the news at 5:30 starts right now. thanks for joining us. i'm janelle wang. >> i'm raj ma thiechlt a new development in a tragic case our investigative unit has been following for more than a year. the family of a teenager girl who died from a fentanyl overdose has reached a settlement with some of the people accused in her death. >> candice nguyen joins us with this new development. >> we have been investigating this case digging into how it was handled by law enforcement and who is liable in the death of 16-year-old emma price. a report shows price died in 2021 from an overdose of fentanyl and concoction of other drugs. she was spending time with michael j. russell. mikey was never criminally charged in price's death. earlier this year he was sentenced to ten years in prison for providing price and another

minor with narcotics and having sex with both girls. separately the price family sued michael russell and his parents for wrongful death. the prices recently settled the civil suit with the parents for an undisclosed amount. in the lawsuit they accuse mikey and his family of delaying medical help that may have saved their daughter's life. they also accuse mikey's parents of knowing their son had a history of preying on young underage girls and that their home provided a place and opportunity for crimes against underage girls. today i spoke with price's father about what this settlement means to him and his community. >> i think all of us as a family, we just knew we were going to make a big deal, like this is not something that we were just going to be quiet about and go away and not make public and to raise a fuss about it because it was devastating, devastating to our community, to our family. >> i reached out to the russell

family's attorney but have not heard back. in court records they denied the allegations. this settlement is only for the parents. the price family has not agreed to settle with the son which means they could still continue their civil suit against him. with the investigative unit, candice nguyen, nbc bay area news. >> candice has been on the forefront of this story. you can watch all her previous reports on our website, nbcbayarea.com. just click on the investigations tab at the top of our home page. >> get out in three days or you'll be evicted from the home you've lived in and owned for three decades. that's the very blunt order given to an 81-year-old woman in san francisco. today was the deadline. tonight the fight to keep her in that home continues. as nbc bay area's ian cull explains, things began to fall apart after she took out a loan to pay her property taxes. >> 81-year-old rosemarie benter has lived in this condo for 30

years. money is tight and she has health issues, but it's a legal mess that may force her to now move out. >> all of this time i was getting no worries, no worries, you're safe, nobody is going to take your place. >> reporter: two years ago she couldn't pay her property taxes. she says a lender pressured her into taking out a $9,000 loan and unknowingly used her house as collateral. when she missed payments, it led to a series of events. she talked with our alice ka gourd over the weekend. >> the man said hi, i'm here to repossess your house. i said what do you mean. he said, well, unless you have $13,000 to pay off this debt you have, it's going to be sold in about 29 minutes. >> reporter: less than an hour later her home was sold at a foreclosure auction. last friday the buyer put a notice on rosemarie's door saying she had three days to leave. her lawyer says an actual

eviction would take more time, and today attorneys from legal assistance to the elderly filed a lawsuit on her behalf, aimed at the new owner, the broker and the lender who gave her the loan that ultimately led to a foreclosure. the attorneys claim it was a predatory loan with terms that were far greater than the amount of money they were loaning rosemarie. another non-profit says it's willing to step in and cover her debt. they're asking the court to rule that rosemarie is still the lawful owner of the condo. >> ms. benter is taking action to try to undo that sale and void that unconscionable loan. we're hopeful that justice will prevail. >> my background for 20 years before taking office was in eviction defense. >> reporter: the home is in supervisor dean preston's district. he says his off miss is willing to go to bat for rosemarie. >> the idea a homeowner would lose their home for under

$10,000 and be faced with a notice to get out of their home on three days' notice is totally unacceptable. >> reporter: the person who bought the home at auction says he's willing to negotiate if benter wants to buy it back. her attorneys say they hope the court will do what they say is the right thing. in san francisco, ian cull, nbc bay area news. environmental groups rallied at the san francisco headquarters of wells fargo. they want the bank to divest from fossil fuels. this is all ahead of the annual shareholders meeting for wells fargo. the group is asking shareholders to stop investments into fossil fuels and end financing for fossil fuel expansion. >> as individuals, we have a responsibility to take care of mother earth and protect our natural resources. but there's an even bigger role these corporations and these banks play in changing the systems that are allowing for all of this chaos to continue

being funded and to continue to happen. >> in a statement wells fargo called climate change one of the most urgent environmental and social issues of our time. it added, quote, we have set a goal of net zero greenhouse gas emissions including client's missions attributable to our financing. that goal by 2050. we are committed to reaching our goals and to supporting our clients in traditional energy as well as the renewable energy sector to facilitate an orderly energy transition and a sustainable future. big changes for the biden administration. susan rice announces she is stepping down. the white house's domestic policy chief is set to leave next month. rice has spent over two years helping president biden tackle a number of political issues, including his immigration policy. rice says she intended to leave even sooner but stayed to deal with the ongoing influx at the border. the white house is now vetting

candidates. the presidential election is next year and most voters are turned off by the likely candidates from both parties. the latest nbc news poll, voters don't want president biden or former president trump to run next year. let's bring in political analyst larry gerston. this is not breaking news here. trump sees the polling, biden sees the polling, yet they continue to want to run band the candidates. >> that's right. they want to run. they want to be the candidates. so far not too many people are interested. if the election were held today -- as you know, that's the question -- it would turn out that biden would have a slight edge over trump by about four points, 38-34. if you dig deeper, what you see is this right here, nobody wants them to run. only about a quarter of the democrats want to see biden run and only about a third of the republicans want to see trump running. they want somebody else. >> so we see the polling here, we see the numbers on the screen. it suggests that we don't want

them on either side, regardless of your party affiliation. what's happening? >> a few factors are important. you have to begin with the fact that the amount of money has grown tremendously over the years. independent expenditures being allowed. the roles of the political parties are weaker which can't push anybody in any one direction. rather it's a free-for-all. you have to think about the primaries where people turn out in very, very low numbers. finally, you have to think of incumbency. it's important. we may not think it is. but people tend to go with the familiar. there you have it. those four factors, they change things. a lot of them are recent reforms that may have backfired. >> on both sides whether it's desantis, ro khanna, kamala harris, do they have a chance to even get in the forefront here? >> i think the only way we see something shaking this up is if there's some sort of scandal. that's a possibility.

we know what former president trump is facing. something could happen to him, and the biden administration as well or perhaps an inability to get something done, maybe a deep recession. something else could be an unfortunate demise, a death of one of those two, but it's tough. it's tough breaking through. as long as we have this kind of system, it's going to be hard. they're going to be the default candidates. they may change by the time we get closer. form now, we've got unhappy campers. >> real quick, is this democracy challenge or just where we are as a society challenge? >> it's really a question of us not thinking clearly enough about who we want, when we want and how we want them. at the end of the day, raj, we the voters have a lot to say. sometimes we're not saying it. >> we were saying it in the polling. thank you, larry. our decision coverage continues on "nightly news." nbc's kristen welker will dig

cable news. two anchors are out. fox news is parting ways with tucker carlson. carlson was the network's most popular primetime host and a leading voice in the moderate conservative movement. his sudden departure comes days after fox news settled with dominion voting systems for nearly $800 million. that settlement avoids a defamation trial over fox news' coverage of the last presidential election. also, cnn anchor don lemon is out. he tweeted the news this morning claiming there are, quote, larger issues at play. lemon recently faced backlash after saying republican presidential contender nikki haley was, quote, past her prime. variety is reporting that lemon mistreated female colleagues at cnn. tonight nbc bay area responds responds to an east bay area man hung up on a phone

issue. >> we're talking about phones. >> new phones or old school phones. >> one of these things. actually the latest version is what norman in brentwood wanted. he said he traded in his old iphone 11 for a new iphone 14 with verizon last year. he showed us a screen grab of a conversation he had with a verizon rep who confirmed he would get $800 in credit broken up over his monthly bills for that old iphone 11. norman says he shipped the phone to verizon and he showed us confirmation of delivery from the cargo company right there. so norman contacted us because he says those billing credits we talked about, they came out $155 short. he says he contacted verizon and waited. went to a verizon store and waited. he asked us to call verizon because nothing happened. well, we called verizon. norman then said verizon gave him seven additional credits of

tonight, more errands. you have to hop in the car and go from point a to point b, beautiful weather to do it in. not going to need any kind of jacket at least for the next couple of hours. as we head through tomorrow morning's forecast, i see it starting off mostly sunny in the bay area. patchy fog near the coastline. it will go down to 52 in the peninsula. south bay at 50 and the 50s continue for the east bay, san francisco and right there for the north bay. daytime highs for tomorrow, again, get ready for it. you'll feel the heat. temperatures 10-15 degrees hotter. down in the south bay, it's going to put us back to 80 in los gatos. over to morgan hill, coming in with the low 80s. inland, east bay valleys, concord 83. by the bay that's a warm day in oakland at 76. peninsula, 66 in daly city. you can see the split picture here. we get the ocean breeze.

in the 60s. down to half moon bay, you get away from that, we're warmer, 77 in redwood city. san francisco, 65 in moreno, 66 for the mission. 81 in santa rosa, 82 back towards napa. so big-time changes on the way while we warm up a little bit here for tomorrow. we'll see things increase even more as we head through thursday. high pressure will expand and get stronger. a one-day event is the way it looks on thursday as we'll get into hotter 90s. still looks excellent through this weekend. more sunshine, 70s and 80s. hang on. we'll see this big turn in the weather by early next week. i want to make sure you're aware at least early on, it's going to be huge here. numbers dropping to the 60s and low 70s, even the chance here of spotty showers. it doesn't look like a lot of rain. maybe trace amounts to about quarter inch. but still something that is

while sharing his insight on this upcoming draft class. here is nbc's anthony flores. >> with purdy and lance still on the mend and trade rumors, there's a lot of uncertainty surrounding the 49ers. what we do know is unless the team makes major moves in the coming days, 49ers will be spectators for the first two rounds of this week's nfl draft. >> sitting down with the media to preview the upcoming draft, a good portion of john lynch's press conference was spent addressing the 9ers' quarterback situation and the fact that the team has fielded multiple trey lance trading inquiries. >> i think there's a lot of smoke really. it hasn't been extremely active. it's not like, hey, we put it out there that we're taking trades. that's not been the process. >> despite receiving calls from other teams about lance, the 49ers' general manager says he sees lance being on the roster this season.
