election. good morning, and good to be with you. i'm anne-marie green. president biden is getting ready to deliver the annual "state of the union" address tonight. the white house says he's expected to focus on building on some of his previous achievements as he pivots toward a general election rematch with his predecessor. cbs' skyler henry is joining us from the nation's capitol with what we can expect. good morning. >> reporter: hey, good morning to you. the president has his work cut out for him, if you will, in terms of convincing voters of his record. he'll have the stage tonight as millions are expected to tune in, and he's looking to not only quell any concerns about his age but tout his and his administration's achievements and make the case for a second term. >> mr. speaker, the president of the united states. [ cheers ] >> reporter: tonight president biden will deliver his third "state of the union" address to the american people and a

divided congress months before the next presidential election. >> you will hear the president lay out the historic achievements he has delivered on for the american people and his vision for the future. >> reporter: according to the white house, the president plans to push congress to take action on lowering prescription drug costs and to extend the $2,000 out-of-pocket drug cost cap that currently applies only to seniors to all americans with private insurance. he'll also focus on other aspects of health care including mental health and reproductive rights. >> president biden is defending reproductive rights. fighting for a national law that would restore roe's protection. >> reporter: additionally the president will be greeted by awe new republican house speaker, louisiana's mike johnson. the two have recently clashed over several major issues including border security and funding for ukraine. >> president biden is going to try to suggest that the state of the union is strong, but of course the state of the union is not strong.

state on super tuesday, nikki haley suspended her campaign for the republican presidential nomination. >> and although i will no longer be a candidate, i will not stop using my voice for the things i believe in. >> the former south carolina governor and u.n. ambassador said she has no regrets. she did not endorse trump but challenged him to earn the support of the moderate republicans and independent voters who supported her. trump invited haley's supporters to join his movement while criticizing her saying she got trounced on tuesday. in a sign of party unity, senate minority leader mitch mcconnell endorsed trump yesterday. he had been the highest ranking republican to withhold his support. alabama governor kay ivory signed into law a -- ivey signed into law a bill protecting in vitro providers from potential legal liability. the republican-led state legislature overwhelmingly passed the law after last month's ruling by the state

supreme court that frozen embryos have the same rights as children. the law is aimed at getting fertility clinics that pause services in the wake of the supreme court ruling to reopen. the weapons expert on alec baldwin's movie "rust" is spending her first night behind bars. this after a jury convicted hannah gutierrez-reed for her role in the shooting that killed the movie's cinematographer. elise preston has reaction from the courthouse in new mexico. >> reporter: the jury quickly found hannah gutierrez-reed guilty of manslaughter. >> we find the defendant, hannah gutierrez-reed, guilty -- >> reporter: she remained stoic, her mother stunned and visibly shaken. >> this case is about constant, never-ending safety failures. >> reporter: gutierrez-reed was in charge of nearly 20 weapons during the filming of the movie "rust" including the prop gun held by alec baldwin that discharged killing halyna

hutchins and injuring director joel sousa in october, 2021. >> what do you know? >> reporter: prosecutors argue gutierrez-reed was negligent because she mixed live ammunition with dummy rounds on the set. >> she had three hours in the morning waiting for the camera crew to arrive. she had every opportunity to go through that box of dummies -- >> reporter: which is why juror albert sanchez said gutierrez-reed was at fault. >> pretty much not checking the weapons. just handing them over like here. >> that's something you can consider -- >> reporter: the defense tried to hit the blame to baldwin who they argue never should have pointed the gun at hutchins. they say at the time of the shooting gutierrez-reed wasn't inside the church and didn't give baldwin the gun during rehearsal. >> he's going off script. that defeats any idea that that was foreseeable to ms. gutierrez-reed. if she doesn't know what's happening she can't foresee it. >> reporter: gutierrez-reed was

taken into custody as she awaits sentencing. as for baldwin, he has been charged with involuntary manslaughter but has also maintained he did not pull the trigger. baldwin's trial is expected to start in july. elise preston, cbs news, santa fe, new mexico. now to the middle east where we are learning new details about the first fatalities in ship attacks by yemen's houthi militants. a missile attack yesterday on a commercial ship killed three, two filipino and one vietnamese. according to the ship's owners. the ship suffered significant damage. these are the first deaths from the months' long attack by the iranian-backed group over israel's war on hamas. and efforts to get desperately needed humanitarian aid into gaza are gaining momentum. israeli officials say the government will begin allowing aid to move directly from its territory into northern gaza and will cooperate with the eu to create a sea route from cyprus. the white house is throwing

its support behind a new bill that could give the president the power to ban tiktok. lawmakers are pointing to national security concerns because of the company's ties to china. as cbs' jarred hill reports, tiktok says users' data is safe. >> reporter: the future of tiktok, known for everything from dance videos -- ♪ -- to thrifting tips -- >> $30 and they're fabulous. >> reporter: -- could be hanging by a thread. today the u.s. house energy and commerce committee is reviewing a bill that would require tiktok to separate itself from its chinese-based owner bytesdance or be banned in the u.s. >> this bill is a choice and a choice for bytedance as well as any other social media app controlled by a foreign adversary. >> reporter: lawmakers have long expressed concerns about the national security risks of tiktok. in 2022 president biden signed a bill banning the app on government phones all

amid fears information could fall into the wrong hands. biden's re-election campaign just joined the app earlier this year. >> instead of being fed whatever the party-controlled algorithm dictates, americans will then have real freedom of thought and expression. >> reporter: now users like kim fam who leans on the app -- >> follow us -- >> reporter: -- to bring customers to a company worry about a world without the platform. >> it wouldn't kill us tomorrow, but tiktok as a platform has represented a very kind of meaningful and new way that reaches consumers. >> reporter: tiktok's ceo has argued the company has firewalls in place to protect user data. in a statement yesterday, tiktok's owner said the bill would, quote, trample the first amendment rights of 170 million americans setting the stage for legal challenges if this does become law. there are several hurdles before legislation would actually get to president biden's desk. >> all right. jarred hill in new york.

"cbs philadelphia" says eight high school students were shot near a city bus stop. police say they were getting onto a bus yesterday when three masked shooters jumped out of a

car and fired more than 30 shots. authorities released video of the three suspects. a 16-year-old student is in critical condition after being shot nine times. the others are said to be in stable condition. this is the fourth shooting on the city's transit system in as many days. "cbs new york" reports governor kathy hochul is deploying national guard troops to new york city to the subway system there amid rising crime. hochul said 750 members of the national guard and 250 state troopers and transit officers will help the nypd patrol subway platforms and conduct bag checks for weapons. new security cameras will be added. mayor adams said he's adding more city police officers to the subways, as well. and "the pittsburgh post-gazette" says a pennsylvania woman suffered non-life-threatening injuries in a bear attack. police say the woman was attacked as she tried to separate her dog and a female black bear with their cubs. the woman suffered injuries to

[ cheers ] heroics to heartbreak at a new jersey high school championship game. celebration erupted when a player from underdog manasquan high hit what appeared to be a game-winning buzzer beater before time expired. then the refs ruled that the basket came after the buzzer, awarding the victoy to camden high school. manasquan appealed but the interscholastic association rejected it even though it acknowledged officials made a mistake. speeding up airport security and the fda sounding the alarm about more products with lead-tainted cinnamon. here's carissa lawson with today's cbs "money watch." >> reporter: stocks rose wednesday after federal reserve chairman jerome powell told congress we could see interest rate cuts this year as long as inflation stays in check. the dow gained 75 points. the nasdaq added 91, and the s&p 500 rose 26. the fda is warning everyone not to buy half a dozen brands
