we want to continue our coverage tonight. it's already turned deadly when it comes to this cold weather. people are having a hard time trying to stay warm. >> it's been so cold for so long. but a 50-year-old man was found dead out in the cold wearing just a t-shirt and shorts. the coroner will figure out whether or not the cause of death was hyperthermia. the long-term solution is permanent housing. >> the shelter beds aren't going to end homelessness. >> reporter: the ceo who runs the shelters is looking ahead to the long-term selection.

>> when somebody is living outside, they are more likely to access more expensive government services like law enforcement, emergency psychiatric, medical care from the emergency room. >> reporter: funding for affordable housing is in the middle of a perfect storm. san jose lost 40% of his federal funds because of sequestration. the city went from about 1,000 units of affordable housing per year to fewer than 300. the city is researching the possibility of a housing impact fee to create a stream of funding dedicated to affordable housing to benefit not only the homeless, but the entire community. >> if we want to see sustained economic development and growth, we know that employers need

housing opportunities for their employees. we know there's a lot of families and individuals and households who are struggling to get by. >> reporter: the outreach continuing. one of those outreach workers a former homeless woman herself. she goes into the encampment to encourage them to come. if you want to know how you can help the shelters, go to our website nbcbayarea.com. this cold snap is prompting a record number of people to heat their homes. pgne is monitoring all the gas lines. the utility company says it's seeing a record demand of gas. >> we expect it to continue for

several more days. it's been going on since december 4th. we plan accordingly. we line up our people to be operating the system, and we make sure that we have adequate gas on the pipeline. >> reporter: the company says the amount of gas is double what it was on thanksgiving day. a live look at sfo's terminal one. flights are recovering following a morning of cancellations and delays. most of the issues related to storms in new york, philadelphia, and dallas. the duty manager says right now only a couple of departures are cancelled for the evening. the few delays are running for about 14 to 15 minutes.

we want to see what the weather looks like in your neighborhood. check out these photographs. we'd like to see yours too. go to nbcbayarea.com. in other news tonight, an afterschool program aid has been arrested and charged with having a sexual relationship with a young student. police say the victim is now 14. this is actually the suspect, but the relationship started when he was just 12. we are live in hayward with more. >> reporter: i spoke with the suspect's mother today. she says her daughter does not hurt children. she helps children. but the police department and the district attorney's office is painting a very different picture of her. she's facing eight counts of having sex with a child. this is the booking photo. police say she was arrested on

november 26th and charged with multiple counts of lewd acts with a child. >> we were notified by a local hospital. >> reporter: the victim told the hospital he was in a sexual relationship. >> he was in the seventh grade and he was in a sexual relationship with an afterschool assistant. she's 29 years old now. she was 27 when the relationship began and he was 12 at the time the relationship began. >> reporter: police claim the relationship went on for two years. including at least five sexual encounters on school grounds. we contacted the diocese. he spoke with a representative by phone. >> in our investigation internally, we discovered proper testing had been done when she

was hired in 2005, one of which is fingerprinting and checking criminal record. >> reporter: she passed all the diocese requirements. a woman who says she's lived next door to the suspect says what the woman is accused of doesn't make sense. >> i never believed it for a second. mia is a good person, and she would never hurt anyone. >> reporter: she was arraigned on december 2nd. she's right now on paid administrative leave. new at 5:00 tonight, the palo alto man detained by north korea said the price of freedom was making a confession, even if it was a lie. this is him arriving at the airport saturday morning after a long ordeal. newman said he was told if he did not apologize for his alleged crimes during the korean

war, he would be sentenced to 15 years in jail for espionage. he says he confessed to the video, but he did his best to read it in a way to emphasize the bad grammar. it is now clear to me that the north koreans feel more angry than i realized. the sheriff's deputy who shot and killed a santa rosa teenager in october is now back on the job, but he's behind the desk. the activist group justice for andy lopez is calling for a protest at city hall tomorrow. the district attorney is still investigating the deadly shooting. a grisly discovery at a

north bay park. a hiker with young children came across human remains. investigators are trying to figure out who the bones belong to. jody hernandez spoke with the hiker and joins us live from the park with the very latest. >> reporter: sheriff's investigators spent the entire day out here at shiloh park. they came out here collecting human remains after a hiker and his young children discovered a human skull out here yesterday afternoon. now, these are the photographs that hiker chris cain took of that gruesome discovery. a human skull and a tennis shoe. cain and his two young children were hiking along the creek bed yesterday afternoon when they made that troubling find. cain says he knew right away

what it was and he called 911 immediately. he's hoping the discover will bring answers to that person's family. >> i hope that the families can be like, at least now we know where they are. the circumstances are terrible, but at least they'll have some kind of closure on where the family member is. >> they've collected a majority of the large bones, but not enough yet to determine who it is, gender, what might have happened to this person. >> reporter: investigators spent the entire day out here at the park carefully and systematically collecting those human remains. a pathologist will do an examination. they're hoping dental records or dna could identify who this person is. it could take weeks or longer.

twist in the saga of our online privacy. according to documents leaked by former edward snowden, the national security agency has been monitoring online games like world of war craft, even posing as trolls to look for terrorists posing as gamers. >> i think a lot of times when you're playing video games or on facebook, you want to be friendly with everybody. you never know who is on the other side. >> reporter: that's the virtual world. there's also talk today about this, an ad taken out in big city newspapers by silicon valley tech rivals like google, yahoo, twitter, facebook, and linked-in urging u.s. officials to reign in security policies and protect the data we give to

companies like these. at barracuda networks, security is their business. >> if you don't want it on the internet, don't put it on there in the first place. >> reporter: it's up to us to make sure the government and these companies don't use our data in ways we don't want. we reached out to the companies who participated to be part of this story, but none of them agreed to go on camera to talk with us. tomorrow the ntsb will hold hearings in the deadly airline crash of asiana in washington, d.c. flight 214 crash landed at sfo back in july killing three teens

and injuring nearly 200. we'll have live reports from stephen stock beginning tomorrow morning. the retired engineer who wrote his own report about the problem steel rods on the bridge. the 81-year-old expert did not like the errors he found on those rods which snapped when tightened earlier this year. today cal tran issued a statement saying it agrees with some of the conclusions and will continue to work with those experts. imagine this. flooding at sfo and water flowing through high-tech company. it's not happening, but it's a very real possibility on the coast. bay area leaders came together to look at the problem and come up with a plan.

the view of san mateo county is breathtaking, but the sea level is rising. a big section of the bay area could be underwater. >> the glaciers will eventually melt enough that the sea level will rise three feet, nine feet, and six feet. let's adapt to that. >> reporter: a group of scientists met to discuss steps to prepare for rising sea levels. >> sfo airport would be inundated if we don't start taking some steps. >> reporter: some steps include increasing sea walls. >> we have entire silicon valley companies located in areas that

would be flooded. >> we may need to build more sea walls. build more levees. we may need to create more marshland. >> reporter: scientists can't predict when the water levels will rise as much as three feet, but they're confident it will happen. nbc bay area news. let's turn things over to our meteorologist. bitterly cold. >> yeah. we do have a little bit of hope in that forecast that is going to prove much better for us. another record breaker again this morning. santa rosa got down to 19 degrees. this makes four out of the past six days new records here in santa rosa. that also goes for napa and lots of the north bay. freeze warning in effect for

tuesday morning in all of the bay area except san francisco. outside, it is still getting very cold. 39 degrees is your average. 47 in the south bay. not overly chilly in san francisco. you're going to see that number drop a lot more. right now we're dealing with winds 5 to about 10 miles per hour. those numbers are going to go down this cold as we head throughout the morning hours. 19 in napa. santa rosa 22. mill valley also 25. as we look ahead towards tuesday morning, san jose expecting 27. let's get a focus in on the next possible shift in that forecast to give us some warmer weather. we still have plenty of this chilly air moving right across california, but the hope in the forecast is going to come by a slight shift. we're going to see this chilly

air gradually move off towards to the east. warmer air should be warming up our temperatures. it's still going to be cold in the overnight hours. what you're going to see in napa is by thursday and friday, instead of upper teens and low 20s, we'll go into the low 30s thursday and friday morning. there is some warming coming into that forecast eventually, but it is going to come at a cost. we have high pressure aloft that's hoping to bring in some of this unhealthier air. it is going to be illegal to burn in the next 24 hours with that spare in the air in effect. tuesday forecast, it's going to be chilly out there. jacket weather for sure. temperatures 48 degrees. 53 for your high in san jose.

the 21-year-old accused of killing a man and stealing his playstation 4 appeared in court today. collins made arrangements online to meet up with the victim in san francisco to buy his playstation. when the two met in the bay district earlier this month, he fatally shot the victim and stole the console. police are investigating a string of robberies that appear to be connected in oakland. investigators say this is the car the robbers used.

it is a black 2009 toyota venza. one suspect is being described as a thin african-american man in his late teens. san jose police hope hundreds of people show up this weekend to turn in their guns. the department is teaming up with the district attorney's office on its first gun buy back event since 2001. other cities have done it this year with such success. it happened between 9:00 a.m. and 1:00 p.m. people will be given 100 bucks for each gun they turn in. >> it will have a tremendous impact have helping to remove unwanted firearms from residential households in your community. >> police are asking people to leave the guns unloaded in the trunk of their cars as they drive up to the church. shirts designed in honor of

batkid are raking in funds for the make a wish foundation. the son set a goal of raising $5,000 for the make a wish foundation. so far he's raised $30,000 through his clothing company, kid monarch clothing. miles returned to san francisco over the weekend for the make a wish fundraiser break the bay. how much it is going to cost to bring up a couple of candlesticks. that's next.

football games at levi's stadium have been sidelined. lisa gilmore says because of parking issues potential games on monday or thursday nights are not plausible because there's not enough parking spaces available during business hours. they're counting on the 21,000 parking spaces from neighboring businesses that would be vacant on sundays. the city is working on a solution for future seasons. now you can have a piece of it. san francisco is selling seats from the stadium following the 49ers farewell season. they went on sale today. if you get them before christmas, they are $649.

if you get them after the deadline, they go up to 795. it's pretty steep for chairs that don't recline or have cup holders, but there are memories. not just the games, but concerts there. >> red hot seats. i wish we had warmer temperatures. >> thursday and friday that's the days you want to focus in on. we have clear skies across the bay. relatively light winds that will enable temperatures to drop down into the teens. for the east bay and the south bay, it's going to be another night right around the freezing mark. as you head out in the morning hours, make sure you have those layers on. it helps to trap some heat next to your body.
