charged with one count of involuntary manslaughter. alameda county district attorney pamela price announcing charges against 3 officers involved in the death of mario gonzales. >> on the eve of what would mark 3 years since the deadly encounter on april. 21st 2021. alameda police responded to a call for a report of a man at a park talking to himself and scaring the colors wife. when police arrived, they attempted to take him into custody, but a struggle ensued. police body cam video shows 3 officers pinning gonzalez down for several minutes. the coroner ruled his death a homicide saying officer restraint played a role along with other contributing factors under the former district attorney nancy o'malley. prosecutors concluded there was not enough evidence to warrant criminal charges against the officers. price reopen the case along with 7 other cases involving custody deaths. the da's

public accountability unit reexamined the evidence and filed charges against the officers thursday. price says she is not directly involved with this case that i'm walled-off from the case. i will not be participating and have not participated in. >> the ultimate decision about the case, the attorney of then alameda police officer james fisher tells me he doesn't believe price. topping honest with the public. >> about role in reopening the case to begin with. and frankly, i'm sure a role in making the decision to charge on. but really the last day that you could charge case. michael rains says his law firm just started to represent fisher. so he still looking into the case. >> but he says he's confident his client followed police protocol. the family of gonzales settled a wrongful death lawsuit against the city of alameda and the officers involved for 11 million dollars back in december. the

attorney representing gonzales, his 8 year-old son michael haddad, spoke with us on the phone saying in part, the charges are obviously appropriate. it's been obvious for a long time. in addition to costing the city 11 million dollars. these officers should also face a jury who can decide if they should be held criminally responsible to at the press conference. price said the officers charged face 15 years to life, but then emailed us a correction saying they actually face up to 4 years behind bars. thursday was the last day to file any charges against the officers due to statute of limitations. >> in the newsroom, sara stinson back to. >> it's 10, 0, 3, and the 3 men accused of killing our kron 4 security guard while he was protecting a news crew in oakland appeared in court yesterday. the 3 face murder, attempted robbery and assault with a deadly weapon charges for the killing of kevin nishita who was gunned down november 2021. she his wife, helping us follow this case.

and she says the plea hearing has now been continued until next month. we will continue to follow what happens to these 3 oakland police officers made several arrests oonnected to a series of tobacco robberies that happened throughout the bay area. the most recent was tuesday morning on mountain boulevard and shown avenue. that's where a truck was delivering tobacco products when 2 cars pulled up. >> and armed people came out. they stole other tobacco products and took off. >> oakland police along with other law enforcement agencies arrested 8 people connected to this and other cases of tobacco robberies around oakland. and they also recovered tobacco products and firearms. >> on the peninsula, a person has sadly died. now after their car went off a cliff thursday gray whale cove state beach in montero. that's just south of pacifica. here's a look at the scene. >> firefighters say that vehicle fill 200 feet down the

cliff. saw the helicopter. they had to use that to lower rescuers down onto the rocks with that vehicle landed. unfortunately, the person inside died were still working to learn why it was the car left cliff. >> cal osha, fines of san francisco, construction company, $370,000 in the death of one of its workers. the accident happened last september in the city's lower haight neighborhood. 24 year-old worker was placing sewer parts inside an 8 foot deep trench when the dirt walls collapsed. burying him. cal osha found the employer darcy and hardy construction knowingly committed safety violations by not properly protecting employees working in that trench. >> walnut creek city council meeting is once again interrupted by a man spreading hate. take a look at the video wednesday night. this man's as he came to a the walnut creek meeting. he drove in from sacramento to spew hate against jewish people. and you

can see that they were prepared from this time. now take a look back in march when he showed up same guys feeling, hey, they didn't know what to do this time. they had pride, flags and religious symbols behind him as he continued his rant against jewish people 10, 0, 6, right now. and >> we ever go home and your boss calls you on your off the clock and make sure do stuff for you have to answer emails. >> well, there's a bill working its way through the senate assembly that would stop that. it's headed to the appropriations committee now after passing in labor and it was introduced by san francisco assemblymember matt haney. this bill would give employees the right to disconnect from e-mails, text messages and calls after their work shift is over. it does make some exceptions, though, if it's an emergency or to discuss scheduling and certain businesses like if you work on usual hours or you're on call employee, those businesses are exempt from contacting. >> well, state lawmakers are also trying to block a new fee

that you might see on your electricity bill next year pg e customers are on track right now to see $24 charge every month. but in return for that fee, regulators want to reduce electricity rates by 5 to $0.7 per kilowatt hour. as it stands, the california public utilities commission is expected to approve the plan next month. and if they do. well, that new rate would take effect late next year. >> time now is 10, 0, 7, and 10. it eastbound highway 12 santa rosa is going to have some closure. so, some full closures, some partial closures. we've got rain harbor here in the studio to explain right now. that's right. so the closures in a start tonight at 8 o'clock and it's going in 05:00am monday morning. so caltrans says alternate partial and full closures between dunn avenue and south e street exit. they say the closure is going to be divided into day and night shifts and they hope is going go by a little faster. so at night, the eastbound freeway right between dunn avenue, south e street, that's going to be fairly close during the

there essentially bringing these pandas to san francisco. she's been working there to bring new businesses and tourism to san francisco over the last week. and she's been working to get pandas to the city since really november during apec summit when she asked the chinese president to bring them here to the city. take a listen to what she had to say about the new historical moment. >> we have been working closely with our local. >> chinese and asian community in san francisco to advocate for pandas for nearly a year. and it's an honor that our city has been chosen for the first time to be a long-term host, 2 giant pandas. >> now, as of right now, there is no official timeline as to when they'll get here. but the san francisco standard report that the zoo here, the ceo, says they're already working on renovating an extsting space in the pandas could arrive as soon as 2025, they also add in their report it

approved the 77 million dollar renovation and a whole new reinvention really of that facility is going to combine the aquatic park and the community center so that it will also function as an emergency space as well. design work will likely begin in september of next year. and the construction time is about 2 years to build the existing swim center will stay open. they say through that entire construction process. >> if you love food and you love a good festival, here's one that happening tomorrow. the multicultural food fest takes over piedmont park. they've got dozens of food and drink vendors showcasing special menu items at the piedmont food festival and also live music and all kinds of merchandise. the doors open tomorrow morning at 11:00am. >> and redwood city is gearing up for some fun activities this summer, a free concert series. it kicks off in may and runs to august. they're going to have weekly music lineups over it. stafford park

be wanting to rename it, but san francisco in the name somehow some way out. the ruling could revolve around whether that name change. >> confuses travelers kron four's dan kerman with a closer look. >> what's in a but it comes to san francisco's airport. the city says so much that it's suing the city of oakland to protected. we're asking the court. >> to tell oakland to stop using its new name last week. oakland port commissioners voted to rename oakland international airport, san francisco bay, oakland international airport. this is about clarifying to travelers that oakland is an efficient instinctive. choice to fly into the san francisco bay. oakland's proposed name is going to create immense confusion and chaos for travelers, particularly those who do not speak english. san francisco season differently and is filed a federal lawsuit maintaining oakland airport's name change violates its trademark and is designed to confuse travelers and safe and

name. >> to make online flight reservations. well, the port of oakland is already approved. the name change final approval will not come until the may 9th meeting. that means until that time. this will remain oakland international airport. dan kerman kron. 4 news. >> a lawsuit against bart riders by disappear. a lawsuit against bart by disability rights advocates has now been settled. the suit was filed back in 2017. it claimed bart systematically failed to ensure full and equal access to its stations and services, which is a violation of the americans with disabilities act as part of the settlement, bart has agreed to renovate its elevators and escalators and dispatch a repair person within an hour after either breaks down to the station. in the south bay, san jose police have arrested 2 men and a woman connected to the kidnapping and torturing of a man. so it's back in february that police say the victim was held against his will and assaulted multiple times at a house on million court. not far from reid-hillview airport

they say the man was released eventually about a day later and checked himself into a hospital. officers say that's how they learned the 3 people were responsible for the assault during the arrest. police say they found illegal gambling machines and marijuana for sale with the suspect's home. >> it's 10 20 and take a look at all of this merchandise. police found $150,000 worth of stolen goods into homes in san jose. they arrested 13 people. they may discovery earlier this month while searching for a search warrant as part of an investigation into retail theft. and they found things that had been stolen from home depot, target and kohl's. and it's all going to be returned. >> there are supporters of a bill that is aiming to curb retail theft prop 47, which was passed by voters. >> in 2017 reclassified, some nonviolent crimes, including theft to a misdemeanor. and as a result, punishment went down

>> we are back 10. 24 is the time in april as parkinson's disease awareness month. parkinson's is the second most common neurodegenerative disease after alzheimer's. and according to the parkinson's foundation, the disease affects 10 million people worldwide with nearly a million people here in the u.s. impacted and that number is expected to go up by the year 2030, a doctor here in the bay area with an expertise in parkinson's took part in a health documentary to bring more awareness to the symptoms and how to cope with them. so we spoke with that doctor. kaiser permanente. neurologist doctor, rima ash about what those symptoms are. >> then as we get older, we have a higher risk of developing parkinson's disease. but in fact, there are people with young onset disease as well, even into their we now know that it's much more than just a motor disease have a lot of non- uttered features, including

changes in mood. insomnia changes in their g i track and blatter. >> if you want to take part in the fight against parkinson's disease. well, this saturday, the parkinson's foundation is going to be holding there moving day. walk at the lake cunningham regional park. the event starts at 9 o'clock and you can sign on sign up online at moving day walk, dot org. >> in other headlines this morning for the first time this year, mortgage rates are climbing back over 7%. freddie mac's latest. >> mortgage rates survey shows that the average rate now for 30 year fixed mortgage is now 7.1% this week. that is up from the 6.8 we saw last week. yes, it is lower than the high of nearly 8% that we saw last summer last year, which was the highest we've seen in a quarter century. but this rate is still high. 7.1. in fact, a lot experts say this could force housing costs go up with sellers opting to keep their houses off the market.

jumped into action and put their own lives at risk. shadix has their story. >> we just knew we had to do something and to help. it was a reaction. it was an almost an instant guide. i didn't. think to think what i was going to do, i just reacted. >> joseph in jena roseman were driving by when they saw the accident and also sprung into action. everybody was trying to push the car back onto its wheels. team. >> u.s. and i don't know a big group ab about 2015 of us. we all helped push the car back up and then. we just did what we what we thought we could do. trapped inside were 3 adults and 4 children. i looked down and i have to be the closest one to the to what i could see was a baby's arm. >> so i just i got down on my on my knees there and and and was trying to be like. >> trying to be gentle cause. you know it to great if you you know it to great if you come right out and grabbed the from accident scene and started cpr.

>> his wife, gina, then stepped in as joseph ran back to help. some more just grabbed the baby from that point and ran further away closer to the truck. but further away from the fire >> leave the baby down and went and started chest compressions there. meanwhile, christian and monica work to get the other kids out from the minivan. >> monica recalls one of the girls after she was pulled out. he just let out a scream. but i will never forget it. she was just being in florida and i told her, you're ok, you're ok, we're helping i was just holding her head. >> in the middle of the street, i could see that other people were grabbing the the other kids and what not. and it was. >> even that night as one was getting rolled by on a stretcher, i could see the breath like condensation from the press coming from the churches are right. there was just ok, good, at least somebody still and has a chance. of course, that that's the feeling knowing that that you're able to at least help somebody. i'm just glad that everybody came together in that moment and able to help. however. however, you know

the life of other 3. i just want to which i mean. >> it's we can. >> thing coming out in manatee carolina shadix. >> also in the news, the driver who hit and killed a 4 year-old girl in san francisco last august will not spend time behind bars. the crash happened as the girl and her family were in the crosswalk at 4th street right near ordcle park. the little girl died. her father was critically injured. the 71 year-old driver who hit them was charged with vehicular manslaughter. but now months later, both sides have agreed to a plea deal and the driver will instead ser 400 hours of community service and complete a driving course. san francisco district attorney brooke jenkins released this statement which reads in part, quote, in line with the family's wishes and with their support, we reached a negotiated disposition rather than going to trial, although nothing that we can do. will bring their beloved daughter and granddaughter back. i hope this settlement brings them

some solace as they work to heal and rebuild their lives in the wake of the terrible tragedy last summer. >> it's 10. 35 sfmta is proposing new safety improvements to the west portal neighborhood after number about a month ago, a family of 4 was killed while waiting at a bus stop the agency is trying make things better by, including more dedicated and protected space for pedestrians and also removing car traffic from the train tracks. the sfmta director says the goal is to simplify the high traffic lanes along willow street by restricting cars from driving through the intersection. >> prioritizes people, i'm going to shop in the west portal commercial district and support street by eliminating all of the left her for about 40% are traffic a result of drivers making left turns and not be best ratings.

>> the agency is going to collect feedback on the improvements and then make the changes by summertime. >> east bay homeowner scared off some would-be car thieves trying to steal his pick up got shot in the process conference. dan thorn has his story from hayward. >> barefoot and running mad francis jones goes face-to-face with 2 men trying to steal his pick jones as it to 30 in the morning last week he was barely awake when his instincts kicked in. >> you can stand inside your house and be a victim and i wasn't going to let that happen. jones's home security camera alerted him and his wife of the crime in progress. jones as he caught one of the would-be thieves taking around after breaking into his dodge pickup. i reached around his neck right here, grabbed him. and since coming to a head lock in and yank him out of the >> i'm in the video. you can see the struggle. is jones

yells out to call police. then a gunshot inspired when the guy shot at me. i kind of got we woke about what really was going on and i let the guy go and i jumped for cover after >> troublemakers then took off in a white sedan. jones says for more than 20 years, his neighborhood along carol avenue has been pretty quiet and he hopes it could stay that way. police discourage people from confronting criminals because of safety. but jones says he had enough. i didn't get shot. i didn't get hurt. they didn't steal my truck. >> so hopefully it sends a message that, you know, don't go so to another street and not come around here again. >> heyward police say they found that getaway car abandoned and it was stolen and their investigation into this attempted auto theft is ongoing in hayward, dan thorn kron, 4 news. >> in the north bay marin county, maybe closer to building and all affordable

housing complex on the site of marine wood plaza. so the county says that developers want to create 125 apartment units on that site and it would be located at the corner of miller creek road and marine wood avenue. they say builders want to make apartments for households with incomes ranging from 30 to 70% of the area's median income. the county come in county community development agency director says that some residents already living in that area may have reservations about a new affordable housing development. but they want to say that this is necessary for the county to build housing that would support the community. >> 10, 30 right now and this dog knows how to party. and it's not just because he's wearing a yesterday, san francisco city supervisors visited the animal welfare organization to honor april 18th as s f spca day. >> state senator scott wiener made a visit there taking the mike, the organization celebrating 156 years helping people and pets in the city. they are known for their

increase access to veterinary care and animal advocacy work for talks like they new school is opening up for students in dublin and its state of the art. oh, yeah. the double unified school district broke ground on a number of high school 4 years ago. >> and kron four's philippe recall gives us a look at what it's like now. >> i can't wait for this to be filled up first day of school, francis rojas is emerald high school's inaugural principal in the dublin unified school district's newest campus. the longtime educator honor to jump start a new era. we've seen a lot. her school schools open up and this is the first comprehensive high school 50 years here in alameda county. when the school opens in august, it will welcome its first students who are currently sharing a campus with dublin high school and will mitigate the academic strains placed on the community caused by a rapid growth in the district's population over the past decade and a half. currently,
