it's a startling statistic. 35 homicides in san jose so far this year. now police are speaking out. good afternoon. i'm tori cam be. san jose is taking action to fight this increase in deadly violence. new at noon, ktvu's allie rasmus joins us live with information just released by the san jose police department in the last hour. allie? >> reporter: actually, san jose police chief chris moore updated the number. he says san jose has had 37

homicides in all of this year. that's her than double the rate of last year, all of last year. so in light of all of that, police and the santa clara county d.a. had a press conference at san jose police headquarters. that press conference is still going on. at that conference, police had updates on two high-profile cases. the first, the hells angel shooting that happened -- that happened at the oakdale cemetery on saturday. police identified steven joseph ruiz as the man suspected of shooting and killing a fell local hells angel member at that funeral. police believe he and the victim got in an argument at the funeral right before that shooting happened and police say they do have a warrant for ruiz's arrest. but at this conference, police suggested ruiz might have been killed by other hells angels' members. >> he left his motorcycle at the scene. we still have that motorcycle and i would think that if he was still around, he would want his motorcycle back as well.

>> reporter: the other case were two individuals shot execution style. police believe the man they shot two day the later, a man named ricardo was the perpetrator of the double homicide. this is what they confirmed. >> we know at one point they were the -- they were in the same dorm at san jose, and -- the only connection we can find is narcotics related. >> reporter: san jose has had an increase in officer-involved shootings. according to the police chief,

this is still going on. and we'll have more on this at 6:00 tonight. allie rasmus, ktvu channel 2 news. >> thank you. and police are still searching for a gunman. an 18-year-old man was shot and died later at the hospital. police are not releasing his name until family members are notified. a freed israeli soldier arrived home today to a hero's welcome. [ chanting ] >> the crowd waved flags and cheered in the hometown of gilad schlalit. he was kidnapped and held in the gaza strip for the last five years. he's now free after an agreement was reached between the two sides. his father thanks supporters and says it will an while before his son speaks out. >> long days and long years of

captivity. he's not quite adjusted. >> reporter: in exchange, israeli is -- israel is releasing 1,000 palestinian inmates. police say the occupy sf protest has overstayed their welcome but protesters say they have every right to stay. but they do plan to move at least temporarily. kraig debro has more. >> reporter: good afternoon. about 90 minutes from now, occupy sf goes to city hall to seek another kind of justice. >> this is from the police on sunday night. >> reporter: occupy sf members are outraged by what happened sunday night. they say some police used heavy- handed tactics and they acknowledge that others went out of their way to be careful.

police made five arrests and tore down the plaza encampment. >> this is we're gonna break you and get you out of here. they continued to escalate in the street. >> reporter: today, occupy sf will go to city hall to tell leaders to rein in police. the mayor is already on record supporting the record for free speech rights but not sleeping in the park or block sidewalks. >> that doesn't necessarily explain why the police have reacted the way they have. >> all of the incidents happened in the street. this is not the cops going into the camps. >> reporter: an occupier said this could be the life blood of the movement because it's where

they stay together. >> to be able to protest or speak openly about any kind of disadvantage that they are feeling overnight. >> reporter: today there was a sign of thaw in relations. >> i'm here to represent our positions. >> reporter: the movement is hoping it can work it out with police so they can get back to the reason they are here. >> what's happening here is people are engaging each other and talking to each other and people from diverse backgrounds are discussing their struggles. >> reporter: the supervisors' meeting is scheduled to start at 2:00 p.m. people leaving from here are walking up market street around 1:30. kraig debro, ktvu channel 2 news. >> thank you, kraig. across the bay in oakland, occupy demonstrators were joined by three uc berkeley grads released after being held in an iranian prisoner. the three had spoke yesterday at the occupy oakland encampment outside of city

hall. shane bauer and josh fattal returned to the u.s. after 26 months in prison. sarah shourd was a prisoner for 14 months before she was free last year. stay here for more on the occupy movement. look under the "occupy protest" tab. tension is rising between richmond city officials and police after a gang fight in city hall. a city-one group called the office of neighborhood safety paid gang members from north and central richmond for service they did for the community empowerment program. however, rival gang members showed up at the same time in city hall and a fight broke out. police say blood cover egg the walls and 40s of the office but no one -- covering the always and floors of the office but no one was -- walls and floors of the office but no one was

willing to give information. this was the scene this morning -- morning as people showed up to the oakland dmv office to do things like renew their driver's license. they could not do that yesterday because the computer system was down. a dmv representative states an upgrade over the weekend created problems but they were resolved last night around 5:00. an autopsy is being performed to help determine the cause of death of a stockton woman missing more than two months. >> reporter: the body of dalene carlson was found over the weekend in a cornfield in escalon. she was last seen at a bar and grill in stockton. police say they have three possible suspects but not enough evidence to charge any of them. the u.s. senate approved a new bill late last night. it would boost fines for safety

violations, increase the number of federal safety inspectors and require automatic and remote-controlled shutoff valves. the measure comes after last year's deadly explosion and fire in san bruno. the house is now debating a similar bill. oakland police are defending their response to a bold pawnshop theft caught on tape. the thief grabbed a 14 karat chain yesterday morning at a pawnshop on international boulevard. you can see him in this video clearly but he's still on the run. the angry pawnshop owner says police never came to a store to investigate. police say they were responding to more serious crimes at the time but they are investigating this theft. a task force is now working to catch a group of violent marked robbers responsible for a series of takeover holdups in contra costa county. this pleasant hill 7-11 was their latest target. police say around 4:00 atm on

sunday, the masked robbers pointed guns at the clerk and stole money at the register before running away. over the past few weeks there have been a dozen robberies in walnut creek, concord and antioch. >> i think people out here have more of a sense of security and that -- it's a little upsetting. >> i hope they catch the guys. one of the things i can't -- i just can't stand a thief. >> so far, police have surveillance video from one of the robberies but they say all four robbers where masks and hood sweatshirts making them hard to identify. there's no official ward so far but it looks like the raiders will be getting a new quarterback. the raiders are gauche -- the raiders are in negotiations to get carson palmer to replace jason campbell. espn says palmer came to the bay area to get a physical.

it was a messy morning in southern california after a train derailment caused a major freeway shutdown. two trains collided on the tracks in coleton around 2:00 this morning. six cars were scattered on the tracks. part of i-10 and 215 were shut down for a few hours but were reopened for the commute. hazmat was called out because some of the tankers were carrying hazardous materials. social security recipients will see their first increase in benefits in two years in

january. 55million beneficiaries will find out tomorrow just how much their checks will grow. the benefit is based on a calculation of cola, which is a price inflation. there was no boost in benefits in 2009 or 2010 because inflation was so low. president obama is on the road for a second day. the main theme in his bus tour through north carolina and virginia is jobs. as craig boswell reports, he's asking pressure to be put on to support his jobs initiative. >> reporter: at each stop in north carolina, the president has -- has been slamming. the president follows the criticism with a call on congress to pass his jobs bill piece by piece beginning with a $30 billion proposal to keep more teachers in the classrooms. >> our plan would mean about 13,000 jobs right here in north

carolina alone. >> reporter: the senate blocked the entire $447 billion proposal last week. >> when you look at the president's jobs act, even if you break it into bite-sized pieces it's spending money we don't have. >> reporter: republicans oppose the new taxes included in the plan and say they've heard it before. >> throw another bailout together, slap the word "jobs" on the cover page and dare people to vote against it. >> reporter: republican presidential candidates debate, once again, this time in las vegas. >> another piece of the caucus and primary puzzle is now in place as iowa sets its sights on january 3rd. it's now up to new hampshire to set its nominateing concept. a truck carrying presidential sound equipment was stolen. a virginia tv station says the truck was parked in a hotel in the richmond, virginia area when it was taken yesterday. the bus was later found and it

appears no items were stolen. secretary of state hillary clinton is in tripoli as she stepped off the plane, she was greeted by libyans. many in -- the secretary greeted the current head of state. clinton is expected to offer american medical assistance to libya. jobs will come up in tonight's republican debate. seven of the candidates will face off in las vegas. since he's been surging in the polls, herman cain will be under attack. his 9-9-9 tax plan has been slammed by both democrats and republicans. one candidate who won't be there, jon huntsman. he's boycotting it after nevada pushed its primary ahead of new hampshire's. the iowa republican party has officially moved their caucuses to january 3rd. this comes after nevada and florida pushed their dates

forward. iowa pea caucus was set to be held february 6th. iowa also moved its caucus back to january 3rd in 2008 because of a similar chain reaction of states changing their dates. san francisco board of supervisors will discuss free muni youth passes when they meet in less than two hours. there is debate over how much it will cost to offer free rides. according to "the examiner" a study released estimates the cost will be $3 million. but an earlier supervisor study put the number at around $7 million. caltrain riders in san bruno noticed the change this morning. starting today, trains will debart and -- depart and arrive

at a new temporary station south of the current san bruno station on hunting ton avenue. the change is part of a $147 million project that will elevate caltrain tracks over several streets and eventually build a future permanent station. well, for many it's cooler. for others, it's still kind of warm. in fact there's still this fight between a west wind and north wind. there is a lot of fog out there. it's noticably cooler by a good 15 degrees. fog bank getting helped along by a system moving into the north. the fog cannot clear the coast. it's still too shallow. look at livermore, almost 80 degrees yet that's sfo at 62. downtown san francisco is only 60. yesterday, they were 83. we have a huge drop. san jose, 73. santa rosa 72. fairfield and concord pushing in the upper 70s.

for some it's really warm and for others it's cold and foggy. westerly at sfo, little north wind continues including san jose also out to travis and vacaville, a south wind at santa rosa, that's a cool direction for the north bay in this kind of a pattern. for many it's like okay, there's the fog. but other others where is the fog? that system right there is just -- literally disintegrating but it's enhancing that fog bank. it should lift it by late this afternoon tonight and by tomorrow inland areas will cool down. for today if you are well inland you are gonna miss out. if you are by the coast and by the bay it's cool and foggy. the breeze has picked up for some. but inland areas still held in check. it will be much cooler coast and bay today. there's plenty of fog out there but there's also sun if you don't have the fog temperatures, some, 80s, low, mid for others, it will be in

the 50s, 60s or even the 70s and the extended outlook which always has your northbound view, we'll have low clouds and fog, probably into thursday and after that friday, it looks like more and warm weather will take us into the weekend and the last week of october, i might add it's also looking sunny and very warm. thank you, steve. here's something you won't see in the bay area, a massive tuft storm rolled you three -- rolled through lubbock, texas. the wall of dust was picked up by strong wind gusts, some up to 60 miles an hour. no injuries were reported but the heavy winds brought down some trees and power lines. the number of credit card customers missing payments is on the rise. five of the six major card issues are reporting an increase in customers missing payments from september compared to the -- compared to the previous month. the last time so many companies

reported such an increase was february of 2009. analysts are worried that could be a sign of deepening economic woes. a hayward woman is $2 million richer. shirley mills is the big winner of the set for life scratcher game. mills bought the winning ticket at a lucky supermarket in san lorenzo. she will get $100,000 a year each year for the next 20 years. she says she will use the extra cash to pay off bills and help their two adult children with their expenses. just ahead a check on stocks. is was not just customers clerking out fresh produce at an alaska grocery store. we'll tell you how a bear cub got inside. ♪ [ ukulele strumming ]

banks and home builders, bank of america rose 8% after it beat earnings expectations for the third quarter. the survey of u.s. home builders show they are let pessimistic, i should say, about the struggle, market. that's helping buyers. right now, the dow is up 189. the nasdaq is up 43. s&p is up 25. two bay area tech companies will report third-quarter earnings today after the closing bell. that includes apple and it will

be the first report since tim cook replaced steve jobs as ceo. iphone 4s sales will not be included in this report since the third quarter ended in september and the new phone did not go on sale until last week. engineers may be able to complete the shutdown -- or rather, shoppers at -- rather i should say the engineers may be able to complete the shutdown of japan's fukushima power plant ahead of schedule. the plan was too shut down three reactors in january. but engineers say they mighten cool enough to shut down earlier and start on repairs. >> the plant was badly damaged during the earthquake and tsunami that hit japan. shoppers at an alaska

grocery store got a bit of a surprise last week. there was a bear scurrying through the produce display and the bear somehow found its way in and a brave customer grabbed the cub and put him inside. no word where its mother was at the time. the store believes -- believes it got in through automatic doors. a new showdown is in the works between so-called occupy protesters and the city of san francisco. we're tracking the protesters and we'll be following them throughout the day. we'll show you what happens when any show up to talk to city leaders. when they show up to talk to city leaders. fine, i just got a little fender bender.
