45," a coffee mug it says, "sent him to the big house, that the white house, oh and cohen of course confirm that all these references were made in the direction of the former president donald trump. but we can expect a lot more cross-examination there is going to be going in to impeach the credibility of michael cohen. assuming mentioned michael cohen as we know has led to congress calculating the miller investigation, he apologized for those lines in 2019 and how pleaded guilty to lying to banks and feeling guilty threw toxic -- tax, all of that is likely to -- a sign that i think is really indicating that the cross -- prosecutors acknowledge a real weakness in the fact that they are hanging the case around michael cohen allowing him to talk about some of these, you know, prior negative things that he's been involved in that really show that you might not be a credible person to believe. try to take the sting out of what is yet to come at this cross-examination move forwards. we do expect it will be the prosecutor's last witness to

is the final witness for the prosecution, and really, all has been established is that michael cohen says that he claims that former president trump new that he was going to cover this money, to keep stormy daniels quiet calvin pickard and nda, that's not a legal. they haven't gone that extra step to show that that check was in furtherance of another crime which were still waiting to hear about, and i wonder, you know, if jury -- the jury instructions obviously will be very important here. but look at the other side for a moment. what is -- the defense new? if you were in their shoes, would you say look, that has been proven, we are done? or would you feel that the jury needs a little bit more than that? >> well, you know, couple of things from a number when i think you're totally right. jury instructions and really jury selection, the process we for faking injury will loom large if there is a condition in this case. is the only way you get a

conviction with michael cohen reserve their problems with the two calls. were in terms of the defense case, look, is a dream come true and with cohen. there's no pressure to put on anything collier certainly don't put on your client at this point no matter who is no matter what what type of baggage she had are doesn't have. it's a fools errand. let the court ability fight be all about michael cohen and nobody else. i think at the most what you would do is you would call somebody to describe billing practices as an expert perhaps to say look if i'm a lawyer that works for fox for instance, i will submit a very detailed bill of all the work i did for fox. but when they write me a check or put it in their leisure, they're saying legal services rendered by jim trusty. we don't even get to the mysterious felony intent here if there's nothing wrong with the original bookkeeping. >> -- i guess it would come in to the closing argument the explanation that you both have said that was apparently known to you does not describe a crime and certainly not the next step which is what they needed to

[ engine roars ] i think one point is that you can only put on witnesses and so on to prove facts and what you just laid out, martha, is i think a serious i think compelling defense in the legal aspect of the case which is these bookkeeping issues which as you said, martha, haven't really been proved out yet as having met the state of mind that you need to prove a conviction. you need to not -- to show that there is an entry hear that should have been somewhere else. the prosecution has to show that donald trump had the mental state to commit a crime, do you that the cover up a greater crime. there is a legal argument as you say, martha, i think there is messed -- really should have been decided by the judge of the trial never went first -- for the first place before it seems --

case. now aside from that, aside from the actual legitimacy of this case, this gag order, martha, is i think an insult not only to donald trump or even primarily to donald trump. is an insult to the american people. we deserve to have a real presidential election where joe biden and donald trump make their cases to the american people. this judge has imposed what i think is an absurd gag order and put -- on the president --'s that to me is actually outrageous. it's not performative outrage, it's me telling it like i see it. >> martha: you know, what do you think happens if there is a conviction on any of these charges? >> i don't think it really affects things. if you see the polling here you are releasing the evidence that the american people recognize that this trial is ridiculous. you have, you know, it's in southern manhattan where 95 cents macro people voted for joe biden in 2020. you have a prosecutor who actually ran his campaign

funded by george soros on the promise that he would go after donald trump. you have the biden administers an assessment -- officials jumping ship to join the local polynesian team and perhaps the worst example of all, martha, he have the judge presiding over the trial, his daughter had made millions of dollars fundraising for democratic causes. so this is obviously ridiculous and i think the conviction or acquittal either way, the american people see this is a sham and rightfully so. >> martha: with regard to the vp stakes, what is it like when you're altogether? you talk about the fact that you are all on the same list and is that a job that you want? >> well, when i was there yesterday, it was just with senator temporal and normal number of other folks from across the country so we didn't talk about vp percolation at all. in 20, martha, i see the steam media reports and everyone else does and like i said i certainly want the bill -- be helpful to the president however -- whatever form that takes but i've never spoken to donald trump about become his vise

a lot of debate over how cohen has done and whether or not this is good or bad for former president trump. how weak, what is your take? >> much in mainstream media seems to be in love with his testimony but now as we were at the cross-examination we have seen terms of attorney go after him on were you involved in leagues -- leads to the ap and cnn? have you attacked trump on social media, of course he has. were you asked if the ltv? new one trump convicted? i think we can all agree that he very much wants trump convicted, he's been on this crusade against his former boss for quite a long time. and obviously the defense is

going to wrap up and portray him as a disbarred, serve time in prison, like the congress, on trustworthy, who is doing this to make money. but what i don't see and i don't think we will see, martha, is michael -- is the defense taking on michael cohen's testimony, the court testimony, about the hush money that he was involved in paying the stormy daniels and two of course stormy daniels and karen mcdougal. and the reason it is backed up by a very thick stack of e-mails, tax and corporate signal messages, bank records and one surreptitious audiotape. and i think some jurors may say well if they're not taking that on, maybe i can believe michael cohen on that or they may decide that he is light sometimes and acknowledge like so many times that the fixing is just not believable in anything. >> martha: yeah, but

choice? because it's all -- not that far away now. what you think he should consider? >> the most important thing is that if that person that is vice president needs to become president that they are capable to serve on the one that moment one, hit the ground running and be of great presence. what's interesting is if we set our expectations ever seeking out perfection, you know, a 100 out of 100, good luck ever finding someone who will fit that bill of taking everything a possible box. was interesting in that the republican bench is actually quite the and instead of looking for absolute perfection of checking every box, you are just one notch below that the new have a dozen names you can consider. the fact is president trump has a lot of great choices. you should pick whoever he believes would be the first -- best person to be his running mate. and most important leader who directly answer your question in that trait of being capable of stepping in to the position and serving as president himself or herself.

>> martha: who do you think he should consider? >> is a tough decision because -- i don't -- my preference in that he picks whoever he wants to pick. as far as vetting goes, you know, they are there other traits that you look for. that has to be good chemistry, hard work, their positions on issues -- you don't want to have a vice president shall not many who is in doing an interview and that person is getting asked for the position or the road or whatever is something that is, you know, the opposite of what president trump believes on this really important issue. you want a partner to help implement your agenda, somebody who can go to congress and speak to congressional senate leadership and rank-and-file help build support. i think he has a lot of choices that check those boxes and ultimately at the end of the day -- >> martha: not going to give me any names? >> know. >> martha: are going to go down to the courthouse? >> the offer is certainly there and anytime i am happy to do it whether it is -- weather its now, when the
