isn't until 7:00 a.m. this is a possible dui situation or you know, inerms of two vehicles being involved, there was an overturned big rig and apparently another vehicle so i know that we're getting more reports on that and i know we also have pete on the scene as well, bringing us updates. so far again this is at appian way. pete i'll send things over to you. i know you have more info on what could be bind this crash. >> reporter: yes, vianey, good morning to you. we're getting more information from chp. you mentioned it, a little bit there, this was a situation with a big rig trying to avoid a car that was actually stopped in the slow lane before you hit appian way in pinole. traffic is starting to move along, letting folks off of the shoulder off the appian way exit. in our last live report traffic was actually halted as they were trying to tow the car. you so he that big rig, that's what they were able to kind of lift up, that was overturned as a result of this accident earlier. i want to show you some video of this whole situation. according to chp, 2:45 a.m. the

big rig driver swerved to avoid a black camry that stopped in the slow lane. in fact, the video you're seeing is the driver of that camry that was stopped in the slow lane. that's that driver being handcuffed. we're being told according to chp that this camry driver was passed out in the car. it's unclear exactly why that driver was passed out, but the big rig did avoid that black camry but in the process, that big rig did overturn. now the good news, guys, is that there were no injuries in all of this to either to the driver of that big rig, as you see they're starting to work on trying to tow this car, guys but we're being told the camry driver was arrested, but they're expecting the freeway to reopen sometime before 7:00 a.m. guys. >> all right, thank you very much, pete. hopefully it will reopen before the bulk of the commute but we know it will be a difficult morning. what might make it easier, nice weather. >> meteorologist kari hall has been tracking that for us this

morning. >> it's going to be another really nice day, slightly warmer in some spots, as we head over to cupertino, check out our temperature trend, starting out in the 60s, leading into the low 80s today, by early afternoon, with some of our south bay high temperatures getting a boost this afternoon, reaching into the upper 80s in the south county. so i'll have a closer look at our microclimate forecast and some things going on this weekend, coming up in a few minutes. >> thanks, kari. new for you this morning, a chp officer recovering after a scary rollover crash during a high-speed chase. >> "today in the bay's" bob redell is live in san jose with how the officer is doing right now. really scary video, bob. >> reporter: it is, kris and marcus, but fortunately that officer is okay. walked away with just minor injuries, which is remarkable, when you do take a look and see what happened to his squad car. take a look at this video on your tv screen. this happened around 12:30 last night. the officer was chasing a driver for speeding. this was along southbound 280 here in san jose. the officer lost control near

the 880 and highway 17 interchange. again he or she was on southbound 280. it appears the squad car rolled over at least once and as you can see in the video the air bags fortunately did deploy. as i mentioned the officer is okay. we don't believe they had to go to the hospital. the speeding suspect, however, did get away. reporting live here in san jose, bob redell, "today in the bay." >> bob, thank you. 5:03 right now. president trump back on the campaign trail, held a late night rally in the battleground state of ohio. he weighed in on the numerous issues including the democratic debates, tariffs and north korea's latest missile tests. consumers that another round of tariffs on china won't cost you more. >> you're not paying for those tariffs. china's paying for those tariffs. >> reporter: but will china pass on that extra cost? experts think so. starting september 1st, the trump administration is imposing 10% on $300 billion worth of goods. that's on top of the 25% already in place. electronics, appliances, auto parts, clothes, bicycles, baby products. >> we just put a tax on having a child. >> reporter: financial markets took a nose dive. president trump is also reacting to north korea launching two short-range missiles. it's the third test in just over a week, after none last year. >> i have no problem. we'll see what happens, but these are short-range missiles. they're very standard. >> reporter: experts think kim jong-un is angry about upcoming military exercises with south korea. tracie potts, nbc news, washington. also developing on capitol hill this morning, the trump

administration is preparing to withdraw thousands of troops from afghanistan, it's all part of a deal the administration is reportedly making with the taliban. "the washington post" is reporting that the deal requires the taliban to make some concessions, including a cease-fire and a reunification of al qaeda. on the wake of the mass shooting at the garlic festival, security is on the top of mind for many people planning to atend events around the bay area. the fremont festival of the arts kicks off today and organizers are assuring the public that they have partnered with police to make sure that everyone can feel safe. following a string of deadly terror attacks in europe in 2017, city officials installed large barriers designed to prevent vehicles from plowing in to crowds. you might have seen those. we are learning of the second of the two friends who were shot in the rampage that they have now beenreleased from valley medical center in san jose. brynn ota matthews and her

friend gabrielle gaus were hit by fire. they spoke for the first time about the gunman and the chaos and the physical and emotional wounds they think they will feel for a very long time. >> it sounds really bleak and sad but like i hope i feel a sense of general trust towards humanity because right now i really don't. i feel like paranoid when i leave my house. like i don't know, like who i can trust. >> sometimes it's just terror. i see him walking into the festival. >> how the friends also thanked the doctors who helped them and they remembered the people who lost their lives. new details are coming to light about oakland police and their use of force during investigations. according to "the chronicle" the department's inspector general office found more than a third of 47 studied cases last year, officers never reported instances when force was used. all of those unreported cases involved in a non-white suspect. the department previously

reported those cases were down last year, something this independent audit says was likely exonerated. in response, oakland's police chief promised to follow the inspector general's recommendations to fix that issue. san francisco mayor london breed signed the city's largest budget ever. according to "the examiner" the mayor signed a new $12.3 billion plan into law yesterday. it includes a focus on housing and homeless, as well as investments in affordable housing. a comeback for a six-time olympic gold medalist ryan lochte is making serious strides this week in the stanford swimming pool. wednesday he swam the fourth fastest time by an american in the 200 meter medley at the u.s. national championships. with the win he also qualified for next summer's olympic trials. lochte is just back from a 14-month ban for improper vitamin infusion. there was also the incident in rio in 2016 when he was tied to

a fake police report. lochte is entered in five events at the nationals this week, which continue at stanford through sunday. i know a lot of our swimmer friends are going to watch that in person. >> getting out and swimming this weekend might be a good thing because the heat that we can experience this weekend. >> we'll start to feel some warmer temperatures today, and martinez, at least we do have a cool start with some lower 60s. we'll be at 71 degrees at 10:00, and then at noon, we're at 79 degrees, reaching into the low 80s. as our temperatures continue to rise, we're looking at some low 90s in antioch, and concord today. 83 in san jose, and in palo alto. ukiah today reaching 91 degrees. and we'll get a closer look at our east bay forecast coming up in a few minutes. vianey now has a live look at that big rig crash. >> i do want to show you this. this is a pic of the crash eastbound 80 at appian way, just west of that. this was overturned. they have managed to sit this back up, but apparently it was a big rig and one other vehicle,

possible dui situation where chp is letting us know that the big rig kind of swerved to avoid another vehicle, in turn that caused it to turn over and now we're seeing that all lanes are closed, with the exception of the slow lanes, so, so far chp is saying they expect to reopen all lanes not until 7:00 a.m. this is going to take some time, even though it is counter commute. it's starting to affect our commute side as well, the westbound side. look at our speed sensors. you can see we have the red along the eastbound lanes, but along the westbound side it's also starting to slow down as well. i also have a new crash to tell you about along the westbound side right near the 580 interchange near the toll plaza. we have a crash reported there also involving another big rig. it doesn't seem to be an injury accident, but it looks like they're working to clear out some of those vehicles from an earlier crash. i'll have another update coming up shortly. >>still ahead, the bay area ney. honors the gay rights activist killed in russia. coming up at 5:25, the clues

meteorologist kari hall. in south san jose as we heck check out santa teresa, upper 60s as the skies clear around 10:00 and warm up from there. it will be warmer today compared to yesterday and tomorrow even hotter. we'll look at those numbers coming up in less than five minutes. we're now really starting to see the delays along the westbound side as well. there is a crash along the eastbound 80 side. just west of appian way. a sig alert is in place. all lanes are siestimated to reopen at 7:00 a.m. the overturned big rig has been turned out. eastbound 80 at appian way all lanes are expected to reopen at 7:00 a.m. more updates are coming up 37. good morning to you. it's not just friday, it is jobs

already up at the bottom of the screen, as we go throughout the day with all of our microclimates, and i want to show you how the day will shape up temperature wise. we take you through 8:30, it's still cool. at lunch time we're starting to warm up in the east bay valleys as well as the south bay. we're up to 81 in concord while santa rosa is at 80 degrees, and san mateo will be at 74. then going into the afternoon, there will be some spots hitting the low 80s, and hitting the low 90s i should say with concord at 90 degrees. fairfield at 89, and in livermore, we're at 87, while palo alto is at 80 degrees, and then it all starts to cool off once the winds pick up and we get an ocean breeze carrying in cool air. it will still be a warm day. at the santa clara county fair today looking at highs reaching up to about 83 degrees at 3:00. after that, it's starting to feel nice, as the breezy winds pick up and temperatures in the mid-70s. tomorrow we've got the fremont festival of the arts. i'll be out there with the treat truck. we'll be handing out bottles of

water so keeping you hydrated, as our temperatures reach up to about 81 degrees. as we go throughout the weekend, high pressure makes its way back into the bay area. we're going to see that changing our wind direction, but then going into next week, this area of low pressure off the coast allows for an ocean breeze to pick up once again, and we're going to cool off significantly. so we go from the low 90s on saturday to the low 80s on thursday. we just have to wait it out a few more days before we get the cooler air coming back, and it will be a very warm weekend, while san francisco stays in the upper 60s, and a little bit more sunshine. so how is the traffic moving through the east bay, near that traffic alert? >> it's still pretty slow and this is a live pic along eastbound 80 just west of appian way. this was overturned due to an earlier crash shoving another vehicle. they have is sitting upright. even though it is counter commute the westbound lanes are slowing down not because there's a crash but because of course

people tend to slow down to see what's going on in the other lane. you can see the cars getting by just on the shoulder here so we can go ahead and send things over to my traffic maps, again, chp is saying that they're not expecting to reopen lanes, estimated time is around 7:00 a.m., and speed sensors are certainly showing both sides eastbound and westbound side kind of slowing down because of that crash. we have another kra shall crash 80 near the 580 interchange near the toll plaza a crash near the toll plaza so this area tends to start to back up regardless, once the metering lights turn on, which they are now on, and i wanted to show you the drive times. westbound 80 toward the bay bridge 13 minutes, and a quick check of the south bay drive times as well, northbound 101 from highway 85 to highway 87, you're looking at 12 minutes. the rest of the bay area is doing okay. back to you. >> thanks, vianey. coming up next, how the bay area is fighting to bring the killers of a russian lgbtq activist to justice. plus coal miners in kentucky blocking a train full of coal. the reason they say that train is not leaving any time soon.

the murder of a gay rights activist in russia is striking a nerve in the bay area. >> members of the lgbtq community gathered at harvey milk plaza in san francisco to honor yelena grigoreya who died in a targeted attack. >> her name appeared on these basically gay hunting websites in russia and eastern europe,

and they went to authorities and authorities completely ignored her and a few days later, she was found dead, stabbed to death. >> organizers of the vigil say they want to raise awareness about being a member of a community that's being hunted in that way, they say. they say that while violence in russia seems far away, they are concerned that it is helping to fuel hate and discrimination here in the united states. a petition is started demanding russia bring the people behind the anti-lgbtq websites to justice. continuing coverage, sources tell "new york times" the death yesterday of one of the young members of the kennedy family was an overdose. 22-year-old saoirse kennedy hill was the granddaughter of robert and ethyl kennedy. the family released a statement saying she died yesterday at the kennedy compound in hyannisport, massachusetts. authorities are not commenting on "the times" report. in the past, hill wrote about her struggles with depression and mental illness. happening today, singer k.

kelly is back in court, this time in new york city where prosecutors recently charged him in connection with sex crimes involving minors. kelly flew in to new york yesterday on a department of justice airplane. it is not tied to charges he faces in chicago now. once kelly is arraigned in new york he'll return to the midwest to stand trial on sex crime charges there. 5:25 and happening right now, in a rural part of kentucky, a town south of cincinnati, coal miners who haven't been paid are blocking the coal train. the coal belongs to black jewel, the sixth largest coal company in the u.s., and the miners are its employees. the company filed for bankruptcy last month, and stopped payment on those checks. the ceo says he accepts responsibility for being unable to lead the company. the coal has been haulted in it tracks for five days now. you know august means football time. >> oh, yeah. >> we are ready for some football, and it is preseason

forecast for today and the weekend in a moment, about you first, we want to get to that breakingffic new right now. an improvement, we saw the truck move out from behind you in pinole. >> that's right, that's great news along eastbound 880 at appian way. they still have the lanes closed because they're working to clear out debris but they have moved the big rig out of the way, which means their original estimated time of reopening until 7:00 a.m. might actually be a little bit sooner, now that they were able to get the truck out of the way. you could tell by speed sensors it's slowing things down significantly for the eastbound side and the westbound side, as people tend to stop and look over to see what's going on in the opposite lane but i do know we have our own pete suratos and he is live out on the scene and has the latest on what could have caused this crash early this morning. pete? >> reporter: yes, good morning to you, vianey. reports from chp the big rig was trying to avoid a car stopped in the slow lane. as you were talking looks like the traffic is now moving. they cleared out that big rig, they were able to tow it away.

i want to show you video from the scene earlier this morning, this is video from the ground. according to chp, they say it took place roughly around 2:45 a.m. and a big rig driver swerved out of the way to avoid a black camry that was stopped in the slow lane. but in the process, that big rig overturned. now as for the driver of the camry, i want to show you video, here is that driver being handcuffed by police. they say that the car was stopped, and he was apparently passed out. here is chp describing the condition of that driver when that he arrived. >> the drunk driver was passed out and/or sleeping in the driver's seat of the camry in the slow lane and the big rig able was able to avoid him thankfully. >> reporter: take you guys back out here life to 80 eastbound off of appian way. traffic is moving along as they've cleared up that big rig accident. thankfully, no injuries to report in all of this, but it looks like as you can see things have reopened here on the road.

we're live here in pinole, pete suratos for "today in the bay." >> thank you very much, pete. let's get to the friday forecast, that will definitely make you smile if you like being outside, kari. >> absolutely. it's going to be a nice one today but a little bit warmer in the south bay, even though we're starting out with some clouds. san jose will have some low 60s as you get ready to head out the door. so you may need a jacket for those early hours, but then later today it's going to be very comfortable, upper 70s by noon, eventually reaching 83 degrees and it's starting to crank up in concord, reaching 92. we'll talk about how hot it gets this weekend, and some events going on, that's coming up in about five minutes. >> all right, thank you, kari. 5:32 for you. now the latest on the mass shooting in gilroy. the three police officers who killed the gunman have now been identified. together the officers have more than a half century of law enforcement experience. last night the community took another step toward healing. hundreds remembered the victims at the downtown vigil.

this was something that a lot of people took part in. this was an event for both people to remember those who died and to support those who survived. one speaker called for action against gun violence. >> for too long and too often we have been subjected to too much mayhem that gun violence inflects upon our nation. >> several vigils are planned this weekend in gilroy and san jose. recent events in gilroy prompted police there to postpone the upcoming national night out. bay area cities will celebrate the night next tuesday, but gilroy police tweeted this out yesterday, saying that the city will be moving the event to october 1st. a man says that rather police say that a man lured a 12-year-old girl into an alley and sexually assaulted her, but that he is now in custody. san jose police officers arrested this man, 43-year-old cashman hill. investigators say the victim was walking down north first street wednesday afternoon when the

suspect lured her into an alleyway. somebody was walking by, witnessed that assault and called police. a follow-up now and a judge is expected today to decide whether to unseal two more warrants tied to a high-profile case involving a bay area freelance journalist who was targeted in a police raid. the warrants are linked to police raids on brian carmody's home and office. officers were investigating a leak of a police report on the death ofpublic defender jeff adachi, but working journalists and their sources are protected from such searches under california shield law. two weeks ago another judge banned police from using evidence associated with a separate warrant in the case saying that police never told her that she was a journalist. police in north berkeley are issuing a warning if you drive a toyota prius consider yourself a thief target. thieves are stealing catalytic converters. since july 20th, at least 14

have been taken mostly in the northern part of the city. thieves can get up to $200, melting down the converters which contain a large amount of precious metals. a single word sparking new controversy on b.a.r.t.'s fleet of the future. >> the transit agency is removes the signs on the screen from the 85 newest trains. as you can see, they read "no panhandling, subject to fine." but homeless advocates complained and reminded b.a.r.t. that panhandling is in fact legally protected as free speech. the president of b.a.r.t.'s board of directors agrees, saying that the signs were missing a word and that the signs should have said no aggressive panhandling, which is against the law. >> i think it's really discriminatory towards people who are poor, who are unhoused, saying that you can't be here in this public space. >> so far this year, b.a.r.t. officers responded to 340 calls for panhandling, only two of which resulted in citations. and it is 5:35, about to be

5:36 and i have a fantastic update for you. all eastbound lanes along 80 near pinole right near appian way are clear following a big rig crash. you can see this is what it looks like now, all the roads are clear. the traffic is recovering quite nicely for eastbound and westbound lanes and that's also certainly showing up in our speed sensor maps as well. i have a new crash to tell you about, this one is going to be northbound 880 near the embarcadero exit. the right-hand shoulder is blocked because of a crash, and our speed sensors so far haven't shown any delays but again that crash just happened so we could start noticing some delays through there. as far as the sig alert that was canceled along eastbound 808 appian way, the traffic will begin to recover nicely and thankfully right around 5:45, when we start to notice the traffic building in the tri-valley and that's it exactly what our drive times are showing. right now westbound 580 from grant line road to 680, you're looking at 24 minutes, and a live look right now at a very busy bay bridge toll plaza,

out there during the middle of the day. so if you can get out early or late in the evening, and at 9:30, the fireworks begin so it's going to be great for that. we also have the world dog surfing championships tomorrow, and that's in pacifica, only $10 to enter in your dog and it's going to be cool, at times foggy especially early in the day, but going toward 2:00 we may get a little bit more sunshine and temperatures in the mid-60s. as the sun rises over the sierra and look at lake tahoe, we're going to reach into the mid 80s there, great weather for hiking, but starting to warm up especially for saturday and sunday afternoon. if you want to go hiking a little bit closer to home, maybe going to muir woods, it's going to feel nicer with some mid-70s today and a little bit cooler on sunday, with a high of 71 degrees. heading out of town, santa barbara, we have some warm weather along the beaches there, reaching 79 today. 78 on saturday, and 77 on

right now at 5:42, as you get ready to head out the door, we are going to have another beautiful day. los gatos in the low 60s, and it's going to start to warm up this afternoon. already by noon we're at 77, and 80 degrees by 1:00 today. we'll get a look ahead to some hotter weekend weather in less than five minutes. and a live look at the san mateo bridge. so far we're seeing no issues on the bridges. i'll have a look at the drive times throughout the entire bay area, coming up. 5:42 now. a new survey reportedly finds that two-thirds of contra costa county is at risk for wildfires. >> according to "the mercury news" coco county fire leaders

recently finished a survey and the map shows the areas that firefighters consider to be in a fire hazard zone. the fire chief says an average of two fires a day were reported during last year's fire season, most of them either intentionally or unintentionally caused by people. and here is the latest reminder about the danger of wildfires in contra costa county. some homeowners in lafayette had a brief scare yesterday afternoon. firefighters put that fire out quickly. this is near rancho view road where taylor boulevard meets pleasant hill road. we just got the july jobs report. 164,000 jobs were added last month, just a bit below what analysts were forecasting. unemployment rate remains unchanged at 3.7%. developing now in snow has county, sheriff's office talking to us about a bizarre deputy shooting last night, it happened about 5:30 in the evening on ninth and morgan streets near st. rose catholic church where a deputy shot a shoplifting suspect at least three times while that suspect was inside the deputy's car.

this was after investigators say the suspect tried to grab a security guard in the face at a nearby shopping mall. the deputy located that suspect nearby and said that he used a taser, it had no effect and the suspect eventually got into the patrol car and allegedly lunged at the deputy with a knife. the suspect is expected to survive. new details now involving the case of a navy s.e.a.l. accused of covering up war crimes. a san diego-based admiral was dismissing charges against lieutenant jacob portier. the former platoon leader was accused of holding a reenlistment ceremony for special operations chief edward gallagher next to the corpse of an islamic state militant. earlier this month a military jury acquitted gallagher in the killing of that isis prisoner. the admiral also ordered a review of the services justice system. now to a video of a huge brush fire in southern california. crews are scrambling to get the caliente fire under control. it's burning east of san diego. about 500 acres have burned so

>> no, no, no. the dog does, i don't. but no, we went fishing again with my family in colorado this last week and nothing. my nephew caught some sunfish. >> a lot of people may go out fishing this weekend. >> it will be a beautiful weekend although it's starting to heat up in the inland valleys. i wanted to show you this shot on your friday morning to help get it started right. i know in san francisco you're looking out the window, you're not seeing anything that looks like this. so we're going above the clouds from our sutro tower camera and looking at the fog that's right now at about 2,000 feet and below. so it's a beautiful start to this friday morning, and we're seeing a little bit more of that in the inland areas. so in brentwood we're in the low 60s. up to 69 degrees at 9:00, and after that, it starts to really warm up, low 80s by noon with the south bay reaching 86 in east san jose and up to 89 today in gilroy. so our east bay valleys will also be hotter and starting to hit those low 90s in pittsburg

today. 90 degrees while oakland stays in the lower 70s. we'll see a high of 76 degrees in san mateo. san francisco 63 in the outer sunset and the north bay up to 93 in clear lake while poi reyes will have a high of 65 degrees. even a short drive can change your temperatures drastically and for the tri-valley a celebration tonight, pleasanton celebrating the 125th anniversary, so there's going to be a lot of parties going on, up and down railroad avenue and it's going to be in the mid 80s to start and then dropping down to 68 degrees at 9:00 so there's going to be a big change there. i said i'd keep you up to date on what's happening in the pacific. we have two tropical storms, both of them have weakened and we've been keeping an eye on flossie. this looks to have a little bit more of an impact on hawaii but the good news is now it's going to expect it to clear, to start to curve to the north, and stay clear of the hawaiian islands

but may make the waves a little bit more rough. as we look at the forecast inland, some upper 80s and then low 90s in the valleys and we gradually strart lly start to . a cooldown by the middle of next week with low 80s. san francisco doesn't see too much in the change of temperatures over the next seven days but i think we'll get a little bit more sunshine tomorrow and sunday. vianey tracking the roads it's good to see some spots are clearing and others are backing up. >> we're doing okay in terms of crashes down in the south bay. the east bay is actually doing good considering things get busy around this time along 880. let's get to drive times for the south bay. northbound 101 highway 85 to highway 87 you're looking at 14 minutes. northbound 87 from highway 85 to highway 101, only 9 minutes, and even northbound 17 highway 17 is doing okay this morning. southbound 101 from van ness avenue to sfo and the peninsula looking at 12 minutes. southbound 101 from sfo to highway 92 only 5 minutes and a
