they were stunned to hear gunfire. >> there's about ten gunshots. the cops running right there, look at that. >> word of the shooting triggered a massive police response. heavily armed officers swarming the scene. and armored vehicles blocking the streets. officers say when they showed up the shooter was still firing. >> upon arrival the officers discovered shots that were actively being fired and our ivers did engage in an officer involved shooting and discovered four victims that are deceased. one of those victims does include a child. >> police say the shooter is in critical condition. there's no word yet on a possible motive. more information as we get it. we turn now to minneapolis and the derek chauvin trial. >> the former police officer charged with killing george floyd has been heard publicly for the first time defending his treatment of floyd on that fateful day. his statement part of a series of graphic videos shown in court. this morning legal analysts

are weighing in on where the case stands but first a warning, some of the images that you're about to see are disturbing. this morning, day four derek chauvin trial with more witnesses set to take the stand after a day of dramatic and emotional testimony wednesday. including from charles mcmillan, a neighbor who saw george floyd struggling and urged him to comply with the officers. >> i was telling mr. floyd, mr. floyd, just get in the car because you can't win. - >> reporter: mcmillan was heard on the police body camera verd in court. >> i'm not trying to win. >> reporter: george floyd needed to plead with the officers as he refused to get in the backseat saying he was claustrophobic. >> don't do me like that. >> get in this car. we can talk. >> i'm claustrophobic. i'm claustrophobic, man. >> reporter: the officers then pulled him from the car. >> get in the car. >> i'm not getting in the car. aagh. oh, man.

>> i can't. feeling helpless. i don't have a moment. i understand him. my mom died june 25th. >> reporter: also on that body camera video the first publicly heard defense of officer chauvin's actions in his own words. >> i got to control this guy because he's a sizable guy. looks like he's -- >> reporter: jurors also saw video of george floyd before the tragedy unfolded inside the convenience store. chris martin who worked there said floyd was friendly but appeared to be high. he says floyd paid for the cigarettes with a counterfeit $20 bill and told his manager who called the police. the store worker then watched the tragedy unfold and

he says he felt guilty. >> what was going through your mind? >> disbelief and guilt. >> okay. why guilt? >> if i would have just not taken the bill this could have been avoided. >> legal analysts say chauvin's defense team says there was resistance from floyd even if it was passive resistance. chauvin's unemotional demeanor could hurt his standing with the jury. it continues today at 10:30 on abc newslive. we have new information about the scandal surrounding florida congressman matt gaetz. investigators are looking into allegations that gaetz had a sexual relationship with at least one minor including a 17-year-old which he denies. now sources say the investigation is looking into the congressman's conduct in the other case but in other states

as well. kevin mccarthy says he's waiting for all the facts. turning to the pandemic new quality concerns delaying johnson & johnson's covid vaccine. meanwhile, sarah palin is speaking out after testing positive for the virus. ike ejiochi is here with more. good morning. >> reporter: good morning, andrew. millions of doses of the johnson & johnson have apparently been ruined because of a mistake at a factory. it could take weeks to recover. this morning "the new york times" reports workers in a baltimore, maryland manufacturing plant actually mixed up ingredients for the johnson & johnson vaccine possibly ruining 15 million doses. the company says none of the vaccines in question made it into circulation. politico reports the biden administration was aware of the problem two weeks ago and getting the facility back on track could take weeks. >> two, three. >> reporter: it comes as it's revealed it's 100% effective on kids as young as

12 and now testing on 5 to 11. >> maybe by there summer they should be available for the preteen and young teenagers so parents should be ready to get their kids vaccinated. these will likely be safe and effective vaccines and could help kids get through the summer and certainly into school. >> reporter: a fourth wave of the coronavirus is looming. hospitalizations nationwide up 6% in the last week. still authorities are easing more covid restrictions. georgia's governor is limiting more limbs on gatherings. more americans are also traveling. united airlines now reports its first profitable month since the pandemic and delta will stop blocking middle seats on may 1st to accommodate more passengers but overseas, a more dire picture. france extending its lockdown and in brazil cemeteries can't keep up with the bodies as variants of the virus and lack of testing fuel a covid nightmare. abc's victor oquendo is in sao paulo. >> covid testing isn't free so for the poorest people

at the southern border. we're learning more about the children scene on video dropped over the border wall. here's abc's megan tevrizian. >> reporter: this morning, stunning images from the southern border showing the horror of human smuggling. an apparent smuggler on the mexican side drops a young girl off the border plunging 14 feet landing on her stomach. moments later a second and loy 3 and the sister of the other one from ecuador. the man seen running off with a second person back into mexico. authorities jumping in to help after seeing it unfold live on a surveillance camera and rushed the girls to a hospital and contacted their mother who is here in the u.s. >> they are healthy. they're good. they were eating a banana and some orange juice we gave them. >> reporter: that area is now

seeing about 100 unaccompanied minors. >> they're treating human beings like a commodity just to make money. no one gets to that border without a coordinated and organized effort with cartels and criminal organizations. they are managing the flow of people. >> reporter: our cecilia vega recently spoke to an official about how savvy smugglers can be. >> how organized are these smugglers? >> i think they got spotters. i'm sure they know where we're at. >> reporter: authorities in south texas rescued this 6-month-old girl after they tossed her and her mother into the rio grande mother. the mother from honduras paid $3500 to cross. homeland security secretary alejandro mayorkas releasing a statement late wednesday calling human smugglers' behavior criminal and morally reprehensible. nearly 18,000 migrant children are you now in u.s. custody and more are testing positive for covid-19. officials say border facilities are overcrowded and are not able to conduct their own covid testing. andrew, mona. >> megan, thank you.

now weighing in on the big business of college sorts. >> oh, it's over. >> reporter: the justices heard opening arguments wednesday in a case centered around the ncaa can continue limiting th benefits paid to student athletes. current current rules scholarship money offered is capped even though the games are generating huge profits for the schools. >> where does this go? it goes to millions and millions of dollars in salaries to the athletic directors, to the coaches, to palatial stadiums. >> reporter: the ncaa argues it needs those payment limits to preserve the amateur status of competition and a ruling against them would threaten the critical distinction between professional and college sports, but the justices grilled the ncaa lawyers on the league's business model. >> schools that are naturally competitors as to athletes have - all gotten together in an organization, an organization that has undisputed market power and they use that power to fix

athletic salaries at extremely low levels. >> why does the ncaa get to define what pay is? >> reporter: the case is not about whether students can be paid salaries but it's part of a larger debate about compensation for student athletes. six states have already passed laws allowing student athletes to profit from their name, image and likeness. as for the case at the supreme court just cyst sonia sotomayor expressed concern about the long-lasting effect it could have. >> how do we not that we're not destroying the game as it exists? >> reporter: but most of the justices appeared willing to side with the players. a ruling expected in june. it's opening day in major league baseball. all 30 teams will be in action, and each ballpark will have different covid protocols. the texas rangers will open at 100% fan capacity which president biden calls a mistake. the yankees and mets will open at 20% capacity. boston's fenway park only 12%,
