>> now the 3 he was shot 5 times during a mass shooting, including once in the face. and today he's speaking out. pedro perez was working at the mushroom farm in half moon bay when a gunman opened fire. his brother and 6 others were killed. there's a co-worker now charged with their murders. thank you so much for joining us here on kron. 4 news at 3. i'm justine waltman and now kron four's theresa stasi reports. perez is suing the farm for not protecting workers from harm and for the deplorable living conditions that were exposed after the shooting. >> i have suffered a lot. >> those that >> i was 2 months in the hospital speaking with the help of an interpreter on friday, pedro perez shared how he lives in pain every day since the mass shooting in half moon bay on january, 23rd 2023 on that day. he says the shooter identified by police as disgruntled employee surely shao shot perez 5 times twice in the stomach and once in the

arm hip elbow and face. >> they're really getting on my feet since happened and still not working. >> he's struggling emotionally from going through the experience of being a witness to his brother's any struggling financially because the injuries that he suffered are preventing him from working. perez is now being represented by coach it pitre mccarthy. they're suing california terra garden corp, the owner, the mushroom farm. >> we're pedro and jose worked for negligence and for wrongful death. perez's brother jose died that day leaving behind a wife and 4 children. perez says that they came to this country to earn money and spend time with his brother. we would come together and we would go to the store. we were inseparable. >> really all about. yeah, sure will land nation's were >> show you federal government and the state of california to

not spending few dollars more to help people that go out and hit the road that tourney. joe coach, it says that they are asking for an undisclosed amount of money, adding that the lawsuit is bigger than just perez family. it's also for workers throughout the state. and nationally who face similar horrible conditions after the shooting, it was revealed how the mushroom farm workers lived an empty container boxes with no running water, no bathrooms, no insulation or kitchen to prepare food to eat. >> the accused shooter allegedly opened fire because he was frustrated. the farm wanted him to pay $100 fine for damaging the machine used at work. his trial is expected to start in the coming months. and half moon bay theresa kron, 4 news. >> in the east bay, a man accused of starting small fires around fremont. newark has been arrested. firefighters in fremont spending a few hours putting

out fires after some furniture was lit on tuesday morning. the same day at newark, a passerby put out a fire that was set on stairs at a vacant building. there were also reports of nearby dumpsters being lit on fire. police got a description of the suspect and found a man matching that description starting another fire in a wooded area near thorton avenue and 8.80, 36 year-old joseph paulson from newark has been arrested for arson. no one was hurt. we'll stay in the east bay because a man is saying a man police say is connected to a number of car burglaries from the east bay was arrested by hercules police officers stopped the 47 year-old early yesterday morning after they say he was prowling around turquoise drive. they searched his car, but let him go after not finding any evidence of a crime and then a woman flagged down. police reporting that her car had been burglarized. officers found the man they had just let go circling another nearby neighborhood. and he admitted to them to stealing from cars in hercules

and pinole and was arrested for charges including burglary. another round of closures and layoffs hitting the bay area. and this is coming us. the san francisco's a controller's office released new data showing that the city alone has lost more than 20,000 jobs in a three-month period. a lot of those job losses are from layoffs in the tech industry. and today apple announced it's going to be adding to that number. apple planning now to laugh more than 600 of its workers from various locations in santa clara. this will start next month. the tech company recently notified state labor officials about the layoffs in february. the tech giant shut down its decades-old quest to build an electric car and that resulted in more than 1000 job cuts or reassignments for employees. we're working on that project. and now to some closures because after more than 40 years, $0.99 only stores closing their doors. operators of the popular discount chains say they're just not making enough money

to survive. the closures will leave nearly 14,000 employees without a job bay area locations include richmond, antioch, fairfield, in fremont. the discount store had a wide variety of items from household goods to groceries and official closing date has yet to be announced. and in the east bay and oakland restaurant that is featured in a michelin guide. now closing lion dance cafe. the last day there will be april 27th in an instagram post. they wrote over the past 12 plus years. we've got to be part of so many people's milestones for for states to weddings, celebrations of life. we're coming out to nurse. it's been challenging. it's also been sweet and rewarding. as for why the restaurant is closing, the post said it was for family reasons. a live look outside across the city of san francisco getting ready for the weekend on a very chilly friday. pilots tracking those temperatures for us where looking forward to that rebound. but that's not to wait late next week. no, that's right. or not there

yet. we still have some chilly temps today. >> and we've got a little wind out there right now to getting breezy, especially out by the coast and around the bay itself. san francisco right now at 51 degrees, upper 50's in spots like oakland, san jose in concord, you can see livermore. still a 53 santa rosa just hit the 60 degree mark. half of a little cooler there at 54. but this is what i was talking about. i said it was getting breezy so you can see from, you know, point race to san francisco to half moon bay, but now heading over towards oakland as well were upwards of 20 miles per hour or so quite gusty, making that kind of cooler air feel a little bit cooler. still, we also have some showers that are popping up. this is because we've hit the heat of the day and that he acts as an impetus for this unstable air mass to pop up some showers and some just rolling through napa on the way to allay right now over by fairfield as well. that could be making for some, you know, wet roads as you're making your way around in the east bay in parts of the north bay. right now, as you can see, livermore long, heading towards tracy. there are a few more showers there, too. so these are going to be kind of hit or miss this. not going to

be as pervasive as yesterday, obviously, but we do still have some of this energy out there as this low pressure system. it's still very much influencing our weather right until it fully moves away. we get some of that moisture being drawn in and some of these cells could potentially be thunderstorms, too. so just be on the lookout for that throughout our afternoon and evening. clearing skies will happen later tonight and very chilly temperatures. very chilly as and cooler than last night. so we are under frost advisory for good portion of the bay area. here you can see from the north and east bay, all of the interior areas. so just be ready for that as well. i'll be back in a little bit. we'll talk more about that warm up that justine elated to all right. well, convicted murderer richard allen davis is attorneys were in a south bay court today. they are attempting to have his death sentence reduced. >> back in 1996, a jury found him guilty of murdering 12 year-old polly klass in petaluma and now kron 4 soup to call reports from san jose or his representatives are arguing that based on a new

law, his sentencing enhancements should be dropped. >> marc klass return to santa clara county superior court in san jose friday. his late daughter, polly, is convicted. killer richard alan davis did not. i don't think about richard allen davis. until something like this happens with his absence. court-approved davis's defense requested the hearing arguing his death sentence should be reconsidered based on new law that disregards previous sentencing enhancements. prosecutors say he is not eligible and that the attempt to vacate a jury verdict is unwarranted. i believe that the criminals in the california system. have very powerful advocates. in sacramento. because there seems to have been a systemic. attempt to undermine. >> why after law after law apparently accomplish 3 things they seem to be trying to destroy 3 strikes because this

is all about sentence enhancements. this is exactly what 3 strikes was about. they're trying to empty the prisons and i believe the population is down to 77,000. inmates at this point and they're trying to eliminate the death penalty in 1993, polly klaas was kidnapped from her home in petaluma during a slumber party. >> 2 months later, davis confessed to killing and burying the 12 year-old girl in a shallow grave near cloverdale. on friday, a motion was filed by the defense to relitigate the sentencing. another filed by prosecutors disputing qualification the judge heard arguments but did not issue a ruling. marc klass never expected he would have to return to court for this case after davis was convicted. i think it's it's. terribly unfair because >> people like me don't i don't have advocates. i mean, he's got people going to court i think our prosecutors great, but she's representing the people. the only person here

this representing pauley army and the other people that were. in the gallery with know this is terrible. this case returns to court at the end of may. >> in san jose, philippe djegal kron. 4 news. >> the city of san jose has launched a pilot program that uses artificial intelligence to detect homeless encampment. city officials say the technology is used on one city vehicle to provide better essential services for those in need. but homeless advocates are worried this will be used to push homeless residents out today. i'm kron 4 news at noon. we spoke to san jose mayor matt mahan about how this technology well work. >> we have one car. we've got outfitted with a half dozen cameras were just beginning to test this one of the things we found we actually didn't set out initially to do this. we're really focused on potholes and graffiti to start. is that these cameras are pretty effective at identifying when people are living in vehicles. this is on

correspondent raquel martin joins us now live from dc where cal, tell us about his visit. well, today, president biden pledged the full support of the federal government to help the port of baltimore rebuild. he says this needs to be a national issue. >> to reduce further economic harm. >> the damage is devastating. the president got a firsthand look at recovery efforts and met with local leaders. i'm here to say your nation has your back. and i mean, the president has promised baltimore that the federal government will pay 100% of the cleanup and reconstruction of the bridge. we're going to get this pay for, aren't we? how much that will cause is unknown. the bridge collapsed after being struck by a container ship last week. 6 construction workers were killed, all the families and loved ones are grieving. come here to grieve with right now. federal and local authorities are racing to clear wreckage blocking ships from reaching

the port. they've opened a temporary channel for smaller vessels. in the meantime, losing paychecks daily and the economic impact is spreading to local businesses. >> simply put. >> fact, here is a significant impact everywhere. the u.s. army corps of engineers predicts the port will be partially reopen by the end of april. >> and is aiming to return to full operation by the end of may. >> and a bit of good news for the local economy today, president biden announcing that companies including amazon and also home depot have agreed to keep their workers on the payroll until the portal reopens. we're now washington. raquel martin, back to you guys. >> i don't know if this is earthquake. use it. >> was residents in new york and across the tri-state region rattled this morning by 4.8 magnitude earthquake. it struck around 10, 30 eastern time epicenter, about 50 miles west of new york city. a

had gone. absolutely crazy. it's kind of. right? your brain goes to all kinds of crazy directions. we're cool today. we do have a slight shower chance. in fact, we've got a few. they're popping up right now in the north bay in the east bay. we're going to cool down tonight. frost advisories get ready for that, everybody. and we've got a warm-up on the i've got it all in your seven-day forecast. let's start with the showers that we're seeing right now. so futurecast showing you that this is going continue throughout the afternoon and the early evening by the time we get into the later evening, we start to calm down. saturday is looking good. however, overnight saturday into sunday notice just a little weak front trying to throw a few showers our way. it won't be much but a little something there and a little tiny popping the radar showing up on sunday afternoon, too. so that's just to say that until this low pressure system really pulls away from us. we still stay a little bit unstable. having said that, it's not going to be kind of huge rain totals, but you can see just how massive this low pressure system is in now with the heat of the day, you can also see all of this lightning that is starting to pop up as

we get this heat kind of kicking off the convection, right? it's the thing that you need to kind of start the car. so that's what's happening right now. you can see a little bit of this lightning in parts of the north bay in the east bay. so just be aware if you're headed out now, once this system goes high, pressure is going to start building in and by monday, we are going to notice a big difference. much calmer weather, but we're starting to warm up as well and lots of sunshine to start the week. now. high pressure keeps moving on in there. and as that happens, we're going to keep warming on up. so today, temperatures, as you can see, obviously well below average. but we're going, you know, above average, we get to monday to the tune of about a 10 to 15 degree difference. and that's just the beginning of the warm-up. that's coming. take a look at your extended forecast. it's something i'm telling so tomorrow we will get some nice sunshine. we will start to warm up a degree or 2 as we head into sunday. but by monday, we're talking 70 degrees inland and then we're going to well above that tuesday into wednesday. take your eye down to thursday and friday and now we are wildly above average here. so quite a swing. it's why i was calling

it weather whiplash rates like you're dealing with the cold and then all of a sudden we're back into dealing with what almost feels like summer, like temperatures towards the end of next week. all right. some dramatic video to show you here that was caught on camera as a small plane crash lands in a yard in florida. this happened yesterday afternoon. >> after the plane took off in the tampa executive airport. you can see the plane's emergency parachute deployed that helped ease the impact with the ground. the aircraft landed upside down near home and witnesses say 2 adults inside. we're lucky to walk away from the crash. in the south bay. 2 men accused of selling drugs on the dark web arrested following a monthslong investigation in san jose. so here are some of the items that were found in those homes. police say the investigation started with a traffic stop in november where they found illegal drugs in the car and that led officials to get a search warrant for the suspect's homes. and that's where police say they found multiple guns, a large amount of drugs intended for

sale. and police say the investigation revealed that these men sold the illegal drugs in the dark, dark web and only accepted cryptocurrency as payment. in the east bay berkeley now getting fined $130,000 over how the city managed its landfill site at cesar chavez park bay area, air quality officials say the site failed to prevent harmful gases from escaping into the air during a power outage in february. they say these gases can negatively affect the health of residents. officials also claim the landfill failed to submit gas emission test results. >> bart is celebrating autism acceptance month. and robert, he recorded a station announcement and then after school he went to go listen to his voice at the embarcadero station. his announcement. is really important to him

number is well above analysts, expectations of 200,000 jobs, the healthcare industry led to the job increases followed by government, leisure and hospitality and construction. the unemployment rate ticked down a 10th of a point to 3.8%. oil prices are climbing, though, to their highest level in months this week with crude oil going past $90, a barrel for the first time since october. growing demand drone attacks in russia and turmoil in middle east creating just the perfect storm for the prices to spike up more than 18% so far this year. aaa says the average cost for a gallon of regular gas. 3 58 as we approach the busy summer driving season, the average some california 5.27. and in the east bay gas is even more expensive for in the bay area in general. but will see what's going on here in marin county. the price here. 5.53, the least expensive place to get a gap get gas in the north

footage showing the deadly encounter before we play it. just a warning. it could be difficult to see. so that's the moment right before an officer opens fire at her. police say the officer spotted her pointing a handgun at another officer. officers responded to her home on francisco boulevard last wednesday morning after a report that she shot and injured her son. the district attorney's office is conducting an investigation to see if the shooting by police went by the rules, the results will be released in 8 to 9 weeks. the 2 officers involved have been placed on administrative leave and the race to replace congresswoman anna eshoo. it's a tie between assembly member at the low and santa clara county supervisor. joe submit ian. both candidates are now moving on from the primary and joining

former san jose mayor sam liccardo on the november ballot. both surprised at the outcome been faithful. the voters neither seen interested in a recount. instead, their focus now on november and the issues they want to tackle. they're also reminding voters why they are the best candidate for the seat. >> there are a host of issues out there that are calling out for someone to be effective in congress. we've got a high cost of living. we've got climate change to tackle. we've got a woman's right to choose all these are issues that cry out for effective legislators among the candidates who are going to be a runoff. i've got the ability to say. i've been there. i've done that have had the success and i can take that same set of skills to washington to deliver for people in our district. what sets me apart is that record of service that when it comes to the most pressing issues that time. >> i champion and coauthor legislation to enshrine reproductive freedom protections in our state constitution. i've been legislative beer from the california police chiefs

association. record amounts legislative proposals continue that washington, d.c., will continue to look partnerships over partisanship and also answering the call for service. >> la carte u.s. team sent out a short statement saying, quote, we welcome the opportunity to continue to talk to voters about the issues facing our communities, including the high cost of living utility rates and housing and sam's long record of fighting on behalf of residents. so if there's a tie in the november election, our political analyst michael yaki says it will go down to drawing lots and a winner will be picked. the san francisco mayor's office is saying now it has received 380 applications for its new affordable housing that's aimed at housing teachers and staff from the city's unified school district. but they say they will not be able to accept all of them. the housing community that's planned for the sunset district will only have 135 homes. it is expected to open

up in the fall, but applications are still going to be excepted through the 23rd. and it is a major disappointment and a financial loss for the city of oakland. the a's are headed to sacramento after more than 50 years in the town. but the question is now what's going to happen to the oakland coliseum? alameda county leaders say the focus is going to be bringing in as many events as possible, such as sports with the oakland roots. also, they want them to be able to play at the coliseum. maybe even the oakland ballers. they're hoping for a chance to play there. but a former longtime a's executive is now worried about the current job losses. >> coliseum was the last town square left in open that people of all backgrounds could get together and celebrate their sports change. and now it is going to be a quiet location. >> oakland councilmember rebecca kaplan posted on social media list of possible it is to field phil, the

break and we'll see those overnight lows start to rise up. but until we get there, unfortunately, yes, we've got this to contend with a notice. it's not just northern california. it's also parts of central california under this frost advisory tonight from 01:00am until 09:00am expecting those inland spots in the north bay and the east bay to potentially get down into those 30's. so that means tonight want to take precautions with, of course, people that definitely pets and your plants to. these are the lows of expecting napa santa rosa getting down to those mid 30's. and then you can see some upper 30's as we head over to the inner east day. so one more night. and then as i mentioned, it will get better. this kind of shows you the risk of those freezing temperatures. so the time we get to 07:30am, we'll be looking good. but that overnight around 05:00am. that's when we get into that really coldest spot as you can see here the next few days that we look at santa rosa. once we get past tonight, we do pop up and then get into the 40's and even 50's as we head later into the week as we've got that warm-up on the way, we mentioned some of the ski resort picking up a little more snow. you're looking at

and it's an opportunity for participating restaurants to highlight their most popular dishes with some special, a prefix menus and also diners can discover some new places too. enjoy. and i get to know san francisco's culinary scene a little bit better. so joining us right now is amy cleary from the golden gate restaurant association. thank you for joining us. thank you. having time of the years that we've been doing, san francisco restaurant week. >> worried you're going to ask question let's just say more than 10, ok? so more than 10, some we haven't. we've been doing this a hot minute here. how does that proved to be successful for san francisco and introducing people to new restaurants in new neighborhoods that they've never tried before. sure. well, i think it's nice because it feels like a celebration across the city. one of things we work really hard at it that get restaurant association is trying to make certain that we have participants in all different neighborhoods across the city. >> and also at all different price points. we have $10 lunches all the way up to $90

dinners. so it's really there's something for everyone. that's something that's accessible and nearby for everyone. so what kind of restaurants are participating this year? what's new on the list? >> well, you know, it's funny. i was really excited. there's a vietnamese place in the tenderloin clips icon sandwich that has been there longer than i've been in san francisco. i've been here a long time and they're participating the first time ever at just like a $10 lunch point, which i think is really exciting. >> homework house, which has gotten a lot of attention downtown is participating. but i also think, you know, we spent a lot of time talking about new and exciting because that's what we think about his human beings. but i love the place is like now law, irwin market or blue plate who've been doing restaurant week for years and years and years. i think people should should not forget about places like that. nothing like old faithful. sometimes you just want want, you know, in the comfort food that you love. what are the restaurants tell you after this 10 day event is over about how it changes business for them. well, i think it brings hopeful i i think for most places it brings in a lot

of new customers. i do think there are a lot of people, you know, we're all perhaps more cost conscious and we used to be. so people are looking for an opportunity to try a new place with perhaps not breaking the bank so it can bring people into places they might not try otherwise. and overall, how is this san francisco restaurant scene doing as kind of wrap up? crisis is enter into the spring and summer travel seasons. remains mix. i think we can. we keep saying you know, there are some places that had amazing best years ever last year. and there are some places. you know, we heard about a couple of closures again happening this week. so it's really mixed. i we're excited for the summer travel season we're hoping that it will be a good one for san francisco and that should really, really help people off the share. so for someone who's like thinking what's for dinner tonight, which is the constant question. i think most people asked themselves what should they know about restaurant week about finding

ask i live here in a second. they just say that that there could be some cloudy skies in different areas when we just check in with kyla straight up. and yet her tell us what is happening is people like traveling all over i know expensive owls were expensive to like national parks. if buy tickets. see it. so it requires planning people getting. i know i have friends in texas that are going to be celebrating. i was going to go visit them for this. in that i look to the takes like forget it. so i went like 2 weekends ago. instead. >> take a look right now of this war today happening, texas will be doing great new england. not so much right because there's storm system there. >> that's where the path of totality is. we're not in it. but anyway, we're happy for those who are so here's what's going to happen in key to future cast and show you monday when this is going to be happening. you notice this system kind of pulling things up here in the upper midwest. but it drags moisture in all the way from the gulf. so this is going to be a little bit tricky for folks in texas. and frankly, i think it's going to be little tricky for the northern new england people as well. but if you look at this

kind of forecast, breaks down where the better chance is probably going to be in that ohio valley area or maybe the farthest reaches of new england. now here in the bay area, i mentioned we're not in the path of totality. so we will see will be a partial eclipse will see about a 30 to 40% chance here of seeing that clip straight. so will i should say, chance to say 30 to 40% eclipse as opposed to totality. the chances of us seeing it. well, pretty good for at least that because we're likely to have some pretty good weather on mo day. we've got some high pressure moving in. so that should help us out. so it's next. monday is going to begin just after 10:00am peak just after 11:00am and end by the time. get about 12. 22 so again, we're not going to be the path of totality, but still something kind of cool to check out on monday and certainly to watch some of the coverage. you know, it's going to be out about it. i think it's going to meet some of the websites are doing quite a bit live look from the east bay. we've had some showers have been rolling through parts of the east bay, in fact, wanted to zoom in here and just kind of show you what's going on. we've got one particularly

juiced up cell right now rolling through vallejo. some of these have had lightning associated with them. and that does mean there could be some heavy downpours. as you can see, it extends down through the east bay and it is lighter look down and see where some w- of that is getting up in elevation and seeing a few snowflakes fly again. we've got a cold air mass out there. in fact, right now where that just went over or 44 degrees in napa. and 47 in vallejo just shows you unsettled. it is. we do have a frost advisory tonight. so be prepares for that for my inner north bay and east bay, folks. and then we have a big warm-up on the way. here's a look at your extended forecast. so if you're tired of the cold, have i got a forecast for there you go. by the time we get to the end of the week, looking pretty good back to you. all removing a large eucalyptus tree. >> off of highway one in moran. the agency says the tree is already uprooted so they want to remove it before it falls onto the road. right beneath it. the highway is closed until 5 today. this is between tamala son, marshall crews are using a large crane to remove the tree. and cal
