he was the special counsel who recently decided not to prosecute president biden for his handling of classified documents. but still went on to criticize biden's memory in his report. his decision not to prosecute angers republicans. his decision to bring up the president's memory angering democrats. and tonight, after the fireworks on capitol hill today, the white house now saying case closed. mary bruce leading us off. >> mr. hur, do you believe joe biden is mentally competent -- >> reporter: tonight, on capitol hill, former special counsel robert hur facing hostile questions from both republicans and democrats, as he defended his conclusion that president biden had mishandled classified documents, but should not be prosecuted. >> we identified evidence that the president willfully retained classified materials after the end of his vice presidency, when he was a private citizen. we did not, however, identify evidence that rose to the level of proof beyond a reasonable doubt. >> reporter: hur has come under attack from democrats for saying one of the reasons biden should not be prosecuted is because he "would likely present himself to

a jury, as he did during our interview of him, as a sympathetic, well-meaning elderly man with a poor memory." >> my assessment in the report about the relevance of the president's memory was necessary and accurate and fair. i did not sanitize my explanation, nor did i disparage the president unfairly. >> reporter: today, democrats unloading. >> you understood when you made that decision -- didn't you, mr. hur -- that you would ignite a political firestorm with that language, didn't you? >> congressman, politics played no part whatsoever in my investigative steps. >> reporter: but today, republicans furious, too. asking should biden not be prosecuted just because he's sympathetic? >> one of the points you make is president biden's likely to be an elderly, sympathetic figure with a poor memory. but how does that bear on any individual's guilt or innocence? isn't that, again, a question for a judge or jury to decide? >> reporter: democrats

president went into great detail with his answers? >> reporter: david, the transcript of the president's five-hour interview really paints a nuanced picture. there are moments where the president's millimeterry lapses. for instance, allhe can recall day his son died, he struggles to remember the year, and has to be prompted by the staff. but the president offers vivid descriptions of years-old events. he's conversational, he jokes around with the interviewers, and yes, he does go off on tang tangents, but that is not unusual for this president. david? >> david: mary, thank you. to the other news this tuesday night, and to the images just coming in at this hour. the moment of the blast, after a deadly home explosion outside pittsburgh, killing two. the staggering damage tonight. the home in splinters, only the foundation left behind. the bodies of a man and woman found inside, and the description from the neighbors tonight, what the blast felt like far and wide. here's erielle reshef. >> reporter: tonight, a smoking crater is all that remains of a home after a massive explosion

rocked a neighborhood outside pittsburgh, killing two people inside. >> i'm on the scene, and i got a house on the ground. completely on the ground. >> reporter: the home in crescent county, township, detonating just before 9:00 this morning. shock waves felt for miles. firefighters from multiple counties responding within minutes, saying they could feel the blast in their chests. >> we all felt and heard the explosion instantly. the column of white smoke up in the air, followed by the thick column of black smoke. >> reporter: john bundy was working at a nearby factory and thought a truck hit his building. >> that was my main concern when i came out, is, like, is everybody okay? and i looked to my left and that's where i saw, literally, it was a mushroom cloud. >> reporter: debris scattered on the ground and in the trees. the explosion damaging at least two additional homes and setting fire to part of a nearby hillside. authorities say a man and a woman were found dead at the scene.

david, still no confirmed cause of that explosion. the house was connected to a private gas well, and there were propane takes on the premises. david? >> david: erielle, thank you. now to the new troubles for boeing tonight. a longtime worker turned whistle blower, allegie iing safety iss found dead. it comes amid a new report tonight, an audit of boeing's production line, and what it found. here's trevor ault. >> reporter: tonight, a boeing whistle blower now dead from an apparent suicide only days after his lawyer says he'd been deposed. john barnett worked for boeing for 32 years, and was involved in a lawsuit alleging serious safety concerns with the 787 dreamliner, and retaliation from the company. his lawyers say barnett was "in very good spirits" and "we didn't see any indication he would take his own life." but police in south carolina say he died saturday from a self-inflicted gunshot wound to the head. his body found inside a car in a hotel parking lot.

in january, just weeks after a door plug blew off an alaska airlines boeing 737 max-9, barnett spoke with "tmz live." >> what we're seeing with the door plug blowout is what i've seen with the rest of the airplane, as far as jobs not being completed properly, inspection steps being removed, issues being ignored. >> reporter: since that incident, a six-week faa review of the boeing production line has raised new concerns. "the new york times" reporting boeing failed 33 of 89 audits, and boeing supplier spirit aerosystems, which builds the 737 max fuselage, failed more than half of its 13 audits. >> as difficult and as painful these inspections are for boeing, they will help them get back to basics, to be able to begin to earn the trust of the faa and the flying public. >> reporter: david, boeing says they are saddened by john barnett's passing, but his

attorneys say they're shocked. they're calling for a full police investigation into his death. david? >> david: trevor ault tonight, thank you. overseas tonight, and there is word an american citizen who, for a long time, was believed to be a hostage, was, instead, killed in the attack on israel by hamas on october 7th. his body held by hamas in gaza ever since. matt gutman from israel tonight. >> reporter: tonight, the idf announcing dual citizen itay chen -- one of several american hostages believed alive in gaza -- was actually killed in fighting during hamas's october 7th rampage. hamas then taking the 19-year-old soldier's body into gaza. in the weeks after the attack, we spoke to his father. are you hopeful that you will ever see your son again? >> oh, that's -- no -- no option to think otherwise. i am positive that i will see him back again. >> reporter: with a hostage release and cease-fire deal stalling last week, tonight, israel's prime minister again insisting that israel will invade the southern gazan city of rafah, where 1.5 million

people are seeking shelter, and hunger is epidemic. that as aid to gaza now arriving from land, air, and sea. for the first time, a hip is en route to deliver aid directly to gaza. working in coordination with the israeli military, the ngo world central kitchen is sending 200 tons of rice, beans, flour, and proteins, set to arrive in gaza as early as tomorrow. our team in gaza filming trucks carrying landfill to northern gaza to build this makeshift anchorage. >> once this gets here, it will be offloaded by crane. it'll be put on trucks and we'll be taking that into northern gaza. >> reporter: and the u.s. set to build another temporary pier off the coast of gaza. hours ago, 500 u.s. troops deploying from virginia. david, back to that world central kitchen aid ship, it's part of a major pilot program approved by israel, and the hope is to start a maritime convoy of ships delivering aid directly to northern gaza, where the hunger is most severe. david? >> david: matt gutman, thank you. we turn now to russia, and tonight, word of two simultaneous attacks inside

russia by fighters supporting ukraine. and this evening here, the body camera video showing those fighters storming over the border. and russia responding with a deadly missile attack in president zelenskyy's hometown. and president biden's announcement tonight that some u.s. help is now on the way, while congress continues to largely stand in the way of aiding ukraine. here's james longman. >> reporter: tonight, two simultaneous attacks inside russia. pro-ukrainian militia launching a major incursion as the ukrainian military fired a wave of drones, two of the biggest strikes yet inside russia. body camera video showing those pro-ukrainian fighters storming across the border. russia claims it repelled the attack, killing more than 200 fighters, though it's still not clear if the situation is under control. as that barrage of ukrainian drones hit multiple locations, setting this oil refinery ablaze. it's the biggest challenge to vladimir putin on russian soil since last year's failed wagner coup. and comes just days before russia's presidential election.

to this tonight, the biden camp asking major questions on this? >> reporter: yes, david, because it is highly unusual for a foreign leader to travel to the united states and meet with the president's political rival, especially in an election year. far-right hungarian prime minister victor orban has been sharply criticized for embracing russian president vladimir pu putin. just days ago, president biden on the campaign trail said orban is looking for dictatorship. trump has said he could end the war in ukraine within 24 hours. orban said the former president laid out a plan to cut off aid to ukraine, saying, that's why the war will end, because it's obvious that ukraine cannot stand on its own two feet. the trump campaign tonight not denying that the former president said those words, telling us that if trump is re-elected, it would be his top priority to negotiate an end to the war, but still not providing any detales on just exactly how he would do it. >> david: rachel scott, thank you. next tonight, we showed you the horrific images from haiti last night here. well tonight, we have learned the prime minister of haiti has

agreed to step down as soon as a transitional council is in place. prime minister ariel henry is in puerto rico, unable to return. politicians in haiti are now scrambling to be part of this new government. gang members tonight saying the violence will end only if they have a seat at the table. back here in the u.s., and to a case that made national headlines for years. well tonight here, 20 years later, convicted killer scott peterson facing a judge today, fighting for a new trial in the murder of his pregnant wife. the innocence project has now taken up the case, citing new evidence. kayna whitworth in the courtroom. >> reporter: 20 years after he was convicted of murdering his pregnant wife and unborn child, scott peterson today appearing before a judge by zoom to fight for a new trial. >> good morning, mr. peterson. can you both see and hear the proceedi proceedings, sir? >> yes, your honor, i can. thank you. >> reporter: peterson is serving life in prison. but the l.a. innocence project is now leading his defense, arguing new and overlooked evidence could exonerate him. >> mr. peterson has been waiting

20 years to find some of these police reports and audio recordings and video recordings that should have been provided. >> reporter: the defense wants new dna testing on blood found in this burned out van, discover neers the family home the day after laci disappeared. the fire investigator telling me he believes the evidence should be reassessed. >> this has always been one of those things that kind of sits in the back of your head and kind of bugs you a little bit. >> reporter: peterson has always maintained his innocence, sitting down with our diane sawyer. >> everybody sitting at home wants the answer to the same question, did you murder your wife? >> no, no. i did not. >> reporter: a few months later, the bodies washing up on shore not far from where peterson claimed to have gone fishing the day laci disappeared. the former detective on the case says he welcomes new dna testing. >> the big thing is, test that blood. if we have the wrong guy, i want the truth to come out. i just don't have any doubts. >> reporter: and david, the innocence project thinks that a burglary across the street from the peterson home could be

thanks for joining us. i'm larry biel and i'm ama daetz convicted killer scott peterson appeared in san mateo county superior court today asking for a new trial. dan noyes was in court. he's been going over the latest filings and this is a case you've obviously been covering for quite some time. so what's the latest developments and what's the likelihood that this ends in a new trial? >> well, larry and anna, this was mostly planning today. you know setting daetz for future legal briefs, replies and hearings. it's just an immense undertaking, going through all the evidence to decide if peterson deserves another trial on my cell phone, i captured the executive director of the los angeles innocence project entering the courtroom with scott peterson's half brother and his sister in law, janey peterson. she became a lawyer to fight for his acquittal. inside, scott peterson, now 51, appeared from mule creek state prison, 40 miles outside sacramento, with that new ponytail. he only addressed the court a few times here to say he would also appear at future hearings by zoom. >> mr. peterson, is that correct ? all right. yes, your honor. okay. >>
