ow considered toxic and a health hazards. good morning, it's thursday, the 16th of september. i'm elizabeth wenger. >> i'm sydnie kohara. good morning, it is 5:00. we begin with a developing story out of the east bay. police in concord have shot a suspect in a residential neighborhood. now, this happened just a few hours ago at clayton road and amedure avenue. some roads in that area are closed right now. there is not a lot of information. but we just got off the phone with a lieutenant at the concord police department who says the man flashed a gun at officers and that's when they fired. reporter anne makovec is on the way. we'll have more on this story at 5:30. we have an intersection blocked in san francisco. let's go over to our traffic reporter gianna franco with more. >> it is going to affect your drive. it is at the intersection of richardson and chestnut. multivehicle accident.

sfpd is on scene close to golden gate. expect closures around that area. we have keep you updated all morning long. the golden gate bridge looking good so far, so good. traffic fairly light this morning so it's not affecting your drive on the golden gate bridge this morning. coming up, though, we have some street closures near the moscone center. i'll have details in my next report. back to you guys. >> thank you. not too much fog out there right now. it is expected to be warmer today than it was yesterday. >> okay. we just got word tracy is on her way so she will be here in a minute to give you your full forecast. here's your seven-day forecast. chance of showers in the bay area saturday and sunday. one week after the pipeline explosion in san bruno, that blast zone still cordoned off as a crime scene. police gave residents two

hours yesterday to search through the ruins of their home to look for any mementos. the city of san bruno now estimates the damage to homes property and infrastructure to be $38 million. as for the debris left behind, it's considered a cesspool of environmental toxins as well as a possible airborne health hazard. state and county health officials are rushing to remove toxic ash before the rainy season starts. for the first time, governor schwarzenegger got a firsthand look at the neighborhood. this was yesterday afternoon. he was in asia on a trade mission when the pipeline blew up a week ago today. the governor sent a letter to president obama asking for a federal major disaster declaration. he says the president promises to help. >> every, single thing that will come out of this accident, out of this disaster, if there was a fault of somebody or a problem or something that has not been maintained or whatever it may be, you will know, there

is no hiding of information, i can guarantee you that. >> while the governor was gone, lieutenant governor abel maldonado declared a state of emergency in san mateo county making state money available. four people face felony charges accused of trying to take advantage of the san bruno disaster. the four are charged with lying about living in the burned-out area trying to get free food and other aid for victims of the explosion and fire. they were caught when they applied for replacement driver's licenses. two of those suspects live three miles from the explosion site, the other two are from san francisco. later this morning, officials in san bruno will offer tips on how to avoid scams as fire victims recover. a vigil is planned this evening for the mother and daughter killed in the san bruno disaster. it begins at 7:00 at saint cecilia catholic church in san francisco. 13-year-old janessa grieg went to school there and her mother

jacquelin offered volunteered for school activities. the funeral will be at the same catholic church tomorrow morning at 11:00 a.m. this morning in washington, president obama meeting with his export advisory council. they will talk about ways to increase american sales to the rest of the world. the president will also keep working to extend tax cuts for families making less than $250,000 a year. republicans want cuts for wealthy americans, as well. >> they want to hold these middle class tax cuts hostage. >> if we're serious about helping our economy this month we need to stop the tax hikes and we need to cut spending. >> more than 30 democrats in the house joined republicans in calling for tax cuts for all americans. a new cbs news/new york times poll finds one in five americans thinks the economy is improving. 38% think the president has a clear plan for creating jobs. nearly half think the stimulus package had no effect.

one in five thinks it hurt. a busy weekend for hurricane watchers with three named storms now. tropical storm karl is dumping some heavy rain on mexico's yucatan peninsula. it's expected to become a hurricane threatening mexico's central coast by the weekend. out in the atlantic, you see hurricane igor is a category 4 storm. it could produce life- threatening riptides along the eastern coast of the united states over the weekend and then farther east, there is hurricane julia, with a category 2 storm. here's a heads up for commuters. more build-up today to the opening of a freeway express lane in the south bay. that express lane will open monday morning on southbound 680 running from highway 84 in sunol all the by down to 237 in milpitas. the left lane will be available to solo drivers but they have to pay a fee with a fastrak. carpools will still be able to use the lane without charge. that express lane will be between 5:00 a.m. and 8:00 p.m.

at 10:00 this morning, politicians and transportation officials will have a kickoff celebration right there near the freeway. it is 5:06. let's get another check of the weather and traffic. gianna, how's commute looking? >> the freeways are looking very good. very light on the roads. but the surface streets is where we are having a trouble spot this morning near golden gate accident at richardson and chestnut. sfpd and emergency crews are on scene. expect that intersection to be blocked for some time until it's cleared out of the road. give yourself extra time if you head through richardson near chest enough. elsewhere closures taking place. near the moscone center, this is for oracle open word. tonight at 8:00, howard street will be shut down between third and fourth streets. that will be in effect until friday the 24th. so definitely give yourself extra time through that area. right now the bay bridge checking in problem-free. the metering lights are off and as you can see, no delays at

[ inaudible ] >> 15 officers wearing cameras to get audio and video recordings of exactly what they

do. the recordings sense the end of each shift. >> i'm able to record everything, you know, and i'm able to download it. it's there. you have a record of it. so i can go on the computer and log on. it's like you have a phone with all your contacts. >> the oakland city council expected to decide next week whether or not to buy cameras for all 350 officers. the cost, $900 each. those cameras, though, would provide evidence when there are allegations of misconduct. another bay area city has adopted strict new limits on where smokers can light up. the menlo park city council approved a ban in common areas of apartments and other buildings. parks, athletic areas, transit stops. the council needs to vote one more time before it goes into effect. violators could be fined up to $100. the use of illegal drugs is

at its highest level in nearly a decade. that's according to the substance abuse and mental health service administration. the report says last year's high rate was fueled by a sharp increase in marijuana, ecstasy and methamphetamine use. one government officials says there are eroding attitudes about the harm caused by illegal drugs. one theory on the changing attitude, the growing number of states approving medical marijuana. cocaine abuse, however, on the decline. talk about an out-of-this- world vacation. boeing plans to start offering space tours in flights by 2015 partnering with private marketing firm space adventures. the boeing spacecraft will be able to carry 7 people on missions up to 62 miles above the earth's surface. no ticket price yet. but it is estimated the trip will cost tens of millions of dollars. so only a select few can actually go. >> so that leads us to our question of the day. what's the most adventurous thing you have ever done?

now. it's expected to be a bit warmer today than it was good morning from the traffic center. dealing with city street problems this morning. expect lanes blocked at richardson and chestnut due to a multi-vehicle accident. one of the vehicles overturned. san francisco police department is on the scene as well as emergency crews. at least three lanes are blocked through that area. traffic is being diverted on baker street through the area so give yourself extra time or

avoid it if you can. delays at richardson and chestnut. elsewhere the oracle open world is taking place this weekend so we have some closures that start tonight at 8:00. howard street between 3rd and 4th will be shut down until friday, september 24. so expect closures through there. there are more closures taking place throughout the weekend. delays and around the moscone center expected throughout oracle open world. golden gate bridge problem-free looking good both directions. very quiet cross the span, free- flowing. bay bridge no troubles. lights are off at the toll plaza. light traffic approaching the pay gates. 880 so far, so good, northbound no delays to report. everything clear near the coliseum, southbound light as you work your way towards hayward. and getting a look at our drive on 580 and highway 4, first 580 lots of green on the sensors so that means traffic is up to speed. 68 miles per hour. so far, so good through there. if you are taking highway 4 through antioch, just a little sluggish. starting to see speeds around

40 miles per hour but overall traffic clear near l street through the antioch area. that's a look at your drive. sydnie has your forecast. >> thank you very much, gianna. really, not too much fog out there right now. that's certainly a nice break as we take a look at the temperatures all around the bay area. expected to be a bit warmer today than it was yesterday along the coast. the 60s, mid-70s around oakland and fremont and napa. then you get farther inland and you've got fairfield, concord and livermore in the 80s. those are some of the highs expected today. taking a look at our five-day forecast, 85 degrees tomorrow, 80, starting to cool down because then when you get into the weekend we have rain in the forecast. so keep your umbrella handy and a jacket. it warms up monday and tuesday. so not bad for this time of year. i don't know where that rain is coming from this early but maybe we'll have warmer temperatures out there. poor elizabeth is not real happy right now.

>> i know. freezing in san francisco! i got to head out to the east bay. thank you, sydnie. here's a look at this morning's top stories. president obama today continues to push for a tax cut for american families earning under $250,000 a year. that's all restoring higher taxes for the wealthy. more than 30 house democrats are with the republicans on this issue calling for tax cuts for everyone. four people are facing felony charges for allegedly trying to get benefits for the victims of the san bruno pipeline explosion. a san francisco couple and two women from an area of san bruno not affected were arrested when trying to sign up for replacement driver's licenses. there is an express lane opening in the sunol grade. there will be a celebration kicking off the lane.

foreclosure listing service realtytrac says more than 95,000 homes were repossessed by lenders last month an increase of 25% from the same month last year. and it's up 3% from july's tally. the previous high was back in may. california's budget stalemate is on the verge of become the longest in state history. this is not a record that you want to set. the record will be set today if lawmakers don't reach agreement on any plans. there is no indication that they are anywhere close to a deal. some are questioning whether an agreement can be reached before the november election. democrats and republicans remain in a standoff on whether new taxes or more spending cuts are needed to close a $19 billion deficit. time now 5:20. helping to stop people from texting and driving. >> coming up, the app for that you can get on your cell phone.

the fog wasn't too bad this morning. a clear picture of downtown san francisco. we are going to have a little built of a warmup today in anticipation of a good cooldown this weekend. showers in the forecast. but it may be just a little bit of a drizzle. an effort to discourage ticketing while driving. there is a phone application for that. >> there is an app for everything these days. a southern company has developed a new smart phone application called sms reply. once installed the app can sense when your car is moving. it will send out responses to anyone who sends you a text message so you don't have to. you get an inbound call and an inbound text. the phone is silent and it automatically replies back to the person that says, oh, you can't answer, you're driving right now. >> it lets the person texting you know that you can't respond right away because sometimes you feel that pressure.

16th of september. i'm sydnie kohara. and i'm elizabeth wenger. good morning, everyone. it is thursday, the 16th of september. i'm sydnie kohara. >> i'm elizabeth wenger. we're following a developing story out of the east bay this morning. it's a shooting overnight involving a concord police officer. anne makovec is in concord where officers say the man flashed a gun at them.

anne. >> reporter: it was police that did the shooting overnight apparently, elizabeth. i'm here in concord right now on the intersection of ashbury and clayton. we have a map of the area. police say the man was walking here in this area of concord and let me show you back out here live now. apparently he took off down ashbury when police told him to stop. he was recognized as a wanted man. we are not sure at this point why. police say they told him to stop again and he started running away. he got halfway down ashbury when police say he pulled a weapon. then officers shot him, wounding him. he was taken to john muir hospital. police have ashbury drive closed off as they begin their investigation. as is common with the police- involved shooting, we have a vehicle here with the contra

on the day of the explosion, he was in asia on a trade mission. governor schwarzenegger says the president promises to help. and there was a remarkable act of heroism moments after the explosion. bob and his 25-year-old son bobby ran into a converted nursing home in the burning neighborhood. they found several wheelchair- bound women in their 60s, 70s and 80s. those women had been left behind by two caregivers who ran off when they saw the fire. >> bobby went to the left. and i saw a lady there, an elderly lady, in a reclining chair with oxygen on and had stereo headphones on with her back to the window. she had no idea that what was going on. so i took everything off of her and i said, come on, sweetheart, we've got to go, we've got to go. >> reporter: what do you say about this? >> i just want to thank the people that save all the people in there that's all. thank you. >> reporter: tell me about the people who are giving the care

weekend forecast in just a few moments, back to you. >> thank you. $17,000 reward is being offered to find the gunman who shot and killed a berkeley man while he was walking home with his fiance. adolfo had just left a party celebrating his 35th birthday sunday morning when he and his fiancee were attacked by two robbers at adeline and emerson streets. the woman was punched and suffered minor injuries. police say the gunman got away in an older model two-toned suv. today a san jose community group will unveil details of a new survey about police relations on the city's east side. people acting in community together or pact said 35% of those surveyed said they have been stopped by police without cause. the east side has a larger minority population than the city as a whole. "pact" says more than half of those surveyed don't trust the police but almost 90% say they want a strong relationship with local law enforcement. meg whitman has now spent more of her own money on her

campaign than any politician in u.s. history. the former head of san jose- based ebay just contributed another $15 million to her run for governor of california. the running total of her personal donations, $119 million. that is more than the previous record set by new york city mayor michael bloomberg. the california teachers association has made changes to a television ad criticizing whitman. a campaign attorney warned tv stations they could be held liable for slanderous or libelous statements if they keep running t cbs 5 and some other stations have since pulled the ad. now, according to the ad, whitman says another $7 billion should be cut from schools. the spot also suggested 100,000 more teacher layoffs. >> i have never said anything like that. in fact, my third priority is education. >> have meg tell us where she is going to get the money from, that's all we're asking. teachers want to know. >> but the ad says "meg says

she is going to take $7 billion from education." >> yeah. >> she doesn't say that. >> that's what her plan says. >> her plan doesn't say that according to her attorney. >> you can talk to the attorneys about it. i'm just telling you the real question is: where is the money coming from? >> the cta's revised ad has a slight wording change saying whitman plans to make those education cuts. attorney general and gubernatorial candidate jerry brown has sued city leaders in the southern california town of bell. the lawsuits are against eight former and current city leaders. they are accused of fraud and conspiracy. the civil suits demand they return hundreds of thousands of dollars in inflated salaries they gave themselves. >> no doubt that the activities of the city council and the method by which they worked with the manager produced the result that wasted public funds

helping our economy this month, we need to stop the tax hikes and cut spending. >> reporter: but republicans aren't the only ones refusing to get on board. more than 30 house democrats signed a letter urging the tax cuts be extended for everyone. with unemployment stuck near double digits, the economy is still the top concern for most americans. and according to a new cbs news/new york times poll, only one in five thinks it's improving. >> it's not being fixed. it's being smoothed over to make look like people are filling jobs. >> reporter: only 38% think the president has a clear plan for creating jobs. and some 46% think the stimulus package has had no impact on them. one in five thinks it made matters worse. >> it's too soon to make any final assessment of this presidency. >> reporter: today president obama and the democrats could get one of their last chances to prove themselves to voters.

the senate is expected to vote on a long stalled measure that would boost lending to small businesses. in washington, tara mergener, cbs 5. the obama administration is ordering oil and gas companies to plug or dismantle thousands of wells that are no longer in use in the gulf of mexico. meanwhile, that relief well at the site of bp oil spill is expected to be completed today. that broken well has been capped for about two months now. but the relief well will allow it to be more permanently sealed. that could happen by sunday. very busy weekend for hurricane watchers with three named storms. take a look. tropical storm karl dumping heavy rain on the yucatan peninsula of mexico. it's expected to become a hurricane threatening mexico's central coast by the weekend. then out in the atlantic you see igor is a category 4 storm. it could produce life- threatening relationship currents on the east coast of the u.s. over the weekend. and then east you see julia, hurricane julia is a category 2

on foot when they tried to question him. they say he pulled a weapon so they shot him. four people who don't live in the san bruno fire area are under arrest for claiming they live there. and they are facing felony charges involving filing faust claims for assistance that was meant for fire victims. and president barack obama criticizing republicans for threatening to block tax cuts for most americans if the wealthy don't get the same cuts. more than 30 house democrats are also calling for the cuts to be for everyone. and we have some health news now. you can add one more thing to the list of benefits for taking aspirin. it can help prevent colon cancer. that's according to a new study. people who took even a low dose of aspirin for regular basis for one year reduced their risk of developing colon cancer by 22%. the numbers are even higher after taking aspirin over a five-year period. good news for her mitts out there. being popular could come at a price could get you the flu

early. popular people tend to get sick an average two weeks before their less popular friends. researchers believe the center of attention exposes you to more germs. they say identifying the most popular people, not just facebook, in real life, could be a useful tool to prevent the spread of the flu. >> you're shaking hands and hugging more people. >> more friends, more germs.
