i'm terry mcsweeney, live in oakland where a sniper opened fire on police this morning. when they went to look forhim they really got a surprise. story coming up in a live report. >> also this morning, new details emerge from the body-armored wearing gunman. investigators say he was intent on committing a more serious crime. >> fog is beginning to enter the bay. we'll see a little cooling and more dramatic cooling tomorrow. >> so far fog free and delay free at bay bridge toll plaza. no accidents on bay area freeways but if it changes we'll let you know. >> we know you will. look who is back. i'm eric thomas. >> i'm kristen sze. >> oakland police, police are trying to find a sniper. it's what police found after

that that is really troubling. terry mcsweeney has the latest. >> police entered that apartment building on eighth street where they think the sniper was, they came upon a surveillance room. they thought they could get some video of the suspect from the cameras that had been recorded in the surveillance room but the room had been vandalized. it was no use to police. perhaps the person vandalized that room ahead of time. it happened about 11:30 last nate. officers stopped the car at eighth and market for a marijuana bust but it became secondary. officers were calling for back-up on the ground and in the air. >> rifle rounds were shot at them in the area. they backed down and called for additional resources. we basically locked down and

secured what we believe he came from. >> officers went into the apartment building but did not enter individual units. they were not certain exactly where the shots came from. they didn't know what unit they had come from. again they found the building surveillance room, hoping to find pictures going into the building, but the room had been vandalized and right now the shooter is still on the loose. no arrests were made last night. terry mcsweeney, "abc 7 news." police and f.b.i. agents are looking into what caused a man to shoot it out with chp officers near grand avenue in oakland yesterday morning. the new video posted on youtube captures the sound of the gun battle that go began around midnight. police say 45-year-old byron williams begin shooting after they stopped him for a traffic

citation. two officers were slightly injured with flying glass. the gunman survived because he was wearing body armer. >> no doubt, body armor and type of weapons that was in his possession that he was on his way to do a serious crime to someone or a group of people. >> the freeway was shut down for much the day while crime scene investigators used a robot to remove evidence from the man's truck, including a handgun, a rifle and a shotgun. and freeway shooter, a new law that prohibits violent felons from purchasing body armor. the chief tells the examiner that it's a perfect example of why that equipment should on the be available to people with criminal backgrounds. gascon says it makes a tremendous risk for the public and law enforcement the we're learning more about the gunman's

background from the town of groveland. he was ununemployed carpenter and been frustrating for not being able to find work after being released from prison after serving time for a bank robbery. he is going very upset going on rants on liberals. she told us he was upset with the direction the country is going. the shoot shootout came a day after bart and oakland officers shot a man near the fruitvale bart station. they tried to use a taser on fred colonel interests of oakland. police say officers were opened to fire on collins when he charged at them with knives. they are promising a thorough investigations, something that could take weeks to complete. review panel which governor swarzenegger signed into law last week won't form foothill

january. oakland residents may soon see the guardian angles patrolling streets again. they plan to step up patrols following the layoffs of 80 police officers. in 2008 mayor ron dellums requested their presence in the lake merritt area. now, a shortage of police officers. members of the volunteer group are not armed but trained in self-defense and they carry handcuffs for making citizen arrests. >> new report finds an elementary school's large system failed to send out an alert after 45 minutes. they say it's unclear why there was a delay in the fire at trace elementary earlier this month. but an analysis by the paper finds the school district has only been minimum safeguards at many of its schools. among the findings, 20 of the district's had 3 schools have

fire alarms that ring but do not alert the fire department. only three have full systems and most of the schools including trace elementary don't have fire sprinklers in their classrooms. >> a group of merchants in san francisco's north beach neighborhood are pushing for legislation to fine business operators for keeping store fronts vacant. merchants say there is a loophole in the tax structure that allows landlords to keep spaces unoccupied. the owner can write off the vacant property as a loss. empty store fronts urt hurt other businesses many located on columbus and powell street. at last count there were 36 vacancies in north beach. >> enjoying the gorgeous weather do you want it to continue or change? >> i would like it a little cooler. >> maybe. looks like one day we're going to hold on to the eat today for inland valleys. sea breeze is not going to make

trouble spots and find out the forecast. >> san francisco's jobless rate is on the rise again. it was 9.2, but in june it jumped to 9.6%. one reason is the census workers those were temporary jobs that ended in june. new figures are in line with the national unemployment rate. >> a report criticizes the u.s. treasure to impact husband of thousands of job losses when it pushes gm and chrysler to close last year. the move was kind to make the two companies important profitable. the report for the tarp fund says the treasury neglected to protect the broader economy.

obama administration says the plan has saved million jobs. >> stocks were up modestly. investors are looking for bargains after 251 plunge on friday spurred by bank earnings report. with more financial news. >> good morning. we begin money scope report with the economic recovery. a survey of economists released this morning find the recovery continued during the second quarter but the pace of growth has slowed. one encouraging sign is hiring. 31% of businesses said they added workers. 39% of companies expect to hire more workers over the next six months. >> ford is bet that go people will buy a big suv with better fuel economy. wall street journal reports that the automaker will unveil one

coastal fog. warm weather inland and cooling trend gets underway for everyone tomorrow and that will set the staying for the rest of the week where temperatures will be slightly below average. we've had the warmth around concord and livermore and breezes have kept up cool conditions around the bay. really, it's been quite pleasant. this afternoon with the wind at 10-20 miles an hour the is fog will eventually gather around the shoreline. by tomorrow when the trough of low pressure, another one continues to drop to the south we'll looking at further cooling. it will this afternoon until we feel the effects of chilly air headed our way. nice afternoon in the south bay, 85 in los gatos. peninsula, you managed a few 80s today, 80 in mountain view and 79 in palo alto with 60s at the coast. starting out sunny and sea breeze is going to kick in keeping it cool there. downtown mid-60s.

good monday morning. it's 5:22. let's take a look at light traffic coming across the golden gate bridge. that is good, but starting today if you are a car-pooler you must use the fastrak if you want to get the $3 discounted toll otherwise you have to pay $6. that enforcement begins today. frances has more and keep up with the traffic coming up. san francisco finally has something a lot of major cities have had a long time. a major flea market for antiques. it opened at candlestick point. they have a contract to run the market third sunday of every month for a year. if it takes off they have an option to extend the lease.

>> i'm eric thomas. oakland police are looking for the sniper who opened fire on them from a high-rise building while they were making an arrest last night. nobody was hit but nerves were rattled in what has been a violent weekend for oakland police. terry mcsweeney is live at the oakland police department. we understand there were surveillance cameras in the area and ordinarily you would think that is a good thing. >> as it turns out it's not such a good thing. they went into the surveillance room in this apartment building where all the images are captured. they had been vandalized. so they are no help in this investigation. it happened about 11:30 last night. they pulled over a car on eighth street near market street. they were dealing with that when all of a sudden someone opened fire. the apartment building at 1055 eighth street. helicopters were flying above. a lot of officers responded. they didn't enter individual

apartment units. they weren't sure where it housed the sniper's nest. then they found a surveillance room in the apartment building. >> in an effort to see if there was video footage that captured the shootings, that is where we went to first. apparently their video system room was vandalized. >> officers do not know for a fact that the person doing the shooting is one who ransacked the surveillance room, but if in fact he is, there was a lot of thought put into this attack on police. sniper is still at large. i did ask officers, one week after 80 officers were laid off, did that interfere with what you are doing here and homicide unit they said no, they had plenty of officers to deal with the problems in oakland overnight. oakland police are also

looking for suspects in an overnight homicide. police were called to an intersection of 19th on reports of gunfire. they found a 45-year-old man who was shot to death. police have not begin his name but believe he was in a job interview today and was killed during a carjacking. >> f.b.i. is now investigating a notebook that was found in the truck of a man who shot it out with highway patrol officers on 580 in oakland yesterday. man was heavily armed and wearing body armor. lilian kim has newly released youtube video of the intense gun battle that broke out. [ gun shots ] >> you can hear the gunshots from the home video posted on youtube. it happened shortly after mid night that left this white pickup truck riddled with bullets and windows of three chp vehicles shattered.

by ron williams is under arrest. it began when officers pulled him over for swerving in and out of traffic. >> he seemed to be reaping for something in the car. next thing we hear, officers were fired upon. >> officers fired back. the shootout lasted for as long as 15 minutes. >> back up, back up! >> many residents thought they were hearing firecrackers. they realized it was gunfire when officers were out in the neighborhood. >> it was nonstop, 15 minute, fired round after round. >> after the officers arrested williams, crime scene investigators were brought in to blow up anything that was suspicious from the truck. they found a rifle and shotgun and home made notebook on california.

>> there is no doubt based in our mind, the type of weapons in his possession he was on his way to do a serious crime to someone or group of people. >> williams is expected to recover from his injuries. in all, ten officers opened fire in the shootout. we're learning more about the gunman's background from his mother in the town of groveland. byron williams is an unemployed carpenter that has been frustrated for not finding work after serving time in prison. she says he gets upset on the political climate. williams has previously been arrested for assault, property destruction, d.u.i., hit and run and theft. >> starting this morning, carpoolers will need a fastrak account on the golden gate bridge. they will be charged full amount

57 in oakland. 59 in mountain view and san jose. highlights then today, the fog is just patchy at the coast but it's going to fill in around the shoreline. we'll see the 90s inland, one more day before the cooling heads into the east bay valleys. that is going to set the stage for a pretty good cooling trend all week long. winds will be out of the west at 10-20 miles an hour. that will bring clouds back our way, it's tonight when the fog will rush across the bay, not soon enough to cool us down in parts of the east bay. some of this bubble of high pressure and series of troughs will slide to the east. inland, still 93 in antioch and 65 in san francisco and monterey look for clouds and partly cloudy and 64. today the warmest day of the week. good morning.

it left one man dead and four others injured. last weekend a man was shot and killed outside jelly's restaurant. legislation proposed would allow the commission to revoke permits with a history of failing to curb violent behavior. right now they can only suspend the permit up to on the days when it comes to public safety issues. >> oakland could be the first city in the nation to allow wholesale medicinal pot farms. they will consider licensing four large warehouses. public safety committee approved the plan which also includes an undetermined number of medium sized farms to supply the three tons of pot sold legal ily had the city every year the licensing the farms would generate millions in taxes. >> crews will construct a temporary bypass.

apartment building on eighth near market streets. search did not locate the sniper but fosters found a room containing surveillance equipment had been vandalized. >> police and the f.b.i., they are sifting through evidence taken from the truck of a man who shot it out with police on an oakland freeway yesterday. gun battle on interstate 580 after they pulled over the suspect for traffic violations. they say convicted felon byron williams pulled a gun and started firing them. high survived because he was wearing body armor. >> starting today on golden gate bridge, carpoolers without fastrak will have to pay the full toll. they still have to stop at a tollbooth so number of passengers can be verified. but to qualify for a $3 price, they must have fastrak. latest stories coming up at 6:00. >> in vallejo, two fire stations will be shut down to save the

city money. the two stations serve north vallejo and glen cove. the fire department warns response times for both fire and paramedic calls will increase because of longer distances crews will have to travel. barrier man has lost his life serving his country in afghanistan. defense department says an army specialist of napa and three other soldiers died after insurgents attacked their vehicle with an improvised explosive device. he was assigned to 20th engineer brigade out of north carolina. >> three months after the devastating rig fire, an oil leak in the gulf of mexico there is still no clear solution. oil well may be capped but there is a disagreement how to proceed and concerns about possible methane leaks. for the fourth day in a row

there is no oil leaking from a capped well. while pressure is holding steady as hoped when you the pressure seems to be building. bp likes the cap the way it is. >> we are hopeful if encouraging signs we'll be able to continue the tests until we get the well tilled. there is no target set to open the well back to flow. >> but sunday, thad allen there is an unidentified a distance from the well. he wants bp to provide more sea bed testing results. the testing will continue in 24 increments. they may be leaking methane. scientists have worried about potential leaking and one reason why they want to siphon oil to the surface. >> once and for all, they can get a good number on what the flow rate was. >> bp says 43,000 people in the spill response effort.

more fog around the central coast and more mid-50s. 59 in san jose. good morning, mountain view, 59 for if you. patchy coastal fog. still warm inland, holding on to few 90s, warmest day of the week. we'll be looking at a cooling trend at our coast that is going to take us through the rest of the workweek. temperatures have been warm only in the east bay communities. today, 10-20 miles an hour and the fog, it is going to get a little more dense. it is shallow right now. depth is about 1,000 feet. weather has been dominated by a ridge of high pressure, much of the west coast but we're beginning to see a shift with a couple of areas of low pressure dropping to the north and west of us. that is beginning to provide today the start of a few degrees of cooling and another reinforcing shot will begin better cooldown tomorrow. then low clouds and fog that

will determine our highs throughout the rest of the week which will be just a little bit below average. 82 in san jose. look for 80 in sunnyvale. peninsula numbers, mid-70s for san mateo and menlo park with san francisco coming in at 65 later on this afternoon. north bay numbers, about five degrees cooler with low 80s in sonoma. near east bay, nice day, warming up into the low 70s. 78 in fremont. few more 90s today in concord at 91. a fog clears for partly sunny in monterey. cooling trend and more dramatic the rest of the week. >> "h" train number one running sex minute late but train number three on time and bart looking good. no delays at this point. there is new stall reported across the richmond-san rafael bridge in the eastbound direction blocking a lane.
