all. right now a live look as they ring in the day out on the new york stock exchange. perhaps a bit of a bounce this morning, they're hoping so after another rough close last night. it is tuesday, june 25th. this is "today in the bay." good morning.  i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. an update on breaking news in san francisco where police are still on the scene following an overnight home invasion. it is an attack they say appears to be random. this one happened after 2:00 this morning near elmira and industrial right near bayshore boulevard at the highway 101 interstate/280 junction there. police say it appears one of the un away from one of the sus smekts and shot him with it. we're also told two children were inside the home at the

time. we're happy to report none of the children were hurt. two of the three adults right now are suffering life-threatening injuries. today in the bay's christie smith is live at the scene where the search for the two other suspects is taking place at this hour. we'll have another live update coming up with all the new information in just a few minutes. we also have an update right now to breaking news down in los angeles. we have a live look from our chopper. two lapd officers have been shot and hurt during an ambush attack outside the wilshire police station. the lapd issuing what they call a citywide tactical alert which means everybody there is on alert.

that we don't know this morning. what we do know is the united states is still looking for hip and we know that ecuador is considering whether or not to grant him asylum. they've said that they think he's persecuted. so while the state department tries to get the word out to latin american countries to return snowden if he shows up there, at least one, ecuador, says they're considering letting him stay. marla. >> tracie, thank you. a settlement reached in a federal class action lawsuit brought on by 150 people who protested after the sentencing of former b.a.r.t. officer johannes mehserle. they've been awarded more than $1 million in damages. the suit claims the civil rights were violated when oakland police arrested them back on

november 5th, 2010 for unlawfully assembling. protesters claiming the police gave them no chance to leave peacefully and that violated opd's own crowd control policy. mehserle shot and killed oscar station. a lawyer is threatening to go to court overrule changes made after a deadly training accident. at issue is a change in specifications for a piece of boat equipment known as a rudder elevator. it helps control the high-tech catamarans when they go airborne. italian team luna rose sea says the elevators are for boat performance and should not be regulated. the rule changes come after a catamaran capsized in may killing olympic goldkiç7 medali andrew simpson. be prepared for developing) weather this morning. give you a live look.

the fog blanketing the golden gate bridge as cars roll through the rain. christina loren is here to tell us what is going to be happening all over the bay area with this rain and more. >> that's what's causing those 3:40 flight delays out of sfo, jon and marla. more shower activity, becoming more steady and more organized right along the peninsula. we're starting to see our first showers move into the east bay and here in the south bay, san jose in particular, rather dry we're about 58 minutes away from showers movinwb in here. also santa clara, about.$xf 51 minutes away from steady rainfall headed your way. all this will continue to press to the east throughout the day. here is what we're expecting, the steadiest showers, the heaviest rainfall is expected in the heart of your morning drive. by 11:00 a.m., we'll start to see the showers partially clear out. lingering a. a.m. rain. elevated fire danger right on the heels of this area of low pressure. talking triple digit heat and the warmest weather so far.

show you when that comes in on your seven day outlook. mike has been busy. let's get an update from him. >> good morning, folks. the chopper showing the tremendous backup, southbound 880 out of union city in newark through fremont and down toward stephen son boulevard. if you follow the backup south all the way to the scene of the crash, the coroner's truck and chp are still on scene doing the investigation. the flatbed tow truck looked like it was positioning itself about a minute ago to try to load up the car. we've seen the smashed up suv, what remains of it. they are getting ready to load that up. they've moved that flatbed into position. that looks like the remaining piece to be removed from the roadway. we don't know about continuing investigation that needs to go on there. chp has not told us when the lanes will reopen. they're doing something with regard to the equipment. we'll follow this. the big backup shows on the map.

fans swarm the streets of chicago overnight. look at this, after the chicago black hawks won a stanley cup stunner over the boston bruins, chicago police in riot gear cleared out the fans at 1:15 this morning after some people started throwing glass bottles at police cars, not a+bpñ good . the sun times reports some people set off fireworks, others climbed on top of bus shelters, atm kiosks and even a sculpture outside wrigley field. two people are in the hospital. it's unclear how many people have been arrested. also this morning, a memorial for the victims of the boston marathon bombings now being removed. items in the memorial located in

boston's copley square will be take tone the city archives this morning. a remembrance committee will be formed to oversee the creation of a permanent memorial to salute the victims and survivors. 6:41. breaking news. two victims turn the tables on their attackers overnight in san francisco. we have new details about this random home invasion that sent .e to the hospital. keeping a close eye on the stock market as well. a bit of a bounceback today. we'll take a look coming up. summer showers continue to stream onshore causing a slower-than-usual drive this morning. we're tracking showers minute by minute, about 52 minutes from steady rainfall in livermore. i'll tell you when the rain is slated to hit your household and for how long coming up. even more impact than that slick roadway and wet weather is this sig alert deadly crash south 880 heading through fremont. it looks like they're making progress. we'll bring you the latest on this scene coming up.

progress. want to give you another update right now on the breaking news down in los angeles. a live look there where two police officers, lapd officers were shot and hurt during an attack outside the wilshire police station. the officers were going back to the station when somebody standing nearby opened fire. that happened about 4:00 this morning. the officers were rushed to the hospital. police now saying the officers' conditions not life-threatening. they both seem to be doing okay. the police now on the hunt for a gunman. residents within that perimeter are being instructed to shelter in place and stay inside their homes with this gunman on the loose. developing weather this morning as we give you a live look at oakland and san jose.

two -- excuseéj?z me -- on the arrivals, one or two cancellations and some delays. if you step outside t rain has stopped up here at sfo, but if you look out, we don't have fog, but we do have storm clouds out there and a low ceiling. i don't know what that portends for the rest of the day, if that means it's going to get worse or if that's as bad as it was going to get. yesterday there were over 100 cancellations here at sfo stranding people likexjnñ this who has been balled up with his backpack since we got here a couple hours ago in one corner here of terminal one. there were many people like him stranded including one woman trying to get to portland to start her new job at a hospital. >> booked the last night to get home in time to start clerkships tomorrow at the hospital and i'm missing them right now. >> how many 234r50i9s haflights canceled on you today?

the next couple hours by about 11:00 a.m., we should start to clear you out. we have@o;v residual isolated activity for tomorrow morning and then we'll crank the heat up. showers right now moving into the south bay, not all the way into the san jose area just yet, but they are on the way. we're expecting those showers steadily. streaming into san jose over the course of the next 55 minutes, 19 minutes away from the steady rainfall. let's take you through your day hour by hour via your futurecast. we stop the clock at 8:00 a.m. you can see the heavier pockets roll onshore mostly impacting the north bay, but also we'll see some of that moderate rainfall move as far to the east as oakland. we stop the clock at 11:00 a.m. when we meet back for the midday broadcast. a lot of this activity will have started to clearp5m out. by about 5:00 p.m., mostly cloudy conditions, a few isolated showers. we'll keep that in the forecast until the first part of tomorrow. by 9:00 a.m. tomorrow, we'll see the sunshine. then the sun stays with us and heats us up quickly.

79 in lynn moore, 75 in fremont, 75 in san jose. 73 on the way to los gatos. wednesday into thursdau9&s the temperatures soar. we bring the sunshine out and then we couple it with the dry northerly winds that dry us out in the bay area. saturday into sunday the heat stays on. we crank it even more so for monday. we are talking about elevated fire danger. you want to have a barbecue, today will be a better day for you to do so than geing into the weekend and monday. he's been a busy man so far this morning. let's find out if there's any improvement on the highways. ago. southbound 880 past stephenson. a deadly crash investigation continued up until a few minutes ago. we got word from chp all lanes are open. let me show you the situation. after they pulled this equipment, the coroner's truck and chp vehicles from the area, we have a huge backup

approaching the stephenson on-ramp. all lanes are now open. all this traffic that has built up all the way in toward the scene, that is flowing south in towards milpitas and fremont. that will be an issue toward mission boulevard. mission boulevard is one of your keep you out of the backup. very crowded over the next half hour or 45 minutes. the south bay itself moves smoothly. we'll take you toward the bay ñ earlier scattered crashes, the worst of it out of richmond toward the race track, pretty standard, soupy over there. we'll give you an example of what we're talking about, the low clouds, the mist and drizzle, be careful. an issue for the on and off-ramps. the metering lights are on but moving relatively smooth for the bay bridge. the golden gate bridge, very soupy here, water kicking up

behind the cars. be careful. windshe on full, so are your headlights even if it's sunny, guys. back to you. breaking news in san francisco where two homeowners actually turned the tables on one of three attackers overnight. somehow they managed to shoot the home invader right in the face with the invader's own gun, but not before they were also shot. "today in the bay's" christie smith just spoke with police with where we learn the attack happened where children were sleeping in the other room. christie, what a scary scene out there. >> reporter: absolutely. good morning to you, jon and marla. these three armed men who broke in certainly got more than they bargained for overnight when they got into this home right up elmira. one of them ended up getting shot with his own gun. four people were inside at theñ time including two children who were woken up by all this. fortunately the children were not hurt. the residents at this home on

elmira street tell police these three men broke into their home around 2:30 this morning. a man, a woman in their 20s or 30s wereg+yy inside. those kids right nearby as this gunfire broke out. the woman was shot, the man was shot. again, that suspect shot, too. when police arrived they had to sort it all out. here is how the tables turned on the guys who broke in. >> we believe that one of the victims in the house somehow got ahold of the gun and shot the suspect. >> his gun? >> his gun, his own gun. >> reporter: now, i just got off the phone with san francisco police. again, they tell me that the woman suffered life-threatening injuries, the man suffered non-life-threatening injuries. the suspect, he suffered life threatening injuries, too. two other men involved. they ran away when all this was going on. they are still outstanding this morning. workers trying to get up the hill this morning tell me that the children are very young and that the family has lived here

for quite some time. reporting live in san francisco, christie smith, "today in the bay." 6:53. new this morning a father wanted in antioch for allegedly kidnapping his own daughter has turned himself in. the kidnapping prompted antioch police to issue an amber alert yesterday. investigators say 23-year-old joshua benton broke into a home, started a fight with the child's mother and kidnapped his 11-month-old daughter. benton left the baby behind when police spotted him nearby. after several hours he turned himself in to police. the little girl was not hurt and is now back with her mother. two men accused of killing a 3-year-old oakland boy will be in court today. the preliminary hearing for lawrence denard and willy torrence starts this morning. police say back in august of 2011 these mená&ta fire in an east oakland neighborhood hitting and sadly killing 3-year-old carlos nava with a stray bullet. the city of sunnyvale wants to see changes in gun laws and

it's not waiting on congress to act. the city council consideringre2 possible ballot measure that would tighten restrictions on guns and ammunition in sunnyvale. some of the new rules could include requiring private gun sellers to conduct background checks on buyers and requiring shops to report to law enforcement when anyonezn purchases more than 500 rounds at a time. the sish use will be discussed to night at sunnyvale city hall. a brand new study at stanford finds that charter schools are improving but not necessarily outperforming the public school kountd parts. the old study showed 37% of charter schools are actually providing worse education than local public schools. in the new study, the number dropped to 31%. the new study also finds 29% of charter schools raised students' math scores above those of local public schools.

that's up 17%. researchers also say charter schools vary widely state to state making this very difficult to pinpoint a national trend. 6:55. anticipation is building outside q morning as the clock ticks down on the final rulings of the session. among the decisions yet to be announced, california's prop 8. "today in the bay's" cheryl hurd is live outside the courthouse this morning in d.c. where the couples at the center of this case just arrived moments ago. good morning, cheryl. >> reporter: good morning, marla. in about ten minutes the doors will open and, as you said, anticipation is building this morning. people inside will be seated very quickly and there are still some people already inside who are involved in the case. just like clockwork, though, the plaintiffs arrived in a black suburban. they got out smiling, but not saying a word. everyone asking them questions. the big question, what do you think will happen today? of course no one knows. they walked up the steps hand in

hand. yesterday kris perry told me she was feeling hopeful about the rulings today. the ruling could go many different ways.3qe+ it could be simple or it could be dramatic. i spoke with the policy director for the national center for lesbian rights and she put it this way. >> i'm feeling optimistic about both proposition 8 and the doma case. i think section 3 is going to get struck down. i think prop 8 is going to somehow -- i think prop 8 is going down, i'm not sure if it's goings to be the supreme court making a ruling or just sort of punting it back to the ninth circuit and letting that decision stand. >> so as you can see, everyone has their crystal balls out. no one really knows. ten minutes from now, the doors opening seated very quickly. the rulings usually start coming down soon after that, and if any indication -- if yesterday is any indication of what will happen today, we should know if
