in an east bay freeway an investigation underway right now after someone was shot during rush hour. shooting causing the driver to crash their car on ashby avenue on that on-ramp eastbound 80 and the chp is now searching for the shooter and searching for answers. was it targeted was the victim caught in the crossfire? alyssa gord was there during the investigation and explains what we know so far. >> during rush hour a crash silver sedan was passed on the ashby avenue on-ramp as investigators try to figure out how it got there. >> what we ended up finding was a vehicle that had been involved in a crash and it appears as part of the crash the victim in this vehicle have been struck by gunfire. >> the person driving that

sedan was taken to the hospital with injury. officers are investing this -- investigating this as a shooting. >> we need to determine -- >> we are announcing 180 new cameras. last week governor newson announced plans to deploy 480 new license plate reading cameras. caltrans tells us why the cameras have all been installed many will not be up and running until mid april. in the meantime chp is urging anyone nearby when this incident happened to get in touch with them. >> no matter how little you think the information might be, it could be incredibly valuable. >> alyssa gord, nbc, bay area news. >> a frost advisory going into effect for several parts of the bay area.

klaas and today they say --'s attorney say a law invalidates the conviction entitling him to a full resentencing. nbc bay area jocelyn moran joins us with details. this is very unsettling for the girls father who has become an advocate for victims rights. >> reporter: it has been 30 years but this is a case that many remember and one that caused fear for families. tonight we are talking about this case once again because the convicted killer essentially wants his sentient -- sentence to be re-evaluated. he was not in court today but polly's father was there he felt like his daughters killing is being thrown in his face again. >> reporter: it is a horrific case that shock the bay area. agent allen davis was convicted of kidnapping and killing 12- year-old polly klaas. she was hosting a slumber party at home when davis kidnapped her in 1993.

davis already had a lengthy criminal rap sheet. his conviction led to california three strike law. three decades later lawyers representing davis argued he is entitled to a full resentencing. >> this has thrown this crime right back into my face yet again three years later and it should be done. >> reporter: polly's dad, mark, was at the center -- community court. >> in 1996 when the trial concluded i said this is over, yet here i am 30 years later. this guy has gotten every consideration in the law since the day he was arrested. >> in the last few years there have been criminal justice reforms having to do with the fact that california prisons are overcrowded so state politicians have been looking to expunge enhancements put on minor sentences like drugs, but lawyers representing davis are hoping to use these recent reforms to their advantage. one of the laws is smb 483

introduced by state senator ben allen. in a statement he says davis is allowed to make whatever wild legal assertion he wants, but our lie was deafly not designed to undo the death sentences of condemned child killers like him and any attempt to argue otherwise is off base." >> i think the court will look very carefully as to whether these guidelines actually apply to mr. davis and his death penalty verdict or whether they should only be used in other sentencing schemes. >> this could also set a precedent for future cases. >> other courts will look at this case in deciding how they handle these death penalty decisions when they have to go back and do resentencing under the new law. >> i think the judge is very good and thoughtful and will come to the right decision. >> important to note while mrs. davis has been on death row -- mr. davis has been put on death row -- in regards the judge did

not issue a ruling today and the next hearing is scheduled for may 31st, audrey? >> joslin, thank you. 11:00 a federal judge taking unprecedented action against an east bay women's prison. a special master has been appointed to oversee the federal connection -- correctional institute. this is the first time this has -- prison has been susceptible to this over site. the prison has been dealing with charges of sexual abuse and medical neglect for years. two years ago the previous warden was convicted of sexually abusing three inmates and then last year two guards were charged with abusing several female inmates. new at 11:00, you may have seen smoke across the bay bridge. firefighters battled flames at an abandoned building. it took them a while to get inside. they found rooms filled with debris and believe that

squatters may have been living there. one person was taken to the hospital for smoke inhalation. an investigation underway after a shooting that left a man dead happening around 1:30 this afternoon around the el capitan hotel on mission street. police say the man was shot several times and that last check no arrest had been made. we are one month away from cinco de mayo but as gdp is already making plans they are trying to keep people safe. last year police broke up crowds and you aspect this year the department says it will be more proactive and have more officers and diversions to deal with traffic's -- traffic or crowds. the list keeps getting longer. tonight united airlines in sfo are once again under scrutiny after another incident involving a flight that had just landed at the airport. this happened last night as the plane was passing through a gate

when it accidentally clipped wings with another united airlines plane that was already parked, thankfully no one was hurt. it has been a turbulent few months for united at sfo. there has been at least eight incidents involving united flights. one pilot tells us what he thinks caused this latest incident. >> quite simply either one of the aircraft was not on its assigned lead in line or they shortcut trying to get into the gate and in doing so they did not leave themselves proper clearance to clear the aircraft parked in the gate next to them. >> recent events have triggered increased scrutiny of united's operation by the faa and last month the agency initiated a review to check the airline compliance and safety regulations. >> everyone on standby waiting to see if there will be another aftershock. a rare earthquake rattled the northeast. it was big enough to shake the

hernandez has the story and we should warn you these images are disturbing. >> there is basic care that every animals deserve and i don't see that here. it breaks my heart. >> becca says she is sickened by how the horses who live in the pasture near her home are being treated. she called animal control on wednesday after discovering two horses down, one dead in the field and one so skinny he couldn't stand up. >> she was laying down and she couldn't get back up and she was completely emaciated. >> solano county animal control got a warrant to go on but the mayor -- mare was too sick to save. animal control confirms they have opened a credible animal cruelty investigation and an officer tells us to give the owners 40 hours to get a better -- vet approved care plan. they say the owners of the

horses rarely come to feed them. >> the pastor is not maintained. >> reporter: several of the horses appear to be pregnant and she says they have babies every year. >> they stay there till they are four or six months old and then they disappear. >> this morning several people were trying to round up the horses and one appeared too weak to run. a woman chased several of the animals out of a pen forcing one to jump through a fence to get away. they declined to talk to us but they loaded two of the animals in a trailer and one of the drivers aggressively swarf to turn -- swarmed towards us trying to block us. about a dozen horse -- courses -- courses

>> in solano county, jody hernandez, nbc bay area news. one of the most tragic and deadly crimes in half moon bay history is now the source of a new lawsuit. a farmworker shot and killed seven people and wounded two others and that happened at two mushroom farms. today one of those survivors, 24-year-old pedro perez, filed a lawsuit against the farm owners. perez was shot five times by the suspect was awaiting trial for the murders. through a translator perez said he is still recovering. >> translator:, i had two bullets in my stomach, one in my arm and one of my back.

>> and california landlords have a duty to pray -- protect their employees from criminal acts. >> attorneys are also following -- filing the lawsuit of his older brother who was killed in that shooting. farm owners declined to comment. your pg&e bill may be continuing to soar but so is the compensation for the company ceo. we learn pg&e paid patricia pope nearly $17 million last year, that the 20% bump from what she got paid in 2022. pg&e says it pays the executives based on the safety record as well as its financial performance. the company says its shareholders are the one that pay for top executives. the utility, so that you know, earned more than $2 billion last year. pg&e is california's most expensive power provider.

gatos and we show you where we still see a wintry mix. the instability with the cold air mass brought on also those windy conditions and of course that wintry mix on top of our peaks here in the bay area. zoom in closer and you can see activity still through portions of merced and fresno. we are well to our south now into southern california within this, but that cold air mass will stick around through tomorrow morning and evening to sunday morning before we see a warm-up. as the clouds make their exit we will see a frost advisory go into effect. notice it includes areas in san rafael but also oakland, danville, stretching down to san jose and the santa cruz mountains through gilroy as well. this was actually added on this morning and we will be really cold, protect your pets, your plans and your pipes. how cold? early saturday morning around

5:00 a.m. santa rosa, 36. san jose, morgan hill, 39. dublin, 39. livermore, 37. concorde, 40 and we do warm-up just a bit into the afternoon but because the cold air mass as rain makes its exit we will also notice areas of fog so keep this in mind especially for areas in through fairfield. less likely down through portions of the south bay but even some areas could wake up to patchy fog. daytime highs for tomorrow we will be in the upper 50s and 60s and here in the bay area we will see an increase heading into monday especially but by the time we get to tomorrow we get sort of a mixed bag of sun and clouds and yes we do have a system passing to our north that could bring the return chance of maybe some instability , mainly in through portions of the mountainous areas and parts of the north bay at least through saturday night. by the time we get to sunday, good news, it will be cold but

a controversial idea to cool the planet is now being tested in the east bay. scientists with the marine cloud branding program are doing experiments in alameda on the u.s. hornet. they created a unique machine to cook -- send air particles of salt water into the air. the goal is for those to make clouds brighter. they say brighter clouds reflect more fun back into space and further cool the planet. >> i think it would work but will we have enough information to understand at a local scale
