a golf instructor charged in a molestation case. tonight new shocking allegations of a plot to kill. good evening i'm heather holmes. >> and i'm frank somerville. good evening, a golf instructor is being accused of plotting to

kill the boys who brought charges against him. jana katsuyama has the story. >> reporter: he basically, nisbit tried to kill the boys and he tried to hire a hit man from inside his cell. today prosecutors added three new counts for solicitation of murder. that's on top of the 75 counts already facing the livermore golf instructor. seen online in video and photos posing with many of his students. the charges include molestation and lewd acts on three unnamed boys who were between 12 and 17 years old. according to an investigator's report, on february 25th a deputy at the jail said an informant showed him letters from nisbit asked for the informants to be taken care of.

the informant then received a letter from nisbit agreeing on a price. an undercover inspector told nisbit he was a mechanic and could fix a car for him and made a pistol with his hand. the inspector said the crimes wouldn't be traced to nisbit because it appeared the victims got robbed for their cell phones. on march 18th. officials searched nisbit's cell and found directions to the victims to one house. jana katsuyama, ktvu channel 2 news. happening now live pictures outside the staple center in los angeles where the golden state warriors took on the l.a. clippers tonight in that all

important play off game. but this game five may have been overshadowed by the actions taken today on the clipper's owner. nba came down hard on sterling. the commissioner called on sterling to sell the clippers. they also imposed the maximum fine $2.5 million. he said sterling acknowledged it was his voice on the recorded conversation. sterling was heard telling his girlfriend not to bring blacks to games as well as other racist comments. >> we stand together in condemning mr. sterling's views. they simply have no place in the nba. now here is what's next.

nba owners will meet and decide whether to force sterling to sell. when is not clear. if sterling does sell the price could be between 500 to $700 million or more. sterling's attorney declined to say if sterling would dispute the decision, reaction to it has been swift. including from nba great magic johnson. he was singled out in sterling's remarks. the clippers owners said he didn't want johnson at his games. johnson called today a great day for the nba. >> i'm just happy that commissioner adam silver came down hard and showed that we can't let people get away with this. and even if you're an owner. >> reporter: now inside the staple center tonight, a show of support from clipper's fans. many held signs denouncing sterling.

later in this newscast we will take you live to the staple center. we've been working with clipper fans to bring your their reaction. new information now on a homicide investigation that we first told you about at 5:00. tonight we know that the victim is a mother of three. and her stabbing death has people on edge this evening in one neighborhood in san jose. she is the city's 13th homicide victim so far this year. ken pritchett live at the apartment complex where she was found. it's just across the street from regional medical center, ken. >> reporter: we're at adam rock and jose fuigeroa avenue. at this point san jose police have said very little except that a woman was stabbed. she was found dead and they are looking for a suspect. this is the bottom floor apartment where a victim was found. a neighbor said he heard nothing, no yelling, no

screams, no crying baby. this was according to that neighbor a mother of three in her 30s. police say she was stabbed once. one neighbor called for help. >> don't know any of these circumstances surrounding the murder. we just know the neighbor was somehow notified and called the victim. >> reporter: we know several neighbors were home at the time around 3:00 this afternoon. >> that's scary. that's why i was concerned. because this is daytime. usually things like these happen at night. >> reporter: no one heard any commotion or fire trucks and paramedics who arrived with nothing they could do. according to neighbors the family in this apartment moved in about a month ago. little else is known. reason enough to concern the people who live on this street. >> we don't know right now if this is just an isolated incident. we don't know. we don't know who the suspect is right now. >> reporter: as police were clearing the scene we were able

to speak to neighbors closer to that apartment. they provided more information. this is from neighbors, they say that victim was a mother of three daughters. twin daughters and an infant. they also say the man who liveded in that apartment was here on scene talking with police. san jose police say there have been no arrests. there are no suspects and no motives at this time. in san jose, ken pritchett, ktvu channel 2 news. san jose's independent police auditor released her annual reports. the report includeed the recommendation that an officer be fired if it's determined he or she died during the investigation. the report was also critical of some of the police department's handling of mishandling cases including one that included having sex on duty. >> when that happens it is our view that such an officer must go. the department we believe must recommend termination. >> reporter: after much

discussion, the city council decided against a proposal that would have made termination automatic if it was determined that an officer lied to the investigator. the auditor did take time to praise the work of the police investigation division. a court appearance today by ashley newton was delayed until tomorrow because of unspecified medical reasons. newton remains in custody accused of repeatedly stabbing her 7 -month-old baby boy on saturday in a park in livermore. family members say she has a history of depression and police say she has confessed. a man convicted of stabbing a uc berkeley student to death in 2008 had his conviction overturned today. today an alameda county judge dismissed the case against him saying the defense attorney who

represented 26-year-old andrew hoeft-ede nfield showed a level of disingenuineness. prosecutors now have 30 days to decide whether to offer hoeft- edenfield a plea deal or retry him for second degree murder. ktvu has confirmed that abduh youseff has arrived in hawaii. his son survived sub freezing temperatures in extreme altitudes to make the flight. the boy told investigators that he was trying to reach his

mother in ethiopia. according to the owner of the parachute center in ocampo, two sky divers collided. one of them broke his leg but the other one was knocked out and did not deploy his parachute. >> yes extremely experienced divers. both of them had probably in the neighborhood of 400 to 500 jumps each. >> reporter: the men were reportedly wearing swing suits with extra material between the legs and under their arms which can be used to greatly increase their horizontal speed. with warmer weather here, calfire is preparing for fire season. it's the dry conditions that are to blame for the high fire threat. in all, calfire told us today it will be fielding 7,800 full and seasonal employees plus 5,600 local firefighters organized by calfire.

three drought declaration. >> mandatory conservation of 25%. so, we're now voluntary, it will be mandatory. >> reporter: they're not the only east bay city cutting back. the city of dublin will only two of its three splash parks from memorial day weekend to labor day. and they will only open when it's hotter than 90 degrees. the fountain at central park uses recirculating water. >> the pump is under ground, enclosed and sealed. >> reporter: they rebuilt this water park with conservation in park. >> water costs a lot and we didn't want to waste water. >> reporter: still the park is reducing the hours the park is open. the hope is the kids won't note the difference and their parents won't mind. >> this is our planet. we have to watch the resources we consume. >> reporter: other cities like

new at 10:00, people in one oakland neighborhood are outraged after the driver of car struck a man and left him dying on the street. neighbors contacted police hoping to generate new leads in in case. amber lee is live where that hit-and-run occurred. >> reporter: this is a very busy intersection. friends of the victim tells me they want justice for a man who walked these streets every day. an empty chair in front of a chair. bill was a friend to many.

>> minus one. tomorrow it's going to be minus two. >> reporter: minus two these men say because it could have easily been one of them. hit by a driver who didn't stop to help. unthinkable to this group of friends. >> everybody here is almost like a family. you know. we know each other. we greet each other. and that's how it is here. >> reporter: they say the 68- year-old lives close by and was likely on his daily stroll here to pete's. when he was killed crossing the street saturday morning around 7:30. neighbors say the driver got out of the car, looked at bill, and then left. >> why he didn't stop and help him out. >> reporter: the street is heavily traveled. many surveillance cameras are focused in on the area. >> even if they think it's a small piece of information that could lead this case into the direction that we try to identify who's responsible.

>> it's really sad. it's inhumane. >> reporter: neighbors tell me, the suspect vehicle is a white audi suv. police declined to confirm this but did say they are investigating all leads. live in oakland, amber lee, ktvu channel 2 news. the federal monitor overseeing oakland police say the department still has work to do but over all he's seeing improvement. robert warshaw says it's doing a better job of investigating witness claims. but the department still needs to get better on reviews of excessive force. there's a new development tonight in a story we first told you about last december. it involves fire trucks negotiating tight turns in narrow streets. today a city supervisor asked for a review of the size of the fire trucks and whether they cut into the safety of people walking on streetless. supervisor scott weiner wants

to know if the city could use smaller fire trucks. >> their fire trucks are really large. and one could argue more appropriate for a suburban setting. >> fire chief white tells us the city's fire trucks are not oversized. the chief says they are the standard size for urban communities. tolls keep going up on the golden gate bridge. now2 investigates that part of the money is being wasted on high priced toll bridge workers. >> are you guys being efficient? are you clocking in day after day? >> every day. >> why the general manager admits it is an ongoing problem. that's2 investigates tomorrow night on the 10:00 news.

in oklahoma today the execution of an inmate was stopped in midstream after his vain failed. now the government is calling for an investigation. the first drug was supposed cause locket to go to sleep but after 15 minutes he was still awake and tried to get up and speak. locket eventually died of a heart attack 43 minutes after that first drug was administered. as a result of what happened tonight's planned execution of a second inmate charles warner was stayed for two weeks. severe storms in the southeast and midwest over the last 48 hours have left a trail of destruction that spans across several states and the death toll has now reached at least 35. 16 people died yesterday as tornadoes ripped through parts of mississippi, alabama and tennessee. this funnel cloud was spotted earlier today in eastern north carolina. and a tornado warning was issued but the warning has since been lifted.

however the threat isn't over yet. more severe weather is in store as that storm moves east. the storms have destroyed thousands of homes and buildings and left tens of thousands without power. and some areas that were hit yesterday are once again in the storm's path tonight. thousands of people are trying to find shelter any where they can. in al dexin al baa -- alabama, we're getting a look at the severe damage. a large tornado hit near a hospital and an apartment complex there. but no injuries were reported. temperatures today increased a lot over what they were yesterday. 25degrees. that high pressure intensifies the air begins to sink a little more aggressively. as it sinks it warms. around the bay we could see

upper 80s. in the inland bay valleys low and mid-80s possible. at the surface it generates offshore wind. not just for us but for southern california. they have a santa ana wind condition going on over there. wind advisories for them but not for us. we're not going to see a wind advisory. so the wind are not going to be as strong. mostly about this sinking air. 67 in fairfield. 70 in concord. so it's 10:20 at night and we're doing temperature that is look like daytime highs. you know tomorrow is going to be warm. how warm? these are your forecast highs for wednesday. it'll be easy to get a 95 out toward livermore. 86 in oakland. 87 in napa. we're going to take a look at specific forecasts. we'll look for a chance for the cool down and even the long range forecast increasing clouds and maybe some showers out there.

the other plane landed safely. one of the boats that responded to that crash was from the richmond fire department. and firefighters say that boat is so new it isn't even officially in service yet. the 37-foot water craft is named victory. it was built in petaluma by the moose boat company. officials say it has all the tools needed to respond to everything from fires to rescues. the cessna has been the seventh time the boat has been put into service. although it will not actually be put into service until next month or the month after that. >> even though we're not officially in service, we feel it's important to get it on the water. >> there are hopes to train at least 20. $43 million that's the price tag for a project meant to get more b.a.r.t. training on a busy rout. two investigates why that

project is still not finished. eric rasmussen found that even the landscaping is plagued with problem. >> this is it. this is our new school. >> reporter: it'll take years before landscaping will cover their view of the tracks. but now she's wondering if the project that caused all of the upheaval will ever be ready. the promise two cross overs allowing a train to cross over to the opposite tracks and head back in the other direction without having to go to the end of the line. >> it increases capacity on b.a.r.t.'s busiest line. in february, two investigates found the cost of the project had climbed to $43 million plagued by delays. but a b.a.r.t. spokesperson insisted one of the two cross overrers was almost ready to go. >> we're going to be able to put that into use as early as

receive a close. >> reporter: major violations include improper food handling and personal hygiene issues. >> all the restaurants they hold themselvess to higher standard already. if it's going to hurt anyone it's going to show your customer base how well you're providing for them. >> reporter: restaurants will also have their inspection reports and another score of those posted online. that's where the silican valley chamber of commerce thinks it could be a bit confusing. >> you could have a lower score because you have a slightly chipped tile. or because you left your door open when you were loading or unloading produce. i think if people see a numeric difference they will think how safe is my food. >> it will give people who aren't up to par a standard that they have to meet that way everybody can feel safe going into the restaurant. >> reporter: for the first year of this program, there will be no fee for business owners.

breaking news now from san leandro. where firefighters are on the scene -- are on the scene of a fire that has badly hurt a person. this is a photo sent to us by police officers on the scene. alameda hazmat crews are also on the scene. at this time there's no word on what exploded or the conditions of those two people who were burned. we do have a crew on the way to the scene and we will bring you more information as we get it. the u.s. supreme court is now weighing whether police should need a warrant to look at someone's cell phone. the court heard two hours of testimony today and some justices hinted that a cell phone search may be similar to looking inside a suspect's pockets or wallet. which does not require a warrant. but other justices suggested that smart phones should be treated like computers. which do require a warrant

first before being searched. >> the arrest should not expose somebody's life and correspondence or letters. >> reporter: the case may result in a compromise with rules based on the severity of the crime versus the need to search a device. a simple traffic stop for example would not qualify. >> the last known transmission from flight 370 was played today for the families of passengers. relatives sat and listened to the recording in beijing. it covers a very routine exchange between the pilots. investigators says it provides no hint as to what happened to that plane but families wanted to hear it any way. a private australian company has claimed to have found the wreckage of that

plane. that's thousands of miles from the current search area. the company geo residence says metals before found during the time of the plane disappearance. one analyst says he sees new record highs very soon. ebay's first quarter profits beat market expectations but it announced bringing back $9 million. that resulted in a $3 billion tax bill. the news sent shares down. and shares of twitter took a big hit following its latest earnings report. investors were disappointed in an apparent slow down. shares fell about 10% or more than $4 in extended trading.

a series of recent encounters between pit bulls and police officers now have san francisco animal control officers sounding the alarm. in three different cases aggressive dogs have been shot. some believe san francisco police officers need to rethink the handling of pit bulls and other dangerous breeds. ktvu's david stevenson shows us how recent changes are prompting calls for change. >> reporter: this is duke's

put down. employees and volunteers blame severe under staffing for their problems. two major german auto makers issued recalls today. mercedes benz is recalling c class cars because of possible problems with the rear lights. federal safety officials say mercedes dealers will make the fix for free starting in august or september. and bmw has issued a recall of car and suvs in the united states because of engine problems that can cause a stall or a loss of power. repairs are expected to be offered on that recall starting next month. you can find complete details on both recalls on our website at ktvu.com under web links. >> we're warm out there toáe. big increase in temperatures. 10 to 15 degrees warmer than yesterday. these were the recorded highs so you see that 90 up in santa rosa. 87 in antioch and it's going to be slightly warmer tomorrow.

the winds are kind of working their way offshore. what they're going to do is continue to do is keep the fog away from the beaches and what i'm finding now, as i do a surface check of temperatures out in the sunset district. we have temperatures in the low 60s down by sunset boulevard. very warm this time of night. there's no warmth in pacifica or daly city. it's fog free along the coast. that's setting us up for a pretty warm day again tomorrow. actually warmer than it was today. these are the current numbers, 70 in concord. san jose right now 70-degree. san jose tomorrow is going to warm rapidly starts off in the 50s. lunchtime you're already 80 degrees. downtown san jose the warmest day of the week. 91degrees. with all that concrete around, 91 degrees is going to feel more like 95 or 96.

it's going to be very hot out there. all the molecules rub together and produce friction. we're not seeing the significant or offshore wind. for us we're going to get the benefits of the sinking air and high wind. you're going to wake up warm and stay warm. but you'll be 20 degrees warmer inland. 93 in livermore. so slightly warmer. but a nice day. thursday looks warm as well. but i think what's going to happen then just this is typical. with the cooler ocean air is going to try to pull at the surface. this is on thursday. and temperatures will calm down a little bit. tomorrow should be the warmest day. as you heard toward thursday, you still see your numbers
