afford that and then some so my next step might be something more serious. what he actually threw him in jail for that kind of stuff? >> i mean we have seen in the past other judges do this when the issue gag orders. issue here is the is donald trump exercising his freedom of speech and is the judge not offering him a fare trial by not allowing him to speak publicly or to respond to what others are speaking on social media, elsewhere. that is the big question he here. juan merchan is saying i'm going to put you in jail for this. how far does this go to a violation of constitutional rights? in a violation of someone's free speech. will see. but this judge seems very politically motivated to continue the trial against donald trump as a witchhunt so i wouldn't be surprised if he keeps threatening these

things. if he wants to have a gag order in place judge merchan why didn't you impose a gag order on the entire proceeding rather than just the defendant in the proceeding? michael cohen said he voluntarily -- voluntarily is going to not wheat as often or not to eat about this issue. what is michael going to have to make that decision? widening the judge have an all-encompassing gag order for every witness including the defendant if he is going to restrict the constitutional rights of the former president? why do we not have all other witnesses on the same plateau? >> martha: >> neil: is a valid point. tom dupree i want to ask you a little bit about that grandma and i -- i know we not supposed to weigh the celebrity order status or the -- nature of the prominent individual like donald trump but threatening even to throw him in jail, you know, obviously it wear its all

sort of other hazards that the judge might not welcome or expects, at the very least of which is the growing popularity of donald trump through this entire trial itself. is right now leading joe biden by six points in the latest polls and virtually all the battleground states. so he's got to weigh that. what do you think? >> i think you don't have to be that and a queer -- erect and protection the first amendment shouldn't -- and he is in the right constitutional right to speak on issues of public importance and there's no question that this -- constitutes a matter of grave public importance. [inaudible] the judge has a job he has to maintain the integrity of the trial and run his courtroom in order to ensure fair trial. i get that. at the same time in my opinion at least the judge has been in --

he placed it in my view is an extraordinary order on reporters and journalists covering it in the jury selection process not to report on things that they were observing in the courtroom, public courtroom with their own eyes and ears so all the judge does have destructive anesthetist strike a balance a little differently and a little bit more in favor of the first amendment. >> neil: how do you see this going this far? you been hearing his arguments -- the judge -- had it out for the former president. is a delicate desk, dca going? >> percival i all i don't think there is any doubt that the judge has it out for donald trump and mackey should have refused himself and i don't think there's any doubt that the order -- that the entire order by the order is overbroad and violates the first amendment. the problem for former president trump is that just because an order violates the

first amendment, a gag order disobedient that your remedy is to violate it. there is case law to that effect, a court order is different then an unconstitutional statute. if you violate analogous additional statutes and you take it to trial in the court rules that it was unconstitutional, your conviction is wiped out grandmother is not true if you violate a gag order and i'm not sure that former president trump has fully understood that this judge i think i'll show his bias in many ways. not only by the overbreadth of the order but the ridiculous prohibition on trump's attorney referred to trump as president trump. is the former president, it's completely appropriate to refer to him that way and to forbid him from doing that in front of the jury is just the kind of daddy, with nicholas ruling that unfortunately is indicative of how the judge is operating here. >> martha: i would imagine

the university of the liberty bell florida gainesville officials say the police officers arrested about a dozen including six students who wouldn't comply with orders to disperse but a lot of these institutions -- new being told would be a good idea -- even though many have been calling on them to do so but this is where it gets a little dicey because many of these indicators of those that are not public institutions this is private property so how do you juggle that? -- you get a sense not everywhere but a lot of these college protests, the police are told condo and make a big c-note events, we can deal with this but they're not dealing with. >> well the ball is in the courts of the school's mostly.

obviously there some public institutions that may be a little bit different other states but clearly in columbia the administration has to make the call. the police are going to go in there and invited respirator away. there is an emergency call if there's somebody being assaulted obviously they see that and then they will go in but unless they're invited by the administration cannot going to go in because they need a complainant. you need someone in court that sets this person, that person there trespassing, should not have been there i gave every -- criminal court summons and they'll be told to respond to that maybe 30, 40 days down the road. it's not a deterrent that used to be quite frankly. so even with arrests, i'm not certain we are going to see a significant change. i think in my view this is largely motivated by students

for justice in palestine. they have 200 chapters on college campuses in america. this is -- looks to me like a conspiracy because crimes are being committed. i would hope that the federal authorities are looking at this. word is outside instigators coming from. it is an awful lot that we don't know anything near that you're probably right that the police have been told to go very easy in all these college campuses which is probably a good thing. >> neil: but, you know, one of the things i didn't understand -- miguel cardona was talking in congress earlier today that there are no, you know, -- or any of these other institutions -- >> can you say that again? >> martha: megan currie the education secretary -- i apologize had said that there is none of his personnel at

columbia or any of these others that are monitoring all of this but it does seem to be an official hands off to echo what you just mentioned and wondering if the universities involved in colleges involves aren't taking matters into their own hands and i want to be fair some of them indeed are in texas, for example, but most are not in there hoping maybe this plays out that it's the end of the school year for most. this is exam week and all that and maybe they're trying to run out the clock on this and hope cooler heads prevailed after the -- what do you think you might be what i think you're right. i think that's exactly what is happening in the going to kick the can down the road and hope that somehow dissipates like for instance in columbia the graduation date is may 15th and schools of the university have made graduation ceremony even before that so i think that's what they're betting on in the car in the police that they've already done that once before, you know, this will be slightly different undertaking.

obviously this is former president is very upset and feel this is a kangaroo court, stacked against him and he kind of knows where this is going. what do you think? >> there's no question that he feels that way but also, neil, there's a question that this is of all of the provisions of the it was rejected by the u.s. department of justice when biden was president candidate and prosecute this as election interference or election fraud. it was rejected by bragg's predecessor and initially as a former president just said it was initially rejected by bragg. it is the case not as bad as what we call in the business and white-collar business well it's a hyphenated phrase that starts with chicken and

ends meet with it, that's what i'll say about it. this just nobody -- nobody would be prosecuting this case if it wasn't donald trump. that's just the facts. >> neil: you know, tom debris we always come back to these 34 counts charges against former president all around the way the so-called hush money was paid, to whom it was paid and whether it was a misdemeanor or a felony to a limited to the felony stage matter, of course, they made other implications here. that would be the one appeal but what do you make of that? >> i think we will be a challenge on appeal looked at the prosecutors have several huge obstacles that they're going to have to overcome. first thing you have to do is persuade this jury but even if they can do that, even if they can achieve adamantly, obtain a conviction to your point they will face another big battle

on appeal. bragg's theory even his supporters would say it takes a bit of work getting their. you have to layer on the business crime with the election interference in order to get this felony conviction and i suspect that the court of appeals at a minimum is going to give that very rigourous what lawyers call the noble scrutiny meaning the devil approached it independently without any perception of the theory is valid or not -- even if trump were convicted i would say it >> neil: rebecca -- legal schemes here to talk about, you know, conventions or anything like that but is this the type of judge in your eyes who would take a conviction and say alright now you have to go to jail while you wait this out or appeal or whatever if it ever came to that? >> if it came to a guilty verdict you're asking between the verdict and sentencing what were the judge do? in this case he'd be i think

very out of order to place the presidents in any sort of situation where he'd be behind bars pending in sentencing. what i think will see and i think that reasonable down -- will be very hard for the prosecution. if he gets a guilty verdict out of this prosecutor gets a guilty verdict and this goes up on appeal -- the court of appeals at our top cargo we have an intermediate court as the appellate division gimmick in both of those courts affirm a guilty verdict sea class that the supreme court will take up an appeal from a state court guilty verdict. what i think then we will see there is the supreme court making a decision that this case has been held

unconstitutionally. meaning the former presidents as a defendant, a criminal defendant who is fighting for his freedom has not gotten a fare trial based on various constitutional laws that apply to him as a defendant in this case. very specifically that there should not be unfair advantage to the prosecution and i think we are seeing this over and over in this case that donald trump is being really pointed to an treated unfairly in a court where he is fighting for his freedom. >> neil: sol, i do want to switch to the protesters we are getting a development from columbia university. it has been threatened before but now they're putting it in writing that columbia will expel any student protesters occupying the administration building, they're not putting a time sort of deadline on

that but >> i'm not too, you know, i'm not too hopeful that columbia will do what they say they will do. to let several deadlines has an i think that the -- i don't think there is much of a legal recourse depending on exactly what their expelled for. have a first amendment right of course columbia is a private institution but you have a first amendment right in general to protest. you don't have a right to disrupt campus rules, to keep people from passing by, dorsal people. soup assuming they do it in

the right way which is very important that they actually follow columbia, i'm talking about their own stated policies, that's very important in this situation can't really follow their in-store data policies and expanding these kids? i would think you have a pretty decent case but i don't know. i am okay most of your viewers of the following was happening here in television. >> neil: but a lot better that i do. tom really quickly or your take on that and sol instantly drew a distinction between a protest which are sanctioned supported and praised in our constitution got a whole different matter when they get as disruptive as these have become. and is apparently were columbia might be drawing the line and sol was also right to say they've threatened before coherency out loud, but, you know, this is the last time kids are mourning you but that is the approach they're taking. what do you think? >> i hope to follow through on your prompt -- i think it would be a very solid legal ground if they were to expel

somewhere. forgive me, senator tillis and i just concluded a two hour hearing on ai and deepfakes, so i may not be as current on exactly what is happening peer from what i have picked up about coverage today, there continues to be understandable and widespread concern that protesters on campus are going beyond expressing passionately their views on an issue and are using violence and disruption to prevent some of their classmates from going to clamp us, to jewish students feel unsafe on campus and it is my hope that the administration is on university and college campuses will act to ensure that there is civility and respect, and that frankly, they are teaching young americans how to have disagreements in a responsible and civil way. we hear in congress have an obligation to model that conduct, and frankly, young americans need to show the world that they can disagree over

something as important and urgent as the conflict between israel and hamas in a way that doesn't interfere with classes or inflame tensions by taking the side of those who have committed horrific acts. >> still, you do have to be a little worried, right? your crucial support for president biden and the big democratic convention in chicago of all places this year, with protests that are legendary back in the 1968 -- are you worried, senator, this will get out of control? >> what i am peripherally hopeful about today, neil, their urgent ongoing conversations in the middle east right now. secretary blinken is there. other senior representatives of the biden administration are there. meeting with saudi and egyptian and israeli leaders, trying to secure the release of hostages still held by hamas, trying to secure a humanitarian cease-fire

in gaza, and trying to lay the pathway for a regional security alliance to contain iran. this is something that many of us on a bipartisan basis have been working for. of course, the protests on campus is concerning and the way in which this is fueling division here in the united states, but the biden administration is delivering aid into gaza to address the humanitarian situation, and is continuing to support our vital ally israel. in the broader context, the thing i hope your viewers realize, for months will work on a bipartisan basis to try and bring together the saudis and the israelis to move ahead exactly the deal that was moving ahead on october 6th, that hamas acted in a brutal and violent way to try and prevent, to try and prevent peace in the middle east. >> neil: real quickly, sir, you do have to worry about where this goes, and i know you are saying you are doing all the
