evening. thanks for joining us for kron for news at 6. i'm ken wayne and i'm vicki liviakis to have the debate was set to happen on monday. and according to the organizers, 4,000 people of ours feet. pete. >> we first learned wednesday, mayor london breed and supervisor aaron peskin won't be participating. the mayor's office cited conflicts with her schedule and format of the debate together. sf action announced today that candidate daniel lurie also pulled out making former mayor and supervisor mark farrell and supervisor sof 80 as the only would be participants in their cancellation announcement together. sf action said, quote, their refusal to show up and speak to the largest community of voters in san francisco. >> cruz and our movement to hold our elected officials accountable results is working. if the mere announcement of a real mayoral debate in which candidates would be as tough questions causes this much drama, the political establishment must be really afraid of change.

now to our other top story tonight, a top story tonight, david de pap the man convicted of brutally assaulting nancy pelosi's husband, paul pelosi. we'll spend 30 years in federal prison. he was sentenced today at a federal court in san francisco. >> the judge allowed several victim's statements to be read into the record, including one from nancy pelosi who said that her husband is still struggling with his injuries and that she's in favor of the maximum sentence. one of david, the paps 2 sons also spoke in court. >> and you really tried his best to be a kind person. and the thing is because i know him personally, i know that there is no real heart and that person. >> the path is also facing 6 felony counts in state court, including premeditated attempted murder and burglary. jury selection in that trial is set to begin next week. >> crowne forza lezla gooden spoke to a legal expert about how today's sentencing at the federal level could affect the state proceedings. leslie?

>> federal trial is finally over for david de pap. the man convicted of breaking into former house speaker nancy pelosi is home and assaulting her husband with a hammer 2 years ago. a federal judge on friday sentenced him 30 years in prison for salt in 20 years of attempted kidnapping. the federal official, the sentences will run concurrently. the government wanted to say here is that we have to protect. >> our governmental officials and we have to protect our american system of democracy. and this was much bigger than just the pelosi family. this was sent to the community. and i think that was loud and clear. legal analyst steven clark says >> the sentencing could determine the outcome of dip happes upcoming state trial. some charges he's facing their includes attempted murder, assault with a deadly weapon and elder abuse. but the key will be did he have specific intent to commit murder paul pelosi? and i think that would be the big fight. >> in the state case, if he's

convicted of attempted murder, he will face a life sentence. but if he's only convicted of assault, it will be a much want less sentence. 44 year-old the pap admitted that he had planned to hold the speaker pelosi hostage and break her kneecaps if she liked him. >> both the prosecution and defense stated that conspiracy theories played a role in the attack. >> lou, janell statements and conspiracy theories. he was espousing. >> both before and after. >> the incident with mister pelosi, i think is going to go a long way in. >> the state court to show that he did not have the specific intent to commit murder, that this should be an assault with a deadly weapon. clark says there is another factor in the paths federal case that the defense did not focus on. >> but it could be a key point in the states. the mental health issue is going to be much more important in the state case. it was in the federal case. and i think that. >> well, before front in the defense presentation, he did not have the specific intent

to kill. and, you know, they will acknowledge he mister pelosi with a hammer but not 2 killed. >> and the path state trial is expected to start its jury selection next wednesday. we'll have those updates here and online live in the newsroom. let's go in. kron. 4 news. all right. thank you. less >> take a look at this. a huge oak tree crashed onto at least 2 homes in nevada this morning. this is on cinnamon teal lane and puffin court west of highway 101. nobody was hurt, but both homes have now been red-tagged pg. e crews also responded to handle a gas leak. a total of 8 units had to be evacuated for about an hour. one man says he was working at home when heard the tree collapse. my office actually overlooks the tree and probably around 11, >> sounded like large cans being dragged across trio of rumble of sorts, which i thought maybe was an earthquake. but nothing's moving. and then seconds later, just enormous pop. and then i saw the right down the

middle of the street. >> neighbors are telling us the tree was more than 300 years old. it was the oldest oak tree in novato. >> that are 4 zone forecast as we're on the cusp of the weekend. looking live at mount diablo in the east i want to go hiking up there. lawrence is a good weekend. yeah. should be beautiful weekend. i think we'll see less fog this weekend. but slightly cooler temperatures around the bay area's a cooler air mass kind of settles in overhead out there today yesterday that fog that is rolling back on shore. but you can see right now it's not thick as was this point last night. just something there's a fog, a sliding inside the bay from our mount tam cam outside right now. but temperatures kind of all over the map. you've got cool fog along the coastline. 55 in half moon bay, a pleasant 72, though, over the redwood city, 71 beautiful and sunny and san jose. 71 in concord and 70 degrees in the bottle. so that fog certainly playing a factor in our weather and will continue to do that as we head throughout the weekend, little bit more of a northerly component today kicking in

that up the road, some of the marrne there outside. but still hugging the coastline right now. and there's no getting around that is going to move in back on shore for tonight. start to creep inland right now. more that on the way. but i think less fog overall as we head in toward tomor ow. still, if you're headed out on this friday evening, what a nice evening to get outside and enjoy comfortable temperatures inland cool by the coastline. if you're headed that way, we're at a light jacket or sweater. temperatures in the 50's and fog at the coast. thank you, lawrence. in the east bay, martinez residents might see flaring this month because >> the martinez refining company is finishing major maintenance project late last month that began restarting equipment to make sure that they're processing units are in good shape. the company says that flares are essential part of their system to safely manage ex-us combustible gases while burning them off efficiently. they say and effectively the martinez refinery hopes to minimize or prevent any flaring during this process. more than 70 million dollars has gone into upgrading equipment.

happening tonight, highway 37 will be closed again this weekend between sonoma and solano counties. >> caltrans will be working on a repaving project. they say they'll have detours beginning at the highway. 37 highway one. 21 interchange near sears point. the closure will begin tonight at 10 and will run through 5 o'clock in the morning monday. >> also happening tonight, lanes of us. i 6, 8, are going to close this weekend in san ramon starting at 9 in alaska through 4 o'clock nday morning. the partial closure is one of 2 with another set for the weekend of may 31st. caltrans says it's going to affect southbound 6.80, between al costa boulevard in san ramon and the i 5, 86, 80 connector in pleasanton to keep traffic congestion down. caltrans suggest taking alternate route for a full list of those that you can head to our website. kron 4 dot com. >> trader joe's is now open in san francisco's hayes valley neighborhood. the fulton street stores now the city's

7th, tj location. the area's been subject to encampment and vandalism over the years. but now neighborhood residents say they're excited to have a new grocery option nearby. >> we're so excited because this is part sort of revitalize and savor. do so excited. it's yeah, it's tough to get to grocery store a lot of the time and it's so nice. i look like a block away. so i'm excited that i can actually it on the plan is launching groceries going to be it's a great community. so i think it'll be a place. >> store hours will be 09:00am until 09:00pm 7 days a week. thousands of people are going to be in san francisco sunday morning for the annual bay to breakers running jogging, financing their way to the finish line during corky 12 k our kron four's rob nesbitt talked with organizers and runners taking part this weekend. >> on sunday participants, a bay to breakers will start on main street in san francisco around 08:00am and make their way all the way to ocean beach on the other end of the city,

the costumes are always a big draw. but there's also a rich history to this 113 year-old tradition from the starting line. the creativity is evident with the runners, a bay to breakers. it's become a tradition for tony him. all to and this has been day or they're also in charge of coming up with different group costumes for their friends every year. 80's aerobics instructor. >> for the year that we got married, we did a big group of bridesmaids together and we had to be case. we throw strangers. and this year argue cost you ms cheerleaders. they'll join around 21,000 other runners who have signed up for the annual 12 k. >> race director kyle myers says the fun of the race is always the biggest draw. one of those days of the year in san francisco that everybody kind of supports the runners supports the neighborhoods are coming out. course, just to have a good time and celebrate. francisco myers says this year there will also be a 2 person relay option with one person starting the

race while they're running partner finishes the 2nd half. in addition to the race that started as a symbol of san francisco's rebuilding after the 19, 0, 6, earthquake hansford. the city turned rally around and get people excited about something. francisco really being fact. so that i was in 1912 at its peak bay to breakers was the largest road race in the world over 100,000 people. organizers have had to make some changes over the years to ensure public safety, no more floats and alcohol checkpoints have been added along the route. what's always remained is the fun that even spectators join in on first year the san francisco bay to breakers. and it's just such a great entry into the city >> you get to see how a vibrant and while the city can it's just such a great time. runners are recommended to get to the starting line at howard and made at least 45 minutes to an hour ahead of the 08:00am start. >> there will also be several road closures along the route from 03:00am to 04:00pm on sunday. you can find the full list of details about those road closures on our website. kron 4 dot com reporting in

>> so now the state university president mike lee, has decided to retire. this comes after csu administrators placed him on leave for insubordination after he made a deal with pro-palestine protesters. the chancellor of the csu system says it president lee's agreement was made without the appropriate approvals. the agreement included an academic boycott of israeli universities. some students in sonoma think his punishment was unfair. >> i support the president they green months because against genocide, kind of crazy. how a statement about lake ending genocide is like. crazy, crazy thing that has put someone on leave. >> pro-palestine student activist groups say that the agreement late out in a 3 page letter was a win. others saw it as anti-semitic. >> the nature of the program being in southwest asia, north african studies was made

without consulting with subject matter. experts in the middle east of whom i consider myself. one of them is done a really good job up until now as president. i think that he did not handle this this situation. well, but i personally would hope you'd be given another chance. >> csu has appointed nathan evans as the new acting president of sonoma state graduation is scheduled for tomorrow. >> on berkeley's campus, a dozen people were arrested, including one student after police broke up a pro palestine demonstration at a vacant uc berkeley building. officers say 12 people blocked an entrance to the and ahead building with plywood and shields last night and violently resisted arrest. they say some even used crowbars to hit officers. those arrested are now possibly facing several charges, including vandalism, trespassing and destruction of property. uc police are reviewing video to see if they can identify those who attacked the officers. meantime, the university of california is responding to workers voting to authorize a strike. the union representing

off-ramp shortly after midnight, they say one of the cars overturned near the center divider. information on the person who died. your cars in the crash have not been released. california lawmakers have decided not to advance a bill to legalize psychedelic mushrooms. san francisco state supervisor rather senator scott wiener was behind the regulated psychedelic assisted therapy act. it would have allowed licensed professionals to give psychedelic mushrooms to patients over. 21 years old. the bill failed to advance out of its senate committee this week earlier this year, governor newsom vetoed a bill from winner that would have legalized the possession of small quantities of hallucinogenic >> this year's allergy season maybe a little worse in years past for some people here in the bay area. scientists at harvard say that not only are our cheese intensifying, more people are finding themselves allergic to airborne irritants for the first time they blame a warmer client climate rather and recent rainfall. earlier

not so bad, but by sunday, monday, tuesday and wednesday, boy were cameron very high. pollen counts as we head in toward those days. so be prepared if you are susceptible to those upon be prepared. this could be running very high as we get to the weekend. and in the next week, of course, it's all carried by the winds out there. we've got plenty of wind out there right now. a lot of times we see the wind switched directions. that's a lot of people have trouble. stu, we see the offshore winds that will carry a different type of pollen from a different pot type of plant in different areas. then we see those switching. it goes the other direction. we get the sea breeze as if to carry pollen from the ocean back toward the coastline. so there you go. we got the winds kind of sweeping things on shore right now. some of those wind gusts. how about that? the 32 miles an hour and a san francisco right now that will things along. overall, though, the pattern, looks like a nice weekend to besides all the high pollen count, we've got some nice weather coming our way. i think overall, i think we'll see a little more sunshine. but looks like the temperatures are going to be a little bit cooler. we've got little trough of low pressure

versus board of education decision paved the way for black students to integrate schools. we must accept they have today. before they even decided to place us in the clash. but at justice department ceremony tuesday celebrating the decision 70th anniversary. officials say segregation still exists. there's still so much work that we need to do to protect our kids. kristen clarke, the assistant attorney general of the civil rights division, says examples of segregation include an equal access to higher level courses and disciplinary actions against students. we need a level playing field that gets every kid a fair chance. the government accountability office reports more than 18 million students still attend a segregated school today to fight back. clark says the justice department sues schools to reach settlements. we can take progress for granted. education secretary miguel cardona says his department is also fighting back against curriculum changes and book bans in some states. we all know that black history is

utilities commission led by governor newsom's appointees approved a new charge for $24 and $0.15 last week in return for paying the new fee. consumers. we'll get a lower rate for their power. the state's electric rates are the second highest in the country. the new fee course sparked utrage, which is why the bill was introduced. the committee did not explain why they killed it. although still above 7%, mortgage rates have dropped for a second week in a row. the latest data from freddie mac shows a a 30 year fixed rate. it's now 7.0 2%. that's down 7 hundredths of a point from the week before a 15 year fixed mortgage is now 6.2 8%. the lowering rates could start to fuel a new wave of mortgage or even refinancing applications. still ahead on kron for news at 6, the california gop will get underway this weekend in
