>> plus, newly released video shows a former san francisco fire commissioner getting brutally hit with a metal bar. we talk with the public defender who claims he might have started the fight. but first. >> nothing like this should ever happen. no family should ever have to go through this. >> 5 year-old girl killed in a freeway shooting in the east bay. while her parents were on their way to a birthday dinner tonight, a family friend talks to kron 4 about the moments the parents had to go through during that incident. thanks for joining us for kron. 4 news at 10. i'm ken wayne and i'm ella sogomonian and investigators say leanna chris passed away within seconds of being shot. >> people with highway patrol say that they have not released any information so far about the shooting suspects nor a suspect vehicle. meanwhile, the young girl's family is still grieving and trying to cope with what happened. kron 4 sarah stinson spoke with a close family friend and joins us live in the studio. that's right. i spoke with a best friend of the family. she

tells me that she's trying to stay strong for them. >> as they mourn the loss of 5 year-old. eliana, she's speaking on behalf of them during this unimaginable time. >> it went from happy birthday dinner that then. >> their family losing their 5 year-old daughter. just the simple outing on a saturday evening, like most of us do all the time and it changed in the blink of an eye as the family drove down 8.80, looking for a place to celebrate grandma's birthday. >> gunfire ripping into the family's suv, killing 5 year-old eliana, one of her mother's best friends. ashley is speaking on behalf of the family about what happened saturday night. the shots fired. >> they screamed, get down and then. that last shot. that was the shot that leanna. >> we're pretty sure she died instantly because who just

over in the back seat. they didn't know what to do. they tried to drive faster to get away from the people they didn't know what was happening. they found chp officer that had pulled somebody else over it was still just sitting there they pulled over and just started going out. we out me. the officer called 9-1-1 and eliana was taken to the hospital. >> but it was too late to save her. that unimaginable night turned into the early morning hours of easter holiday. that will be forever changed for this family. eliana was sitting right next to her brother when she was shot. >> and his easter basket is still sitting on the kitchen counter. told his mom, i'm not opening that mom because i can't. my sister's not here to open with peak. >> ashley says the family is trying their best to mourn while also being strong for their son. we're all worried about him the most. of course, his sister was only 11 months

younger than him. she would have turned 6 on april. 21st. i'm a very little girl. little 5 year-old with hopes and dreams of being a doctor. a little girl full of big dreams taken far, far too family mother should ever have to bury their child like this. an absolutely heartbreaking story. now there's a gofundme to help. >> the family, ashley says they want to be able to get them a new car. they don't want them to have to relive that horrific night. >> they also say that this family is very hard working. they want to be able to give them the proper amount of time. to grieve. i'm sara stinson reporting back to you. sarah, thank you. >> new video tonight showing a violent attack in san francisco that severely injured a former fire commissioner don carmignani. the commissioners father says his son suffered a broken jaw in the marina district attacked. you have to get 50 stitches on his face along with surgery to remove part of

his skull. coming up tonight at 10, 30, why the suspect's attorney says her client was just acting in self-defense. >> now to a large fire that destroyed a dozen privately owned many buses in san francisco. he went up in flames shortly after 10 o'clock last night underneath i to 80 on 23rd street in potrero hill. and here's a look at what's left of them today. no injuries were reported. thankfully. and an employee for san francisco minibus tells kron 4 that most people keep cutting the fence to get into the yard, but an exact cause for that fire remains under investigation. >> in the east bay, the city of oakland has started the final round of evictions at the wood street encampment. now the city started the process of clearing that cap more than a year ago. and kron four's amanda hari. it's getting some answers tonight on where people we're getting kicked out can go man >> the city of oakland estimates there are still about 70 individuals living in the wood street encampment.

some of those people have lived there for years. the city is promising to help all of those people relocate. >> the encampment beneath macarthur maze highway interchange on wood street is in the process of being shut down by the city of oakland. it once housed hundreds of people has become a concern for the city due to health and safety conditions and fires, including one in april of last year that killed one person and displaced 5 others. actual amount of planning has gone into acting homelessness administrator let honda simmons says they hope shutting down the encampment will accomplish 2 goals. the first would be to transition the house into available shelter. >> and to convey the property over developers for the development of 100 and set >> permanent affordable housing. i'm the construction on the wood street cabin program. can't start into the site is closed and secured. >> the city is also offering a safe rv park site on 66

avenue. outreach services been talking with residents for agreed to relocate to the cabin shelter program and they're working with other cats. they are at liberty to take shelter resources or to self relocate to the extent that the city says there are enough shelter. space is for everyone who wants one. but some advocates for the encampment are unhappy protesting the closing. you can hear them chanting as simmons tried to speak to the >> darrius brewer used to live in the encampment. he's sad to see his friends being evicted. not fair. it's not maven. carter griffin says the city is told her and others living in the camp that they would help them find safer housing. but it hasn't happened for her yet. >> they were promised we've been disrespected and that very i've i've i've set on fire. >> the entire eviction process is expected to take 2 weeks.

then construction will begin and the wood street cabin program in the newsroom. amanda harry kron, 4 news. >> thank and and now we are turning things over to the forecast as we take a live look outside at the quite tower. and it is foggy out there tonight. yeah, that's the word that pretty much sums it up, lawrence, isn't it? how about that fog out there? i mean, really, we haven't seen much of pretty much all year long. but >> here we go. the atmosphere stabilizing a bit. now we've got that thick fog settling in tonight and it's moving well on shore. i think going to push not only into the bay but many of the valleys overnight tonight. so watch out for some dense fog overnight tonight. and then tomorrow it's going to be gone. i think in a hurry as we've got a cold front coming to town that's going to scour out that marine layer. in the meantime, though, we've got a widespread 50's around the bay area at this hour. 58 in san jose. 59 in any act. 55 degrees in oakland 55 little wet in the san francisco. maybe a little drizzle but the pacific still remains --

active. there's another cold front headed our way that front, i think is going help deep in the marine layer initially. and then behind that, it's going to kind of scour out. it does. we're going to see that cooler air will be in behind that cold front. that will mean that we're going to see those temperatures around the bay area coming off a few degrees. the winds will be kicking up in toward tomorrow afternoon. we'll talk more about that coming up in a few minutes. i think florence. >> the bay area family held a rally today for a child who fell victim to a freeway shooting about 2 years ago as kron four's rob nesbitt tells us jasper wu's family's concerns at alameda county's district attorney. it's not doing enough to prosecute a 3 man of killing the child. it was not just jasper wu's case that was talked about monday, but the families of several victims in alameda county took to the podium. >> 2 asked district attorney price to, quote, do your nearly 2 years after jasper was shot and killed on an oakland highway, his name is still being chanted during protests and haha, this time

on the steps of the alameda county district attorney's office monday rally organizer bob, he says da pamela price is lacking transparency when it comes to sentencing. violent crimes like jasper's where she is laying the groundwork for reducing penalties for jasper was killers. >> talking about no jail sentence for murdering a 23 month-old. >> 3 men were arrested for was murder and december. trevor green, ivory bivins and johnny jackson. they are awaiting preliminary hearings. but if convicted, this group is concerned that da prices office will pursue an alternative to prison time. stuart chen with the oakland chinatown improvement council read a statement from jasper's mother and asking. >> for the maximum sentencing. allowable under the law. but ford was the first president of the alameda county prosecutors association but was placed on leave 13 weeks ago by da price. >> he said from the podium monday alleging that her office is not doing enough to see justice for jasper. johns

considering not charging the president on i that is someone who created a false narrative. >> and took a some language completely out of context. that was not my language and put those words attributed it to me. >> to hear more on how da prices responding to that case and defending her actions when it comes to several other cases that have awn national attention, tune into kron 4 tomorrow night for our exclusive interview at 9 o'clock. >> developing news out of sacramento. a father's in jail after his 3 year-old son reportedly shot himself. this happened saturday afternoon and it's not clear how exactly the child got a hold of the gun. they were rushed to a hospital. and at last check, the boy is in stable condition. his father was arrested on illegal possession and improper storage of a firearm as well as child endangerment charges. 5 people are dead and 8 others have been hurt after a mass shooting at a bank in louisville, kentucky. authorities say the gunman was an employee of the bank. he

individuals that a terrible act of violence toward. >> from all of us, police say the gunman, 23 year-old connor sturgeon who worked at the bank livestream parts of the attack. he used a rifle and was killed during a shootout with police. still people who've lived in the area for years are on edge. so >> here we go again. >> others staying at nearby hotel say no matter what city they're in, they can't seem to escape mass shootings. >> but i heard all the sirens siren sirens, tons of sirens going and i've no idea what was going on until i went downstairs. and the girl in the coffee shop said there's been mass shooting like an active shooter. >> i think i yeah, i think i don't feel safe almost anywhere now. and the u.s.. >> again, a knee pain reporting tonight. in other

news, the justice department is trying to appeal a texas court ruling that would make it illegal to access. >> abortion medication called press stone a trump appointed judge made the decision on friday. but ruled that it would not take effect for 7 days. the doj is now asking a federal appeals court to extend the pause, calling the ruling extraordinary and unprecedented. >> meantime, another ruling says the drug must still be provided in 17 states, washington, d.c., correspondent trevor shirley breaks it down for us. the drug in question is mifepristone widely used for medication abortions and approved by the fda back in 2000. >> but on friday, a texas judge ruled the fda was wrong to approve the drug and ordered a federal hold on mifepristone's 2 decades old approval. this ruling is in extreme abuse of power. it is an extraordinary example of judicial overreach. the grounds of the ruling are are

are just completely discredited. but almost immediately after the texas ruling, a judge in washington state ordered the fda to maintain the status quo and lead the drug available for women who need it. we certainly have access today and we intend to do everything to make sure is a available to them. >> not just in a week but moving forward, period. the dueling rulings will almost certainly end up on a fast track to the supreme court. i don't care who the 9 justices are on the supreme court or any court of appeal. they should be able to discern the difference between inserting their personal judgment and using the facts and evidence to make a legal ruling. the white house now has a choice to comply with the texas ruling until the supreme court makes the final call or tell the fda to ignure the texas judge's decision if the administration wants to not a lead. this ruling not live up to this ruling, then we're going to have a problem and that may come a point where house republicans on the

appropriations side have to fda programs that don't make sense, ignoring a federal judge's ruling could open the administration up to political attacks by republicans. >> who may argue democrats only care about the rule of law when it benefits them. everything is on the table. if the supreme court upholds the texas ruling, it would make it quarter million pills of that abortion medication. according to governor gavin newsom. the state currently has a stockpile of more than 250,000 of the pills. a newsom says the state has negotiated the purchase of up to 2 million doses. more and has also l with other states. >> governor gavin newsom is also taking another shot at

florida's governor ron desantis advising him against challenging former president trump for the republican nomination. national correspondent nancy loo reports on the rivalry and who we could eventually see on that ballot. >> i asked 5 years we've rights with rest. >> in a new video, california governor gavin newsom shared highlights from his campaign style trip out east last week. lot of work to build a movement. >> to counter what's happening in red states. newsom was also in florida where he attacked governor ron desantis on various issues including immigration. >> and now newsom has publicly advised the santis you not to run for pres>dent, telling him to, quote, pack up and wait a few years. but to keep going at it, even though neither has officially entered the presidential race, they're not just making the case basically screaming each other from across the field. they keep going on to the own turf to try and speak to not just the people in that state. of course. >> but they're both trying to talk to a national audience.

the political posturing comes amid the new desantis pushed to penalize those who help undocumented immigrants in florida. all in line with the conservative agenda desantis used to woo donors here in the west just last month. hello, california desantis had a packed house at the reagan presidential library where he attacked progressive policies. our state is where woke goes to die in line with the progressive agenda. la district attorney george gascon on has just introduced new legislation to protect many undocumented immigrants in particular. those who can help in the prosecution of criminal cases. the many parts of community not trust law enforcement. >> because they are fearful that reporting a crime, maybe leave to the arrest of a loved one. the proposed bill would protect undocumented california crime victims or witnesses from deportation. if they come forward yet another highlight of newsom in california versus desantis and

foot. nobody else was hurt. >> tesla is facing a class action lawsuit over alleged privacy violations. it claims the tesla employees accessed and then shared videos and pictures of customers that were taken by the cars. cameras between the years of 2019, 2022, the lawsuit is asking the court to force tesla to pay damages. and the travel warning for those who are taking advantage of free public phone, charging stations like those found at airports and hotels. the fbi says that they may not be safe. the agency issued a warning saying the usb chargers can infect devices with software that can grant hackers access to your phone, your tablet or computer. the fbi recommends carrying your own charger and usb cord and then instead using an electrical outlet instead of those usb charging stations. >> coming up on kron, 4 news at 10 classified documents said reveal american plans to try to help ukraine have been

>> tonight we are hearing from the former san francisco fire commissioner seen here being kind of metal object. this all happened in the marina district last week. the beating sent don coming yanni to the hospital with severe injuries to his head. >> and the attorney for the defendant says her client didn't start this attack. kron four's dan kerman reports. >> the attorneys for former san francisco fire commissioner don common yanni have released this video which they say shows wednesday night's brutal attack of their client by a man with a metal pipe. coming on. father says his son suffered a broken jaw in the marina district attack

which resulted in 50 stitches in his face and surgery to remove a piece of his skull. the suspect garret doty now faces multiple charges including assault with a deadly weapon. aggravated battery with serious bodily injury and assault with force likely to produce great bodily injury. but the public defender representing doty says that's not the full story. mister doty did not start this altercation. >> mister. carmack nani. approached mister doty. and threatened mister doty. sprayed him with pepper spray. >> any use of pepper spray is not seen in the segment. a video coming out. attorneys have released. but in a statement from his hospital bed coming out, he says 3 homeless men set up an encampment in front of his mother's home that wednesday

morning. he says my family has said prior interactions with these individuals who have made repeated threats of violence to my family members. as a result, my mother did not feel safe. leaving her home. he also says calls that morning to 9-1-1, were ignored. and during the day, he says my mother and girlfriend inform me that these individuals were still in front of her house and had been openly consuming drugs and and exhibited extremely aggressive behavior towards passersby. he says when he arrived at his mother's home that evening and asked them to leave 2 of the individuals move toward me in a threatening manner. the incident culminated with one of the individuals producing a piece of metal and striking me countless times on the head coming out. he says as a native san franciscan and lifelong marina district resident, i firmly believe that the city needs to promote the safety of its law abiding citizens over those who chose to do drugs and commit violent acts in our streets. i am

hopeful that this unfortunate incident will lead to policy changes to better protect the interests of san francisco. residents and that my attackers will be fully prosecuted coming on. e is expected to make a full recovery. in san francisco. dan kerman kron. 4 news. >> to police are looking for a man who they say sexually assaulted a woman while she was walking along and under pass. it happened at this pedestrian underpass at california avenue sunday afternoon. she screamed for help and the suspect ran away but not before taking off with her cell phone kron. 4 spoke with the homeowners association. it's located just a few feet away from that and are pass regarding safety in the area. >> not had at least to my recollection, any crime in the tunnel it's considered to be safe. although property crime has been going up rather considerably. >> take a close look at this. police sketch of the suspect.

he's described as a man between 30 and 40 years old standing at about 5 feet, 5 inches tall with a stoc%y build and he was last seen wearing a bicycle helmet and a yellow shirt. anyone who has seen him is asked to call powell to police. >> over the east bay, uc berkeley police have released pictures of 2 suspects. >> who are wanted in connection with 2 cases of battery. there. police say that they both happened on campus the first last wednesday in the second just yesterday. and in both cases, the suspect is said to have touched a female student inappropriately. now to other news, the skyrocketing student debt has long been a problem here in california and across the country. but now some state lawmakers here have introduced a new proposal to try and help lessen that financial burden. our capitol correspondent eytan wallace reports on the bill and who is not on board. >> it's an issue impacting more than 3.9 million californians student debt. >> as assembly member bloc but

described wreaking economic havoc on many of the most economically vulnerable students across california. but now this democrat from downey is behind ab 11, 60 a bill she says will protect students a very specific kind of debt called institutional debt. that is money to an institution of higher learning for things like tuition and room and board. but to says that's not all. >> parking fees were talking about sometimes late library fees. students are rbc was school. they have worked and they forget to pay fine little it's accruing interest coasters, predator, more and more fees for being on to it. and it's not hill years later that they realized they had this happens to so many students while protections are in place for students who take out loans from the federal government or private lenders. pacheco says that's not the case for students who owe money directly to the school

itself. she says she's most concerned schools can place holds on the accounts belonging to students institutional debt and can prevent those students from enrolling in courses are completing a degree until a plan is worked out to pay back the money. a lot of time students having to hold off. >> and graduations because of that, we should be encouraged to >> 2 too, to go to college is too pursue their dreams. ab 11, 60 will help students persist and graduate. marlene blas is a uc student regent and 30 year law student at uc berkeley. if students get sent to debt collections that impacts credit score and that impacts their ability to rent a place. so this is such a pressing issue impacting directly to students. but the executive director of the coalition of higher education assistance organizations expressed concerns about the bill writing, quote, schools whose registration hold as a tool to help students. it makes no sense to allow a student struggling with paying a debt. >> to take on more debt. that will likely also be difficult

to manage in the bill heads to the assembly education committee next week reporting at the state capitol. wallace kron. 4 news. >> a whole foods in downtown san francisco is temporarily closing its stores just a year after opening the store says it's not safe enough to stay open. a spokesperson told kron 4 the store could potentially reopen at some point in the future if neighborhood safety concerns are addressed, they say employees the store will be transferred to other locations nearby san francisco supervisor matt dorsey says he's not surprised by the closure writing on twitter, quote, our neighborhood wait a long time for the supermarket. we're also well aware of the problem. say the experience with drug-related retail theft adjacent drug markets and the many safety issues related to them. >> for the 4 zone forecast. wow. look at that. the golden gate bridge is socked in tonight. yeah. we finally saw return of karl the fog yeah, boy, a lot of fog out there now thick in spots, especially

near the coastline and over some of the coastal hills and i think tomorrow we're going to actually watch that fog mix out early in the morning and we'll see more sunshine. but the winds are really going to kick up outside. so we do have a cold front that is moving our way right now. it's going up the deep in the marine layer as it moves by, though we got on the backside. we started that cool air move in behind it. that's going mix up that fog in that's when the winds kick up to fog, though, moving over san francisco right now, more than on the way toward the golden gate bridge. that is going to move all the way to the interior valleys overnight tonight. tomorrow we start of a fog early in the morning, but i think that we quickly mix that fog out becoming mostly sunny breezy, though by the afternoon, blustery along the coastline. but high pressure, the long-range looks like building for the next weekend. and that is going to make for some a much warmer temperatures back in the 70's next weekend. but tonight, watching those winds calm down a little bit. then that front comes through with the winds begin to kick up out there. all the sudden we start to talk about some 30, maybe some 40 mile an hour gusts along the coastline by tomorrow afternoon. so blustery out

toward the beaches elsewhere, this front, it's coming through most of the energy going up in the pacific northwest. so it's going to be a dry front for the bay area. if we see the precipitation, maybe a little drizzle out there, the rain is going to stay north of the bay area. you see we're tracking right now up reading across the city are seeing some rainfall in that direction. puerto rican, too. but this front coming through going to kind of fade away as it moves on by behind that. we've got another week one. so couple breezy days coming our way here in the bay area. temperatures. yeah, they're going remain cool in the san francisco is planning some 50 some low 60's. but those winds going to be kicking up out there. so it's going to feel cooler than that. 50's along the immediate coastline inside the bay will start to warm things up. a little more wind sheltered that will drive the temperatures up a little bit more to 64 mount you tomorrow. the south bay looking pretty good. you're going to see some amid maybe some upper 60's by tomorrow afternoon as you head toward the east bay as high. 69 live more 69 in walnut creek. 67 degrees in hercules and 68 degrees in benicia back along the coastline. generally in the 50's next couple days. those temperatures not bad

lawmakers are asking chief justice john roberts for investigation into those trips. according to reports they were funded by republican mega-donor harlan crow over several decades. thomas defended his actions saying that he waa advised that he was not required to report those vacations. >> u.s. officials and foreign allies are scrambling to try to understand how dozens of highly sensitive intelligence documents were leaked online. the documents exposed a range of top secret information, including how the united states spies on friends and foes alike. other files reveal details about the war in ukraine and an analysis of russian intelligence agencies. the leak is suspected to have come from inside the pentagon. one top official calls it the most serious intelligence breach since more than 700,000 state documents appeared on wikileaks in 2013.
