generation. supreme court about to hear arguments whether president biden illegally bullied social media companies into removing content that they disagreed with. >> bill: the targeted content was posts on covid-19, 2020 election. missouri senator eric schmidt sued the administration over this back when he with as the state a.g. in missouri. stakes could not be higher for the country. >> it's the most important free speech case in our lifetime. it involves some of the highest ranking government officials in our country colluding and coercing with social media companies to suppress millions of posts related to the hunter biden laptop story, origins of covid. lab leak, efficacy of masks and much more. >> bill: this is rich. david spunt live outside the u.s. supreme court with more now as we begin our coverage. good morning, david. >> this is a case with major

implications for public health, postings on the election, also potentially even national security. social media and technology continue to improve, the supreme court continues to find itself in the middle of these social media cases. these hot button issue. they'll decide if the biden administration improperly communicated with some of the largest tech firms in the country to fight disinformation. this content that was posted by private parties everyday people on twitter, facebook and other sites. the administration was accused to collaborate with some social media sites to take down content. another big issue, election security and the fallout from the 2020 presidential election. president biden and several others are being accused of colluding with these companies, several states and private parties sued. administration argued their free

speech was being stifled and the white house was behind it. the justices will hear arguments this morning. those arguments will take about 90 minutes. they could go a little longer. they have been audio will be streamed live on the supreme court website. we expect to get a decision by the end of the term, the end of june or early july. this comes, of course, right in the middle of an election year, a busy election year with big topics. public health, national security and election security. another big case before these nine justices today. >> bill: drama will land soon late june, early july. thank you for that. more in a moment with the attorney general suing out of this out of louisiana. we'll hear from her and hear her make her case coming up in a few minutes right here. >> showdown now for years since biden became president. we're being attacked by land, by sea, by air. literally. millions coming across the border, many armed and many criminals. terrorists. >> dana: that was texas

lieutenant governor dan patrick defending his state's border enforcement law to allow state officials to arrest and deport anyone crossing the border illegally. supreme court could weigh in on that today. while texas officials await that decision, migrants have moved west. cameras caught hundreds of migrants pouring across the border in cities like lukeville, arizona. garrett tenney? eagle pass, texas with more. >> good morning to you. we're seeing scenes like that in lukeville play out multiple times a day. cartels are cutting open holes in the border wall allowing groups of hundreds of people to pour across the border and into country. those just as fast as border patrol the catch up the holes. cartels are moving to new spots and opening up new ones to continue this process going. now we're not seeing those same kind of large groups here along the texas border anymore. ever since the state took over shelby park and started expanding the fencing along the

border, this cartel gang member, though, we're still seeing groups like this people who don't want to be caught smuggling six illegal immigrants in his car in texas and took troopers on a dangerous high-speed chase hitting speeds over 100 miles-per-hour before he got rammed off the road. right now texas troopers can only charge the drivers with human smuggling. everyone they're carrying just gets turned over to border patrol without any real punishment. that could change this week if the supreme court allows texas's new law to take effect. at that point texas troopers could arrest, charge and potentially deport anyone seen crossing the border illegally. >> any time you have a law it is a consequence. you have to have something in place. right now we're in a situation what we've been in for the last three years there are no consequences. >> texas dps says the law could have allowed them to stop someone like this venezuelan man from getting into the country

listed on columbia's most wanted for murder, extortion and drug trafficing but released by border patrol after crossing in eagle pennsylvanias in january a week before texas took over shelby park. this past week ice agents were able to track him down outside san antonio and arrest him. texas officials say that case highlights the kinds of dangers they are trying to stop from coming into the country that the biden administration's policies are allowing. >> dana: garrett tenney on all that. thank you so much. >> bill: more coming up on that later this afternoon. apprehension among democrats about the election now reaching the top. nbc news reporting this weekend that behind the scenes president biden is angry and anxious about his efforts for a second term. what about that? james freeman assistant editor from "wall street journal" and joe concha. most of this reporting seemed to happen in january. what's your take. >> one of two things. the president is angry, he is

anxious, he is involved and passionate trying to whip campaign troops into motion because he sees the poll. one poll at this stage, donald trump was at 48% in march of 2020. george bush 39%. jimmy carter 43%. all lost re-election. joe biden right now if you look at the average is at 38%. perhaps he is angry in private. the leak is familiar. we've seen reports coming out from other publications like "politico" last month what biden says about trump behind closed doors. axios, old yeller, "new york times" joe biden's folk see demean or a short fuse. let's look at the schedule for today in a campaign year. you want to hear it? he has one reception at the white house to celebrate women's history month. then he gets the daily briefing at 3:15 in the afternoon because terrorists sleep on mondays.

that's it. you talked about it. there is no flexibility. there isn't that ability to just say okay, let's show we care and get out to pennsylvania, wisconsin, michigan, georgia and hold a campaign event. >> dana: he did travel for him it was quite a bit last week. when i read this one thing that crossed my mind, james, maybe he is more with it than some on the right give him credit for. if he recognizes how bad things are and now saying to his family and friends go out there and tell the press that i understand wh's going on to maybe at least tell the donors i get it and we have to work harder? am i being too generous. >> that's a fair assessment. i think flowing from that is that nbc i think is getting spun along with other people because if he is realizing the problem, is he really sitting there saying gee, i came into office with this low inflation, high growth economy and i turned it into a high inflation low growth economy and everyone is so angry and don't appreciate what i've done. of course not.

it is a disaster. you are running 2 trillion annual deficit and you are creating this huge burden down the road and not getting a lot of growth out of it now and as we discussed, the investments that have been made, investments in electric vehicles and so forth are not meeting consumer demand. so we're not going to get the payoff out of all of this government spending that he hopes. >> bill: "the new yorker" was writing about this earlier this month talked about him being defiant. he is making a trip to arizona and nevada this week and we'll watch that. in the meantime you have this event from saturday where trump was stumping for a senate candidate in ohio. he was in dayton, ohio, the world bloodbath has been like a ping-pong for 48 hours. here is what we want to do. we want to play what he said. we'll get the reaction from the white house and let you guys respond. first. >> we'll put a 100% tariff on every single car that comes across the line.

running with this false bloodbath narrative as well. who comes along but musk who says you aren't talking about the full context here that trump was talking about auto workers, biden's push for evs and what it means in terms of china taking jobs. scarborough deleted the tweet. suddenly the playing field is being leveled because musk's tweet was seen by 58 million people. the number of views it got. what we saw this weekend was yeah, you know, used to be fox news. we would give the context just like you both did. play the clip and play the reaction. now social media is leveling that playing field. >> dana: there is no learning in the second kick of a mule. nine years into president trump being on the political scene and the media keeps making his case for him, james. >> he lost me at 100% tariff in the clip. >> dana: people missed the news. >> it is very clear what he is

else. late on sunday evening crowds fleeing a jacksonville beach after a deadly spring break shooting. one person is dead, two others injured after a party near some oceanfront bars got out of hand. dana marie live in miami. what we're learning. >> good morning, jacksonville police say last night there were three separate unrelated shootings in three separate locations all happening within one hour of each other. now the first shooting happened at 7:50 p.m. in the parking lot of a best western hotel. jacksonville police say they broke up a crowd of 200 teenagers gathering on the beach. after that two males ended up at the hotel where they shot at each other. a guest was caught in the crossfire and shot three times, police say. all three people are in serious condition but stable currently at the hospital. 20 minutes later police say a man in a ski mask shot a gun

while running by the ritz bar in downtown jacksonville beach. no one was shot or injured in that incident. then that third shooting was fatal. it happened just after 8:30 p.m. in the parking lot behind snager's bar. there was a disturbance that led three males to show their guns. one male was shot and killed in that parking lot. last night jacksonville police called an active threat alert locking down all bars and evacuating the downtown. the mayor commented on the quick response time by officers. >> very saddened by this tragic situation that impacted our beaches but so glad to see how our police department has worked together to react and to be really responsive. our business owners really worked together to help make sure their p patrons were as sa as possible.

>> this morning the threat alert has been lifted as well as evacuations. the crime scenes have been cleared but not made any arrests as the investigation continues into the three separate incidents. >> dana: a few minutes from now the supreme court will hear a new case. louisiana attorney general is one of the prosecutors who filed the case. one thing from the u.s. solicitor general from the white house percent peabodyive saying influence is also the natural result of successful efforts to inform, persuade or criticize. the platforms often acted in response to the government's communications thus does not remotely show that those communications were coercive. it comes down to who do they believe more at the supreme court? tell us about your position in the case. >> thanks, dana. this isn't really about the

government using its bully pulpit to influence. it is about the government bullying big tech platforms to submission to take down speech they don't approve of or push narratives they do approve of. could not disagree more with the united states solicitor general's characterization of what the government did here. >> dana: i was surprised to relook today at some of the email communication from the surgeon general in the biden administration to companies like facebook, twitter, etc. and it is an incredible amount of i guess arrogance and almost the threats were quite incredible and i can understand why the attorneys general that joined in on this case wanted to push back. do you think that that kind of evidence will be persuasive today? >> well certainly i hope so. i think the facts ought to drive the outcome, not the different

framing that the government would like or spin the government would like to put on what the actual facts show. we have thousands of pages of document showing the pressure that the federal government brought to bear through the white house, through the f.b.i., through the cdc, through the surgeon general and -- they created an category called cognitive infrastructure to police our thoughts. >> dana: let me ask you about the attorneys general across the united states who didn't join you. are you in a way disappointed but maybe not surprised that a lot of these cases, when the states are weighing in, is becoming a red/blue state issue. >> we filed this case a couple of years ago with missouri and it was always kind of a louisiana and missouri fight. i think we have enormous support from all the other republican states in this case. it's unfortunate that we don't

the state department says that those who are traveling particularly the several hundred americans believed to be stuck in haiti to travel at their own risk. now also the state department says over 30 americans were on board that first rescue charter flight that took off yesterday and landed in miami. the donor funded project dynamo rescued at least two americans yesterday via helicopter from remote southwest haiti. the organization says it is trying to rescue three dozen americans by air or sea. >> i expect we'll deteriorate further until there is a reason not to deteriorate. gangs have the control where they want. >> haiti is on the brink of civil war. gangs have control of. there is need for humanitarian aid or facing famine of concerns

of a new migrant exodus. they have built a 12 foot tall border wall in the dominican rep republic. we drove in doone buggies along the border with a commander of border patrol who says the wall offers protection from haitian gangs and crime. the 15 miles of border wall has reduced the theft of livestock, motorcycles and vehicles by 80% according to the president of the dominican republic. the goal is to have a wall run throughout the entire border with haiti. >> the wall is helping us in that we no longer need a large number of soldiers to make the border safe. it allows our soldiers to do more patrols. we use cameras and drones. >> the d.r. has stepped up deportations every day trucks at the border are he lease people of all ages back into haiti

corridor and so is this sector along the mediterranean sea. this hospital is in gaza city. all the headlines and news pushed into the southern end of gaza toward this border crossing of rafah. this action is here in gaza city. bring in general jack keane. what's it all about as israeli say they have found hamas fighters inside that hospital. >> bill, of course the israelis conducted significant clearing operations in northern gaza, many, many weeks ago. but given the scale of what they are dealing with, it is impossible for them to occupy all the territory that they cleared out of hamas fighters. what we have here is hamas reinfiltrating the hospital, something the israelis had been through and actually has occupied for a number of days, if not weeks because of the

complex tunnels that were underneath it. so it is not surprising that hamas comes back and where they do it? last week up in the northern part of gaza, the idf was going into a school, which raises everybody's eyebrows, nobody wants a war being fought over a school. we don't want it being fought over a hospital either. hamas chooses these sites purposely because it will shield them from idf operations. also, it enhances international condemnation of what the israelis are doing. and that's what this is all about. they will clear these people out of that hospital, but don't be surprised if there isn't some instances of more infiltration in the northern part of gaza despite the clearing operations that have taken place. >> bill: we'll follow that. i know you came on to talk about the military. there is a political equation in this as well when you think about chuck schumer's comments

last week talking about the israelis losing their confidence in benjamin netanyahu urging them to hold a new election soon. netanyahu was on "fox & friends" sunday morning and said this. >> schumer's statements are wholly inappropriate. we're not a banana republic. the people of israel will choose this they have election. we need the change the regime in gaza, bringing down the terrorist regime of hamas and not the duly elected government of israel. that's the right policy. >> bill: don't mean to put you in a pinch but how does that fit into this war in the current equation and the relationship between jerusalem and washington? >> certainly this has gotten into public spaces now. we've known for many weeks the administration disagreed with how the idf and prime minister netanyahu was conducting military operations.

something i think they should have stayed out of and left that up to the idf and their national leadership. now we have schumer actually calling for the removal of the prime minister by holding elections prior to the time they would likely have them themselves. i think that's pretty shameful and this is a close ally of ours and actually doing something like that plays right into the hands of hamas. why is that? because it gives them leverage in negotiations that are taking place. it helps them in the international community with the condemnation of israel because they believe now they have on their side the president's words that he has used, now senator schumer's words, the highest elected jewish official in the united states government. all of that will be used against the israelis and the prime minister in negotiations and also the fan the condemnation of israel worldwide. >> bill: general, thank you. see how it goes this week and
