suspect was in custody after 13 months those feelings of relief have since been replaced by concern after meeting with the alameda county district attorney's office this week. they became aware of new guidelines, which could drastically reduce sentencing for those arrested in the case if that happens, you know, if the new das that's the direction that she goes lowering the sentencing what kind of message we're ascending to the public. i obtained this internal memo which indicates prices intention to bring balance back to sentencing and reduce recidivism by not allowing prosecutors to file or require defendants plead to sentencing enhancements this includes for gang activity or gun possession. anthony brass is a criminal defense attorney and explained why enhancements matter enhancement and time to ascendence if i run up someone um that carries a certain penalty, but if i rob someone with a gun it adds an additional 10 20 years to the experience according to brass a gun

questions her office later sent me a statement saying she was unavailable for the rest of the day in the newsroom tonight dion lim abc 7 news. well, we hope to ask for those questions soon. don't we dion? thank you very much. we've put together a timeline of the crime based on the district attorney's investigation. you can read how it unfolded by looking for this story on our website abc7news.com. new at six the alameda county district attorney is filing a second hate crime charged against a man accused of assaulting two people in 2021. the previous da had filed a hate crime charge against a quail khan for punching a woman several times in the face at central park in fremont month months later khan was arrested for ramming his vehicle six times into 54 year old corey brown brown survived authorities released video of the attack today, but we are not showing it because of how graphic it is. the da says khan had assaulted the victim. he had previously been threatened and and abused with

racial slurs by mr. khan. his vehicle had been vandalized with racial slurs. khan also faces charges of premeditated attempted murder and assault with a deadly weapon. abc 7 news stands up for those victimizes especially on the basis of race to be an ally go to abc 7 news.com/take action. all right, let's move on now. we are on storm watch once again because rain returns tonight and we're watching an atmospheric river approach, which will bring a strong storm before the weekend abc 7 news meteorologist. sandia patel is tracking it all for a sandia. yeah, dan and alma get ready for intense rain rates and strong gusty winds as that atmospheric river hits later on this week right now. we are sort of in a lull. we do have some clouds overhead in a few showers up to our north right around the lake county area, middletown highway 29 lower lake. they are seeing a mix of precipitation. this is just shower reactivity and association with a light level one storm, but we are watching for a stronger storm

that's coming in later. so let's talk about the immediate concern which is scattered showers not just later on tonight, but tomorrow morning's commute give yourself extra time light to moderate showers snow over mount hamilton and then system is gone quickly atmospheric river comes in thursday afternoon evening going into friday. this is going to be a strong ar it is tapping into a warm moist source of air and it is going to soak us a flood watch has already been issued for the entire bay area 1 pm thursday until 9 am sunday as you take a look here. these are some of the concerns late in the week roadway flooding and trees down and outages very high likelihood. we're going to see that stream in creek flooding river flooding high likeli. in some of the rivers that were concerned about are the russian river and the napa river up north mudslides and debris flows a high likelihood as we take a look at the sierra. the concern here is the sierra snowpack is at 192%f average. statewide snow levels will be rising and they're going to

start out with snow and then rain snow mix as the snow levels rise. you're going to start to see some flooding as that snow obviously starts to get wiped away by some rain as well. i'll be back with a closer look at the watches and warnings coming right up, dan. okay, sandy. thank you very much. we'll see in just a moment roads are open into the sierra right now both 80 and highway 50 have no chain controls at the moment. we've seen that change in mere hours though and the chp wants to make sure that if that you know that you're headed to the snow you should be prepared with chains and emergency supplies as well. now as for yosemite the earliest possible date for yosemite national park to reopen to the public is next week. it is just under snow as abc 7 news reporter leslie brinkley found the concern now both more snow and melting snow. yosemite shut down february because of blizzard after blizzard and now there's an atmospheric river on the way. there's nowhere for visitors to

park right now when i was up in yosemite valley yesterday. i it was crazy. there's nowhere to park the the snow levels are so high we're doing damage assessments. we are digging out fire hydrants and propane tanks. so it's all hands-on deck to plow the snow but crews are also with the same time setting out sandbags because the approaching storm could bring heavy rains to elevations on up to 8,000 feet and that could trigger a massive snow melt event the same scenario took place in january 1997 warm rain accelerated snow melt the runoff caused the merced river in creeks to overflow taking out bridges and roads destroying half the accommodations in yosemite national park. half the campgrounds 2100 visitors were stranded the park was closed for two months. i heard one of my colleagues say, you know, you've been here a long time when a hundred year

event is happening again, so we we're definitely concerned about that and looking at at the modeling. i do believe right now. there is more snow that then we had in 1997 for yosemite valley. there's not a large reservoir upstream to dampen. that snowpack snow melt. i think you should look for road closures. overall. we'll just have to wait and see we have plans in place from the 97 flood with best case scenarios and where to set up sandbags and and all the different plans. we need to set up throughout the entire park if all goes well yosemite could reopen march 13th if there is flooding then all bets are off it could be closed for longer. i'm leslie brinkley abc 7 news people in santa cruz county are preparing for the upcoming atmospheric. river crews are still repairing damage from storms that hit the county in december in january another storm could knock down

more trees and power lines. some people say they're prepared this time around generators. we have a solar panels in our roofs we have lots of freezers january's storms left thousands without power and it took several days for pg&e crews to make repairs city officials say they're stocking up on more resources including replenishing sandbags. it certainly appears 2023 has been one of the busiest storm asons of the bay area has ever seen but what are the numbers actually show abc 7 news reporter dustin dorsey spoke with experts to provide some perspective on how this year compares to others. when talking about the almost constant storms across the bay area and 2023. stop me if you've heard someone, you know say something like this before this is the worst i've ever seen it 22 years old. i have not seen this myself. we were expecting a flood but not like this. it's never been like this in some cases. this is true, and we've seen our share of records fall with one

month remaining in the states rainy season. the sierra snowpack is nearing the all-time record set. 1982 83 san francisco. saw the coldest record low on february 24th since the gold rush in 1891 and bay area wide 2022 2023 has brought the highest precipitation in winter months in the last decade. however, san jose state department of meteorology and climate science professor allison bridger says, it's not quite a never ever kind of year after three or four dry years in a row here suddenly. it's raining like crazy and people have no idea if that's normal usual or walk and just peanut the records it is kind of usual but what's unusual are some of the devastating impacts from these storms abc 7 news uses an exclusive storm impact scale showcasing what the region will see from each storm. our own spencer christian says our scale has never recorded higher impact numbers than this year and that may make the community see these storms as

the flames rising from a san francisco fire this morning. this was on polk street near california just after. san francisco firefighters were on scene within two minutes of the 911 calls.

they rescued three people from the top floor of the three-story building. no one had to go to the hospital. it's unclear. what started that fire. bi even though stocks performance was nothing to cheer about today after the fed chairman told the senate banking committee that a larger than expected interest rate hike is likely this month the dow lost 575 points the nasdaq fell won 45 and the snp dropped 62 today. the justice department filed a lawsuit to block the merger between jetblue and spirit airlines. spirit airlines is a low-cost carrier that the federal government says has helped lower overall fares by other airlines on competing routes, but the goj is afraid customers will see higher fares if spirit is swallowed up by jetblue the proposed merger would create the fifth largest airline. jetblue has already tried to buy spirit airlines twice in just the past six years, california,

senator diane feinstein is out of the hospital. she was hospitalized last month with the case of shingles the senator tweeted this morning that she's recovering at home while continuing to receive treatment the 89 year old thinks. everyone for the well wishes and is looking forward to returning to the senate. we wish her a speedy and full recovery. yes. let's try our attention back to the weather and another strong storm heading this way. yeah, we are in for it sandia. yeah. it's a level three that is headed our way. so dan and alma. let's take a look at live doppler 7 it is going to be fed by an atmospheric river that moisture source is a warm moist air. it's subtropical in nature warm air holds more moisture than cold air. so we're in for quite the soaker. we're gonna see strong winds. let's start with the flooding threat within 25 miles of a point between thursday and friday. there's a slight risk about 15% for the bay area and even some of the surrounding areas. so be ready for heavy rain strong winds flooding on roads and streams mudslides and debris

flows in recent burn scar areas are some of the main concerns right now in live doppler 7. there are a few showers up to the north, but most of it is just a mix of cloud. and a little bit of sun break out there temperatures right now in the 40s and the 50s definitely chilly out there as we take a look at a live picture from our golden gate bridge camera, you're seeing that mix of sun and clouds wintry mix late tonight through tomorrow morning stronger storm gets here thursday afternoon evening going into friday and flooding possibility of thunderstorms are things that we'll be watching for. it's a light level one for tonight on our exclusive abc 7 news storm impact scale through tomorrow morning scattered showers snow over our higher peaks and a chance. thunder and hail now when i say tonight, i mean late tonight. so as we go hour by hour seven o'clock, it's still up around mendocino lake counties as we head towards 11 pm. you start to notice some showers moving into the north bay. it'll be moderate. density for parts of the bay area 5 am some snow showers over mount hamilton so the snow level between 2,500 and 3,000 feet and

by the time the lunch hour arrives. you're already seeing sunshine tomorrow, so you might be thinking what storm. well, this is the time that you'll want to prepare if you haven't done so already for the next storm rainfall estimates for this current system through tomorrow afternoon. it's about 500 to a third of an inch not expecting a whole lot in the sierra, nevada. you will notice there's a winter storm warning going until 10 am tomorrow additional 10 to 30 inches of snow gus to 45 miles an hour will mean difficult to impossible travel conditions your morning temperatures as you get out the door in the 30s and 40s. it will be a little breezy. you will need your rain gear and don't forget to grab a sweater or jacket because it'll start out kind of on the chili's side tomorrow afternoon. you'll see the sun mixing in with some clouds. your wednesday is actually pretty nice day in the afternoon 40s and 50s and then we bring on the winds. this is the first sign that form has arrived as we head into thursday afternoon 30 to 35 mile an hour winds thursday night over 50 mile an hour winds 57

there and half moon bay friday morning still strong southernly winds and with those strong gusty winds you're going to see the potential for power outages downed trees. so be careful out there as we go hour by hour that atmospheric river feeding into the storm thursday afternoon dumping rain across the bay area dumping a mix of rain and snow across the sierra, which is a big concern. as they will likely see some flooding issues up there as a snow levels rise thursday night. you're still looking at heavy rain and going into friday morning as well with the sierra seeing that wintry mix of rain and snow and then sunday is when the system starts to wind down. all right, rainfall projections. this is taking you from thursday to sunday afternoon over a half a foot of rain and ben lomond many areas will be in that two to three and a half inch category. this is going to lead to flooding and the reason for that is the ground is already saturated you dump any more rain on top of that you're gonna have some problems. so be prepared for ponding on the roadways creeks and streams

prosecutors mayor london breed discussed the plan today in the tenderloin district which continues to see open-air drug dealing abc 7 news reporter lamb melendez looks out what it will take take to make the plan reality. what happens in san francisco's tenderloin neighborhood often has repercussions in the rest of the city at the heart of the problem is the open-air drug dealing we are short 541 cops and we are feeling it because as i said, it's not just about showing up in the arrest. it's also about the investigation the mayor is asking supervisors to approve a 27 million dollar budget supplemental to fund police overtime citywide and recruit officers that plan would also add more prosecutors and extend the ambassador program. the district attorney says since she took office the number of cases filed for drug sales has doubled but it all comes at a cost. i shouldn't have to take prosecutors off of murder cases.

i shouldn't have to take prosecutors off of vicious assaults against our elderly community in order to staff these cases the previous district attorney chase a fire for failing. prosecute many drug dealers coming from central america whom he said were themselves victims of trafficking by drug lords in their countries. supervisor matt dorsey today was heckled by a few protesters who came to defend san francisco's sanctuary city policies at all costs. i am fighting for the lives of drug addicts and not the livelihoods of drug dealers. i make no apology for it. dorsey supports the overtime pay for officers. noticeably absent was supervisor dean preston who represents the tenderloin district. he did not respond to our requests for a statement, but just last week said it is preposterous that a department that got bonuses raises and a 50

million dollar budget increase last summer would come back seven months later for an additional 27 million. the police shortage has been an issue for years. now police. chief williams. scott says his department is operating at 75% of what has been recommended. the only way that we temporarily bridge that shortcoming that gap. is through overtime? and we need the funding. that's what the supplemental is all about. and recruitment has been a challenge but the police chief says things are beginning to change since november 2022 four months ago. the number of applications to the police academy has doubled with nearly 1,000 applicants still the question is can they retain them? in the newsroom leanne melendez abc 7 news you fall out from the ash release that came from the martinez refinery around thanksgiving contra costa health now tells people living nearby not to eat food grown in their

own gardens a flare-up over thanksgiving at the martinez refining company sent 20 tons of thick white ash with high levels of metals raining down on parts of martinez and pacheco. the county's health officer says, there is no immediate health threat, but don't want people to eat homegrown produce until environmental testing results are back. those are still several months away. in parts of mendocino county the situation from the recent snowstorms is dire. some people have been trapped in their homes for days yesterday first responders had to rescue a woman who spent three nights trapped in her car after she got stuck in the snow abc 7 news. anchor liz kreutz has the story. in mendocino county as rescue crews made their way up this windy rural road to help three people stranded in the snow one woman spent three nights trapped in her car. they were very lucky. it happened in the town of laytonville right here on spyrock road in the northern part of the county authorities. say a woman was attempting to

drive to her elderly mother when she got stuck. she had no cell signal and could not call for help until more than a day. later. wasn't until monday that first responders were able to reach the woman authorities say thankfully she had some food and water in her car still she was very cold and showed signs of dehydration. efforts the woman had driven up with her daughter and her daughter's boyfriend when they got stuck the young couple decided to walk to and seek shelter in an empty home. they had seen a few miles away. they were also rescued on monday authorities say the incident is one of many scary situations happening in mend. no county from the recent snowstorms like in the sierra and the san bernardino mountains. the region has been pummeled by an unprecedented amount of snow leaving many people trapped in their homes. they aren't able to get out to

get food. some i've heard from ranchers that have cows up in the hills that are there are fearful that the cows are starving. john has track is a mendocino county district supervisor. he's asking governor newsom to include mendocino in the list of counties where he's declared a state of emergency. so yeah, i think focus needs to be you know on our area the concern now is the potentially warm rain that's on the way it could melt the snow and lead to flooding. it's been a very difficult winter for all of us this quartz abc 7 news. coming up next a story of survival in her own words. they said my face was blue my eyes were wide open and i was making snoring noises that noise is called a death rattle. that's abc 7 news reporter loose pena and next you'll hear her describe how a fun day of skiing nearly became the last day of her life quite literally.

hey everybody. so here's the story of what happened? four weeks ago. this was me skiing tahoe and loving this view. this was actually one of my last memories of that day. about five minutes after this video. i crashed head on into a tree. my husband and brother-in-law found me on top of a tree well motionless face down intertwined into multiple trees. they turned my torso around and decided not to touch my legs. that was critical, but they didn't know it then. they said my face was blue my eyes were wide open and i was making snoring noises that noise is called a death rattle. it's a sign that our person is approaching death. my brother-in-law kept asking me to blink and i wouldn't they thought i was paralyzed. my eyes remained open and while my husband held me in his arms.

stopped breathing they that i was unconscious for about 10 minutes out of nowhere while my husband was holding me in his arms. i arched my back and took a breath. he said i let out a cry that sounded like when a baby is just born and i mentioned my knee hurt. i began to come in and out of consciousness after this. meanwhile my brother-in-law yelled at a skier to call this ski patrol for help we had no reception, but i'm convinced that this year was one of the angels of the mountain that day. he had a satellite phone and a device with the exact coordinates of our location in the mountain. minutes later patrol arrived. her name is morgan. my husband said i didn't even know what a sled was or the month or what had happened. when morgan saw the state that i was in she called for a helicopter evacuation her team

immobilized my leg and skied me down the mountain in a sled. we were in the very top of the mountains so it took about 15 minutes or so to get down and they did such an amazing job. my husband and brother-in-law said they closed down the runs to avoid cross traffic and there were so smooth and never hate a bomb or an edge. and that was critical but no one knew it then. i was putting an ambulance and then airlifted to renown trauma hospital in reno. i don't remember any of this. the hospital i met the orthopedic surgeon dr. peter althoughson, and he said couldn't move i broke my tbr plateau and needed surgery right away. here's a 3d image of it. turns out a piece of the fractured bone was acting as a knife. and was one centimeter from cutting my artery one centimeter. saying that out loud even now is just so insane. and truth is there were so many moments where that could have

happened. remember when my husband and brother-in-law found me and decided not to move my legs. yep. let's keep patrol being so careful all the transfers from the ambulance to the helicopter helicopter to the hospital in all those moments a little bump could led to cutting my artery. my surgeon said that at a minimum my leg would have been amputated worst case scenario. my life could have been at risk. so thank you god for another miracle. there was a lot of concern also about my head after hitting it so hard. i was actually the main concern and the neurosurgeon said at a major concussion, but it was a miracle. i didn't have any internal bleeding. i'm convinced that god protected me and my helmet truly did make a difference side note, please ski and snowboard with a helmet especially one with mips technology. you'll know it has mips when it has a little sticker in the back. we had just got in ours a few weeks back and this technology protected my brain during the

what she's been through and what the road ahead looks like. i'll show you what i'm using right now my walker here it is. here's my little walker and he has a little duck and a horn look. so whenever i need extra help my husband comes over and he helps me but i can't i can walk for several months. i can put any weight on my leg because it's still healing. the bone is still healing. so that's happening right now, but it's going well and every day every day is honestly so exciting because i'm learning something new on bending my knee and i'm excited about bending it this much which is so ironic because the month ago i was just walking normally right and then now every little thing is just victory so it completely changes your mindset about everything in life. that's our loose just positive and what grit and grace she has shown through this. yeah, and the things you didn't even think about before and now changes some perspective certainly does you hang in there loose can't wait to have your back. but thank goodness. you're okay.
