we are having a nice start and cooler because we have less clouds. mostly 50s through breakfast time and patchy low clouds. temperatures cooled by a strengthening sea breeze and highs in the 60s to low 70s inland with a little bit of patchy fog that may impact the commute this morning. mike? >> we'll watch for that. a look at the golden gate bridge and hit hard with the fog. i was able to see the crew move the cones off to the marin side. we will watch as the clouds roll in and we are following san jose as well. a crew on the scene, alma den expressway and the scene of a deadly accident that occurred overnight. the expressway is closed and all the way south to o' grady drive. a rekrout for the local pd, but it looks like camden may be the most direct avenue. >> new this morning, we are

getting word that as many as nine americans are dead in afghanistan. some are american service members and one was a civilian. no reported enemy fire at the time. also today is day 83 without a budget. talks were supposed to resume and governor schwarzenegger called in sick. the last meeting took place on friday. talks should resume today, but we are waiting to see if that's going to happen. the state is $19 billion in the hole and this is the longest delay in state history. baseball playoffs are a week away and the giants are leading the pack. the division series playoff tickets go on sale at 10:00 this morning. you can buy them at sf giants.com. the cheapest are just $35 and the most expensive are $175. >> we know where the highest risk pipelines are and some are uncomfortably beneath bay area homes. bob redell is live with a run

down of where the pipelines lie. good morning. >> reporter: good morning. you can pick up a local paper in any of the communities throughout the bay area and see a headline similar to this. we are in stanford and palo alto and stanford does have risky pipelines on the campus. a spokesperson from stanford said they don't want people to be alarmed and some of the pg&e pipeline top 100 pipelines run through campus. a 6,000 foot section runs under sarah boulevard between page mill and sand hill road. this is along the southwestern edge of campus near 280. four segments of the stretch mame at 56 and 60, 61, and 62 on the list of pipelines because according to pg&e they had the potential corrosion. the lines are not in immediate need of repair and instead they

are just monitoring them. the university is concerned and a spokesperson telling stanford daily they want to meet to find out more about why the pipelines are on the skpls what has pg&e done to improve them. the area is so populated. at number 14 is another line across the bay. it's in another highly populated area. we are talking about three mile long pipeline in fremont. in santa clara, pipes are on the list. this is in milpitas and another on ranch drive. up north in the north bay, four marin county pipelines under scrutiny. there is an 1800 foot pipeline in san rafael that runs through a suburban area. if you want to find out if you live near a top 100 riskiest

pipeline, you can go to the front page of nbcbayarea.com and i will get you the information you need. live in palo alto, today in the bay. >> oakland police hope to have a sketch out of a man they say rob and sexually assaulted two women in the lake merit neighborhood. the attacks happened sunday evening, but they won't specify what time or where they happened. police say both assaults happened in secluded areas and both victims were on the way home. police think that the same person might be responsible in both cases and think he was armed. they are asking people in the area to be more aware of surroundings and stay in well-lit areas. paper oakland could be the next city to get uniform cameras for the police officers. this is an update to the story we brought you last week. the council will vote on a measure that purchases 350 of the cameras. the police chief said the move

would benefit both officers and the people of oakland. >> what are it allows me to do is watch the interaction. make sure that we are could go the correct things and obeying the laws. if we get a complaint at a given point, it allows me to show the citizens was it occurred. this is the procedures and why we support officers. the officer did the correct thing. >> officers would have to turn on the cameras when they pull people over or make investigative stops. >> meg whitman said she will spend her own money to get her issues passed. to balance the budget, state workers need to take pension cuts. if they don't, she is willing to place a proposal on the state ballot. the former ebay ceo said ideally she would raise money, but she would consider putting her own money behind the measure if she had to. democratic candidate for

governor jerry brown has more backing. the prison guard unit is endorsing him. members do not like whitman's plan to make unions contribute to pensions and ship prisoners out of state. students and teachers urge dianne feinstein to support the dream act. it would provide undocumented students in the u.s. since childhood a path to citizenship. if they go to college or join the military. the rally is set for 11:00 this morning at the senator's office on post street. it is scheduled minutes before a crucial vote is scheduled in washington, d.c. distracted driving kill and injured many people last year and they will hold a summit meeting and hope to find ways to keep accidents like this from happening. a driver of a tractor-trailer lost control while he was texting. family members of victims, researchers and safety officials will be at the meeting to

the single car accident. at least one person is dead. the car caught on fire after hitting a tree. we continue to work the scene and bring you more information as soon as possible this morning. stunning news from the nfl. one of the denver broncos is dead. kenny kinley was found dead in his apartment yesterday. police think the 23-year-old killed himself. mckinley was on the injured reserve list this year and he played eight games last year and returned seven kickoffs. the senate could vote to overturn the don't ask don't tell policy. senators are supposed to vote to end debate on a $725 billion bill. included in the bill is a repeal of the don't ask don't tell law. they are expected to be close today, but it will most likely pass if democrats can stop a republican-led filibuster.

they passed a similar measure in may achl compromised version is expected to pass after the november elections. the president is expected to sign the bill if it makes it to his desk. the irany president will address the united nations general assembly. sunday he said since he helped free hiker sarah shourd there should be pay back from president obama. he wants the president to make a humanitarian gesture and release iranians that were illegally arrest and detained in the united states. the cases have nothing to do with one another. police plan to arrest a woman who admitted to throwing acid in her own face. bethany storro said a stranger threw it in her face. she admitted she did it to herself and she faces theft because she accepted money from fund-raisers. >> everyone is not really mad,

but they are sad. why would someone do that to themselves? >> police will arrest her when the time is appropriate. she is still in the hospital. >> apple is the head of the class when it comes to customer satisfaction. a survey shows a cupertino company scored 86 out of 100. dell and ph scored 77 and all the scores are up from last year. a new study said getting the flu shot may have an added health benefit. a study said the risk of having a heart attack was reduced by 19 percent per for people who had a flack vaccine in the last year. some experts don't buy it. they said if getting the flu shot prevented heart attacks, it would have been noticed before. a link between heart attacks and the vaccine existed, it's not justified by the data.

>> a report on the global impact on alzheimer's disease. the world report said the number of people with dementia will double by 2030 and more than triple by 2050. researchers say dementia is one of the costlier illnesses. money for research is lower than for other major illnesses. >> the court appearance is in store for lindsay lohan. a judge issued an arrest warrant. lohan will not be arrested, but she has to appear in court on friday. it comes after she failed a drug test less than a month after she confirmed on twitter saying she failed the court-ordered drug and alcohol screening. astronauts are using the website to share their view of the world. >> these are shot from the international space station and tweeted by the astronauts. pretty spectacular. they are courtesy of douglas we

yesterday's morning commute and things were fine off of highway 84. the back up we saw, he was confused and started north of there. we talked about where the incidents were going on. a couple trucks full of cones because of all those cones that had to be picked up and landscaping going on as well as the signs that were going to be a distraction. those crews probably won't be there, but we had an incident and when that happens aircraft lot of folks jump over causing more problems into the area where we had a bit of confusion. 680 through the grade and yesterday's slow down was at 6. we may see things starting in about 40 to 45 minutes. second day for the express lane to be open. a bay bridge and a beautiful view and the maze into san francisco. we could not see this yesterday. things are clearer and we have the forecast and we will let you

but what were the results? fact: brown promised to improve schools. but the drop out rate increased 50%, and the state had to take over the schools. fact: the city controller found employees paid for 22,000 hours... they never worked. fact: brown promised to cut crime. but murders doubled, making oakland the 4th most dangerous city in america. jerry brown. he just can't deliver the results california needs now.

your view. today into tomorrow, a strong case of ocean air conditioning and onshore winds. as winds come onshore, 60s and 70s through wednesday and heading towards the weekend, temperatures start to soar towards friday and saturday. low 70s around the south. san jose 73 and cool and cloudy on the coast. it will be breezy. the winds will pick up around san mateo across the east bay and trivalley. mid-70s and in the north bay, highs in the 70s. between now and tomorrow, we cool off and friday and the weekend ahead, things heat up. first weekend of fall looks like summer around the bay area. >> thanks so much. a piece of american history is cheaper. the owner of the hurst estate placed the beverly hills mansion on the market and file forward bankruptcy protection and is asking $95 million for the 1920s

one person is dead and another passenger is in the hospital. we are told that person has no life-threatening injuries. the car caught on fire after hitting a tree. we continue to work to bring you more details as soon as possible. we know the crew affects your morning commute and affects schools in the area. >> no way to look at how traffic is impacted. >> you mentioned at almaden expressway, it may sound familiar to a lot of folks because it's the same street where you located leland high school and bret hart middle school. you have to reroute because south of that point it's closed. if you need a local landmark, you can use camden avenue. locals know it approaches leland high school north of bret hart. use bern side or bret hart drive. a lost surface streets. the freeways through the area

are moving smoothly. we will follow this. back to you. >> new this morning, the commander of the national guard unit that was on a training exercise in utah when a wild far spark side apologizing. he said he is deeply sorry for what he called a systematic failure. it destroyed three homes and damaged a fourth. it's 25% contained. the unit was conducting live training on sunday even though there were high wind warnings. >> three months and no state budget. no negotiations because the governor called in sick. a meeting could depend on if the governor is well again. 83 days makes it the longest delay in history. lawmakers these to close the gap. >> the safety alert for the women in your life. a man sexually assaulted women

and today in the bay's christie smith is live at lake merit where the attacks took place. christie? >> reporter: these attacks took place in a secluded area in the evening. both were on their way home. they are warning people to be careful, particularly getting in and out of the car when you are walking around, don't be distracted by your cell phone or ipod. we have been talking with people this morning and this is the first they have heard of anything going on like this. two women rob and assaulted during the robbery. this happened sunday evening. they are not releasing a lot of details, but believe the same guy may be responsible for both attacks and they do say he is armed. women are being warned to stay in a well-lit, well-populated area and lock the car door when we are getting in and out. we spoke with a woman walking

her dog around the lake. >> you have to be on alert and we carry mace. i think you have to be careful no matter where you live. >> did you hear about it? >> i didn't, no. i haven't seen more police present at all. >> she showed us that can of mace she carries just about everywhere and feels with it. the man that police are looking for, he was wearing dark clothing, african-american male. medium build about 5'10" to 6 feet tall. we are told that police are working on a sketch and as soon as we get that, we will bring it to you. >> time to be careful out there. thank you. >> police in the south bay are also looking for an attacker and a man tried to rape a jogger on a popular san jose trail. the woman is a triathlete and fought back kicking and screaming until the attacker ran

away. she was at the south end of snell avenue when the man jumped in front of her sunday. the suspect is described as an hispanic male in his 20s about 5'6" and 150 pounds. >> we are learning more about pg&e repairs are located. it released a list of the top 100 risk gas lines. more than 2/3 are in the bay area. enteringly enough, the san bruno pipeline was not on that list. today in the bay will explain why in a live report just ahead. >> city council said it has no confidence in california's high speed rail. the council passed a resolution unanimously and called for state and federal officials to pull funding for the $43 billion project. it's slated to travel between los angeles and san francisco.

50. that's typical for the morning star. livermore shows the slowing coming in and still 14 minutes through livermore in towards the interchange and south of there we are focusing on the area approaching highway 84 where woo had a number of problems. a clear view of the great, no problem. how is the forecast looking. >> not seeing too much in the way of low clouds. my drive from 680, wouldn't see anything in the way of fog. some low clouds pushing around and look at the temperatures. jacket weather in novato. san jose kind of chilly at 55. we have the sea breeze starting to pick up. you can see it into fairfield and that's one of the reason yes today and tomorrow, the temperatures will be cooling off. we are talking 60s and 70s for most of the area, but beginning friday, high pressure building in and the temperatures are really going to start to scream upward for the weekend. a system here offshore will not bring us rain. it will bring a stronger sea

president of iran about whether or not their sons will be released as well. that is not likely to happen according to iran's president. he said that he wants a swap. he wants at least eight iranians who are jailed in exchange for the release of the two hikers and said if they are to be released, they would need to prove their innocence. all of this among the backdrop of the united nations where he is to speak. she unclear as to whether he will address this issue in the speech, but clearly it is one of the issues that is surrounding that meeting today. i'm tracie potts for today in the bay. >> thanks, tracie. >> a rocket launch from vandenburg air force base. the rocket was carrying a pay load for the national reconnaissan

reconnaissance. the nation's spy satellite. no details about what was on it. it launched around 9:00 last night. >> time is 5:44. good morning and thanks for joining us. >> i'm laura garcia cannon. first, new this morning, police in the best way are on the hunt for a man who sexually assaulted women getting in and out of their cars. christie smith is live with more on the new information we hope it get today. good morning, christie. >> good morning. these are two sexual assaults and robberies. investigators believe that the same guy may be responsible. they are sending out a warning, particularly in the lake merit area. they are not saying where it happened, but a car had something to do with it. they are reminding women when you are getting in and out of the car, make sure you lock it quickly behind you. if you are inside, but also make sure you are not distracted by

the cell phone or ipod. this was sunday evening when it happened. this may be the same guy responsible for both of these attacks. not much of a description, but he is an african-american male wearing dark clothing. he had a medium build and about 5'10" to 6 feet tall and we are told that investigators are working on a sketch. as soon as we get that, we will bring it to you. christie smith, today in the bay. good morning. we had a good slow down and approaching the area where the express lane starts. 5:00 is when the metering lights and the express lane started the operation and things are moving

smoothly through the area. a little slow down into fremont. yesterday about 6:00 is when we see the slowing as well. so far, so good. a nice easy flow for 580 approaching the interchange where we had a problem as well. that caused folks to head down to add to the congestion. a 16-minute drive continues to build early, but this is a tuesday. we expect that as well through the heart of livermore. clear to about airway boulevard. we will take a look at the bay bridge itself. the toll plaza with no back ups. a clearer view so far. an 18-minute bridge off of the bridge. hercules and towards the berkeley curve. a nice flow and the upper deck shot from san francisco. we could not show you this shot. the steady flow of traffic and we couldn't see the shot because he had a lot of fog.

stanford. a spokesperson from the university said they don't want anybody to be alarmed at the campus's home to at risk pipeline segments. releasing this top 100 list of the pipelines in response to an explosion ranked in the middle. the four segments of a 6,000 foot section that run along the southwestern edge of campus. this is roughly between page mill and sand hill. they put them on the list because they have the potential for erosion. something pg&e is monitoring. still the university is concerned. the spokesperson telling the stanford daily they want to meet to find out more as to why the pipelines are on the list and what pg&e has done to improve them. a sentiment echoed by people who live in the area. pa. >> all facts should be

homeowner's tax exemption for those who have lost their homes. they are devastated financially and way we can help is to ton allow even though they don't own the home anymore, there is no home to continue the tax exemption. locally because of the destruction of the structures, school districts and local communities no longer get the tax revenues and the property tax revenue. they will back fill those dollars and those individual who is have lost their jobs, they can at least take that loss off of the income tax. there is a way that we can somehow help build back lives of so many individuals. >> do you also have to work in the provisions of how long the back pays will take place? >> we are still crunching the numbers and this will cost

additional dollars. we are crunching the numbers and try to extend it as long as we can to give a period of time for individuals to recover from this particular tragedy. >> you see how important it is to people. i understand you are getting a lot of phone calls. it will cost so much money that news to be done and the state of california is not in a good place when it comes to balancing the budget. >> we have emergency funds and that's what we are looking at trying to use to help so many individuals right now. >> i guess in trying to prevent such a disaster, looking at the grirksd ironicalgrids, it wasn'n the site. >> that's one reason why we can't rely on this list of 100 sites. as you indicated, the san bruno tragedy was not even on this

list. we have got to look up and down every which way on the whole issue of pipelines and the potential danger of citing the lines, particularly in the heavily populated areas. it really suggests that the cpuc has to do a better job overseeing the pg&e and in addition, the local government has to get more involved. they are the ones that allow some of these homes to be built on top of these transmission lines. the question then is up and down our level of command and our levels of government. how did we allow the pipes to be located and how do we allow the home to be located on top? >> where do we move from here? we thank you for joining us. >> thank you very much. >> hewlett packard cannot prevent the former ceo from taking a job. mark hurd settled a lawsuit and
