face charges. the brooklyn district attorney says the shooter acted in self-defense after being attacked by another passenger who police say started the brawl. the case is raising new concerns about violent crime in the big apple and how it is prosecuted. welcome to a brand-new hour of fox news like i am arthel neville. >> hi i'm eric shawn. about to show you the video of this incident that's got a lot of publicity. i went to hornet's graphic police say the whole thing started when a man started a fight pulled out a gun after being stabbed by a woman on that train. the other passengers wrestled the gun away from the man and fired at least four shots. the man who was shot by his own weapon is still in critical condition in the hospital. the shooter was a mutely arrested then released after prosecutors declined to file charges citing self-defense. the cases been compared to the incident last year involving daniel penney the ex- marine use a chokehold to restrain a man who is verbally threatening subway passengers.

penny was charged with manslaughter after that man died pennies lawyers condemning prosecutors now for not charging the subway shooter said the case against his client should be dropped. arthel: defense attorney former homicide detective ted williams is standing by to break down these cases but first we are going to go to molly line, live in new york city with the very latest from there. >> arthel, pointing to the evidence of self-defense the brooklyn d.a. will not be pursuing charges as you mention it because the man who shot another man in the head during the fight on a crowded subway car. as fellow writers cowered and screamed as eric mentioned we are about to show the disturbing video but first, how it all started but shortly before 5:00 p.m. on thursday the accused attacker dejuan robinson slips into the subway without paying a fair. nypd officials report that 36-year-old man aggressively approached 8:30 2-year-old man

last year. penny has some thoughts about all of this. his lawyer. >> the potential jurors are out there. they are seeing these incidents occur. they are seeing how, as i said before a situation like this can devolve into something so volatile. i think that's making an impression on all new yorkers to have them take a look at one obviously subway safety. but to the equities of a prosecution like this you have someone like myself, like my client excuse me who did everything the right way. eric: defense attorney fox news contributor ted williams joins us now so you have two cases what is the similarity and why didn't the chargers against petting are still there while the other situation is not? >> hi eric. first, let me say happy saint patty's day to you and arthel and our viewing audience. there is some similarities in

these charges. what we have to look at is the very first incident that just recently took place. and that incident you could see the aggressor was the man with a gun. the other man who took the gun away from the man with the gun and wound up shooting him quite naturally it was defending himself. the law of self-defense kicks in there. when you are in fear of great bodily harm or bodily harm or you know someone else on that train is in fear of bodily harm you can take certain actions. and they did in this instance. when you look at what happened some time ago with daniel penny, it is my belief that daniel penny should not have also been charged in that incident. daniel penny was on the train with other individuals.

there was one man, jordan was acting very disruptive. he had not touched anybody but people on that train were in fear of their own safety. at that stage daniel penick got up, put him in a chokehold and as a result of him being put in a chokehold, he died. but if you look at both of these cases you are looking at individuals who are being disruptive, who have put individuals in fear of bodily harm and as a result of that some good samaritan or someone is taking some action. eric: in a pennies a case is there a level he may not have been in fear if he subdued the suspect at a certain point he could to stop the chokehold? the prosecutors way that is opposed to someone who has a gun. >> a penny it was charged

manslaughter. that's the unintentional killing of a person. simply meaning penny did not mean to kill the person he put in a chokehold. he meant to only hold him there. unfortunately he did hold this person to long and the person did die. so you do have that difference from where an individual pulls a gun on you and at that stage you immediately take action and take the gun away from him and shoot him. that's the dichotomy in the two different cases. eric: these subway has about three-point to million people writing it every day. three-point to million on the date of the shooting occurred last week, last thursday. transit police point out there only six crimes reported, six out of 3.000000 but then you have higher profile crimes, does that instill a sense of fear among new yorkers that something could happen because you have

these high profile type cases? >> yes because of these high profile cases and what they see themselves on a daily basis in the subway. in the new york subway you have had rapes, you have had assaults, you have had robb robberies. you have had it so bad in the crime-ridden new york subways that the governor has brought the national guard in. and as a result of that the passengers who ride that subway daily or whenever they write it or not feeling very safe. and so a lot of crime, i would have to believe is going unreported in the subway system there. but they subway system unfortunately in new york is just not safe. so far write it every day i came to work yesterday talk much killing people, if someone is saying that the guy was using curses and he is like out of his

mind. i thought you go to the police for that is or something they could do? i got on the train like most new yorkers and stay away from them. >> you trying to stay away from them. but you have got to realize the law-abiding citizen that gets on the subway is unaware a person like let's say in the daniel penny case or jordan nearly had about 40 incidents in the subway he had some forms of mental illness allegedly. but the public did not know that. daniel penny did not know that. the individual who was shot and in critical condition i am sure they are looking into his mental state of mind. and what kind of a record that he had. it is my understanding he does have a record of some violent acts. so, this is not known to the public and all of the public can do is try to get on the subway

get from point a to point b without losing their lives or being injured. that is not a way to live it. eric: 1984 new york city thought he was being robbed by four young men, open fire the grand jury did not indict him until the prosecutors did not like that result and they resubmitted it and he was indicted eventually just charge within a legal weapon. ted williams, good to see you think he was always. arthel: ted at eric, there's overnight crime in our nations capitol. two people are dead in five others injured after shots rang out early this morning. police are offering a reward of up to $50000 in total to anyone who could provide information that leads to an arrest and conviction. madeleine rivera has more of the story. >> d.c. police are still looking for the suspect or suspects who they say shot seven people early

sunday morning. what's a total of seven people are shot at this location. to which have since been a pronounced deceased the other individual shot at this location all of which are adults were transported to the local hospitals perverts authorities have not released identities of the victims are the conditions of the five survivors they also not said what led up to the shooting. the area where this took place is a popular spot home to some of d.c.'s biggest restaurants. police are looking at surveillance video of the area on asking witnesses to come forward. the shooting comes just days after d.c. mayor signed a massive bill into law to tackle the crime crisis in the city. it is called secure d.c. some of the key parts of that legislation include strengthening gun penalties, cracking down on organized theft and creating drug-free zones local sub employee with public officials to find solutions but last year was particularly violent in the nation's capitol, homicides rose by 35% while overall violent crime increased by 39%. there is a bit of an improvement this year homicides are down

illegally. excuse me if they have a sponsor in the u.s. already and pass certain checks. it also allows migrants to receive a work permit and a two-year authorization to live in the u.s. so charles, what do you not like about this process? >> what we are seen under the biden administration is the exploitation of all legal pathways into the country. that is the primary complaint of both republicans and now you are hearing for many democrats. in these democrat lead cities. they are saying normally silent for example, fleeing from poverty does not technically meet the criteria. parole, not all of these locations are experiencing persecution whether it is for religion, politics they're also not experiencing violence, significant violence. in the case of haiti this is clear there is a qualification

that's going to be allowed under asylum and parole. that naturally takes us to the vetting question and that is you cannot thoroughly invent many of these migrants. especially when they are originating from third world countries or failed states like haiti. it just cannot be done. that means of some of these migrants have not come to the attention of u.s. authorities or some of our allies we are not going to have any information on them. that is why we are seeing the system be exploited time after time. news story after news story because people that should not be let in under the vetting criteria are getting through the crooks because we just don't have the information on them. arthel: since her focusing on haiti at the moment will take a look at the number of patient migrants encountered at u.s.

other saint patty's day celebration here at the white house. the second of the day and just a few hours. arthel: okay lucas thompson thank you. eric: new study claims a number of american women who die while pregnant or after giving birth could be over counted by the centers for disease control. from 2018 until 2021 the cdc reported almost two dozen maternal deaths per 100,000 births. the new study only logged roughly 10 deaths per 1000 that cuts the number by more than half. why the discrepancy? researchers believe thousands of deaths may have been misclassified after a pregnancy check boxes were added to death certificates in 2003 what is this mean? joins us in fox news medical contributor. doctor janette, always good to see you. what is the study tell you and why is it important? >> hey eric, even though the data it was a flawed the result is good news for pregnant women

and for most americans as well. what this data tells us is the journal of american obstetrics and gynecology association put out information that tells us that over the past 20 years from 1999 until 2021 they found a neat maternal death rate that means pregnant moms are people that gave birth within one year of the death rate was not as high as we once thought. we were told it was about 30 deaths per 100,000 births but in reality it's only about 10 deaths per 100,000 births. it is still a high number that needs to be addressed. and why did this happen? why is the number so inflated? it turns out back in 2003 a check box for pregnancy was added to death certificates and this is why the numbers are completed. this is why the numbers are skewed it is very important that we understand what is the true

value? what is the true data because we use that data to help in her policymaking. in our protocols and in our guidelines to help save lives in the long run. >> did researchers see an uptick in this essay scratch their heads and say what's going on here? is there a failure in the medical system was going on to make them delve into this more thoroughly? >> that is a great question. the researchers look to see why these numbers go up? was there a change it up step critical care to the pregnant moms or was their change of the baseline health of the pregnant women? or was it a change in the monitoring surveillance system. this is only discovered but looked at all the deaths in the 20 year period and discovered it was the checkmark box on the death certificate they even found women in their 70s and 80s were marked as a pregnancy death. it was an error that needed to be corrected. it is important because about

80% of the deaths in pregnant women are preventable. most of the time in the deaths are as a result of bleeding or the result of an infection or what we call eclampsia or preeclampsia and brought blood pressure issues having the accurate data is critical and essential in making sure we determine what is the deficiency wearwhere's the deficiency whern we improve and hackley better manage our patients? especially those in the vulnerable population we know there are certain groups like african americans spread like native alaskans like american indians they are the highest risk of maternal complications and life-threatening complications when it comes to pregnancy. so having the extra information can help us in the medical field to save lives and have better outcomes with their newborn babies. quickset certainly is the reason behind all of this. it is some good news potentially obvious on this front. dr. kagan always good to see
