we want to talk to the city and the only way they are going to give us any attention is if we resist. >> now to developing news. a shooting that led to the death of a five euro girl is still under investigation. it happened on 880 near milpitas while the family was on their way to dinner over the weekend. zach fuentes has the latest on what we know. >> five-year-old eliana would have turned six on april 21 appeared know her family is mourning her tragic death. friends say the family was on their way to dinner as they drove along eight a.d.. a vehicle pulled up and someone inside the car started shooting. >> we had an officer on an unrelated traffic stop on the side of i-8 80 in the vicinity of fremont area. approached about 6:40 pm by the victims family. they said their daughter had been shot. the five euro

transported to a local hospital and succumbed to her injuries. >> we still don't have suspect information. this was one of multiple shootings agencies are investigating. before the deadly shooting fremont police heard from a pedestrian who said a car pulled up to them and shot at that person after some kind of confrontation. that call came in at 6:37. hours later after a pursuit, santa cruz police stopped a car with three people they believe were connected to the shooting. all three were arrested. chp is making clear it is not making any connection between the fremont shooting and deadly shooting. dr. thomas plant says there is not a particular profile of someone who might shoot in a public place like a roadway. >> impulse control is a variable. in other variable is people influenced by those around them. egging them on to do something. the third is people who have don't have any feel for other

is going to need surgery on. >> the defense attorney says the district attorney indicated he may have pepper spray dodi before the incident and the attack may be in self-defense. the da considers him a public safety risk and once him held in jail while the case moves forward. >> tomorrow marks one week since the murder of a tech executive. police remained tightlipped on details about the fatal stabbing of 43-year-old bob dudley. he was found stabbed last tuesday on main street near harrison. lee was an executive with mobile coin. he died at the hospital. tomorrow night organizers are planning a slow ride on our gallo boulevard in san francisco in response to the death of a cycling champion last tuesday. a car crashed into him in the presidio. it has renewed calls by the san francisco by coalition for protected planes for cities -- for bicyclists in the city.

>> this is a sketch of the man which palo alto police believe sexually assaulted a woman on easter sunday in what is known as a popular california avenue underpass before 3:00 in the afternoon. >> the victim did see the suspect and she described him as an asian male. 30 to 40 years old. 5'5" with a stocky build >> police say the victim was just following the rules of the road. dismount her bike and was walking through this underground tunnel when she came face-to-face with the suspect before being violently attacked. >> she was pushed or struck from behind and not down on the ground. she was sexually assaulted. >> when the victim screamed for help the suspect grabbed her phone and took off. a passerby went to give her help and called police. her phone was found less than a mile away within 20 minutes of the attack. >> crime in the tunnel is very

rare and a daytime sexual assault is extremely rare and it is so brazen to be in this tunnel on a sunday. > the victim laceration -- suffered a laceration to the back of her head but was back working with detectives to develop this sketch monday morning. >> seems wild to me someone would randomly attack someone like that. >> with a popular park filled with kids and families right next to this underpass and a community farmers market which happens on the others did every sunday, neighbors we spoke with said this type of crime does not happen here. >> it is a very safe neighborhood usually everyone is nice and friendly. >> occasionall through here quickly on their bikes and there is the occasional collision between a pedestrian and a cyclist but that is just an accident. yesterday was violence. will be stepping up patrols in this area as the search continues for the suspect.

representatives reappointed monday night. justin jones sworn in on the steps of the tennessee capital. the gop expelled justin jones and justin pearson who protested for more gun control using bullhorns after their microphones were turned off. i'm the wake of a deadly nashville elementary school shooting that killed six people including three children should voters in district 52 elected justin jones to be their voice. at the statehouse. that voice was taken away this past week so let's give them their voice back. meeting by the nashville metropolitan council, justin jones was unanimously reappointed as an interim tennessee state representative. this after the majority of the 39 member nashville metro council indicated their support. >> with this vote we will send a strong message to our state government and across the country we will not tolerate threats to our democracy.

make it too hard for customers to fix their own devices. now california lawmakers are reviving a so-called right to repair bill. it would require companies to provide tools and instruction manuals so repair shops could fix all appliances. >> a lot of people if they have the option, they would want to just repair it. people are being pushed into buying new because repairs are so expensive. >> manufactures have pushed back saying modern machinery is too complex for third-party repairs and companies own rights to their patents and software. proponents say manufacturers should not stand in the way of consumers trying to repair their own belongings. >> they restrict access to the manuals that repair shops need to fix things like tablets or computers. and then there are software locks where they can electronically lock you out from repairing anything. >> he says consumers throughout
