hundred times. at first i thought, you know, he's bullying me. >> tonight we are learning of new action being taken in response to our story. and then a battle between bay area airports. san francisco now suing oakland over the proposed name change, but do they have a case? we consult an expert. and later, san francisco's official 4/20 festival may be canceled, but what happens when people show up anyway? an unusual and unorthodox church is now stepping in to help out. good evening. this is "nbc bay area news tonight." i'm audrey asistio. we'll get to all those stories in just a moment. but first we want to catch you up on some headlines we are watching tonight, including a disturbing case in the south bay. three people are under arrest tonight, accused of kidnapping and torture. san jose police say these three people kidnapped a man the night of february 13th and brought him to a home in the evergreen neighborhood.

that is where investigators say they assaulted and tortured the man. investigators say the victim was released, turned up at a hospital two days later. neighbors say the people in the home have been a nuisance and that kim ho, who they knew as lisa, had her house raided three times before. >> so when i found out that somebody had been hurt, that they hurt somebody, i was really surprised by that. i didn't think of them as being violent, though we were nervous about that possibility. >> the trio face charges of robbery, kidnapping, torture, and assault with a deadly weapon. but duk nguyen is going to be facing another charge. the sheriff's department believes that nguyen also leads an organized crime ring. a driver is dead after driving off a cliff near devil's slide. this happened just after 12:30 this afternoon near gray while state beach. the chp says the car lost control, went off the road, and fell 200 feet down a cliff. the driver did die at the scene.

his name hasn't been released. this crash is just the latest along devil's slide. the stretch of highway 1 has claimed dozens of lives. well, get more people off the streets, or he is threatening to sue. that is the new message coming from governor newsom as an attempt to hold cities accountable. the state's new housing accountability unit has secured dozens of concessions and judgments against local governments that have failed to follow housing laws and targets. now newsom says he wants to expand that unit to apply the same scrutiny to homeless efforts. >> it's not about being sparring partners. we're working partners in the beginning of projects and proposals to make sure that we're aligned, that the city and county and the cocs are aligned with the state and our vision, and we're addressing issues in

real time. it's about technical assistance. it's not just about a punitive measure on the back end. >> the governor says he plans to move 22 existing employees to the new homeless accountability unit. they also plan to start using homeless counts to determine housing needs and audit how cities and counties are using state homeless funds. some of those changes will require approval from the state legislature. also tonight, our investigative unit is prompting action. it comes just one day after we reported complaints from antioch unified school district employees who say they're being bullied by their boss. in one instance, a worker's desk ended up on the roof. employees of the antioch unified school district and other community members sent us these photos you're looking at right here. they say the district's director of maintenance, operations, and facilities, ken turnage, was behind this incident and that he allegedly directed district employees to use a forklift to move that desk. this incident happened 15 months

ago. employees also tell us that not only has turnage not been held responsible, but that the bullying has continued. our investigative unit spent weeks trying to reach him. he has not responded to us. we also tried reaching the antioch school district superintendent, and after multiple calls and emails, we have received a statement from h.r. saying that they investigated the concerns and took action. but it didn't specify what kind of action. now just one day after our story aired, the school board president is vowing to get to the bottom of what's going on. >> yeah, i was horrified. this is not the district that i hoped to create or that i envisioned for our employees and for our community and for our students. i was so inspired by the bravery that these employees had to share their stories, to share the trauma that they suffered through their employment at this school district, and i'm sorry that we've not done more to help

address this and create the district that we truly want for our community. >> now, joining us is investigative reporter candice nguyen. candice, remind us again of the other types of bullying the employees said they faced. >> this is on top of that picture we saw of that employee's desk on the roof. so i spoke to four employees, sat down with them. i received more complaints even today after the stories aired. but the ones i sat down with, they say they have been demeaned. they have been yelled at. they say it's on a daily, constant basis. one of the employees said he actually felt physically threatened when turnage charged at him. >> we just heard from the school board president, very apologetic. what else did he tell you? >> he tells me he's taking a lot of action tonight. we have a lot more coming up at 11:00, but he actually just minutes ago, audrey, he told me he is now asking for the superintendent to step down. we have a lot to catch up everyone, but he first called for this special meeting.

supposed to happen tomorrow where they'll talk about disciplinary action. but you need a quorum to have this meeting, meaning a majority of the school board members to be there. the majority did not agree to it, so this meeting has not happened. he says he's very disappointed. at this point that school board president who you just saw there is going on the record, saying he's calling for the superintendent to step down because he feels she has been allowing this bullying to happen. >> i know you've been extremely busy all day catching us up and getting all of the updates, candice. so i'm wondering what has the reaction been like since you broke this story? >> it's been huge. i woke up to emails, calls to our investigative tip line, and really on all sides of the aisle. this issue, what we've -- the thread we're pulling on here, what we're shining a spotlight on, i'm learning it's not just with the school district. it seems to be with antioch, the community, as a whole. >> all right. i'm looking forward to your full story at 11:00 tonight.

thank you. another big story we are following tonight. a new battle of the bay. a legal fight now brewing between two bay area airports. we're talking about sfo and oakland. san francisco now making good on a promise to sue over oakland's proposed name change. the oakland airport is in the process of changing its name to san francisco bay oakland international airport. in a lawsuit filed today in federal court, san francisco argues oakland cannot change its name because it infringes on an sfo trademark. the city attorney also claims that the name will confuse travelers. the port of oakland, which runs the oakland airport, says that the name is about clarifying where the airport is located. they also say they have no plan to back down after the proposed name was approved by port commissioners last week. >> the port's proposed renaming does not infringe upon sfo's mark. sfo cannot lay claim to the geographically descriptive term

"san francisco," let alone claim exclusive rights to the san francisco bay. >> we're concerned about travelers who will inevitably experience economic loss from missed flights and mishaps. we're concerned about damage to the travel industry for our region. >> s.f. city attorney chiu believes oakland is deliberating trying to pull business away from sfo. the second and final approval for the name change will be voted on by the port of oakland may 9th. in the meantime, we wanted to know does sfo have a case? joining us now is lolita darden, a patent attorney. she's also the director of the intellectual property and technology law clinic at george washington university school of law. lolita, thank you so much for joining us. first, i want to ask you does sfo actually have a case here? >> i think they may have a case. in trademark law, the main

concern is mitigating instances of consumer confusion. and in this case, because both trademarks include san francisco, i believe san francisco international airport does have a case because consumers seeing the word "san francisco" will automatically or very highly likely think that the two airports are one and the same. so confusion would be likely. consumers would likely buy tickets to the san francisco bay oakland airport, thinking they're going into sfo. so it's very likely that san francisco international airport has a very strong case. >> mm-hmm. >> but that's not to say that oakland doesn't have some arguments as well. but i think the law may favor sfo in this case. >> that's what i was actually going to ask you next, speaking of oakland's arguments. what would those be?

>> they will likely say that they have a right to use a geographic designation that communicates to consumers the origin of their services. their services originate in san francisco bay, oakland, california. they should have a right to use that designation. but the question will be, do you need to use the designation in the format of a trademark, or could you just use it as informational purposes the way that oakland has already been using the designation "san francisco bay." oakland currently has registrations at the u.s. patent and trademark office for a designation that says "we, and then an airport image, oakland." so it's we fly oakland. then underneath in smaller letters are the terms "san francisco bay." so they could continue to use

something like that, but now they moved the geographic designation, san francisco bay, up into the main body of the trademark, which is what most people look to when they're trying to determine whether to purchase a good or a service. >> i'm always trying to find solutions, lolita. you know, to lessen the confusion that you were talking about earlier, i'm wondering does the order of the name matter? what if oakland changed its name to oakland san francisco bay international airport instead of san francisco bay oakland international airport? >> that is a very good question. and we were talking about consumer confusion. there's case law that says that consumers will really latch onto the first words in a trademark. so it very well could help to dispel confusion if oakland were the first word of the trademark versus san francisco bay. so that might be something that the two parties themselves might

come to a resolution to say, why don't we mutually settle this disagreement by saying, you are now oakland san francisco bay because if consumers see the word "oakland," they're less likely to believe that they're flying into or buying tickets to sfo. >> all right. lolita darden, thank you so much for your insight about this today. appreciate it. >> quite welcome. thank you. up next, keeping the party going safely. the effort under way right now to protect marijuana enthusiasts who show up to hippie hill on 4/20 despite the event's cancellation. plus, marking 118 years since the great quake. the improvements san francisco is now making before the next

welcome back. call it a spark of new life for the annual 4/20 meet-up in san francisco. the hippie hill lineup event will not be happening this year. the organizers canceled the marijuana festival weeks ago. but now a very non-traditional church is stepping in to make sure anyone showing up anyway will have what they need. the church of ambrosia, which is headquartered? oengd, is leading this new effort. they're a non-denominational church that focuses on the use of cannabis and magic mushrooms in religious ceremonies. they say they've been working

with several volunteer works to provide things like medical support, water, even crowd control. the idea is to make sure those who do show up here on 4/20 are taken care of and that hippie hill is cleaned up after. so joining us now is the church of ambrosia's pastor, dave hodges. pastor dave, thank you so much for joining us this evening. my first question for you is why? why do this? why get involved? >> well, thanks for having me. the main reason we're getting involved is because we know the san francisco hippie hill event is a tradition that's been going on since the '70s. and like it or not, people are going to show up. so we want to make sure when they do, that there's some medical and some water and some extra porta-potties and somebody just to make sure that things don't get bad. >> and that's what i was going to ask you. what exactly will the volunteers of your church be doing out there on 4/20? you're just going to be assisting people? >> yeah. the main thing that the church will actually be doing is

passing out water. but there's also -- we've lined up a medical team, so there will be medics out there in case anybody has any problems. we also have some nonprofits, dance safe and mitch's -- i'm sorry. there's a few nonprofits that are helping us. the big one that's really been a big help is the haight street merchant association. they've been working with us to get more porta-potties out there and make sure that all the facilities people need are taken care of if and when they do come out. >> so just assisting people with things they probably need out there. have you been given the okay from the city? >> not really. i mean, again, we know it's happening, and they know that we're going to be out there. we're just trying to make sure that everybody's safe. so it's unfortunate that this has happened the way it did, but we know the city is putting a lot of resources in it, and we're trying to do everything we can to help. >> i've heard of denominational

churches before, but i haven't heard of a church like yours, which involves magic mushrooms and marijuana. can you explain a little bit about what you guys do? >> yeah. we're a church located -- we have two locations, one in s.f. and one in oakland, and we provide magic mushrooms, cannabis, and dmt as sacrament for our members. >> all right. pastor dave hodges, thank you so p for joining us today. really appreciate it. >> yeah. thanks for having me. well, today marks 118 years since the great san francisco earthquake, and the city commemorated the fateful day earlier this morning. [ siren ] today, this fountain was dedicated to the late dianne feinstein for her service to the city. the wreath laying marks the moment in 1906 when a 7.9 magnitude earthquake hit, destroying much of san francisco and sparking a devastating fire.

former mayor willie brown as well as the fire and police chief attended the ceremony to honor the victims. the fire chief says in the 118 years since the quake, the city has made major strides to protect residents. >> we have many more capabilities than we had in 1906. we have redundancy in water supply. i don't think we'll need to blow up van ness avenue to save the city. but the san francisco fire department is always here training, learning new techniques, hiring young people, and, you know, we're ready for you on a daily basis. >> event organizers and participants then went to 20th and church streets near dolores park to repaint that fire hydrant right there that helped put out the fire back in 1906. we are taking a live look at we are taking a live look at san franci

at cache creek casino resort. welcome back. let's go ahead and turn over to our chief meteorologist, jeff ranieri, now. this weekend is something a lot of people are looking forward to. >> it's lining up really incredibly for us. after last weekend when we had the rainfall and the colder temperatures, we have high pressure moving in, and that's going to move the storm track just to the north as we head through tomorrow, saturday, and sunday. so the rainfall is going to be close, but it looks dry at this point. the only other thing we're going to see here is some fog that's beginning to return at the coastline right now. and we'll have that through tomorrow morning. let me show you more details on that in your microclimate

forecast. let's start it off with tomorrow morning, and here is the fog we'll see moving in across the bay area. even the chance of a little bit of drizzle right at the immediate coastline. then as we head through the day, the majority of that will clear back for sunny skies from the north bay to the south bay except that the coast still looks like we'll hang on to some of that fog throughout our beaches. so as we head through tomorrow morning, we're going to start it off with temperatures here in the 50s. relatively light winds through the afternoon. numbers cool off a little bit because of that foggy breeze at the coastline. we're still going to be above average and into some very enjoyable weather. 75 in martinez. 78 in livermore. upper 70s for the south bay. 76 in palo alto. i got you at 64 here in half moon bay. so dry all the way through this weekend. then we're still looking at what could be the chance of some rainfall as we head into next week. right now it doesn't look that big, but some spotty showers wednesday, thursday, maybe even into the following friday. so check it out.
