looking coit tower now much of the morning we've been looking up at coit tower and been like, oh, where is the sun will now? we've got it in full force right there. anyways. you're still seeing some mostly cloudy skies and a lot of the bay area. but gradually, we are getting clear and clear. so that's the plus here. the negative is as skies clear out windsor unfortunately going to be picking up. so that's kind of the catch towards the afternoon where we're sitting right now with fog tracker. visibility is good. we are seeing any sort of remaining stratus rising burning off. so a lot less of that already. radar shows you that we do have some showers to the north of us. those are going to stick up in oregon, not to be bringing any rainfall our direction. we're just tapping into some of the cooler air that the systems to the north are bringing us. that means temperatures today not going to be near as warm as they had been. stratus help to keep us in the 50's last night. only a couple spots like brett would are currently climbing into the low 60's as temperatures climb in skies, clear out.

>> nothing doing properties will tran live in san jose with the story will. well, james, she's hoping to stay out of prison altogether, but at the very least, elizabeth holmes is hoping to stay >> out of prison while she was appealing her conviction. but the judge right be. i mean, the federal courthouse who oversaw the trial. he decided late last night note you will have to go to prison. yes, you still can continue your journey to appeal the conviction, but you will have to do it behind bars. a lot of people they were watching this trial very closely because it involved wealth. silicon valley race privilege. so many factors because they point to the fact that many people who are convicted, particularly women of color, they go right to prison. much less trying to stay out of prison while the appeals process. elizabeth holmes, 39 years old made national news when it was

discovered a few years ago that her blood testing company, theranos did not do what it promised that it promised to take all kinds of blood tests with just a few drops your blood. prosecutors say it never delivered on its promise and she knew that. but she continued to ask investors millions billions of dollars to the point where i one time there are no, it was worth 9 billion dollars. she was convicted of wire fraud 11 year sentence. >> and now that the judge just decided that she must spend time in prison while she continues its journey, james and area. that means that she will have to report unless she runs out of. >> other miracles at the end. and i'm sure she has some legal avenues left to pursue. if that does not come to fruition, she will have to go to prison in texas come april 27th and a lot of people also pointed out jeans and area she actually got pregnant during

the trial as she gave birth to of months ago. i'm sure the judge decided all of that. take that into consideration but decided there was not enough evidence for her to be at home in a multi-million dollar home while she goes to her appeals process. so she will be in texas. back to you. >> interesting. all right. thank you very much. we'll 903, is the time and happening right now. and uc berkeley, the police are investigating a series of assaults that have happened within days of each other. right on campus. yes, fact. the latest one was just this morning right after midnight crawford's michael thomas on the story for us bringing us the latest from the campus of uc berkeley. michael. >> hey, you know, really a scary situation. you know, uc berkeley police say that all 4 of these incidents happened in the last 7 days and they do believe that they're all related saying that majority of th7 time the suspect is coming in grabbing young women in their private areas and they now have photos to match 3 of those 4 incidents. let's

get into some video and photos that we're talking about. this is the latest photo that was put out by uc berkeley police early this morning. it's regarding the incident that happened just after midnight today. police say a woman was walking near the foothill complex, which is residence hall when she was grabbed from behind and knocked down to the floor. she fought back and was able to get away. but that man is still on the loose. and police believe it's related to the 3 assaults that happened last week as well. now, in those cases, they released these photos for 2 of those 3 incidents. now, the first happened last wednesday on the 5th at the eucalyptus groves at around one 30 in the afternoon. the suspect grabbed a female students, private parts over their clothes. then the following couple of days later on saturday on that around 5, 40 in the evening, a female was walking near memorial stadium when a man came up from behind, grabbed her bottom and her and pushed her against the wall. she was able to get away from the suspect and ran. but that suspect was not captured. then this police say that they do

not have a photo specifically for that one on saturday. but the following day on sunday, another incident that's on the 9th happen at 09:40am, in the morning near stevens home. the suspect again grabbed a female students, private parts over their clothes. we spoke with one student this morning who is a uniquely uc berkeley student. i asked her if she thinks that this man will be caught and how safe she feels in the area. >> i really hope so for the safety of the students, especially for the women. now walk around early in the morning like just now, man, somewhere else where walking around just to go to the gym. so i hope that everyone is just say it. >> are normally walk around campus alone. and most of the time, i'm a little scared. i carry around pepper spray. >> so that made me really >> now she goes on to say that many times since she's been here all throughout her college career, that she has never really felt safe. but she says that, you know, police are working on and she hopes that that person is captured again, back out here live there. many students are

walking around and i'm sure as we all know, college campuses, people are walking around in wee hours of the night studying the police not only are asking for your help in identifying this person, but they're saying they also want you to be safe. that's the very latest here in berkeley. and michael thomas. i will send it back to us live in the studio. >> all right, michael, thank it's 906. and the family of this little girl who was shot and killed on 8.80, in fremont will. she was driving with her family. they are grieving and just trying to cope with what happened. kron four's spoke to their friends and family and hear sarah stinson. >> i spoke with a best friend of the family. she tells me that she's trying to stay strong for them as they mourn the loss of 5 year-old. eliana, she's speaking on behalf of them during this unimaginable time. it went from happy birthday dinner that then. >> their family losing their 5 year-old daughter. just the simple outing on a saturday evening, like most of us do

all the time and it changed in the blink of an eye as the family drove down 8.80, looking for a place to celebrate grandma's birthday. >> gunfire ripping into the family's suv, killing 5 year-old eliana, one of her mother's best friends. ashley is speaking on behalf of the family about what happened saturday night. the shots fired. >> they screamed, get down and then. that last shot. that was the shot that leanna. >> we're pretty sure she died instantly because who just over in the back seat. they didn't know what to do. they tried to drive faster to get away from the people they to do know what was happening. they found chp officer that had pulled somebody else over. it was still just sitting there they pulled over and just started going out. we out me. the officer called 9-1-1 and eliana was taken to the

hospital. >> but it was too late to save her. that unimaginable night turned into the early morning hours of easter holiday. that will be forever changed for this family. eliana was sitting right next to her brother when she was shot. >> and his easter basket is still sitting on the kitchen counter. told his mom, i'm not opening that mom because i can't. my sister's not here to with peak. >> ashley says the family is trying their best to mourn while also being strong for their son. we're all worried about him the most. of course, his sister was only 11 months younger than him. she would have turned 6 on april. 21st. i'm a very little girl. little 5 year-old with hopes and dreams of being a doctor. a little girl full of big dreams taken far, far too family mother should ever have to bury their child like this is an absolutely heartbreaking story. now there's a gofundme to help.

>> the family, ashley says they want to be able to get them a new car. they don't want them to have to relive that horrific night. they also say that this family is very hard working. >> they want to be able to give them the proper amount of time to grieve. i'm sara stinson reporting back to you. >> thank you, sarah. well of area families also demanding justice for another child who fell victim to a freeway shooting about 2 years ago. we're talking about 23 month-old jasper. wu. he was shot and killed in a freeway shooting in oakland back in november of 2021 and is family and supporters rallied yesterday because they're concerned that the district attorney, pamela price isn't doing enough to prosecute the 3 men accused in jasper's killing. also in attendance were other families of other victims in alameda county. and they each took to the microphone to ask the district attorney to, in their words, do her job. >> where she is laying the groundwork for reducing penalties for jasper was killers. talking about no jail sentence for murdering a 23 month-old jasper. his life was

stolen. his killers don't need a version of restorative justice. his killers need to go to prison. i am worried as well. just like the death family that. >> are they going to take that happens? the way is kevin going to get justice? i don't know. >> well, the 3 men arrested for wu's killing are preliminary hearings if convicted. the group at the rally is concerned. the da's office won't pursue. prison time, but it will instead look for alternatives. the group also says that if the 3 men are punished to the full extent of the law, if they're found guilty, da should, again, their words lose her job. >> kron 4 since and sat down with the alameda county da pamela price. in an exclusive interview to ask her about the jasper wu case. and here's some of what she had to say. >> is that something that you are considering not charging the president? not at i that is someone who created a false narrative and took a some

continue as well, especially for coastal areas and her upper elevations, those hillsides, more subject to those higher wind gusts. futurecast shows less cloud cover more sunshine this afternoon. we actually stay really nice and clear overnight tonight into tomorrow, wednesday and thursday will be coming along with abundant sunshine. but both will be our coldest days of the forecast as that cooler air pushes in. and as that cooler air pushes in, though, winds will be kicking up 30 to 40 miles per hour. gusts at the coast in our mountain tops 20 to 30 miles per hour. gusts along the bay shore late this afternoon tonight into tomorrow morning. temps already cooler today than where we were yesterday. 50's at the coastline for your daytime highs where his 60's can be expected for most other areas. not a lot of us reaching 70 degrees today for san jose. that will take us about 10 degrees down from where daytime highs are yesterday. only at 67 today, hayward san leandro in oakland at 63. a couple of low 70's

>> we're back at 9.25. and a whole foods in downtown san francisco is temporarily closing its doors. now just one year after opening. and it's because of safety concerns. the stories on 8th and market street. it was originally considered a flagship store by its parent company. amazon, the store opened in march of last year and a spokesperson told kron 4 that they could potentially reopen at some point. it's just all going to be dependent on whether it's safe to do so. for now. they say employees at that store going to be transferred to other locations nearby san francisco supervisor matt dorsey says he's honestly not surprised by this move. he wrote on twitter, quote, our neighborhood waited a long time for this supermarket. we're also well aware of the problems they've experienced with drug-related retail theft adjacent drug markets. and many safety issues related to them.

homelessness. administrator let honda simmons says that there were our services to relocate the unhoused, however, advocates for those in the in camp and say that they're not happy with it. >> the first would be to transition house into available shelter. they are at liberty to take shelter resources or to self relocate to the extent that they were promised we've been disrespected and that very i've lost i think a good set on fire. >> and the entire eviction process should take about 2 weeks and then construction will begin on the wood street cabin program. >> well, happening today, the commissioners of the port of san francisco are going to hear a proposal that would give them at least 10 months to wind down operations at a homeless encampment site near peer. 49, it's known as site f currently there about 118 people experiencing homelessness that live in trailers at that site. if the proposal is approved new intake is going to end on

september. 30th and people living in that camp will have to leave by november. 30th. the site came about during the pandemic when the port agreed to accommodate these trailers. while the health emergency was underway. but the pandemic is over and the agreement ended in february. so now the site has to close up and the port has to decide whether to grant the city 10 months to wind down its operations. the city says they hope to help the people affected their get permanent housing or at least get them to shelter beds. >> it's 9.33, and also today people are going to rally in oakland to demand the city council end its eviction moratorium. say the tenants are taking advantage of it by skipping out on the rent without showing proof that they're actually experiencing covid-related financial hardship. so the renters they want the city to get rid of the moratorium. they say that continues. extensions are putting a burden on small property owners. the city council's community and economic development committee has already voted to safely end the moratorium. that rally is today, 01:00pm at 14. 25 harrison street.

>> well, happening today in-home supportive services workers and front-line human service workers are planning a rally to demand higher pay. they're asking san francisco to release poverty or to increase poverty wages for workers that are responsible for combating homelessness and addiction and caring for seniors and people with disabilities in the city. they say the wages are too low. workers are getting burned out and that's leading to a staffing shortage and that is making it harder for them to do their jobs. the rally is going to be held in front of city hall. it's set for noon this afternoon. well, a former san francisco fire commissioner is now speaking for the first time after he was attacked in the marina district last week. we do want to warn you some of the video here is difficult to watch because it shows the violent attack. a former fire commissioner don care minion. last wednesday. you see the person in the brown jacket is the man who was hitting caribbean could mean e with what looks like a metal pipe. he's holding his hands up, trying to defend himself. the attack sent him to the hospital with severe head

injuries. he says 3 homeless men set up camps outside of their mother of his mother's home. they were using drugs. he says they were lashing out as people as they passed by his mother was uncomfortable stepping outside. so we asked them to leave and that's when he says he was attacked by a man who police later identified as garrett doty. but representative for dodi, his public defender says that's not the whole story. >> mister doty did not start this altercation. mister. carmack nani. approach. mister doty. and threatened mister doty. sprayed him with pepper spray. >> in a statement kron 490 said, quote, i am hopeful that this unfortunate incident will lead to police or to policy changes to better protect the interests of san francisco. residents and that my attackers will be fully prosecuted and quote, now

is going to be a crystal clear day from start to finish. but it's going to be cooler and definitely a breezy start to your wednesday. thursday is also going to be another clear, but cool one as this colder air mass settles in as that colder air mass moves our direction wind speeds will increase 30 to 40 miles per hour gusts at the coast and on our mountain tops in 20 to 30 miles per hour winds elsewhere. so definitely breezy rest of the day ahead of us. as for temperatures, coastal areas will only rise into the 50's today for a lot of us here already there. so temperatures really aren't going to change very much at the coast. low 60's to mid 60's for most of the rest of the bay area. some spots will be as much as 10 degrees cooler than yesterday. like san jose. only at 67 degrees. hayward san leandro, oakland at 63 and only a few low 70's for antioch, fairfield and vacaville. tomorrow will be the very cold. a stay of the forecast with thursday. not far above you both in the 60's for your daytime highs friday.

we'll start to see temperatures climbing and this is going to set us up for in another beautiful, comfortable weekend with highs back in the 70's rain. john, thank you for that little burst. a little sluggish out there along some of our highways like. >> you're taking 6.80, right now, doubling down to fremont about 30 minutes to make that drive. maybe you're taking 5.18. you're traveling up to livermore. pleasanton once you get to 38, you're slowing down just a little bit. as you're hopping on to 80, you can see that southbound little slower. then the northbound side, the bay bridge looks good. 14 minutes. meteor lights. they turn those off. so no major accidents there. our san mateo bridge, we have gone up just a bit. 26 minutes so slower as you're traveling along 8.80. and that's why it's taking a little more time to hop onto that san mateo bridge, one of the south bay. 32 minutes. 85 up the middle part. if you are going to be taking maybe 80 right now, like i just mentioned, a 40 minute ride from san leandro down to 37 rocking out towards the maze. going to take you 24 minutes.
