camino just before seven last night. paramedics say the man's roommate found the victim injured in their home. neighbors tell ktvu that the man was in his 60s and had been stabbed to death. the man later died at the hospital. palo alto police did not release any information on a suspect but say they are actively investigating the death. the family of a sacramento police officer who was killed in the line of duty last week spoke out publicly today for the first time. heather holmes is here now with what they are saying. >> reporter: tara o'sullivan's father spoke to a room full of reporters today during a news conference at the sacramento police department. he said his daughter developed a love for sacramento while attending school at secondment estate. and that she wanted nothing more than to be a sacramento police officer. >> we know that this police department provided the best training for tara.

from the academy staff, her coworkers, her field training officers, her teammates and the entire organization. for that, we are always grateful. tara o'sullivan was gunned down back on june 19 on a domestic violence call. police say she and three other officers were ambushed by the suspect near a detached garage of the suspect's home. >> reporter: it took 45 minutes for anyone to reach tara because the shooter continued to fire in the direction of the officers. today officer o'sullivan's father says he does not place any blame on the sacrament to place a permit for his daughter's death. >> we are here the negative and misleading and hurtful information that has been spread about our sacramento police department

and family. beyond certainty what happened on june 19th falls squarely on one individual the notion that anyone in the sacramento police department is responsible for this senseless murder of tara is extremely offensive and hurtful. >> reporter: the suspect in the case, 45-year-old adel ramos, has been charged with murder. officer o'sullivan group in the east bay. funeral services will be held on thursday at the bayside church in roseville. and the second service at destiny church in rockland. both are open to the public. the sacrament of police chief is encouraging the public to line every inch of the procession to the church thursday morning to show officer sullivan o'sullivan's

family is how much they are loved. heather holmes, ktvu fox 2 news. now to walnut creek and you questions about a police shooting that took the life of a mentally ill man early this month. the latest from alyana gomez as she joins us now at police headquarters and walnut creek with the body camera video just released to the public. >> reporter: earlier today we also spoke with miles hall's mother off-camera and she tells us that her 23-year-old son was a good kid and didn't deserve to die like that. she also says that they contacted walnut creek police because he says they were familiar with miles hall's mental health history. we are learning today may family attorney one of the five responding officers that they had been to the hall home before for a mental health incident. now the family says they never thought there calls to police would end in his death. >> miles, my grandson, is having a mental health breakdown. >> reporter: miles hall's grandmother calls 91.

you can hear holly yelling in the background for the next call is from a neighbor. >> a lot of screaming and yelling going on, sounded like what could've been gunshot. two walnut creek police released these photos of a sliding glass door they say hall broke the dispute with his family and that he was carrying a nearly five foot long metal pole. >> he had like this long pull, it was a metal pole and he was threatening but i tell you now, he isn't going to be aggressive to the police. he needs to be apprehended. >> reporter: the dispatcher notified officers that hall had a mental breakdown but the added detail but a sharp edged pole that was never mentioned in the call from family or neighbors. >> he is a long pole with a sharp edge on it and he is being violent. >> reporter: moments later officers made contact with hall and release four body camera video to show what happened.

>> shots fired, shots fired. >> reporter: the first few shots in here are from a less lethal beanbag gun almost simultaneously with a fourth beanbag round here a series of five bullets fired. they posit video at the moment because the graphic nature. he was handcuffed on the ground is still alive as officers tended to his wounds. he died at the hospital. >> at the time he was shot and killed he was moving away from them. off to the side. i do not see the justification for the shooting. >> reporter: here is another angle from a neighbor surveillance video. jon burns says it shows hall start to run to the side of officers after he was hit with beanbag rounds. >> clearly was evading the police officers, not running after them at the time they shot him. that is the most critical fact. >> reporter: since 2015 walnut creek city have responded to eight calls involving hall. police say four of the five responding officers completed crisis negotiation training. >> cannot expect a person who was unreasonable and mentally impaired to act in a reasonable

over the north baby a bit of a north wind that help to bring the temperatures up so you probably felt that as well. giving a look from san francisco as we look across the bay we have a little bit of haze out there. partly cloudy skies. some thought to start the month morning but that disappears by lunchtime. we have been partly cloudy and mostly clear for the rest of the day. right now santa rosa, 86 degrees. a warmer day for you with a north breeze in place. san francisco at 64, oakland is 69, livermore 77 and san jose at 76. temperatures are already beginning to drop just a bit but you can see here from the 24 hour temperature change we are cooler in carlos by seven degrees, cooler and concorde by six. we had to napa or santa rosa, warmer this afternoon. we will continue to cool down as we get into the days ahead it has to do with the trough that is over the pacific working closer to the pacific northwest. that northwest flow is what helps to clear out that fog earlier today. it will return, we will have that fog among the coastline for tomorrow morning and partly cloudy skies for the rest of us.

the onshore breeze is going to continue. oakland reporting a sustained wind at 20, fairfield sustained at 24. tomorrow morning temperatures will be back into the 50s, 56 to start your day in oakland, 35 san rafael and then temperatures continue to roll fall. i'll have a look at those numbers and weekend coming up in a little bit. family members of a hayward man who died in police custody say the city is trying to silence their case. that is because the haywood city attorney has asked the judge for a gag order to stop the family's attorneys from speaking out. 2 investigates candice nguyen is here with what some call an unusual move. >> reporter: an attorney causes death in police custody the west coast aaron gardner case. an incident he says needs to be in the public eye to hold public servants accountable. the city of hayward disagrees and requested a gag order with saying the attorney violated judicial code. >> okay, okay. >> you will get tased. >> get on the ground, all the way down. >> give me your arm.

>> you will be alright >> reporter: it was never before seen video showing roy nelson junior restrained by police in 2015 while experiencing a mental health crisis according to his family. you see nelson lose consciousness. he hello? roy? >> reporter: nelson was later pronounced dead, his death ruled an accident in the corners report. now, just days after the family attorney released the footage and spoke to 2 investigates, the city of hayward file this protective order requesting the plaintiff's attorneys cease making public comment and immediately cease providing confidential records to the media. he says though not only were the records not confidential, they would've been released anyway under the state's new transparency law. >> the city put out a press release as soon as mr. nelson was killed by their offices, which was an inaccurate police report. and an inaccurate police statement about what was in

place and all the family is seeking to do is correct the record. >> reporter: the city of hayward declined to comment referring us to statements in court documents. attorneys for the city acute pointer and the law form of improperly trying this case in the media. they point to the specific statement, accusing pointer of trying to inflame potential jurors. >> this is the west coast eric gardner case. mr. nelson literally said i cannot breathe. ski it doesn't appear that anything the lawyers from the law firm did, in terms of their media statements, was unethical. >> reporter: stephen clark is an legal analyst who is not associated with the case. he feels a gag order is unusual in a civil case. >> the question is can both sides get a fair trial and that will be the decision for the court and whether to issue a gag order. >> reporter: of hayward's goal was to keep this place case quiet, they say that the latest move may backfire. >> what is important is even if

up publicly today for the first time since she was killed in the line of duty last week. her father said that o'sullivan wanted nothing more than to be a sacrament a police officer and loves what she did. funeral services are set for this thursday. a possible motive has emerged from sunday's murder suicide in san jose. and left five people dead. the mercury news reports of the gunmen, chi dinh ta, was angry that his wife was able to get her relatives immigration visas from vietnam, but he was not able to do the same for his relatives. police say he shot and killed four family members and then took his own life. in a scathing report from the alameda county grand jury is out today at accusing the oakland unified school district of mismanagement, favoritism, and a lack of accountability. the grand jury found the school district wasted millions of dollars to poor this practice. the district declined an

interview with us today, they say they will have a response within 90 days. you are watching ktvu fox 2 news at 6:30 the wife of the shipmaster tenant derick almena took the stand today to testify in his defense and the manslaughter trial. ski henry lee tells us that today's testimony aim to project a softer image of derick almena to jurors. >> reporter: was called to the witness stand in her husband's trial for involuntary manslaughter. his attorney says she is bringing "the feminine perspective" to the case. >> she is really there to humanize the defense. >> reporter: the artist and mother of derick almena's three children began weeping when she looked at this picture of her family while on the stand. >> very potent when a mother and a wife speaks out on behalf of her husband and their mutual vision, very powerful to get up there and cried. >> reporter: she testified that the idea of ghost ship began

official marina sabatini were in the warehouse while investigating an arson fire in 2014 that sabatini had denied. >> sabatini said i wasn't in there. captain friedland said i wasn't in there. and they lied. >> reporter: the cross- examination by the da, allison acknowledged she once had a massive venting problem. she also said many of the changes made in the warehouse were done without palmer proper permitting or inspections. derick almena's wife will return to the stand on wednesday for more cross- examination of the da. at the courthouse in oakland, henry lee, ktvu fox 2 news. right now, oakland public safety committee is preparing to debate the issue of facial recognition software and consider a possible ban of its use by city agencies. police department say facial recognition software can help catch criminals, but critics say the technology has led to misidentification, often involving people of color. last month san francisco became

the first city in the country to ban city agencies from using the technology. the berkeley city council is set to consider a similar ban next month. a new state law that places new restrictions on the sale of ammunition is set to go into effect next week. prop 63 was passed in 2016 with 63% of the vote. we are told that starting july 1st, anyone who wants to buy ammunition in california will first have to pass a background check. >> reporter: california's governor touts the state's new gun law pointing to other recent gun measures that prove regulations work. >> a significant decline in the gun murder rate in the states, it goes well beyond the trendline nationally. gun safety laws save lives. >> reporter: anyone looking to buy ammunition will be required to show an id. and subject to a spot background check. and a one dollar fee. in the new law, it also bars online sales of ammunition or see buyers to use a licensed dealer, or cross state lines.

the goal, officials claim, is to deny ammunition to those who illegally obtained firearms. >> they were able to get through online sales, delivered to their front door like a pizza with no background check or any kind of regulation whatsoever. >> reporter: gun store owners say there is no evidence of stockpiling ammo ahead of new regulation come july 1st. some buyers are not happy with the new law. >> now we are going to have to register, do some kind of crazy paperwork just to come in and buy ammo for a weekend with the kids, it is just ridiculous. >> reporter: with the state insists it is necessary. researchers examine sales from 10 l.a. gun stores over two months a claim some 10,000 rounds were sold to buyers legally barred from owning a firearm. the new law does not limit the amount of ammunition sold but under a proposed regulation, ammo buyers would now be required to show what is called a real id. that requires a branch of get or passport to obtain.

we have breaking news out of washington tonight, homer special counsel robert mueller has agreed to testify on capitol hill next month. the news comes from the leaders of the house district committee and intelligence committees. mueller has agreed to appear before both panels on july 17th and he is going to testify in open session. and speak about his investigation into russian interference in the 2016 presidential election. also, lawmakers in washington now racing against the clock to pass a $4.5 billion bunting funding package to ease the humanitarian crisis at the border. >> mike emanuel tells us that the study is considering a second measure, democrats say it doesn't do enough to help migrant children. >> reporter: president trump is upping the president on congress to pass an emergency funding bill to stem the humanitarian crisis at the border. >> we can get this bill signed will be able to do it. the democrats do not want to sign anything and now i think they are going to probably sign this, from what i understand

they call it humanitarian aid, this isn't even about border. >> reporter: but the senate and house are considering different bills and time is becoming a factor. >> we are going to deal with that this week, which we will end up it'll be largely up to the other side. >> reporter: there is a 30-1 vote. w like to pass on a bill and get them into the president's desk asap. >> reporter: were public and say the house packages more partisan and put limitations on the administration like not allowing health and human services to exchange information, which is necessary to protect children. president trump is starting to veto because it doesn't include any enforcement money. house speaker nancy pelosi gave her fellow democrats a hard sell today saying "a vote against this bill is a vote for donald trump and his inhumane, outside the circle of civilized attitude toward the children. and other democrats are trying to urge their colleagues to get it done. >> there are children being

in full force for the first week of summer and then we cooled the back. but it still feels really good out there. low 90s over some of our warmer spots today. mid 60s at the coast, we had sunshine, sunshine usually means a good thing for most. 66 the afternoon high over areas of san francisco. we will continue to drop these temperatures off a little bit, getting into our barrio area wednesday as well as thursday. and as we get close to the weekend we are going to see a rebound, though not quite as warm as where we were this past weekend. giving a you a view at the mostly clear skies, the northwest breeze helps to clear the fog out right about noontime. we were mostly clear for most of the coast. a little bit over areas of santa cruz and monterey but we do expect the fog to return tonight. it will be partly cloudy at the coast, patty in nature around the rest. the onshore breeze is 20, 24. the system is providing us with the onshore breeze with the cooler air also helps to mix out the marine layer and bring us mostly sunny skies. going into wednesday and thursday it will call for just about the same.
