-- degrees cooler than yesterday. if you are ready to step out the door, this should feel very familiar. the only thing that is different is that we are waking up to relatively clear skies. we don't have much of the marine layer out there at all. so you don't have to worry about any fog. and we are pretty much sitting in the low 50s. these are your temperatures. southbay, if you are getting ready to step out the door, i will switch the numbers out instead of showing you where we are now. there is the change, and here is where we will be by about 4:00 in the afternoon. 82 in san jose. northbay, we will check in on the numbers. pretty much just like the weekend. by tomorrow,

most of the numbers will be about 10 degrees cooler than this. it will be a pretty dramatic turnaround into tomorrow for the daytime highs. and yes, there is, it's been a while since we've said this, there is a chance of rain by the end of the week . when we get together again i will take a look at that and show you how likely it is. the drive looks pretty good. the bay bridge, into san francisco, everything is ready quiet. it is a nice commute heading over into the city. great way to start your monday. most of the freeways and bridges are pretty quiet. we do have some delays likely due to roadwork south bound 101. and westbound 580 is a little slow, eastbound 580 there is an accident . the homeless crisis is

taking center stage. a supervisor is hosting a meeting today to demand immediate action for immigrant families and asylum-seekers with children. families needing shelter plan to rally. back in march the supervisor introduced a resolution urging the city to do more to get them off the streets and into shelter faster. it comes as the supreme court is set to hear a case that could have far-reaching impacts on how cities treat people who are homeless. it involves whether jurisdictions can enforce laws to curb engagements. the plaintiffs in the case say it is a cruel and unusual punishment. it is a consummated issue . -- implicated issue. a man who has called the streets of tenderloin 's home for the past 25 years.

narrow question whether there is any constitutional status at all for people who are homeless. and can you criminalize behaviors that the homeless must engage in . >> the case originated from oregon and raises national concerns about camping ordinances and their effects on homeless communities and whether it can be considered a cruel and unusual punishment to site people from sleeping in public if they have nowhere else to go. >> this lot was attacked by a number of people who were homeless as a class action on behalf of all the homeless. not just in grants pass but certainly situated around california and the country. and the district court dismissed their lawsuit but the ninth circuit court of appeals that covers the entire western united states reversed that and

said, no, these people have a cause of action and the clause that terminal is the status of homelessness are unconstitutional. >> the case prompted municipalities to re-evaluate their approach to homelessness amid the rising statistics. it comes at a time when homelessness is on the rise across the country with a 22% increase reported between 2022 and 2023. >> the court is likely to say that not everybody who sleeps on the street is involuntarily there. and they will say that municipalities will have to pick and choose and have to make individualistic determinations on almost every person. >> professor lytle says we should expect a ruling by the end of june. for now, anthony will stay on the streets,

hoping for the best. >> they shouldn't be fined if just for being on the street. >> for an idea of the scope of the issue, according to the latest available numbers from san francisco, as of 2022 there were more than 7700 homeless people in the city with less than half in some kind of shelter. 2023 data showed that around 6200 homeless people lived in san jose with only 30% in a shelter. oaklands data is only through 2022 but shows a similar trend. less than half of roughly 5000 people were in some short of shelter. a jury has been seated in the first ever criminal trial of a former president. opening statements are set to begin soon in donald trump's hush money trial. he is charged with 34 counts of falsifying business records to hide and alleged a adult film actress stormy daniels. this is ahead

of the 2016 presidential election. he has pleaded not guilty to the charges and claims they are politically motivated. in the next half ever -- hour we will take you live to new york. gavin newsom is taking aim at another republican state. he just announced legislation to make it easy for people in arizona to get abortions in california. it would also offer abortion providers a quick route to get licensed in california. and he plans to renew at an alabama where lawmakers are trying to criminalize people who help minors leave the state to get access to an abortion. he was behind similar had in tennessee. mayor london breed is back after weeklong trip to china . the mayor announced that two giant pandas are coming to the san francisco zoo. no word on when they will arrive but the mayor said it was a chance to stimulate

climate week is in full swing today and throughout the week experts and leaders will gather to engage with the public about the new ideas in the climate field. it all kicks off with the opening ceremony at 90, new claimant innovation

center that will service the central hub for climate week. and it is a perfect day to jump into environment action. if you are interested in attending an event, volunteers will arrive at the guadalupe river park in san jose and the organizers will provide gloves and trash bags. as part of our earth day coverage we wanted to hear from those of you focused on our oceans and the creatures that live in the water. shawn chitnis is live at pier 39 in san francisco with more on the message about the importance of marine conversation. happy earth day to you, sean. >> we are here outside the aquarium and just outside there is already the reminder of the importance of doing more to protect the planet with this amazing art display. it has been more than 50 years since the original earth day.

and while there are some newer messages, a lot of what they want us to focus on remains the same. conservation and reducing pollution. and that message is one not just about the land but what is at sea. thousands of marine animals are on view each day at the aquarium of the bay. many of natural habitats these creatures called the san francisco bay home. seeing them up close helps visitors better understand the challenges we face on earth including climate change, plastic pollution in the oceans and natural habitats going away . >> this environments immerses you straight into the oceans and you begin to appreciate the incredible biodiversity that exists. >> reporter: dr. george jacob is the president and ceo of the aquarium and says the underground tunnels, one of the largest of its kind, creates a connection between people and the ocean. >> understanding the

biodiversity and habitat requirements makes us sensitive to why we should keep the oceans pristine. >> reporter: the director of animal care says it helps their guests remember that they share this water with so many creatures that also call it home. >> i really feel that it immerses people. animals are swimming all around you, they come right up to you. >> reporter: with another earth day comes the chance to remind residents that protecting the planet requires all of us to do more for parts of the earth that we can't see. >> that awareness needs more and more investment, exploration, discovery and storytelling. >> reporter: earth day's origin is in the ocean, entire earth. with a local call to action, making that can get lost on some as

much of the focus turns toward the land. >> there should be a simple axiom that if there is no blue, there is no green. >> a global approach to preserve the entire earth with the local call to action making sure we all have a place on this planet. so part of that call to action is asking everyone to make a pledge about what were can you do to help the planet. we often hear about the importance of reducing our carbon footprint but what that could look like is to use less plastic. also changes to your diet as well as looking for more opportunities to recycle and reuse. >> there are so many areas that i'm sure we can really think of in ways we can cut back. we will check back in with you in a little while. since 1970 we celebrate earth day on april 22nd. we covered that first birthday. let's take you back with the great walter cronkite anchoring. it began with a senator from wisconsin creating earth day and 20 million people around the country demonstrated . that same year they

authorized the epa. before that it was perfectly normal to release toxic smoke and waste into the environment. the same reasons we started taking action then are the same reasons we are fearful of the future now. a new poll shows that 70% of americans are in favor of taking steps to reduce climate change. it shows to be highly partisan with more than double the number of democrats supporting climate change than republicans. be sure to tune in tonight at 4:00 and 10:00 for our earth day special. we will take a look at how scientists and everyday people are working together to protect the planet. it airs on kpix.com, the free cbs news app and pseudo-tv. let's step outside and take a live look on this monday morning . we get grade weather

in the bay area, what an incredible weekend we had. the question i have, how long will this weather continue ? >> one more day. right around 80 degrees inland. but it will , technically, it will be 2 degrees cooler than the weekend. i don't think a lot of people noticed that just yet . by tomorrow i think you will. we will do a comparison on how the temperatures will change noticeably one-way. the map shows the color codes of how far above average you are. we were about 7 to 8 degrees above average , over the last few days. watch how it transitions. wednesday and thursday, deeper shades of blue, going back to below average. but the numbers will be more helpful. let's use the floor map and get specific. just how much is your part of

the bay going to change? we've got a lot of low 80s on here. san jose, 82. 78 in a scotto's. tri-valley in the low 80s and northbay, numbers coming in in the same place. how much cooler will these numbers be by tomorrow? santa rosa, going down 10 degrees tomorrow. san francisco, 5 degrees cooler. 12 degrees cooler in napa. there is a pattern on here. in leonard feliz, concord, 11, antioch, double digits, fremont, you're going down 9 . this is very summerlike. and by that, you really see big swings across the valleys. tri-valley, northbay, all going down by 11 degrees. instead of being in the 80s, you will top out in

the 70s. it is still a nice day, only 3 degrees or so below average, but noticeably cooler. lower 70s inland, mid 60s by the time we get to tomorrow for oakland and northbay valley. and to go along with this, the pattern that is driving in the cooler air , and those temperatures will stay with us for most of the rest of the week, they are tied into a slight chance of rain . we can find that system out in the pacific. not a lot to this and we really have to go into the long-range models to take that batch of rain and see how it finally gets here. so maybe some rain from that. the seven-day forecast, a small chance of just a few light showers that show up. by the time we get to thursday and friday, these are the inland

numbers. 80 today, 69 or 70 tomorrow. here is the chance of rain, thursday and friday. i am hopeful we remove it completely by the weekend. let's talk about public transit, the golden gate ferry has suspended service between sausalito and san francisco. a routine inspection turned up some kind of structural problem. for now they are running golden gate transit buses. over toward the golden gate bridge into san francisco, so far so good. pretty quiet conditions overall. still early. traffic doesn't really start to stack up until a little later on. a live look at the bay bridge toll plaza, no delays, quite right. and a-ok into the san

from cbs news bay area , this is the morning edition. right now, history in new york. opening statements will be heard in the criminal hush money trial of former president donald trump. we are live outside the courthouse with details on the day ahead. let's go closer to home as we take a live look outside on this monday morning. good morning , to all of you waking up in oakland. you will have great weather for now. >> the thing about this change is, compared to where we were over the weekend, that was spectacular. we will cool down

a little. if you like 80 degrees and no rain, you get one more day just like it. the rest of the days will be bad, but we will be down in the low 70s and by thursday and friday there is a chance for light rain to go along with this. none of this is too terrible. we've just got to give back what we had for the last few days. but we are keeping it for one more day. to start the day, a lot of numbers on here are very familiar with where you've been. not a big difference between this morning and where we left friday. if you look over the bay bridge, no marine layer streaming in over the bay or the california coast. it is a nice break from that in terms of waking up with relatively clear skies. and we should keep that throughout the day. more sunshine than anything else. daytime highs

today, 82 in san jose. tri-valley going to 82. redwood city in 76 and temperatures for the most part in the low to mid 70s. and you've still got numbers in the northbay making it into the low 80s. everybody goes down for about 10 degrees on tuesday. and we are close enough to the system on thursday that we may be able to see what it looks like. we will look at that in more detail in a few minutes. for now, how does the drive look? >> not too bad just yet. right now we are not seeing a whole lot of traffic . if you are up early, the good news is, once you were on the roadways, for the most part you won't see any major issues. no metering lights just yet. and if you are crossing the bay via the san

mateo, right now traffic is light. we will take a look at san jose in my next report. a major road in the northbay is back open it this morning a little earlier than planned. it was scheduled to reopen today. westbound 37 was shut down for pavement repairs. caltrans says to expect another shutdown next weekend followed up with two more weekend shutdowns. time for a look at this morning's top stories. these days it seems that congress can't agree on much. but a different story this weekend as the house has to tiktok bandwidth overwhelming bipartisan support. that doesn't mean that the apple go away anytime soon. it is contingent on the popular social media platform divesting from china.

passed in the senate. version of the bill that stalled in the senate in march. tiktok is pushing back saying this legislation would violate the first amendment rights. president biden made it clear that he would sign the ban if it passed in the senate. staying in washington, the senate could approve a package of eight as soon as tomorrow. they approved billions in foreign aid for israel, ukraine and taiwan over the weekend. police have arrested a person who is suspected of breaking into the home of but they weren't hurt the motive is still angeles mayor karen bass. it happened just before 7:00 yesterday morning. the 29-year-old man got in by smashing a glass door. police say the mayor and her family were home at the time of the break-in but were not hurt. the motive is under investigation. if you recall a similar scene nearly two years ago in which nancy pelosi's home was broken into. at the time, her husband was the only one home and attacked with a hammer. the jury found the suspect guilty on federal charges including

the assault on an immediate family member of a federal official. the marineammacenter is working to figure out what killed a 40 foot gray whale that washed ashore on alameda beach. responders colleed initial samples and say they plan to tow the carcass to angel island for inspection. it is the first well casualty of the year in the san francisco bay. the oakland police department is mourning the death of a former officer. the officer died on saturday from injuries he suffered in a crash while on duty in 2018. he joined back in 2013 and was awarded rookie of the year in 2018. in august he was responding to a call when his patrol suv crashed with another car and hit a parked semi truck near the port of oakland. the injuries forced him into

medical retirement in 2020. wingate is the 55th oakland police officer killed in the line of duty. police in oakland are investigating a motorcycle sideshow that led to a collision near grand avenue and parkin street. police arrived at the scene to find a motorcycle driver lying in the street after being hit by a car on saturday. he was taken to the hospital and is expected to recover. the driver of the car is cooperating. former president trump's historic hush money trial taking another step forward today. the jury of 12 new yorkers +6 alternates will be hearing from prosecutors and defense lawyers in their opening statements soon. wendy gillette is live outside of the courthouse with more on what is expected to happen today including details about who could take the stand. good morning to you.

>> reporter: good morning. it is starting to get a lot more active here at the courthouse as we get close to those opening statements which are scheduled about an hour from now. i've seen a lot of police officers walking back and forth and one of the told me that the former president is expected to arrive in about 15 minutes. it is a very big day for him as the trial gets underway. prosecutors in manhattan are getting ready to present their case against former president donald trump to a panel of seven men and five women jurors. the former president faces 34 counts of falsifying business records, prosecutors accuse him of funneling hush money through his former lawyer to adult film star stormy daniels to hide an alleged affair before the 2016 presidential election. trump denies the affair and has pleaded not guilty. cbs news

has learned that the prosecution is expected to call former national enquirer publisher david becker as its first witness as soon as today . he is expected to testify about an alleged catch and kill scheme . other prosecution witnesses include michael cohen and stormy daniels. the former president is also said he liked to testify in his own defense. >> he has made so many social media posts that in cross examination he could be shown to be totally inconsistent. i would never put him on the witness stand . >> the trial has kept drum from the campaign trail . a planned return to the stage over the weekend was thwarted by bad weather. and trump has another legal concern to deal with today. new york state

vehicles. nearly 4000 have been recalled due to an issue with the accelerator pedal. regulators say it could be -- become stuck and those of crash risk. overall, drivers are facing some of the stiffest costs in a generation. used-car prices are 25% higher than five years ago and for new cars it is not much better. last month the average price of a new car was under $47,000 and the average new car payment was north of $700. that is according to edmunds finance. also in march the average interest rate for new car loan was more than 7%. for used cars it was nearly 12%. >> if you want a $20,000 vehicle you are buying a used car. in the end, if consumers don't buy, races will come

>> a small chance of rain by thursday. we've had it so nice for the last several days. we do get one more day where it will be sunny and 80, that will be today . tomorrow, we cool down by about 10 degrees. look at the start of monday. what is different about this? the view outside of our virtual window shows no marine layer of fog with one exception, the golden gate bridge. in the next visit i will show you that view. a little bit of marine layer as developed over the golden gate. it is pretty much just over the bridge. it is not getting over here. if we look at today's daytime highs, low 80s and we will use the virtual set to do a comparison on how tomorrow we are giving like 10 of this back. 82 in san jose and livermore. up north, checking

out everybody else and northbay valleys are also getting up there. just to do the play on the drop for tomorrow, watch what happens as we lose monday's daytime highs. now go ahead and take a look around. a lot of these are 10 degrees cooler. down to the south bay, going down 11 degrees. tri-valley, about 10 degrees cooler, so will san jose. so instead of 80s, 70s. still a really nice day. just not as notably warm as today. and to go along with all of this, we have a small chance of rain by thursday. that system will take its time in getting here in terms of its ability to deliver on the rain. we can already see that showing

up on the other side of the pacific and it takes about three days before it is able to deliver any of the rain it's got with it. now we can track it and see what the system looks like. if that is where it is sitting by wednesday, let's put that into the long-range forecast. that is thursday into friday. a weak little system grazing northernmost california . some showers going into friday, trying to hold together. this would be really light if we do get it. if you've got important things that are related for thursday and friday, stay on top of the forecast. definitely not a rainout. it won't be like the storms of winter. it will be one of those weak transition systems . but technically, yes, a drop of rain shows up in the seven day the time we get to thursday and friday. with temperatures right around 70. how does the drive look? >> getting a little busy out

there toward the bay bridge toll plaza . you can see this behind me, getting a little slow for our commuters making their way into san francisco. grab that coffee. for the most part, just tracking a few brake lights here and there. look at this overview map. a lot of green on 880, no delays on 101. san jose, north 101 all clear for the most part, of view brake lights, but really no major crashes or incidents. the ultimate, started out with a crash on the eastbound side of 580, completely gone. but the westbound mute is a slow one from tracy on two 580 itself. westbound 580, highway 4 look to be the busiest spots.

bustling street in downtown san jose, people came out yesterday for an open streets event where people of all ages got to enjoy the streets in any way they wanted. free from cars. things like riding bikes, rollerskating or walking. >> it is such a fun way to get out and see parts of our city that we may drive by but we get to see it in a different perspective. you can see lots of people from different backgrounds just hanging out and being friendly. >> it was facing the chopping block last year but officials decided to reduce the number of days to keep the event alive. and in honor of the event 35 trees were planted in the area. the voluntary group provides free trees across the city as part of the cooling green communities initiative. scientists say that climate change is draining the world's largest trees. the

california endangered giant sequoias and they also tower over the english countryside. each of these guys pull roughly hundred 90 pounds of carbon out of the air every year. offsetting about 100 miles in a gas powered car. they are young saplings in the states but the uk as a better climate for these trees to driving. >> most people don't think of california and the uk having the same lima. the sierra nevada mountains can be quite similar to here. it is cooler and more damp. >> today more than half 1 million giant sequoias are thriving in the uk compared to fewer than 80,000 in the u.s. scientists brought these trees across the pond during the victorian era because people couldn't believe their size.
