possibility of a new trial. >> i'm meteorologist sandhya patel. the rain is gone. the winds are next. how strong? how long and when it warms up. coming up on abc seven news starts right now at six. >> always live abc seven news starts right now. >> this really strikes at the heart of the fundamental obligation of nursing homes. keep your patients safe. >> a nursing home facility in east oakland faces a lawsuit alleging horrific crimes. good evening. i'm ama daetz. >> i'm dan ashley. thanks for joining us. we want to warn you that some of the details of this story really are disturbing, but we think it's important to bring them to light. >> certainly, the lawsuit alleges rape, elder neglect and fraud. the family behind the complaint says the abuse went on for months. >> abc seven news i-team reporter stephanie sierra is here with that story. one that you'll see only on seven tonight. steph. >> yes, this story impacts the most vulnerable population a cognitively impaired woman said

to be suffering from both dementia and alzheimer's, allegedly sexually assaulted, and the complaint filed is now raising serious questions about one of the largest nursing home operators in the state. these are bruises on cheryl doe, a 79 year old former patient at windsor health care center of oakland. she and her son, robert , allege the injuries are a result of a sexual assault that was swept under the rug. robert says he admitted her here with hopes to keep her safe as she battles alzheimer's and dementia. but he says the real battle happened inside the facility. >> the first time was a rape assault, and i didn't find out until two days later after it initially happened. >> this is the voice of cheryl's son robert, who was kept anonymous to protect his family's privacy. robert says his mom was raped by another resident living in the facility in august last year. he says a certified nursing assistant told him not management. >> she said your mom's been getting raped in this facility

and they know about it and they chose not to tell you. >> according to the complaint, a cna and a charge nurse knew about the alleged assault, but nothing was done. the complaint also says the facility denied it, but later acknowledged an employee witnessed it happen. robert says several days after the first incident, the man was able to get back into her room and attack again. >> he retaliated against my mom and hurt her again, and she went and told one of the nurses. one of the nurses called me again and said, your mom's going back to the hospital. he hit her. he beat her and bruises all over her arm and scrape marks on her knee. >> attorney ed dudensing is a former deputy da who is representing cheryl and robert. he says they're still in the preliminary stages of their investigation. how many people at this facility do you think were aware that this was going on? >> a lot of them, the complaint specifies two legal documents indicate after cheryl was allegedly raped twice, there was a notation of it made on her medical chart.

>> days later, the i-team spoke to an employee working at the facility. during that time, one of my colleagues walked in on the assault. >> she saw the man on top of her. the other employees were trying to sweep it under the rug. i encouraged her to tell robert. >> for the past several weeks, the i-team has made efforts to get comment from windsor healthcare center of oakland, but haven't heard back. it's part of a chain of skilled nursing facilities operated by brius management company, among other affiliates. >> they have, you know, a history of failures of care that not only involves resident on resident abuse like this case, but other areas of neglect as well. >> in 2018, the centers for medicare and medicaid services fined the facility for failing to be in compliance with medicare requirements and determined its deficiencies caused actual harm to one of its residents. >> we know that these nursing home operators, especially the large ones like the one that's involved here, that they respond to their pocketbook. and so we try to hold them accountable in that way. >> according to the complaint, numerous red flags put the

corporate defendants on notice of serious problems at their facilities, including windsor healthcare. brius facilities have been the target of multiple civil lawsuits, as well as state regulatory actions arising from resident injuries, sexual assaults, felony abuse and resident deaths resulting from their deliberate and habitual understaffing of facilities. an abject failures to ensure resident safety often it's because of lack of staffing, the complaint also says the defendants new windsor health care was troubled, but kept admitting new residents without increasing staffing and hid the problems from prospective families, including cheryl's. >> she's an elderly woman. she doesn't deserve to be done like that. >> cheryl was removed from the facility after her son says he learned of the second alleged assault. he says she's continuing her recovery at home now and says she is doing better. but it's been very tough. yeah absolutely. >> okay, stephanie. thank you. >> well, if you have a story for stephanie and the i-team, you

can call this number on your screen 1888 40 i-team or go to abc7 news dot com slash i-team. >> convicted killer scott peterson appeared in san mateo county court today seeking a new trial, appearing via zoom. peterson only addressed the court a few times. he was convicted of killing his pregnant wife, laci, in 2002 and dumping her body in san francisco bay. the los angeles innocence project filed a brief on his behalf with numerous exhibits and claims. evidence was withheld from peterson's lawyers. prosecutors with the stanislaus county district attorney's office who tried the original case, raised questions about the filings. >> the defense was entitled to those at the time of trial. mr. peterson has been waiting 20 years to find some of these police reports and audio recordings and video recordings that should have been provided. >> the people have never been provided with an unredacted copy of those reports. we still do not know who these witnesses are. they're anonymous to us. >> nothing was decided during today's hearing other than the judge setting additional dates. relive the original scott

peterson case and follow updates for the current case. you can find it all on abc seven news.com. >> all right, well, some of us woke up to rain this morning and it could be the last storm of the winter season. >> can you believe it? abc seven news meteorologist sandyha patel has a look at our weather. >> sandy. yeah, and dan and emma. spring starts in exactly a week and we're going to start to notice. it's going to feel like it right now. live views from our tower cameras. all views are dry except homewood where you're seeing those snowflakes right now. but that view from golden gate bridge pretty much tells you what's coming. a lot of sunshine. and as we look at live doppler seven, sierra is seeing snow showers right now. the showers that we had last night and into this morning, long gone. but i do want to show you what it left behind. uh- almost a half an inch there in kentfield. bren loman picking up a half an inch, 3000/800 in san francisco. a few hundreds. concord, livermore, san jose, napa 2000/700 in santa rosa, 2000/500 of an inch. winds are gusting behind that system. 31 at oakland right now, as well as

novato, a wind advisory is going up with north northeasterly winds developing. so that starts tomorrow night at 5:00. it runs until 11 a.m. friday. gusts 45 to 50 miles an hour. there is potential for a few tree limbs going down and some outages. here's an hour by hour. look at those winds ramping up and they'll get even stronger. i'll be back with a full look at those hourly winds coming right up. >> dan okay, sandy, thanks a lot. the city of berkeley today took action in the effort to return some land to indigenous people. the city council unanimously approved a plan to return to the ohlone people, land that is now a parking lot for thousands of years, the land was burial and ceremonial grounds. one of the ohlone elders reacted to today's news. >> i thought we were going to be fighting and fighting and fighting. yeah, but i'm so happy. so, so happy. i think it's a great thing that they did. yeah and i know that there's people out there that really care. >> the current owner of the land will receive $27 million in

exchange for the property. the majority of the money will come from a trust that works to return land to native peoples. berkeley's mayor and ohlone tribal leaders have scheduled a news conference for tomorrow morning to give more details. >> action tonight by the antioch city council could help build a better bay area. like many bay area cities, antioch has been trying to stop sideshows on its streets for years. at tonight's city council meeting, which begins at 7:00, there will be an important vote that takes a big step forward in punishing those who take part. abc seven news reporter anser hassan has more. >> reporter for years, mayor lamar hernandez thorpe has condemned sideshows on antioch streets. don't come to antioch because we'll be waiting for you with the full force of the antioch police department, our allied agencies, and the appropriate resources to ensure that that does not happen in our community. state law already criminalizes sideshows. those convicted can face penalties that include up to 90 days in jail, $1,000 fine, or both

have their driver's license suspended for six months. the city says there's also public safety concerns, citing statistics put forth by the chp over the past five years. there have been 264 collisions statewide linked to street racing and sideshows. 30 people have died, 124 seriously injured . antioch's proposal goes a step further. it will go after those who organize and advertise illegal sideshows on social media. >> it's a big time show and who can top the other media. >> mark pereira has lived in antioch for 30 years. he can see tread marks in the intersection near his house. he supports the city's proposed ordinance. >> where there's a will, there's a way, you know, they can find a way. they'll do it and it, but it won't be as bad. and if they bite it real quickly, yeah, i think it could be stopped. >> some have raised concerns over freedom of speech and expression, but the ordinance states that organizing an illegal sideshow is not legally protected speech. >> law enforcement will have

if at the bay area by allocating half $1 billion to extend caltrain to the salesforce transit center. the underground floors were built to accommodate caltrain, but they are currently empty. caltrain service ends at fourth and king streets. it would need to extend one and a half miles to reach the salesforce transit center, and in the meantime, caltrain says newer, improved trains are on track to start serving passengers in just months. abc7 news south bay reporter zach fuentes explains what a difference electric trains will make. reporter faster, more reliable trains have been promised for years now, teasing anxious caltrain passengers out with the old, in with the new. >> everyone is ready for new and the new is almost here. >> electrified train service bringing big improvements to caltrain system. faster, cleaner, greener. quieter. more comfortable with some great new amenities. and we really can't wait to get people on board to see for themselves how great

it's going to be. those amenities will include wi-fi, power outlets at every seat, increased storage capacity, and on board displays with digital trip information. >> that's what we need out here is the big tech technical world up here in the bay area. and we need this new environment, this new technology here. >> caltrain says the trains are well on their way to the eager passengers. now that a big testing milestone has been reached. we did the first live run test from san jose up to redwood city this weekend. >> the big, big impact of that means that we are now able to test our trains along that whole corridor. >> a big deal because caltrain has to test the electric train sets for a mandatory 1000 miles before they can take passengers. now that it can test the trains within the large testing area between the two cities, caltrain can meet that requirement and launch the new trains this fall. >> four of our trains have been at train sets, have finished the 1000 miles necessary before they can enter into passenger service . all 23 will need to go through that. so we're going to be running that testing as you know, as we lead up to the fall

where the launch is once electrified service is launched. >> the older diesel trains will only operate south of san jose, covering gilroy service. everything else between san jose diridon station in san francisco will run on the new electric trains. >> we've got a lot of people really excited about what you know, about what the future of caltrain is going to look like, and once they see these trains for themselves, we're pretty sure everyone else is going to be excited, too. >> in san jose. zach fuentes, abc seven news. >> parts of south san francisco are going to get a makeover under a new pilot program. state officials unveiled the reconnecting communities project today. south san francisco is one of three california cities where underutilized highways will be converted to restore community connectivity. the state secretary of transportation says the program is one of a kind. >> the first of its kind in the entire country where state is saying yes, we've had some harms, we've made some mistakes, and we're here to correct some of those mistakes and harms in partnership with the community.

>> the plan in south san francisco is to reduce access to barriers created by highway 101, el camino real and railroad tracks. >> well, if you're a little tired of the rain. good news. yes, it's over for a while. >> i've been waiting for this. sandhya. >> yeah, i know a lot of people have been waiting for this. and dan and we are expecting a streak of sunny days and warmer conditions. so let me show you a live picture from our santa cruz camera. you will get a chance to soak up the sun and enjoy. look at this beautiful view. i mean, there are some clouds left over from the system that came through last night into this morning, but certainly is brighter than it was, and we are expecting plenty of sun over the next couple of days. here's why. high pressure coming in and it is building. you can clearly see the storm track is now well to our north and it's going to stay to our north. but notice wind blowing from high to the low. we're sort of packed in between and so as that pressure gradient

tightens a bit, we're going to get caught in it. and the winds are going to go up right now on live doppler seven, we do have leftover clouds. here's a look at the winds increasing over the next few days. so let's start you out with tonight. it's going to be breezy like we have been seeing tonight over 30 mile an hour. winds along the coastline at midnight. now we head into tomorrow evening and the winds are okay. but then they really ramp up thursday morning, 35 almost 40 miles an hour. the higher terrain will see stronger wind gusts. we go into thursday afternoon. and that wind is a it's an offshore flow. so it's a northeasterly wind that is going to dry us out. it's going to warm us up. the good news is the fuels have a lot of moisture from the recent rain. so that lessens the fire danger but certainly will be gusty even going into friday morning and 11 a.m. you will notice those winds peaking at around 40 miles an hour at calistoga on friday. and then after that, we'll drop off those winds. a beautiful view from golden gate bridge camera

mid 50s right now in san francisco, san jose 60, oakland 57 degrees. the temperatures were in the 50s and 60s today, still a few degrees below where they should be. a lovely view from san jose right now where you're seeing the sun there. 62 in santa rosa, 60 in fairfield, the rest of you in the 50s. and from walnut creek. camera. you can certainly see a nice view there tonight. breezy. patchy fog forming tomorrow through friday morning. gusty offshore winds and the next several days. we are expecting sunny and springlike warmth, so let's go hour by hour, 7:00 tonight. temperatures in the 50s overnight. you will notice those numbers are dropping, but the fog starts to form. so tomorrow morning when you get going, watch out for some patchy fog, 30s and 40s for most of you around that time. and then in the afternoon it warms up nicely. i'll show you where those temperatures ultimately end up. first, let's talk about your morning numbers in the mid 30s around ukiah, lakeport. the rest of you, upper 30s to the upper 40s. we'll call it partly cloudy with the fog and some clouds around tomorrow afternoon. mainly sunny, occasional high clouds. most of

>> those living in rural areas of san mateo county are no stranger to power outages. >> a frequent power outages means that we have use of our landline, only a lifeline that could be going away if the california public utilities commission approves at&t proposals to relieve them of the obligation to maintain landline service. >> on monday, we introduced you to the vail family of woodside. they also rely on their landline during power outages. >> so last year we had an eight day outage. there are seven days we would not have any kind of communication for police, fire or ambulance concerns that were amplified at the san mateo county board of supervisors meeting tuesday. >> and we do have a landline. and if it wasn't for that, i would not feel safe, on the coast at all. >> i see it as a threat to the public health and public health of safety. who for residents who live in our rural areas and our semi-rural areas. >> at&t gave a presentation to quell concerns. >> we're not allowed just to

turn off a customer and walk away, explaining that 27 years ago, 15 million california lives depended on landlines. >> now that number is closer to 500,000. >> the application seeks to be able to have that relief. if we are able to prove that there is an alternative that is as good, equal to or better than the landline, that somebody has in their phone today, they say the goal is to transition to more advanced new services. a landline, while it's, you know, feels like it's great and secure. it's actually not. i mean, you can't leave your house when your house is burning down with it. it's not perfect. >> meanwhile, county supervisors directed counsel to bring a resolution forward to formally oppose at&t s application to make sure rural residents don't get left behind. >> we absolutely know there will be, and we're fighting for them every day on this. >> the california public utilities commission will be holding a public hearing about this issue on march 19th in redwood city. lena howland abc

reporter dustin dorsey explains how this may work. >> the clock may be ticking for tiktok. a new bill would force the social media app's chinese based parent company, bytedance, to divest in tiktok or face a us ban. tech expert omid bernafas said. this could ultimately cripple the app that has 170 million us users, more than any other country in the world. so it's a critical problem. it doesn't mean that they're going to go to the phones of every single user and uninstall it. >> the government will ask apple and google to remove it from their app stores, so there is no more update. the app itself is going to start becoming outdated and it's going to start becoming less attractive, and it's going to die out over time. >> this is not the first time the app has faced a ban. in 2020, an executive order from president donald trump was ultimately blocked by the courts. this time, tiktok is fighting back. >> did you wake up with this message on tiktok today? >> the app is calling on its users to reach out to their local congress person to fight the ban. if tiktok is banned, it would be a huge blow to

official joe biden clinched the 2024 democratic nomination today, winning enough delegates in georgia's primary to put him over the threshold. >> donald trump could clinch the republican nomination today as well, setting up a rematch of the 20 20th november election. the former special counsel in president biden's classified documents case defended his investigation. today on capitol hill, robert hurt testified before the house judiciary committee. he stood by his decision not to bring charges against the president and for his description of biden as a, quote, elderly man with a poor memory. >> my assessment in the report about the relevance of the president's memory was necessary and accurate and fair. >> democrats attacked his assessment as partizan. he is a republican and served in president trump's justice department. but gop lawmakers had problems with the report, too, questioning why biden wasn't charged for his handling of classified documents while trump was heard chose not to prosecute biden because his attorneys promptly returned the

records after discovering them. trump, on the other hand, is accused of willfully keeping his an obstructing justice department efforts to get them back. >> new statistics from the governor's office tonight about the impact of that surge of chp patrols and what it's doing to crime in and around oakland. cooperation between agencies is really making a difference, it seems. abc seven news reporter leslie brinkley goes inside the numbers today. >> the california governor's office said chp sting operations have led to the arrests of suspects tied to carjacking rings and gangs in oakland in just one month, elevated chp presence in the oakland area has led to the arrests of 168 suspects, with 360 stolen vehicles recovered and 16 crime linked firearms successfully seized, individuals arrested for possession of, you know, drugs, guns, stolen property and then people arrested for outstanding warrants that they that they had

uh. >> this began with that surge that was announced about a month ago, involving a high number of chp personnel that went into the city of oakland onto city streets, not just on on the freeways. >> oakland's mayor reacted on social media, saying, together we are holding criminal groups accountable and disrupting their networks. 72 chp officers are currently assigned to the oakland area. enhanced cooperation between law enforcement agencies is solving crimes across the east bay. yesterday afternoon, a two year old toddler in the back seat of his mother's car in san pablo was kidnaped by someone stealing the vehicle on california avenue. >> the mother reported that, you know, she had, briefly dropped off an item at a family member's house when, you know, when the vehicle was taken with the child still inside. >> word went out to multiple agencies, and within 20 minutes, the car was recovered in richmond. with the child still buckled inside unharmed. oakland

police, using pings from the victim's cell phone, were able to zero in on the suspect in oakland. a pursuit ensued with three women in a car that was stolen from hayward on march 3rd. the pursuit ended with the arrest of a 35 year old woman. two other women escaped on foot. san pablo police are asking for the public's help. the suspect is being detained in martinez with $350,000 bail. as she faces kidnaping charges in the east bay. i'm leslie brinkly. abc seven news. >> an update today on people's park in berkeley. it's been months since it was shut down and blocked off. uc berkeley reportedly spent $6 million for the operation to block off the park with shipping containers. in january, the park was shut down to build new housing for students in the unhoused community. abc seven news reporter ryan curry has an update. >> if you go around dwight way and haste street, all you'll see are shipping containers stacked on top of each other with cameras all around the park.

>> the university made this unannounced move on tuesday. >> students and alumni stood in front of the barricade of shipping containers, asking the university to open the park. >> this space was actually cultivated by residents, community members, students. >> it's been over two months since the university closed the park. while they wait to start building a new housing project, uc berkeley plans to build over 1000 new units of student housing and 100 units of supportive, low income housing. that project is on hold, waiting for a ruling from the state supreme court. until that comes, people are not allowed in people's park. >> there was a lot of disbelief, like when we saw the plans of like the shipping container walls. we were like, no, that's that's going to be a psych out. this has to be a fake plan. like there's no way this is really what's going to be happening. >> in january. chp berkeley police and university police came in full riot gear to stop protesters and close off the park. a confrontation led to a few protesters being arrested. >> there was just vans driving up to white and then, like full gear, riot cops, crossbody rifles jump out and start

sprinting into the park. >> uc berkeley says these shipping containers, as well as the amount of police that night, was necessary because the last time they tried to fence off this park, they were met with heavy protest. in the summer of 2022. >> all of that was made necessary because when we tried to close the park in august of 22, there was an outbreak of violence and vandalism. >> now, questions are being raised over if the university has a developer to build this project. the university says they are the developers of the student housing building, but they're looking for one to build the affordable housing complex. >> we don't have a developer for that yet because we want to settle the legal issues first and then absolutely, we're going to find a developer. there's a lot of interest out there. >> meanwhile, the students and alumni say they want the university to look elsewhere. >> you have no developer, and that's really not what we want. we've told you like what we want and you're not listening. >> in berkeley. ryan curry, abc seven news.
