officer-involved shootings that prompted reforms by then police chief greg sur. he resigned, forced out over public pressure because of those shoots, and chief bill scott was brought in with a mandate to finish the job. among the accomplishment, the department says officer-involved shootings have dropped by 50%, use of force fell by 65%. this is a process that started in 2016, and while the chief of police is celebrating, submitting the final reforms to the department of justice, there are critic who is still say that the san francisco police department still has work to be done. >> the racial disparities in terms of who gets stopped, who gets searched are unacceptably high. >> reporter: he hopes additional restrictions adopted by the police commission recently will have some impact on those disparities. meanwhile, christine is

concerned recently passed propositions could roll back reforms. she's with the prosecutors alliance of california, a law enforcement reform organization. >> measure e permits now police pursuits in misdemeanor cases. that's very unusual and out of keeping with places this in this country. >> reporter: the measure was put on the ballot by mayor london breed. >> this does not mean we won't continue the great work that we are doing to balance the reforms that we need to implement as well as making sure that we focus on public safety for san francisco. >> reporter: most of the mayor's opponents in november's election say they support the sfpd reforms under chief bill scott but former interim mayor mike ferrell has said he would fire scott if elected. sergio quintana, nbc bay area news. a judge has set the date for

the trial for david depape. a federal jury already convicted depape last november. he was found guilty of attacking the husband of speaker nancy pelosi, but depape is still facing a state trial for the break-in and assault. a hearing was held in san francisco today. his actual trial is scheduled to start next friday. new developments in the search for a missing swimmer in the north bay. rescuers have found a body, but it's not clear if it's who they're looking for. yesterday a pair of teens went missing while swimming in the russian river near forestville. rescuers did find one of them and brought them to a hospital, but they suspended their search just before midnight. and today several agencies were back out on the water looking for the other teen. the sonoma sheriff tells us that they did find a body, but it is too early to confirm whether it is the missing teen or not. in the meantime, first responders have this reminder the water of the russian river is fast and cold. and they say you shouldn't swim in it unless you're an experienced swimmer. a woman on the peninsula says her trust in the legal

system is shattered. her alleged rapist taking a plea deal and serving no additional jail time. >> investigative reporter hilda gutierrez spoke with the victim and looked at how often defendants take plea deals. >> this was brought as a rape case that included a videotape confession and an apology note by the defendant. the victim wonders why there's a deal that leaves him with no sex crimes on his record. >> reporter: carrie banks grew up believing in the justice system. she comes from a law enforcement family. her father and uncle work for the belmont police department. >> and i grew up knowing if you did wrong you'd get in trouble and the police would help you. and the police did. >> reporter: she says her trust was shattered when she was raped. >> but i knew the process would work. at least i thought. >> reporter: it was the summer

of 2021. vance a mother of two was talking to an acquaintance she met the year before. at some point she says she realized she had enough to drink and walked outside with a friend to order a rideshare home. the acquaintance followed them. >> he comes up to the bench we're waiting on and starts kissing on me again, like similar to the year prior. and my buddy's like, hey, hey, hey. and when he does say that, the guy runs off. >> reporter: banks says her friend helped her get home and snapped this photo of her in bed before leaving her apartment. >> clearly i had enough, so passed out from drinking. >> reporter: when banks woke up, she says the acquaintance, mendoza, was standing by her bed. >> he's there, and i'm like what are you doing? get out of here. i remember getting up, chasing him out, and i really truly believed i had -- i saw missed calls through instagram. >> reporter: screenshots show he

tried to reach her before entering her apartment. banks says she reported the incident to the san mateo sheriff's office and obtained this restraining order. >> you don't have the right to come in my house. i've never invited you to my house. this is, you know, this is not okay. >> reporter: banks says it was the sheriff who upon questioning mendoza a week later let her in on what really happened that night. according to the sheriff's report, mendoza wrote an apology note that in part read, i shouldn't have opened your door and gone into bed with you. in the narrative, mendoza also agreed that having sex with someone who is too intoxicated to consent is rape. he was booked and charged with two felony counts of rape and sexual penetration with a foreign object. in november of last year, banks says she was ready to go to trial, but as she sat in this court, she was told the defendant was ready to enter a last-minute plea deal for false imprisonment, a charge she had never heard of before and wasn't even a sex crime. >> and i begged her to please

not do this, that i was ready. i said i would rather lose on the stand than to let him get away with false imprisonment, which meant nothing. >> even though we were ready to go to trial on that day, we decided to offer some charges that were felonious but did not carry sex registration. >> reporter: chang was not the prosecutor in banks' case but supervises the sex assault unit within the san mateo county d.a.'s office. >> the trial deputy after having listened to it decided that there were some issues because of the tone of the conversation. >> reporter: banks says the prosecutor never mentioned the confession tape or its tone. chang says the timing of the plea was unfortunate and in hindsight wishes they would have asked for a continuance to consult with banks and give her time to process it. we reached out to mendoza and his attorney but never heard

back. it turns out the plea agreement in banks' case is not an isolated one. nbc bay area's investigative unit reviewed records for rape and sexual battery cases from the san mateo sheriff's office dating back to 2018. through public records requests, we obtained information on 60 cases and cross referenced the original charges with the final outcome. we found 32% of the cases were either rejected by the d.a.'s office or later dismissed. 11% are ongoing. and about half, only 57%, were resolved. of the 31 cases where the d.a. charged the defendant with a sex crime, 19 resulted in a sex crime conviction, 4 were convicted of a sex crime by jury, but in 8 cases, 26% of the time, the defendant negotiated a nonsex-related plea deal. >> sometimes the facts or the witness statements change after we file the case, and if our

case is weaker than we originally assess it to be, we're going enter into negotiations with defense. >> reporter: but a law enforcement source with a lengthy knowledge of banks' case told us, we expected a harsher sentence. this was a no fail case, meaning everything was put together with a legal confession in a box and ribbon for them to prosecute accordingly. the sheriff's office has not released a confession tape to the investigative unit or the banks but told us as a charging entity, the district attorney's office determines the strength of a case for the purposes of prosecution. >> you know, they just kept saying to me, well, you know, this stuff doesn't happen. and all i could keep looking at is why didn't i matter? >> mendoza only spent five days in jail but was put on probation and told to sustain from alcohol and drugs. two months ago he was caught driving under the influence and is now serving six months in jail for violating his probation. that's more time than he ever served in connection with the banks case. banks is working with civil

into a wider conflict. go ahead and take a live look at the u.s. capitol after the house voted to renew a powerful surveillance program despite vocal opposition from the right. vote was 272-147 with many republicans and democrats voting in favor of the legislation. two days ago a band of 19 conservatives revolted against republican leadership, blocking the program on the floor. the group is supporting former president trump 's call to kill reauthorization of spy powers under the foreign intelligence surveillance act. the bill allows the government to conduct targeted surveillance of foreign nationals without needing to obtain warrants first. after a two-day stand-off, the small group of republicans struck a deal with speaker mike johnson to allow a vote on the bill. the reauthorization was cut to two years from the original five. change means mr. trump could change or kill the law if he wins reelection. up next, big sur's bracing

have a good weekend. >> thank you. let's talk about our weather and our roads here. big sur is bracing for rain. we know the rain is coming, and people are hunkering down. highway 1 you see there is still damaged and now those daily convoys out of the area and into the area are being canceled or postponed, we should say, because of the expected rain. a storm last month washed away part of the scenic highway, basically the only way in and out of big sur. since then caltrans is doing twice daily convoys to safely lead people over that slide area. those convoy, though, will be suspended tomorrow but will restart on sunday. vianey's with us now to talk about the rain which is, what, later tonight into tomorrow morning, right? >> i would say later tonight, areas north of the golden gate, you'll be first see it. timing of this always falls on a weekend it feels like. >> that's the story of our year. >> i know, i know, but the cooling already underway. like we noted, you probably also noticed how breezy it is.

the winds will be sticking around into your saturday, getting gusty at times. so let's start with the cooler weather, because, of course, we have the headlines of the 80s the past two days. well, not so much today. fwher the 60s. in fact, we've even got some 40s out there in los gatos. 54, martinez. 61 for oakland. san francisco, 56. concord is about 20 degrees cooler right now compared to yesterday. meanwhile, down through areas like san jose and livermore, almost 15-degree difference. and then, of course, even around the coastline and the city, about five-degree difference. and for your saturday, it's going to get even cooler. so this is just the beginning, and here's what's lining out in the pacific. you can see the rotation right here. rain beginning to develop just to our north, so we're talking areas really far up, ukiah, oregon, chico. this is going to make its move stretching down further into parts of the north bay, eventually becoming widespread by your saturday. we've got the cloud cover, that's really what's kicking up

the winds as well as the approach of this system. and if you notice timingwise, we're going to stay pretty breezy, pretty consistent, at least through saturday evening with that instability. we could also see not only an intensity of storm cells but also the possibility for some hail as that colder air settles in. now let's talk timing. i do want to make sure you properly plan your saturday, especially if you look right up here. this is around 11:00. so if you noticed, not everyone's going to catch rain tonight, i should say, but overnight it'll become more widespread. this is into early saturday morning. 11:00 to 5:00 a.m. we do pick up some heavy pockets at times. good to kind of bring in everything you have in your patio right now if you don't want it to get wet or blown away, because as the intensity picks up in some of these cells, we could see heavy downpours at times. the good news, though, it does appear around 12:00, lunch hour, we're going to be seeing a lot of that rain to our east. but we'll keep some cloud cover, along with scattered activity. you don't want to put your guard

a fishing trip turned into a nightmare. three sailors are now back home after being stlanded on a remote island for more than a week.

last sunday the u.s. coast guard said the trio was passing through some islands known as the federated states of micronesia. this is in the pacific ocean. bad weather wrecked their boat and forced them to take shelter at a nearby island. they were stranded about 400 miles southeast of guam. earlier this week the coast guard was flying by and saw that word help spelled out in the sand. when rescuers found the men, they were almost out of food and slightly dehydrated. thankfully, though, they were all okay. meanwhile, the search is on for an unusual suspect in an attempted car break-in. we are talking about, yep, that right there, black bear. florida highway patrol said the bear attempted to get into a police car that was parked at a trooper's home. you can see if you take a look there the bear claws and bites at the door handle, but the bear didn't get very far. he actually gave up after the handle broke off. the usgs is trying to solve a mystery surrounding the earthquake that rattled new

jersey and other parts of the northeast. seismologists say they've recorded at least 50 aftershocks since the 4.8 magnitude quake hit last friday. what they don't know is the fault that ruptured in new jersey. to figure that out, researchers are installing new monitoring equipment to better measure the aftershocks. they say data from seismometers that use laser impulses will help to map the fault system, and that could reveal where it likely originated. researchers say slow acting stress likely trickered that earthquake. >> that's still a big talking point in new york after that. >> for sure. hi, jess, what's going on? >> coming up right now at 6:00, robbed three times since january, a south bay bar owner is talking about it and why he says he's tried to stay quiet but that he's had enough. i'm scott budman now in the bedroom and now in the kitchen

of cupertino's smallest house, 384 square feet. it just sold for nearly $2 million. we'll have the story just ahead. so it's feeling like summer for a few day, but now winter is back or it's about to come back. we're tracking the timeline for this weekend's storm. the news at 6:00 starts right now. good evening and thanks for being with us on this friday, i'm raj mathai. >> and i'm jessica aguirre. enough is enough, a san jose business owner is going public with his frustration over crime. three burglaries this year alone, eight since his bar opened its doors. now owners of the guildhouse say they didn't want to go public before over concerns that it might encourage more crime, but now they say that strategy isn't working. nbc bay area's robert handa has the video of the most recent burglary and found out this isn't the only shop that got hit. >> reporter: the guildhouse is a popular gaming center here in downtown san jose with about 1,000 gamers showing up on busy nights, but it's also one of the

businesses in the area getting burglarized constantly, and they want something done about it. owners of the guildhouse on south first street say they're frustrated and concerned about their future. the gaming lounge has suffered eight burglaries in two and a half years and three in the past four months. earlier burglaries were on a smaller scale and some arrests were made, but the latest from march 26th captured on security cameras was the most brazen with thieves cutting through the back entrance, breaking into the office, and literally wheeling away the company's safe on a dolly. all while avoiding alarms and censors. >> i figured that they've probably done it before because they had the right tools and they made the right cuts in the right places. >> reporter: despite all the burglaries, guildhouse owners didn't talk publicly or post anything online until now, saying they didn't want potential thieves to esee the business as vulnerable. but other neighboring businesses ve
