going to vote on whether to ban on house encampments near schools. we're live with the latest and the battle between san francisco and the port of oakland intensifies. >> over the potential name change of oakland international airport going under in harvey in for darya folsom this morning. and i'm james fletcher. lots to talk about. obviously. we'll get to those stories in a minute. but first, one of the stories that's impacting everybody. the beautiful weather today. sunshine's. hi, good morning. yeah. i love to see it that sunshine at the golden gate bridge is very welcome as it is behind me at the bay bridge as well. nothing blocking out the sun today. no clips clouds either. we did briefly a little bit of fog at the golden gate earlier on this morning. as you can see, that is a long gone now. so this has been a morning that has brought us really clear skies. and it's a day in general. >> that's going to be just as clear as yesterday, but actually a little bit warmer. daytime highs will eventually rise to the 70's. but for now, we're still in the 40's to 50's. so i wouldn't forget those jackets this morning, especially if you're going to be out and about may be taking public transit will be outside for a few minutes later today.

there's those 70's showing up will save the 80's for tomorrow. that will be the first time this season that we i'll get to that your full forecast. we have michael thomas in for traffic this morning. one of the roads looking like. >> thanks, john. and good morning, everyone. will the roads look good so far? taking a look right now at traffic tracker for you can see lots of green, which means go but also some small pockets of that red and that orange taking a look right now over in the north, they were still seeing some residual delays. there was an accident this morning on southbound 101, near the san antonio road exit. so if you're heading into the city from the north bay, expect those delays. the left lane was blocked. chp is working to get that cleared out and over in the east bay right now, if you're heading in from the walnut creek area, there's been a traffic collision on 24 near the lafayette area, east of pleasant hill road. so just keep that in mind that still being cleared up. a look at some drive times. we've got a total of 36 minute commute crockett to may's walnut creek to 5.80, a 13 minute commute. castro valley to the maze. 22

minute commute. san leandro to the maze. a 22 minute commute that once you get to that you're heading over that bay bridge. right now. it's a 13 minute commute into the city, james. and right now, send it back to you. all right, michael, thank you for breakdown there. 801, is the time and happening today, san jose leaders will vote on a new measure to limit where homeless encampments can be. yes. so they say the move is necessary to help keep schools safe. >> will tran is live in san jose to explain that and more. good morning. well, the council members, they will decide on something they actually decided 3 years ago in all explained that just a few minutes. >> but few moments, i should say, the council members, they you know, it's not popular with the homeless advocates. homeless advocates believe that this is an attack on the homeless. a lot of times. it's not their fault. they simply cannot afford a traditional house. but a lot of parents and students there are fighting back saying the school areas are not safe for them because when they walk to

school, they say they walk around a lot of homeless as well as needles. they claim what's going to happen is the city council members will decide a couple of measures. one measure was actually decided 3 years ago. that said that the homeless encampments cannot be any closer. that 150 feet to a school. but it was more like guidelines. it's not the laws. so what they will do now is tried to make a law by trying pass it. if that becomes law that a police officer can come up to a homeless person and site that person. >> but they're not asking for money. they're just saying that you can't be any closer then that established distance another measure that they will be trying to pass our rv's and vehicles in school zones. the homeless advocates don't like this because they say there's not a lot of areas in san jose. the park, a lot of homeless use rv's instead of traditional houses to live in. what they will do is they will

look at certain school zones and fake. >> you know what? this is not safe to be here because it's so large that trucks, the views of drivers as well as people in the cross walks and that could be dangerous for the students as well as the teachers and parents moving about the school's own. what's going to happen is they will get a warning. and after that, if they're not moved, then they will be towed. >> all right. well, thank you for the breakdown there. >> it is 803. now to a disturbing case we've been following out of the south bay where 3 suspects now in jail charged with murdering a three-year-old. her family members say they were performing an exorcism. >> no, the released documents reveal that child fought for life want to escape from the church where a mother, uncle and grandfather for an exorcism to cast out a demon. they claim have disaster. this all happened back in 2021. investigators say the girl's body had several injuries when firefighters found her at the altar of this church in downtown san jose. a coroner determined she died from a

combination of expects you and smothering. the 3 have pleaded not guilty. and a judge set to rule on whether the case will move forward to trial will keep you updated. meanwhile, new this morning, a pedestrian died while crossing the freeway near san francisco international airport. it happened last night at about 10 o'clock. chp says a r struck the victim on southbound 101, near the airport. offramp investigators are still looking into why the person was on the freeway in the first place. tesla now battling to court cases in the south bay this week. >> the company decided to settle one where a family was suing the company over its autopilot feature. they say now function and killed a man in mountain view. crash happened back in 2018 on highway 101. investigators say the driver was playing video games on his phone while using tesla's autopilot feature that investigation determined the auto pilot system did not recognize a lane change on the highway. tesla's long said feature does not prevent all accidents. don't have any word on how much tesla settled for both sides, but they're going

back in court this thursday to discuss the settlement further. another court case involving tesla is going to be heard today. case involves a family's 2 year-old son crash. the tesla into his pregnant mother back in 2018 lawsuit accuses tesla consumer fraud for advertising, the model x as safe and also claims tesla knew about a defective design. tesla denied any liability. >> well, on halloween island, check it out. smoke coming from the posey tube yesterday after a pickup truck caught fire inside happened about 7.30, last night. crews from alameda and oakland both responded. they evacuated the toobin work for about an hour to put the fire out. no word if anybody was hurt. also in the east bay hayward, firefighters put out a fire at paul di and hall road last night. you can see here in this video from the citizen app, the flames there coming from the building. the fire was reported at about 10 o'clock last night. no word on if anybody was hurt or how that fire started.

>> san francisco now threatening legal action over a proposed name change for the oakland airport just days before the vote. oakland is set to vote on a brand new name. yeah. so the proposed new name for oakland international airport would be the san francisco bay oakland international airport. a cropper sarah stinson has more on the battle and the confusion. >> at the oakland airport on monday night. rumblings could be heard about the airport, possibly getting a new name. san francisco bay, oakland international airport. i think it's ridiculous. the port of oakland manages the airport and first proposed the name change late march. the port president says this will boost travelers, geographic awareness of where the airport is located. but people flying in and out of the airport say this would only make things more confusing. nothing about here that some francisco. we're trying to get away from some school. that's why we

come here. you know, some of erent cities. so that's way confusing. oakland mayor sheng thao has said the new name could support the airport's efforts to secure more direct flights and boost tourism in oakland. but across the bay, san francisco mayoral candidate and supervisor. asha, suffice as the name change would hurt sf. >> san francisco's a port of entry for millions of immigrants. millions of working people, people from all over the country in the world and what you don't want ever is for there to be confusion ahead of the port commission scheduled vote on thursday. san francisco city attorney david chiu center letter threatening legal action if they go through with it. chew says the proposed name infringes on sf those trademark. >> their proposal appears intentionally designed to divert travelers. it may be unfamiliar with the area. geography. we believe that the clear similarity and a very high likelihood of confusion

gives us a strong federal trademark infringement in response to the possible lawsuit. the oakland airport released a statement saying in part the proposed name modification will clarify, not confuse the new name identifies where the airport is actually located. >> it also added that once the board approves the name change, the port will take appropriate measures to use the new name city attorney to says he hopes to speak with port officials before the vote on thursday. but if it gets approved, they are fully prepared to move forward with legal action. >> i'm sara stinson reporting at the oakland airport kron. 4 news. >> to wait as the time and the war on fentanyl continues in san francisco police department posted on social media that since the end of last may, they seized 182 pounds of fentanyl. they've also arrested more than 900 people for selling narcotics and more than 1000 people for using the drugs. >> well, francisco mayor london breed advocating for

the cities downtown recovery efforts. bree is telling her support behind 3 key state bills authored by san francisco officials. these 3 pieces of legislation would provide the city with a set of creative solutions to help build on local efforts to revitalize the area. mayor also spoke about the work the city is done to help restore the vibrant downtown area. 2023. we saw one of the lowest crime rates. >> we've seen in the past 10 years, not including 2021. we shut down for a global pandemic. we see those trends continuing because of the work that we're doing to address retail theft, open air drug dealing and using car break-ins and a number of other challenges that persist. well, the mayor has touted her 30 by 30 proposal which aims to at 30,000 more residents. >> students downtown live 2030. and the east bay after wet weather postponed of last week, oakland's first friday street fbstival is finally

today, we're all going to be out there, hopefully at least for a little bit. enjoy just for a moment. we are seeing clear skies above what was a very busy yesterday today. much calmer out there. but i have seen a lot of people taking the jogs there on the embarcadero skies. stay clear all day long today, too. the sierra looking great. unclear. it's not going to stay that way. this weekend, though, high pressure ridge only here temporarily and contributing to what will be the warmest days of the year so far tomorrow and thursday. and then just as quick as we warmed up, we cool down again. low pressure dives in from the north, cools us down into friday and by saturday we've got rainfall for the bay and more snow on its way for the sierra. let's time it out the futurecast. so today, tomorrow and thursday, our warmest days of the forecast in particular, as i mentioned being tomorrow, your first day with 80's inland and then friday, we start to cool down saturday. rainfall really pushes widespread rain for the bay and snow in the sierra nevada. a couple lingering showers into early sunday as well.

it's just been so cool during our weekends. and that trend continues this weekend. as for today, though, not cool. it's actually quite nice and warm. so if you get the chance, hopefully can get out there for a bit. i know we all got our work days ahead of u.s. 60's to low to mid 70's on the peninsula. and we've actually even got some temperatures nearing 80 degrees already in san jose. santa clearing campbell getting up to 78 today. concord will actually join you at that number are for warmest spots in the bay today. oakland in richmond at 72 for your daytime highs, fillet. what a warm 75. same in santa rosa and novato lookyng ahead tomorrow and thursday reaching the low 80's inland mid to upper 70's along the bay shore. friday. we start to cool down but still looking lige a nice day. just a bit breezy saturday is when the rain gets here. and most of us will only stay in the upper 50's. michael. good morning. everyone will to go with that good weather. our roads are looking good. well, for the most part, any ways you can see lots of green meaning go some small pockets

that yellow and orange, meaning slowdown, taking a look over in the east bay. right now we're seeing some delays. >> over essentially on 6.80. and that's because there is a traffic collision that happened over on. 24 these air on the westbound lanes. it's over towards lafayette area. currently the left lane is closed. and you see that residual delay over on that 6.80, going south a little bit. 6 ad, also a little bit congested on the southbound lanes near pleasanton. but everything else does seem to be flowing at normal 8.80, taking a look at some drive times for those who may be heading over to milpitas from san leandro. it's only a 43 minute commute right now. and it does seem like it's a little bit longer than normal, but it's probably one of the best times we've seen this morning drive times for those in the livermore area heading to dublin 60 minute commute. 29 minute commute from dublin to fremont. it's a 43 minute commute from san leandro to milpitas in milpitas to sun valley. sunnyvale, his 9 minute commute taking a look at 101 in the southbound right now, san jose to menlo park. a total of a 48 minute commute.

not too bad. some small pockets of that yellow and red san mateo bridge does look good. but heading over towards the east bay near emeryville, taking a look at the area before you get to that bay bridge, some small pockets of that orange and that live look of the bay bridge itself from the maze to fremont street a 13 minute commute. rana james, we'll send it back to you. all right, michael, thank you for that update. okay. president biden is revamping a plan now to provide student debt relief or drink or actually struck a- down a similar measure last year. but this one is a little more focus. washington correspondent jessi turnure explains. >> this new plan helps about 10 million fewer americans than the president's original idea. but the white house is hoping it holds up in the courts this time. >> give everybody a fair shot. president biden is taking another shot at a student loan forgiveness plan after the u.s. supreme court struck down a similar one last year. we continue to find alternatives past reduced to that. the president's new plan would

cancel some or all federal student loans for more than 30 million americans borrowers who now owe more than they did at the start of repayment could see up to $20,000 in interest canceled. the plan would also forgive all interest for borrowers enrolled in the safe plan and making less than $120,000 a year. he's trying to buy votes. president biden made the announcement monday in the swing state of wisconsin. >> where republicans like congressman bryan steil and derrick van orden say the plan is not fair to millions of other americans expecting our hard working blue collar men and women. we decide to go to trade school. >> to pay off the bill of people that have decided to get a 4 year degree. the white house says millions of americans could start to see the amount of drop as early as this fall. we are working hard to make sure that we follow the law but still expects another legal battle at the supreme court. i think the courts will once again find

this action to be unconstitutional. rightfully so. the education department will release a final plan in the coming months that the public will be able to weigh in on. >> in washington, i'm jessi tenure. >> thank you. jessi 8.19, is the time in the north bay. police have arrested a girl who made threats against a student at retro cotati high school. on monday. the school went into lockdown after a student received a threatening text from someone off campus referencing a weapon rohnert park. police say it stemmed from an ongoing dispute between students attending different schools across sonoma county. police say the girl who made the threat was from santa rosa. california's public school superintendent wants to crack down on hate related incidents on campus. tony thurmond is urging people to support 3 bills to help create the education department's own office of civil rights. he says the office will set policies to limit social media use on campus and train staff on how to handle sensitive issues. thurman says there are too many stories of children facing hate at school.

>> when something happens, even if it's awkward or uncomfortable that must be addressed. no room for we want to address anti-semitism islamophobia. any kind of hey, you know, black, white, racism, whatever it is. we want to address it. >> well, so far the bill has no formal opposition. >> the california teachers association speaking out against the bill want to mandate a specific way of teaching kids how to read phonics instruction is a method that teaches kids to read by decoding words. also sound them out. so using pictures to recognize words on site, teachers are against the bill because they say leaves out the need of english learners and it leaves him out of the decision-making process. the advocates say the bill is important to california school districts that they mandate phonics instruction back in 2023. 43% of california 3rd graders academic standards, only 7% of black students. 32% of latino students. 35% low income

international as opposed to the san francisco bay oakland international airport. that's going to get confusing. that's a story we're following. only time will tell you what's not to easing as the forecast doesn't say this could really page on major regardless of what san francisco airport you're at. it's sunny for we're looking at a good forecast today. >> at the golden gate bridge as well, which we know is no guarantee will be sunny, usually are foggy a spot. but look at it right now. nice and clear out there. we're going to be holding on to the sunshine all day long. no cloud cover. >> and only a ramp up to our warmest days of the year so far tomorrow and thursday. temperatures currently are warming further into the 50's alameda. you're close to 60 degrees now getting up to 59 pittsburgh not far behind at 57. so we are warming things under that. sunshine will continue to do so this afternoon, some of us getting nlose to 80 degree mark today. i'll give you the full breakdown of that warmth and the eventual cooldown in this forecast ahead, michael.

>> and good morning, everyone. good. newt's the roads are looking good. bad news is it's only tuesday, right? but take a look right here. you can see a lot of green, small pockets of orange and red. and as i always say, that means things are starting to slow down when it comes to major delays. those in the east bay near lafayette may actually see that there was a traffic collision right there. and you can see that orange is slowly turning into yellow, which slowly is turning into green. so that should be cleared up within the next i would say 30 minutes or so. but taking a look at some drive times for you right here. 33 minutes from crockett to the maze. walnut creek to 5, 80 15 minutes or so. castro valley to the maze. 28 minutes. san leandro to the maze. a 23 minute commute. so not too bad. one to actually get to that mays and trying to get over that bay bridge. well, good news is traffic is flowing completely and it's only an 11 minute commute. brandon, james, we'll send it back to you. all right. thank you for that update. michael. >> turning our attention here at 8.30, to another big story that we're following. oakland assembly member buffy wicks is taking on ticketmaster for being a monopoly. his so called for stephanie just as reports. >> on how which would like to put the power back into the

hands of the consumer. whether you're an artist. >> a venue, orf and you should have a choice. >> monday east bay assembly member buffy wicks introducing new legislation aimed at ticketmaster. it hopes of shaking twix. introducing a b 28. 0, 8 designed to reduce prices and increase availability of tickets. >> it is designed to truly transform live event ticketing by increasing competition when tickets go on sale for the first time. the primary point of sale instead of only having one choice, which is not actually a choice of where to shop, consumers will have multiple options of where they can purchase their ticket. according to the legislation, ticketmaster controls about 80% of the primary ticket sales in the united states. >> after the murder was live nation in 2010 with ticket prices increasing 140% after that merger calling her bill the first in the nation

in the sequence of events for us. able to talk to everybody involved >> it's still really unclear if drunk driving played a factor in that crash. and in the east bay, police are looking for the driver who killed a pedestrian in oakland 7 early yesterday morning. right in the area of 75th and sully angeles street right near the coliseum. bart station police have not identified the victim just yet. >> lawmakers are considering a bill that would allow cities to store rv's used by the homeless on state property. so the proposal would expand an existing law that permits cities to lease the space under freeways for one dollar a month. the goal is to make it easier for the homeless to move into housing and receive critical services. meanwhile, 2 people in the north bay been arrested now for allegedly running a chop shop. detectives say the suspects were altering stolen cars out of an unlicensed vehicle repair shop in santa rosa. when police went in, they say they found 7 stolen cars and several others that were in the process of being repaired.

well, a new report says that open ai trained its chatgpt model on over a million hours of youtube videos without permission from creators or from youtube itself. the new york times says that openai new the move was legally questionable but was desperate for training day to get the company's technology, a competitive edge. the report says that openai as president was personally involved in collecting the videos that were used and that special transcription software was created to scrape youtube content, google, youtube, google, i should say, which is youtube owner says that the terms of service prohibit automated scraping or downloading of its content. we'll see what happens. >> changes are coming to the martinez refining comforting after a lawsuit settlement. so the bay area air quality management district sued the refinery. what is it was unacceptable. number of has a releases refinery had 21 spills or releases in one year alone. as part of the settlement, the martinez refining company, they have to

>> and while i'm at lawmakers in nevada are perfectly happy to hand over 380 million dollars in public money to help build that new stadium for the a's. a recent poll found that a majority of las vegas residents are not growers kerman. has that story. last week the a's were celebrating moving to a minor league ballpark in sacramento for 3 years. >> until the new las vegas stadium is built. the nevada legislature is already shelled out 380 million dollars in public funds to help build that stadium. but a new poll finds residents of las vegas oppose using public money. the emerson college polling survey asked 500 likely las vegas voters. do you support or oppose the use of public money going towards the construction of a baseball stadium for the las vegas a's. well, almost 32% supported public funding. nearly 52% opposed it. and more than 16% remain unsure. >> everyone but nevada, politicians and the stadium
